The objective of the Department of Environmental Quality and Public Works snow and ice control plan is to provide winter roadway safety to you, the traveling public, in the most reasonable, efficient, and effective manner. We're requesting your help during snow and ice removal operations and ask that you follow these simple suggestions. Please limit travel during storms to trips that are necessary. Once roads have been plowed and salted, the potential for accidents is greatly reduced. Please park your vehicles in your driveways and off the road. If you must park on the street, try to park on one side of the street only. Parked cars hinder the speed and efficiency of our snow removal operation. Parking bans may be in effect. Vehicles may only be parked in authorized areas. Vehicles parked in unauthorized areas may be towed. Snow plans are designed to remove snow from the roadway to the edge of the road. It is likely that the plow will leave behind a window of snow in front of your driveway. Residents are responsible for removing the snow. It is against the law to plow snow from your driveways and walkways into the road. Please pile the snow in your yard. Remember, you are also responsible for your snow removal contractors actions. When snow plows are used during snow falls, the initial pass of the snow plow is made to open the road for traffic flow. The following passes will push the snow to the curb line or road edge. This is necessary in order to allow for the drainage of melting snow into catch basins and to allow more space to plow future snow accumulations. To avoid salt hitting your vehicle while driving, move away from the center of the road when you see a salt truck approaching from the opposite direction. Salt trucks are designed to deposit more salt near the center of the road as the salt works its way to the road edge as traffic runs over it. First item appears on page 1. It is item A. It is a major subdivision plan. 17-74 is the case number for Sebastian property, unit 2D. This is an amended plat located at 2944 Trailwood Lane. the next item is page 2 item b and this is also for the sebastian property unit 2e amended with the same address of 2944 trailwood lane and the case number for that is mj sub 17-75 third subdivision plan is on page 2 item c this is mj sub 17-76 for gold circle department store lot one and more specifically lot 1b which is an amended plat located at 131 west reynolds road and then finally a recommend or a reapproval that was recommended by the subdivision committee with a case number of plan 2013-122f for south end park unit 1 section 1 that's located on page to item d of the agenda and it's located in our community at 700 and 800 blocks of derody street moving on to our development plans on the consent agenda the first one would appear on page four item d and it is mjdp 17-118 little and powell property and that's located at 757 newtown pike moving to page 5 item e major development plan 17-119 candia corporation time to shine car wash located at 12 50 south broadway and then a major development plan 17-120 for also for gold circle target and nicholasville road and reynolds for outlaw to 1b that's an amended final development plan and again located at 131 restaurant west reynolds road and then lastly on page six item h this is a major development plan for reapproval from 2016 case number 50 for stonewall shopping center amended and it is located at 3197 clays mill road at this time the commission consider can consider all of these items in one motion for conditional approval unless an item someone from the audience or one of the planning commission members wishes to pull an item for further discussion anyone in the audience would like to pull any of these items for additional discussion anyone on the commission if not we'll entertain a motion also i think that with the motion we have one of those with findings um actually chairman wilson that's the item that was removed oh that was the item that was removed so we don't have to worry about that mr chairman i move for approval of the consent agenda with the exception of the item that was removed okay mr brewer has moved and miss carolyn plumley has seconded that we approve the agenda item with the removal of item c on page four any other discussion on the consent agenda hearing none would you please vote when it comes up on your screens okay motion carries the consent agenda has been approved we can then i think we only have one to hear and that's on page five and without objection from the committee I'll skip over to page six performance bonds and letters of credit since mr. Mr. Chairman, members of the Planning Commission, we have one plan on what is a relatively small agenda. Welcome to 2018. We don't know how the rest of it may be. This is at the bottom of page 5. It is a major development plan, 16-37, Hash and Hounsville property. And this is actually a re-approval. This plan was approved by you a year ago, and it is an area located out off of Greendale, and Spur Road is up approximately in this direction. Sanders Hill Road would be in this direction with the elementary school. You just heard a zone change down here, which was withdrawn by the applicant during the hearing. I think everyone is familiar with where we are. I'm not going to belabor this plan. It's a reapproval. You can see that it's multifamily apartments, townhouses. It has over 400 dwelling units proposed. You can see the areas for detention. There's an approximate break in this location of watersheds. you can see the street system and you may recall there was a tremendous amount of discussion about the street system on this plan and how the townhouses in particular would function and being rear loaded and that sort of thing and again you can see the large traffic circle which is a part of this development we're bringing it back to you today for two discussion items primarily and that is lucille drive as it comes through the property and the extension of apple cross into this adjoining property at this location again apple cross is across greendale comes through and they're proposing that it come to this point this will be a public street stubbing into this property and