It is Major Subdivision Plan 17-77, the townhouses at Jefferson Street. This is Phase 3. It's also known as Preston Subdivision. This is a proposed subdivision for a townhouse development. It actually fronts on Maryland Avenue. All this area is known as Preston Subdivision. You may recall the townhouse development that is immediately adjacent with Jefferson Street in this location at the intersection of Maryland. These are currently under construction. Most of them, I believe, have been finished. And the very same process was followed with these that they have also been subdivided in the townhouse lots with an access easement being proposed in this location. In addition, with this access easement, which does require a finding, which is one reason they are in front of this body today, they also require a waiver of the frontage for these townhouses. And you do have a waiver report as well as a finding report before you today. And again, they're creating the lots that you can see here. Seven lots will front on Maryland. six in the rear this is an HOA lot and again they're immediately adjacent to the to the townhouse development currently being built next door this is a little different in the sense that you just recently approved a development plan on this property you may recall there was talk about the screening adjacent to the single family property and this plant That is slightly premature in the process, and the applicant, I'm sure, will elaborate on this. It has to do with their financing, and they wanted to get the waiver and the finding kind of out of the way in the process. They are going to have to get their plan, their development plan, certified, and then they will build, and they will address the infrastructure issues and that sort of thing that do exist in the area that will have to be addressed. this plan you may recall was mentioned they had to build a stormwater facility out in the jefferson street right away to serve this plan sewer is available in the area and capacity does exist the primary concern was the stormwater because in these old area towns a lot of times there are no facilities or they are woefully undersized for development but with that That is why you have the subdivision plan before you today. And as I said, there is a waiver report that we have submitted to you. This is identical to the previous development that is adjacent. And they submitted a waiver report, which was approved by this body previously, as well as a finding on that access easement as well. The applicant did seek this waiver based on three of the four items in your subregs. They cited exceptional hardship, design innovation, and infill and redevelopment. Staff would be remiss if we just didn't note that utilizing an access easement to serve townhouses is not what we would consider innovative. it's fairly standard and in this case very necessary. We just wanted to point that out. We appreciate that they cited various hardships and that sort of thing to get their waiver but we would point out that this is a matter of infill and redevelopment and as you all are aware staff strongly supports infill and redevelopment efforts and this waiver is certainly in staff's estimation justifiable under infill and redevelopment which in and of itself is a challenge. The finding also we believe it is appropriate in this case for an access easement to serve as the frontage and access for these lots. There is a final development plan that does govern the development of this property. So again staff was very comfortable with recommending approval of the plat, the waiver, and the finding. And if you have any questions for staff we'll be happy to answer them. Questions for Mr. Martin? Applicant? Thank you, Mr. Chairman. I'm Dick Murphy representing the developer, Jeff Morgan, and we agree with the staff report and the staff proposal to you. This is a little earlier in the process and sometimes you see these. We're doing this because you all approved the development plan a couple months ago and the appropriate stage to get the waiver is at the plat stage. So normally we'd bring this in about six months from now when the units are finished and ready to be sold. But we wanted to get the waiver and the findings so that we could tell our lender, the bank, that yes, indeed, we do have the ability to use the access easement to provide access to the back units. This is almost identical to the development right next door, which is constructed and they've sold a number of the units already on this one. So I think it's a very good development for this area of town. So we do agree with the staff report and the findings on the waiver and the finding for the access easement. Mr. Chairman, members of the commission, the next item on your agenda is at the bottom of page two, item B under development plans it is a major development plan 17-117 the Charlotte Price Estate lots 61 and 62 this is an adaptive reuse project for the property in question I'd like to thank Ms. Galt for her very quick rendering of this plan for you today you don't see pink very often but There it is. This is property that is located at the very end of Bel Air Avenue. Now, Bel Air Avenue runs off of 6th Street. It's just offset from Jefferson, where Jefferson intersects 6th Street, and you have the brewing, 6th Street Brewing Company. Bel Air is just slightly offset and runs back and terminates here next to the railroad track, and over here is Loudon Avenue. Down here is the Legacy Trail. So this is an adaptive reuse project. They're utilizing two of the structures on the property. They're proposing 13 residential units and associated parking. You can see the circulation pattern here that they're proposing and the parking. This is a bioretention area. What you're seeing here are green infrastructure elements that they are choosing to use in this area. There