## Full transcript

Music Thank you. Thank you. Good evening. I'd like to welcome you to the March 11th meeting of the Board of Architecture Review. We appreciate those of you in attendance today. The Board was established by zoning ordinance in 1958, and our first historic district was Gratz Park. We now have a total of 15 historic districts. The board, which is appointed by the mayor and confirmed by the Urban County Council, is part of the Division of Historic Preservation. The Historic Preservation Office maintains a full-time staff to assist you with your projects. The board encourages and recommends that applicants use them as a resource. The Historic Preservation Office is located at 101 East Vine Street, room 220. It is our procedure to consider applications in the order in which they are listed on our agenda. In each case, we'll have a presentation by the staff, and we'll hear any additional comments from the applicant. The board will then ask questions or make comments regarding the application, and then hear comments from any other interested parties. The chair will then ask the board members to enter a motion. If you wish to address the board, please come to the microphone, state your name and address for the public record. We also ask that you write your name on the sign-in sheet by the door so that the information can be recorded correctly. I'd like to note the following staff approvals before we begin our review of applications. there are certain items that the staff can approve, eliminating necessity for all applications to appear before the board. There are a total of three approved applications noted on today's agenda. In the South Hill Historic District at 324 South Mill Street, replace trees. At 316 West High Street, remove diseased trees. And in the Cadentown Historic District at 763 Cadent Lane, remove walls. We shall now proceed with the review of applications for certificates of appropriateness. The first case on the agenda this evening is at 731 West Main Street. That application is to change and relocate and install new windows. Is that applicant here this evening? The applicant is not present but has received a copy of her staff report. Okay. Well, the staff recommendation is for approval pending. final details come back to staff for review. Is there, I don't think there's any reason for us to wait for the applicant unless there are questions or comments for the applicant at this time. That being the case, I would entertain a motion. Mr. Chair, Well, before I get that far, is there anybody in the audience to speak to this case this evening? All right. Seeing no motion out there and hearing no further comment up here. Now I would entertain a motion, please. Mr. Chairman, relative to case 122070733-J, I move that we approve this application based based on the staff recommendations that the final window specifications come back to the staff prior to purchase and once reviewed by other LFUCG divisions, all changes come back to staff for review and approval prior to the start of work. Thank you. Is there a second to the motion? Second. Any further discussion of the motion? Mrs. Tate, could you please turn your mic on, please? Thank you. Okay. Was the motion captured or do we need to go through that again? You can't. Okay. Very well. Any other discussion of the motion? So just to catch us back up, Ms. Tate made the motion for approval based on staff recommendation. for the approval of the opening changes with the following conditions. One final window specifications come back to staff prior to purchase. And also, once reviewed by any other LFUCG divisions, all changes come back to staff for review and approval prior to the start of any work. And then that was seconded by Mr. Grant. And then there was no further comment. So all those in favor, please say aye. Aye. All those opposed. And the motion passes with those recommendations. Next case on the agenda this evening is at 601 Russell Avenue. Install grassy pavers in the driveway. Is that applicant here this evening? The applicant has received a copy of their staff report and is emailed back. They are agreeable with the findings. They are not able to attend. Thank you. Once again, the staff's recommendation was in complete agreement with the application, and they've made a recommendation for approval submitted with no other recommendations. Any comments on that from this board? Anybody in the audience to speak to this case this evening? That being the case, I would certainly entertain a motion at this time. Great. No. Mr. Chairman. I'm having trouble finding it. relative to case number 165-20601-J at 202 Bell Place slash 601 Russell Avenue. I move that we accept this application and that it receives our approval without any further action. by the staff thank you very much is there a second to the motion second any further discussion of the motion all those in favor please say aye aye all those opposed and the motion passes the next case on the agenda this evening is at 418 west third street that application is to expand the rear porch good to see you this evening have you had a chance to review the staff's findings and recommendations at this time? Yes, Greg Fitzsimons, 112 West 3rd Street. We've reviewed the staff recommendations and we're in agreement with them. Okay, well just to make sure we're all on the same page, I'm going to run through those recommendations real quick. Staff recommends approvals submitted with the conditions that one, the original rear porch core and the architectural elements such as spandrels, brackets and columns be retained in lieu of demolition. Number two, the squares in the lattice be an inch to an inch and a half. And final details of the streamlined brackets and or spandrels come back to staff. Forch roof meets the brick exterior wall at the elevation of the current porch roof. And that metal roofing and details are submitted to staff for approval. And finally, once reviewed by any other LFU CG divisions, all changes come back to staff for review and approval prior to the start of any work. And you're agreeable to all of those? Yes, sir. Well, are there any comments from the board at this time? Anything to add? Questions? Mm-hmm. Does anybody in the audience here speak to this case this evening? Well, that being the case, I would certainly entertain a motion at this time. Mr. Chair, relative to case number 18800418-F at 418 West 3rd Street, I move to