again lucille and i know you all recall the discussion about lucille on his own channel. That is why we're here. This applicant, with their plan, staff supported their plan. I think it's fair to say that they've worked with established points to lay out the street system. And in fact, we met with the applicant's engineer and went over some of that and how they laid it out and how they determined where these points should be based on these fixed points. And this is what I have for you here. This is the issue with the street system in this area. Here's a fixed point where Lucille comes into the Hash Hounsville property at this location. Again, they're proposing it to come through, have the circle, and then exit at this location. And you can see it on this plan as well. You see See that angle? I know you all remember that discussion from the zone change. This plan, this is a fixed point. This is built right here. This is a fixed point on Rockaway Place and Lucille Drive. What happened on this plan, which has been approved, this plan has not been certified, however, is that Lucille, instead of leaving this point and curving here, curves away, which brings it, as you recall, the discussion, most of it, onto this property where the radio station is. And that was the issue that staff had with that particular proposal. Vision Engineering, when they laid this out, and we have an exhibit that they prepared, but I didn't want to put it up here unless they chose to, but basically it was very simple. the engineer demonstrated how he took this point and then he went to this point and from here he went to this point and that basically aligned Lucille right through here where staff would prefer it so that's what I'm trying to demonstrate to you with this this is hash hounsville property this is the intervening uh property um I can't think of the name sunny um spring bay spring bay it's called. This is also known as Spring Bay. So I just outlined them in different colors because we are dealing with three pieces of property. The orange is the existing or approved street system. This is dashed because again, this was not approved by this body. This has been approved, built to here, built to here. The red is the preferred system from your staff's perspective, planning, traffic, and others who have reviewed this. We would like to see this public street that currently stubs into here come through to Wiggington Point. And you may recall that Wiggington Point runs all the way to Sandersville. And we would like to see Wiggington Point come down to Lucille. And we believe, I know this will surprise you, these are not engineering drawings. Wigington Point could come through here and be aligned and would provide the dam for this detention. It's very common. It's done all over our community. It's one of the ways you can address detention in a street at the same time. Very common design. And it would tie in to Lucille. And staff would stress with you again, the collector is the key here. Lucille is the key to this discussion. This is our primary concern. Now, we did have a concern with Applecross. and it's a local street, and what happened is in June of 2016, which was slightly before Hash Hounshell was filed, this plan, Masterson Hills Unit 1A, was reapproved by this body. So this is an approved preliminary subdivision plan, and what I've highlighted for you are the various connections. These all lead either to Spur, Sandersville, or out to Greendale, This is over and out to spur. This runs on down into the rest of Masterson Station. I just wanted to see to the west those connections that existed. Here's your elementary school, by the way, just to help keep you oriented. Here's the cemetery. I know you all remember the discussion on the cemetery and the access. One of the things that happened on this plan, and by the way, this was a 2003 plan. It's been out here for a long time, and it got re-approved. as I said, in June of 2016. This plan was amended. These were through streets. And it was amended with this body's approval over your staff's recommendation of disapproval to cul-de-sac these streets. So again, this forces traffic back out to these local streets that will take traffic elsewhere and down to collectors. But that brings us back to the Apple Cross connection. This is the Stub Street of Warrington that we believe is important and needs to come through and connect with Lucille. This is Applecross in this location. You can see that it does hit into approved lots on the preliminary plan. That's the issue. The applicant would have to agree to change this plan. It is our understanding that they are currently submitting construction plans on the infrastructure in this area. So they're building off this plan. We want you to know that. we've recorded a couple of plats on our Tibbs Trail up through here. So they've got the infrastructure in, in this area, and they're coming this way with their infrastructure. So in all fairness to them, they have a vested interest in being allowed to build this, as was approved. But we felt as a staff that it was worth bringing it to your attention. We'd like to ask them to consider an additional connection in this area that would just improve the overall flow. with the local street system. So that is really the gist of the concern. This plan, again, this lines up in a way that staff believes is appropriate to bring this street through and to bring Lucille where it should be. So the matter really is getting this area aligned. And we wanted to bring this to your attention because this plan was being brought to you for re-approval. Again, these things are out of their control. This Stub Street, again, we could maintain it, but it would be contingent upon this applicant agreeing to get rid of a couple of lots. And then, of course, it's a matter of who's going to build that stub. It's on his property. So, you know, staff would understand that there might be some reluctance on their part, obviously. And again, we just wanted to explain to you where we were and how this system all is currently set up to function. Again, this is the big connection from Sandersville, Wigington Point, all the way through to Lucille. We would, when