We shall now proceed with the review of the applications for certificate of appropriateness. The first case on the agenda this evening is at 834 West Maxwell Street. That application is to install paving and landscaping. That applicant's here. You can come on down. Good evening. Good evening. Mike Edwards, 834 West Maxwell Street. Very good. Have you had a chance to review the staff's findings and recommendations this evening? I have. What are your thoughts on those? I agree with them. Very good. Now, we have, this is sort of an odd duck here because we have two addresses sharing the same case. I think we'll have to make two separate motions, but let's just talk about them at the same time. Okay. Obviously, the staff's recommendations for 838 and West Maxwell Street match those of 834, and I assume you're agreeable to those as well. I am. Very good. That being the case, are there any comments or questions from the board at this time? I just have one comment. I see some photographs. So had work commenced before the appropriateness or certificate would apply? The fence is not up. The pavers are in place. Okay. It's just a small area, but it was overlooked on our behalf on submitting the application. All right. Any other comments or questions at this time? Is there anybody in the audience this evening to speak to this case? Again, we're discussing 834 and 838 West Maxwell Street. Seeing no motion from the audience and hearing no further comment from the board, I would entertain a motion. Mr. Chair, a quick question. Do we need to make two motions? We do. Okay, so the first is for 838. Yes, sorry, it's been reversed on the agenda. So it's 834? Yeah, let's do 834 first. Oh, okay. I'm sorry. Okay. That's all right. Thank you. Mr. Chair, in reference to case number 12680834-E at 834 West Maxwell Street, I'd like to make a motion to approve the application as submitted. Farewell. Thank you. Is there a second to the motion? I second the motion. Is there any further discussion of the motion? Hearing none, all those in favor, please say aye. Aye. All those opposed? Motion for 834 passes. Would entertain a motion for 838 West Maxwell Street at this time? Mr. Chair, regarding case number 12680838-J, 838 West Maxwell Street, I would like to make a motion to approve the application as submitted. Thank you very much. Is there a second to the motion? I will second that. Any further discussion of the motion? Hearing none, all those in favor, please say aye. Aye. All those opposed? Motion also passes. Thank you very much. Thank you. Next case on the agenda this evening is at 173 Old Park Avenue, install fence. Is that applicant here this evening? Yes. Come on forward. Please introduce yourself. Give us your address for the record, please. My name is Rob Lewis. I know Ron, sorry. He was shocked to see me, I think. And we're looking to install a right iron fence across the front of 175, which is my unit, and 173, which is my brother-in-law's unit, which I'm here representing him tonight because he couldn't be available. But we are, I think maybe the issue was that we are trying to keep it in line with the property across the driveway. Dr. Keller's fence, and I think we needed to be 10 feet off of the curb, and I think we're 8 feet off the curb. So I know that that was an issue, but I don't know if Amelia or what else. And has that been, what are LFUCE's thoughts on that? Well, technically, within the building code, if they do not go for a Board of Adjustment, they have to be 10 feet back from the back edge of the curb, which would give them 2 1⁄2 feet past the public sidewalk into their yard. So at this point, because they have not made an application before the Board of Adjustment to have that ruling ruled differently, we can only recommend what another division can approve right now. So we're limited in our, I mean, obviously our preference would be if they aligned, that would be nicer. But, again, our hands are bound by what the other review agency would say. So, and I think the one thing that they discussed, if they are going to go before the Board of Adjustment to have that in line, because this is a sight distance issue because there are two drives on either side, it's a local street, so you only have to be back 10 feet versus some others. So if the Board of Adjustment does get that, then those final details could come back to us. Sure. And I believe the staff recommendation actually provides the latitude required for you to work with the other agency. And either way, you're covered as far as our approval goes. Okay. Is my interpretation of the first recommendation from the staff, what are your thoughts on the other staff comments? Do you find them agreeable? Yeah. I would defer to my architect, Van Meter, on that because he's who I rely on. Sure. Hello. Van Meter, Pettit, 155 Constitution Street. We're more than agreeable to narrow the plinth. Okay, great. Great. Well, that being the case, and, you know, we're pretty much talking, again, like the previous applicant, we're talking about two addresses at the same