is a pedestrian system being proposed internal to the property. Now, this is two lots, one here and there's one here. This one's I-1. This is R-2. So this particular plan is going to the Board of Adjustment on Monday. Staff has recommended approval of that plan at the Board of Adjustment. That's for the screen, the zone-to-zone screening. From I-1 to R-2, there is significant screening. since they control both properties are going to redevelop both properties there was no need to have screening in this location right on the lot line where normally it would be somewhere in this vicinity so again with the redevelopment of the property the proposed units there will be no need for zone to zone however there will be screening along the perimeter and that does lead to a discussion of one item on the plan that I would direct your attention to. These are all primarily standard as you can see sign-offs for development plan. And that is resolve the need for supplemental landscaping adjacent to the railroad. I-1 in and of itself doesn't require a lot of zoning relative to the railroad and as you all probably know the reason this is I-1 zoning is the old railroad has been there for many many years. We have a lot of I-1 and that area. Staff believes it's very important to provide a good screening element. We're willing to work that out and resolve that with the owner to help screen the railroad track from what we believe is a good attempt at a adaptive reuse. Now this adaptive reuse is all residential. Normally they're driven by commercial and you've seen a lot of these adaptive reuse proposals lately and they are being driven by the commercial component and to use other commercial uses in an I-1 zone. This is actually the first one we've seen that is entirely residential. Here we have a bike rack being proposed, a covered bike rack and an interpretive kiosk. Staff has had some issues recently with the public art component and adaptive reuse and And it really is the intent of public art is to be actually associated with public space and to be accessible to the public. We've had a couple of issues on the plans where we felt that really wasn't being achieved as much as we had hoped or envisioned. So that is one item in your report. We gave you a memo, as we always do, that highlights the elements that they have met that are required. It is required that they meet a certain number of these requirements under the adaptive reuse. And you are required to make a finding that they have met those requirements under the ordinance. And we have the memorandum that you can see before you and we are recommending approval of that finding. One condition, again, as you can see on that, and it relates to a condition on the plan, is to be sure to work out exactly where the art is going to go and what is it going to be. is it can't be a bike rack. Now, if they want to do a fancy bus stop, you know, we're willing to talk. We also think the kiosk, and they can expand on this. As I said, the trail's right here, and we think there's some opportunity to build on that relationship, particularly with public art and public space. With that, staff is recommending approval of this plan, as well as the finding on the adaptive reuse proposal. If you have any questions for staff, I'd be happy to answer them. I would add quickly something that you all probably know, and that is parking for an adaptive reuse is half of the requirement in the zone where the use is first found. So as you all are well aware, because we've had this discussion, the parking, they get a big break on parking. in all of these developments, including this one. Yes. In our handout, there's a picture of a structure, and that will be on the property, right? Be built on the property? That is one of the proposals from the applicant. And so that's a residential structure, right? They will have to explain that. That is our understanding, yes. But I would add that. I would say that would be best for the applicant to elaborate on. Oh, okay. That being the case, I just wonder where that was covered in our zoning. It's a residential unit. Okay. I mean, it's like 600 square feet. Our zoning ordinance doesn't specify the size of any dwelling unit. That's a building code specification. All right. Thank you. Any other questions for Mr. Martin? Okay, thank you. Applicant. Thank you. Good afternoon, Mr. Chairman, members of the Commission. My name is Matt Carter with Vision Engineering. I've got with me Jason Futch. He is the applicant and wants to develop this property. This is an infill redevelopment property. It's adaptive reuse, and we feel like we've presented a pretty good plan to you. This type of infill project, we think, is what you want in an area like this. We're getting rid of a commercial, more industrial-type property and replacing it with residential. We're in agreement with the 16 conditions. We would be glad to answer any questions. Mr. Futch could elaborate on what his proposal is in the layout, but we do have two existing buildings that we're keeping that we will be adaptive reusing and converting those into residential units. But if you have any questions, we'd be glad to answer those now. Ms. Plumlee. Do you mind expanding some on the 600 square feet? So that picture, it was more to inform the type of aesthetic that would be applied through the development. That exact unit will not be built. The bigger versions of that will be built. And it's probably not applicable for this meeting. I don't know how much you all need to know the details of that, but that just kind of made its way into the package when I was doing the application. So you all can get a sense for what it might look like. So the combination of hardy and cedar and the kind of urban lines, that was just an example, if that makes any sense. So that's much smaller than the type of unit we'll