approve the application for a certificate of appropriateness with the conditions as previously read by yourself. Thank you. Is there a second to the motion? A second. Thank you. Any further discussion of the motion? Hearing none, all those in favor, please say aye. Aye. All those opposed? the motion passes with those recommendations. Thank you. With your project. The next case on the agenda this evening is at 341 Madison Place. That application is to install a pool. I see. Tom Cheek. I live at 722 West High. Good to see you this evening. have you had a chance to review the staff's findings and recommendations at this time? Yes. And are you in agreement with those? Yes. Just to make sure we're on the same page, I'm going to go through them if you don't mind. Staff does recommend approval of the pool as proposed in front of the garage in lieu of the walled garden area with the conditions that, one, the excavation for the pool be monitored by archaeologists during construction of the pool, Two final details of pool mechanical system be submitted to staff. Three final details of the fence be submitted to staff. And four, once reviewed by other LFUCG divisions, all changes come back to staff for review and approval prior to the start of any work. And you're on board with all of that? Do you have something to add there, Amelia? I would like to add, just if you know that there is a new plan at your desk. in this note to new parking area. And because that area has not been advertised by at this time, that part of the application will have to come back. I'm okay with that. So a separate application will come back at a later time? For the paving. For the paving, depending on your outcome. Sure. I understand. And just Amelia, I'm sorry I didn't ask you while you were standing up here The staff recommendation for the final detail of the pool mechanical system Is that just dealing with knowing how big it is and how it's going to be covered up in the note that talks about the enclosure? That actually has been answered by this particular plan before it was not there because if you notice the plan that you received earlier this week did not have the details of the area around in front of the garage. Okay. Well, I understand. Thank you for that clarification. I have a question. Shoot. What is the garage going to be used for now that you can't get a car into it? Well, I mean, if you look at the shape, I'm not sure you can get a car in it anyway. But I have seen a car in there. It's actually going to be a pool house. Oh, good. Okay, I was just curious. I should also note that we've received a letter from a neighbor just expressing concern that if this were not a wading pool, or excuse me, if this were not a, how do they say it, if it is not a wading or a river-type pool, that they weren't in favor of the pool. So for the record, that concern has been noted and received by us that they aren't a fan of a full-sweigh pool. I believe they used the word tacky. I don't agree, but that's what we received. Any other comments or questions from the board at this time for the applicant? Anyone in the audience this evening speak to this case? Seeing no motion. Well, I just want to clarify it. There are two different pool locations. In our last hearing, it was behind the house. In this hearing, the application still mentions two locations, but presumably the location behind the house has been abandoned as an option, and we're strictly speaking about the location by the garage. Is that right? That is correct. Okay. My preference really was to put it behind the wall, thinking that that would be the least obtrusive, but that wasn't the staff's opinion. And once I started working on it at the garage, I'm kind of in agreement. We were able to sort of, you know, not make any more hardscape, not putting it at the pool, actually eliminating some asphalt. So, you know, it may end up being a better location after all. Any other comments or questions for the applicant at this time? Well, hearing none, I would entertain a motion. Mr. Chair, relative to case number 12200341-S at 341 Madison Place, moved to approve the application for certificate of appropriateness pursuant to the staff's recommended conditions number one the excavation for the pool will be monitored by an archaeologist during construction of the pool number two final details of pool mechanical system to be submitted to the staff number three final details of the fence to be submitted to the staff and finally once reviewed by any other LFUCG division. All changes come back to staff for review and approval prior to the start of any work. Thank you very much. Is there a second to the motion? I second. Any further discussion of the motion? Hearing none, all those in favor, please say aye. Aye. All those opposed? And the motion passes with those conditions. Thank you. Thank you. The next case on the agenda is at 165 Woodland Avenue. That applicant has requested a postponement until March 25th. Can I get a motion to that effect, please? I move that we postpone 165 Woodland Avenue until March 25th. Thank you. Thank you very much. Is there a second to the motion? Second. Very well. Any further discussion of the motion? Hearing none, all those in favor, please say aye. Aye. All those opposed. and the motion to postpone passes. The staff, are we still within the deadline for action by the 25th or do we need to do some paperwork for that? Yes. We're good? He has until April. Great. The next case in the agenda at 145 West Bell Court, install Red Rock Pebbles in driveway. That's been withdrawn by the applicant. And before we move on to our conceptual review, minutes were distributed to the board for their review from the February 25th meeting. Let's go ahead and get those out of the way. Does anybody have any comments or things to add or amend? I didn't find anything. this is related to the last uh to the uh woodland avenue case oh never mind i answered my own question any comments no no comments no comments well i don't have any either but i wasn't there I would entertain a motion to accept the minutes as they've been prepared. So moved. Second to that motion. Second. All those in favor of accepting the minutes as they're written, please say aye. Aye. Aye. That's two ayes, and then I'm not going to vote because I wasn't there. The final item of business this evening is conceptual review for 148 Woodland Avenue. We'll have a staff presentation. The only