time. If you're agreeable to the recommendations, I don't know that we need a staff presentation on this. Are there comments or questions from the board at this time for the applicants? My only comment is that should the agency allow the fences to align, that would definitely be the preferable treatment due to the existing conditions. So if that helps any. Yeah, well, it's probably a no-go if we can't get it to a line because it wouldn't look good from an architectural standpoint. I mean, I'm not an architect, but any of you all would agree on that. Okay. Very well. Anybody else in the audience this evening speak to this case? Again, this is at 173 and 175 Old Park Avenue. The application is to install the fence. Seeing no motion from the crowd and hearing no further comment, I would entertain a motion. Again, two separate motions. We'll start with 173. Mr. Chair, regarding case number 32200173-G, 173 Old Park Avenue, I'd like to make a motion to approve the application based on the recommendations of the staff. One setback, front yard fencing along public walk to be in accordance with LFUCG building inspection requirements. and number two cap of the masonry plinth wall be constructed of brick and less width than 15 inch wide stone cap thank you very much is there a second to the motion i will second that any further discussion of the motion hearing none all those in favor please say aye aye all those opposed motion for 173 passes now for 175 mr chair in reference to case number three two two zero zero 175-A at 175 Old Park Avenue. I'd like to make a motion to approve the application with the two, or with the one. Why does this, sorry, quick question. This only has one recommendation and the other one had two. Feel free to add the second one if you like. Actually, that's because the plint doesn't run on the other side. It only runs on the one side. Oh, okay. Thank you very much for the clarification. Going back to the motion, I'd like to make the motion is to approve the application as submitted with the one staff recommendation that the setback of front yard fencing along public walk be in accordance to LFUCG building inspection requirements. Very well. Thank you. Is there a second for the motion? There's a second. Any further discussion of the motion? That being the case, all those in favor, please say aye. Aye. Aye. All those opposed, the motion passes. Thank you very much. Thanks. The next case on the agenda this evening is at 371 South Upper Street, and that application is to remove a wall and construct an addition. Is that applicant here this evening? If you'd like to come forward and introduce yourself, please. I'm Mike Kovash, 371 South Upper. I'm the owner. Good to see you this evening. Have you had a chance to review the staff's findings and recommendations this time? Are you agreeable to their recommendations? Every one of them. Very good. Just to review, it states that staff recommends approval submitted with the following conditions. Number one, once reviewed by any other divisions, any changes come back to staff. Are there any comments or questions from the board this evening for the applicant? The only comment I have, and I'm not going to go against the staff's recommendations, but I think it is just a little bit of shame that in that rear wing that the original masonry wall is going to basically disappear. And it's too bad that the design couldn't have sort of incorporated that somehow. I just think it would have been a little bit more generous gesture towards the original structure. But I certainly understand the reason for the necessary changes, and what you proposed is certainly adequate and meets the requirements of the guidelines. Thank you very much. Any other comments from the Board at this time? Anybody in the audience speak to this case this evening? Seeing no motion and hearing no further comment, I would entertain a motion. Mr. Chair, regarding case number 19450371-L, 371 South Upper Street, I'd like to make a motion to approve the application as submitted with the one recommendation. Once reviewed by any other divisions, any changes, come back to staff. Thank you very much. Is there a second to the motion? I will second that. Any further discussion of the motion? Hearing none, all those in favor, please say aye. Aye. Aye. All those opposed? The motion passes. Thank you very much. The next case this evening is at 341 Madison Place, Modify Bay Window. Come on down. Come on down. Good evening, Mike Seish. 