the time came, want to see it come all the way out to Greendale as well. We think a local street that would run from Greendale to Sandersville would be a very beneficial traffic movement in that area, and particularly beneficial to response times. It's been interesting over the years that our public safety people have commented numerously on the fact that there were three pieces of Lucille at one time, all separate from each other, and it created some difficulties in their response time in that area. So again, here we are. This is the last piece from Spur, Lucille, and then we're going to get that piece through Dennis Anderson's property right on Leastown Road that you recently approved. That piece is under, it's being designed at this point, and we would anticipate construction plans being submitted on that fairly soon. They're dealing with some floodplain issues and dealing with some federal permitting issues on that plan. With that, I'd be happy to answer any questions you may have for staff. Mr. Owens. Thank you, Mr. Chair. Tom, I guess the first question would be, one, what we're dealing with as far as the re-approval today. uh i'm i'm saying any connections really for the most parts off-site yes correct yes um as as far as apple cross uh the stub street the neighboring property who owns that is it the same apple same same person i i'm not fully up on all the relationships here i believe this is baker hayden partnership this is hayden this is baker this is baker this is baker hayden so they've been partners out here but they have some individual properties okay so say that again yeah baker hayden baker hayden is here this is baker hayden because here's Apple. Yeah, this is Baker Hayden. Okay. What we're talking about, is Baker and or Hayden involved with what we're talking about today? Well, Mr. Hayden owns this property. He was not the principal driver of this plan. It was a different developer who I think had an option on the property. But he has asked the applicant, the engineer, to bring it back to you for reapproval. Yeah. Okay. Have there been any communication with the neighboring people as far as Alpa Cross connection at this point? Not at this time. And then the property down below that Lucille is eventually going to connect to. Yeah, there. Yes. You said that strip of property has already been approved as well? this plan has been approved but of course as you know all plans are conditionally approved yeah and this plan has not been fully signed off on okay and we have informed the applicants engineer designer that we would like to discuss the alignment of these streets all right thank you oh okay any other questions for mr martin Okay, thank you. Applicant. Good afternoon, Mr. Chairman, members of the commission. Matt Carter, Vision Engineering. I'm in agreement with the conditions that the staff has put forward, and then, as Tom said, we really have no control on outside of our property boundary. The things we do have control over is we can make some modifications on the angle. Lucille leaves the property. It's a roundabout, so we can kind of pivot that road around the center of the roundabout. So we do have a little flexibility there. And then where Applecross terminates into the adjoining property, we can remove that stub and put a i call it an elbow but basically a bend in the road it's kind of like a cul-de-sac there and then we'll still have the connection to the south so that's kind of where my hands are tied on anything else because we don't control outside the limits of our property but with that like i say we are in agreement with your conditions and be glad to answer any questions any questions clarifications necessary needed okay thank you thank you staff would just point out as a matter of housekeeping that that final condition of discuss 18 could be resolved as as Matt indicated to you they could tweak it and help with the alignment so I think that would be a resolvable condition so if in fact we were to vote for approval what we would say is in effect is that the we would re-approved subject to the same conditions as previously required by the commission with the addition of three uh with the modification there reads landscape examiner's approval of landscaping and landscape buffers and 18 resolve lucille drive alignment and stub street connection to the west okay yes sir mr um does traffic up here she comes does traffic work weigh in on this I do. The only thing I would request is I'll point to it. The stuff that Matt said they could eliminate, I'd like to leave it. I haven't given up on the Applecross connection yet. And if we don't build that stuff, we're kind of just losing some cards in my deck. So, I mean, I think that they do have a little bit of say. There is a partnership there. So, in my opinion, it doesn't hurt still to reach out to that neighboring partner. But I'd like to leave the stub on this site to help ourselves going forward. So, leave it as is, not eliminate the stub, basically. Do you have any comments about that? We have no problem leaving this, Doug, but we also want to have the ability to, if nothing does come, like through a negotiation on the adjoining property, we're able to put the elbow back in, as we said. They've already got approved plans, is that correct? They do. That's why we recommend it be a resolved condition. Okay. We can continue discussions and see if we can't work this out. Okay. So it would be taken care of under the resolve. Okay. Any other discussions? If not, we'll close that part of the hearing, and then we'll go for a motion or additional discussion from the commission. Mr. Berkley. Chair, I'm going to move for re-approval of Plan MJDP 16-37 with the 18 noted conditions by staff, changing number 18 to resolve, and also adopting the findings, the two findings. She comes to us most recently from Fort Wayne, but she's also worked for the city of Louisville. So she is familiar with the peculiarities of KRS and some of the other things around Kentucky. So we are delighted to have Aliza here and looking forward to getting her integrated. And I know you all will appreciate her enthusiasm and her skill and the new insight she brings to the work. Good.
