Public hearing on Zota 2017-9. Good afternoon, Chairman Wilson. Members of the Commission, our first item and only item today is ZODA 2017-9, so it was filed late last year, and it's an amendment request for Article 17-7Q of the zoning ordinance, which relates to our signed ordinance. You don't have your notebooks today, since this is the only item, but you should have a packet of exhibits, which include the staff report, a revised recommendation, as well as the applicant's application and justification statement. So we'll just go through. The applicant is Crossroads Community Church, and they are asking to change the sign regulations for places of religious assembly within our expansion area zones. So currently the expansion area zones are sort of lumped together in our sign ordinance, and then they are directed for sign regulations to different zones. First to the PUD zone, and then again to the place where it's first allowed. So in this case, churches are first allowed in our agricultural zones. So the reference in the current Article 17 refers churches or places of religious assembly back to what is allowed in our agricultural zones for signage. The applicant is asking to modify that text in order to allow for both a larger freestanding sign as well as a wall-mounted sign. And the proposal when they filed last month or early, I guess it would have been in November actually, was to allow one freestanding sign based on your frontage up to a maximum of 150 square feet and then also allow one wall-mounted sign based on the size of the wall it's to be mounted to. And they proposed 15%. That's the particular text. They added actually sort of a caveat with that as well, that in order to get the signage, you'd have to be located adjacent to a designated interstate highway. And so that kind of made it more site-specific than the rest of our sign ordinance. And just in terms of how the staff looks at text amendments related to Article 17 of the sign ordinance, The sign ordinance is in sort of a hierarchy of zones and sort of like the rest of the zoning ordinance, where the less intense zone it is, the less intense signage you have. It's shorter signage and it's smaller. As the zones get more intense, additional signage types are permitted, additional signage in terms of height is allowed, and also in terms of size. So it starts with the least intense agricultural zones, then a low density residential higher density residential into the professional office business zones and then downtown business and then within some of our zones we have some more specialized signage that's allowed interchange business zones have the large signs that you can put and be visible from the interstate our shopping center zones have have a larger sign as well so And again, the sign ordinance format is set up so that signage is typically based on use in some cases. And usually there's a maximum square footage that's established. So in our agricultural and residential zones, that's typically a maximum of 32 square feet, which we generally tell people is about the size of a piece of plywood. In the business and industrial zones, most of the time signage is calculated based on linear feet of frontage along a street or how much wall space you do have and or the number of frontages you might have. But there is typically, again, a maximum established. In a lot of cases, for a wall sign, that's 32. For freestanding signs, it does vary. The professional office, you get 40 business zones. It starts to be 50, so it does increase a little bit as you get larger and more intense. But the maximum square footage, these are the biggest signs we allow in Fayette County. Professional office projects allow 100 square feet for their entrance signs. a regional shopping center is allowed at 150 square feet the hospitals and regional medical campuses there was a recent text amendment they are allowed one sign of 150 square feet and then some a few smaller ones the interstate signs the big ones you can see for the hotels and restaurants are 356 square feet and then our billboards are permitted up to 400 square feet so that gives you you some context these are the largest signs we allow and the applicant was asking for up to 150 square feet so when the staff reviews a proposal like that we have to consider is that consistent with how we regulate other signs in fayette county how we regulate other uses similar uses in fayette county so um consistency is is something the staff is concerned about with signage and our staff report goes into this in a little more detail but the planning and public safety committee of the council started last year a work group or subcommittee to update the signed ordinance because of the content neutrality concerns based on the supreme court decision so that work group has worked throughout 2017 and are very close to bringing a draft text amendment to both the planning commission and the council for further review and the staff consulted with our administrative officer and the planning development and historic i guess preservation department and we found that 32 square feet was going to continue to be sort of the standard maximum signage permitted for places of worship and also educational activities so the staff made a recommendation to the zoning committee three weeks ago that was consistent with the workgroup's work to date and that's shown on the agenda that should