348 North Broadway. Good to see you. Good to see you. Have you had a chance to review the staff's findings and recommendations this evening? I have, yes. Are you in agreement with those recommendations? I am, yes. Just to review, the staff recommends approval of the changes to the bay and the window changes as submitted with the following conditions. One, that the bay only have a band board in lieu of an inset panel below the windows. Two, the final details of the brick mold be submitted to staff. and three, any final details be submitted to staff. Let's see, are there any comments or questions from the board for the applicant at this time? My only comment is that I really don't have any problem with the panels below the windows, but I can understand why the staff had required a simpler design. um the other thing is that if if that's just the band board going across do the pilasters that are at the corners of the bay are they still continuing on down or do they stop at the band board those would be corner boards now instead of pilasters and so they would still sort run together i mean so it would just be a band piece with the corner board still running down without the inset panel okay so it's not a full pilaster anymore and any corner board stops at the banding i think it softens it up and really that was kind of our big objection the last time we discussed This was just how heavy and overbearing those pilasters were for such a small. Well, they're six inches now versus ten. Right. And their projection is not anything like they were before, and they're not continuous all the way to the ground. So I think it's gone a long way to soften up the impact. Yeah, no, I agree totally. And, you know, I think that you've made a good effort here to create something that is new but has clear reference to the original structure. Any other comments or questions at this time? Very well. Is there anybody in the audience who speak to this case this evening? Again, this is 341 Madison Place. Seeing no action from the crowd, hearing no further comment from the board, I would certainly entertain a motion. Mr. Chair, in reference to case number 1220341-0, At 341 Madison Place, I'd like to make a motion to approve the application as submitted with the three staff recommendations that, number one, the bay have a band board in lieu of inset panels below the windows, that final details of brick mold be submitted to the staff, and any other final details also be submitted to the staff. Thank you very much. Is there a second to the motion? I second the motion. Any further discussion of the motion? Very well. All those in favor, please say aye. Aye. Aye. All those opposed, say nay. Motion passes. Thank you very much. And I will say thank you for sticking with us through the conversation. I know it took a little while, but I think it's a good end result. The next case on the agenda this evening is at 114 Arcadia Park, and that is to the applications to demolish the addition, construct an addition, and site work. Is that applicant here this evening? Good afternoon. I'm Nancy Stengel, owner and occupant of 114 Arcadia Park. Good evening. Good to see you again. Thank you. Good to see your project back again. I think it looks good. Have you had a chance to review the staff's findings and recommendations this evening? Yes. Are you in agreement with the staff's recommendations? Yes. Very well. Just to review, those staff recommendations are that, one, any changes need to come back to staff, and once reviewed by LFUCG Division, final changes come back to staff. And you're agreeable to that. Are there any comments or questions at this time for the applicant from the board? No, I think this is really nicely done. I think that as an addition to an existing structure, it has great sympathy, and I think that the detailing, while contemporary, clearly relates back to the original, and I think that it's a very, very nice project, and you and your architect should be commended for doing such a nice job. Thank you. Any other comments? I'll agree with Rob there. I'm glad you came through for a conceptual review a few weeks ago, and I think that was great, and I can see where some of those comments were incorporated. I think it's a great project, so I'm glad it's going to move forward. All that being said, is there anybody in the audience to speak to this case this evening? Seeing no action from the audience, no further comment from the board, I would entertain a motion at this time. Mr. Chair, regarding case number 0051-00114-A114, Arcadia Park. I would like to make a motion to approve the application as submitted with the two recommendations from the staff. Any changes need to come back to staff, and once reviewed by other LFUCG divisions, final changes come back to staff. Thank you very much. Is there a second to the motion? I will second that. Very well. Any further discussion of the motion? Hearing none, all those in favor, please say aye. Aye. All those opposed? Motion passes. Thank you very much. Thank you, gentlemen, for your time and consideration. We appreciate it. Thank you. The next case on the agenda this evening is for 1701 Nicholasville Road to install signage, and that applicant has requested to postpone their hearing until February 27th. Can I get a motion to that effect, please? So moved. Can I get a second to the motion? Second the motion. Very well. All those in favor, please say aye. Aye. All those opposed? And that motion passes. We're to the end of the agenda. Can I get a motion to adjourn? So moved. I second the motion. Very well. All those in favor, please say aye. Aye. Aye. Thank you.