be building out there. Any other questions? I have one. What is the average square footage of the property that you'll be? Well, so there's a six unit. Oh, you mean of each unit? Mm-hmm. Average square feet is probably around 600, 700 square feet. 600 square feet per unit. Per unit, yeah. They're one-bedroom units. They're of urban nature. And this example is provided here. That's simply for the facade of the whole. It's the facade, yeah, exactly. There are some a little bigger, a little smaller, but it's around the. Is that wood on the outside or what is that? It's cedar. Cedar? Yeah, no. And the idea with the, you know, the idea was to play off the legacy trail. We had the bike pergola offering bicycles to all the units, and then hopefully that would integrate with the commercial area around there too. Okay. Any other questions from the commission members? And I think it looks great, but my concern is with the parking. It's a dead-end street, and this actually doubles the number of units on the street from Del Camp to the railroad tracks. and we already can't park anywhere on tuesday nights which is runner's night at the west 6th so uh that's a there are 13 parking places on the plan but uh everybody else on the street has two or three cars each seems like a lot of a lot of units for two little lots too Thank you very much. Thank you again for allowing me to have a couple of minutes here. I've been there 35 years in the residence where I live at on Bellar Avenue. I retired from the bakery there that was on the corner. Excuse me, what is your name again, please? Pastor Siebert, T-L-O-T-A-Y-L-O-R. I've been at the bakery, like I said, 38, been married raised my in my home 35 raised my twins there and one that we adopted right now we're running into so much traffic and so much stuff within the street that I'd be afraid to allow my children grandchildren should I say come out at all from the traffic that we have from the brewery and I don't mean to bring the brewery into it but as Mr. Costello said we don't have room to do anything on the streets anymore individuals when they are jogging up and down the streets I realize they pedestrian has the right of way but if you're not careful they'll run right in behind you by the fact you would allow me to say this miss costella his he moved to his dog got hit and got killed street and I'm just saying there's so much traffic on the street now I believe that we should have been informed some time ago about all this is going on I believe that each resident there should have gotten a letter in the mail or somehow got something that would affiliate us letting us know what was going on on the street. As I say again, as a concerned citizen, we've got so much traffic, and when you continue to put this traffic in of these condos that you're putting in, it's just going to create much, much more traffic within the area. And it's just inconvenient for the neighborhood to be so tight and small as it is. It seems like they're trying to cram something in every nook and cranny that's in our neighborhood. and it bothers me as I said to the utmost I would like to see a three-way stop but they're on the corner of Bel Air and Del Camp they've been telling us that we're going to do that there's going to check into it there's gonna have monitors that look at that and there's accidents there every time you turn around the people park when they park at the brewery they park dead on the corner what I'm saying is not in the yellow lines they are parking on the corner when it comes to come around you've got to ease up to make sure nothing is coming before you even attempt to go around. It's just the trouble that we're having, I would say, in the neighborhood with so much of that. You say you're going to put 13 apartments down there in how many houses? 13 total units. Does that include the houses you're going to put in as well? Total units is what you're saying. I don't see enough space down there. Of course, again, I'd like to see a picture of those houses if possible that you were talking about. I get ready to say you would yeah first of all we're certainly sensitive to any impact on the community who didn't want to disrupt anything but on January 9th we sent out a site plan to every resident within 200 square feet because of the BOA adjustment we have to file for so I was hoping that would be an opportunity for you all to see I don't know if you're seated or not happy to share it with you we did not see it if we had seen it I'm concerned neighbor and I'm concerned neighborhood if we had seen it I would have discussed it did you get one there he didn't get one neither he's the house closer than what I am well the city sent him out it wasn't me it was well I'll tell you what let the pastor finish his presentation then we'll bring you all back up for some additional discussion and then we'll give you a chance to do it so finish your remarks and then we'll move on from there just one moment and now I won't take that much more of your time as I said again we've got so much going on that have transpired within our neighborhood that that it is unreal the runners that run I have nothing against people that run that's good matter of fact I probably need to run myself the legacy trail as mr. Costello said that was put behind the house took off probably about where from eight to ten foot of our property cost a pretty rough static over that but we looked at each other smiled and went on you know cost number one there was a city that was doing that and that's what the city is out but again over there where you put in this we did not receive anything I didn't he didn't so there's two of us there in the neighborhood so how many others did not receive what's going on at the end of the street I do know there was apartment building there I thought there was six apartments I thought it