appear on page two there was a staff recommendation at the zoning committee actually that staff recommendations not on there but it's in your packet in terms of a staff report at the zoning committee three weeks ago there was discussion about the staff's recommendation and it being still fairly far from what the applicant was asking for. And the zoning committee asked the staff and the applicant to sit down and see if we could come up with an agreement that would, a compromise that would satisfy both entities. So we did that and I'm happy to report that we have a revised staff alternative text that I believe we are both in agreement on and I'll go over kind of the three changes that were made the first would be to separate out the CC zones and make it clear as opposed to referring back to PUD that refers back to something else this would make just a more clear sign ordinance for community centers they would our CC zones would continue to get the same signage as b6p and then for the conservation district and the expansionary residential zones it would mimic what would be permitted in r3 with this exception so the exception would be the particular text proposed for religious uses and educational activities in the expansion area the one change that you'll i want to point out from the staffs report three weeks ago is in section a1 and that relates to the freestanding signage the staff was not really willing to go beyond the one wall sign because each building would be permitted a wall sign so if you had multiple uses on this on a property you might be getting a wall sign here and a wall sign here so we weren't in favor of allowing each building to have more than one wall sign but the staff agreed to be more flexible about the freestanding signage so the staff agreed with the applicant to allow one freestanding sign for each frontage up to a maximum of two and also to allow up to 10 feet in height for those signs this allows then in any case where you would have more than one frontage you could have up to 64 square feet of freestanding signage the applicant understands the board of adjustment oftentimes evaluates shifting of square footage and i think they understand they can avail themselves of that appeal option but that a 32 square foot sign would be by right for each building for the for the uses on religious and educational activities so and the staff again broke out community centers separately we believe that's a more direct way of regulation the staff also is suggesting crossing out construction screening signs that's a deletion from the work group as well a change that they're proposing so wanted to be consistent with those recommendations I believe the staff's findings did not change. They relate to the community signage hierarchy and making sure that the proposed text amendment is consistent with the way Article 17 currently reads and that it does allow additional signage for the applicant in this case. As far as your revision recommended changes, these recommended changes would only be for what's listed here, the expansion area, CC zone, and ED, no other zones? correct okay the second thing uh one freestanding sign per frontage with a maximum of two does that still mean if they had three road frontages they'd only be allowed two yes okay thank you any other questions for miss wade thank you applicant good afternoon nick nicholson here on behalf of uh crossroads community church and uh as miss wade indicated we are in agreement with the staff's revised recommendation on uh this text amendment it certainly is far away from what we originally proposed but you know that is how compromise works at the end of the day we were approaching this that the current signage ordinance in the ea zone for churches just didn't make any sense it was very circuitous in nature it kicked you back to a pud that then separated it by type of use whether it be residential or commercial and then you either got a planned shopping center use or you got the ag use as far as the type of signage that would be allowed. That's a pretty big gulf between planned shopping center and a simple ag use. And when we are looking at a modern day church, and certainly one with a very large congregation, the demands of the traveling public are much more similar to, I think, a commercial use, similar to like a movie theater is, than it would be an agricultural use when you have a couple hundred, if not a thousand people, all attending the exact same location at the exact same time and leaving in that sound. We just felt that 32 square feet was just not sufficient. I certainly have pictures of examples around town, if you all would like to see them, that kind of demonstrate the lack of signage and the lack of visibility when it comes to where you're headed in a large group of people at exact specific times. We feel that this compromise certainly can achieve our goals through the Board of Adjustment process, and that also gives you the extra layer of kind of assurance that this signage will only be kind of enlarged in very specific situations that are appropriate for each site this isn't a situation where every church in town would suddenly be able to get a large kind of increase in signage it's only in the expansion area and if the Board of Adjustment determines that this particular site can handle an increase in signage that would not kind of have a bad influence on the rest of the area.