was and that part was that were there and they caught on fire all about 15 20 years ago you know departments caught on fire and they never rebuild them back there was a mechanic there that it so cost is so forth and so on there at the end of the street and he had a garage that he kept stuff in what you was talking about there's one house there that's in bad condition that's on the property but I'm just saying again and I'll stop we didn't receive anything I give anything if we was involved then we probably wouldn't been here today because we've been able probably to talk to you I came as a concerned citizen for my neighborhood okay thank you anyone else would like to speak to this particular agenda item but just a minute it's been I'm talking about the audience at this time not hearing not seeing anything we'll come back to now sir now you've got a shot at the rebuttal um some things i'd like to mention is as far as parking we meet the required parking so i i i don't think we're these are small units so i don't think they're going to have three cars each unit you know it may be possible to have two most likely one car the idea for this development is an emphasis on bicycles and you know he wants to promote people walking and using their bikes and being at the end of the bike trail where it is i mean it couldn't be a more perfect spot for development of this type yeah i mean so just another thing to note it's this is three quarters of an acre that's currently a junkyard it's an abandoned properties vehicles being stored on it and so I think the value to the neighborhood would increase it seems like that everybody would want that it's kind of an eyesore right now the second thing is we being kind of aware of that fact we if you look at the plan it has its own road you know so the idea is to really push the residents inside that development plan and to keep traffic off the street when we can't regulate that obviously but being cognizant of that we've tried to be sensitive to traffic impact hopefully with the combination of having its own kind of route through and then the green infrastructure and the bicycles that should be very minimal okay uh to the citizens if you'd like to come back up and make another point or two yeah that's okay he speaks of just bicycles and so forth and so on like that i don't think everyone that moves in is going to have a bicycle that's going to move in to the neighborhood. Again, we have so much on the end of that street, and at the front part of the street, you're talking about it's going to raise the value of our neighborhood. I find that as an insult when you tell me that it's going to raise the value of my neighborhood, and I've been there 30-something plus years. Yes, it was a mechanic place. The guy that was owned the mechanic place owned the place there he was told to leave out and he had to leave but for as you coming and telling the council that that it's going to better our neighborhood it's going to do that to our neighborhood i love my neighborhood i don't need that to make my neighborhood better thank you anyone else no not yet anyone else from the okay now we'll go to the staff if you would Mr. Martin, and I think one thing specifically, would you address this issue of notification too? Oh, okay. That's what I was going to do. I wanted to be clear. With this body, we know you hear it a lot, and we understand that. We want to make it very clear to you that the sign is all that's required by the ordinance to go up on any adaptive reuse, and that was done. You may recall they had to postpone to get that sign up, and it is deemed adequate under your ordinance that that sign is adequate notice on an adaptive reuse project. The Board of Adjustment variance has a 200-foot notification requirement. Conditional use is 500 feet, just like a zone change. The notices went out for the Board of A 200 feet. That complies with the ordinance, and it's been in place for many, many years. So all notification has required, legal notification has been met. I would like to also address another item about this location and the fact that it's a residential adaptive reuse. This is I-1. An I-1 use could locate on this property, an industrial use, with truck traffic and employees and all sorts of things, and the Planning Commission would never see it, would have no jurisdiction over it whatsoever. It could be a buy-write use. They go pull a permit, build a building, put a business in there, and frankly, staff believes that residential adaptive reuse on this I-1 land is frankly more appropriate than tucking an I-1 use way back at the end of a dead-end street because of the potential impact on neighbors and on traffic and that sort of thing. So I just wanted to clarify that for the Planning Commission. Very good. At this time, what I'm going to do is allow the Commission members, if they have questions of either the applicant, the staff, or the neighbors, they can ask the question at this time. But this is for the Commission to ask you all questions. Ms. Plumlee? Thank you. A neighbor mentioned a three-way stop. We usually look at multi-way stops, do some traffic counts and look at the collision history, and that's definitely something we can do at this intersection. Always appreciate the concern and we always hear the concern for traffic and that is something that weighs heavily on us all the time. The key factor for me here is what Mr. Martin said just a few moments ago in the fact that with this being I-1 land, the possibility of a business going in there could significantly increase the traffic with much larger vehicles than just cars going to a residential. That, to me, is a key factor. And with what is being proposed here, I really think this is the lesser of two evils, so to speak, because there's already two businesses. It looks like one right across from Bel Air that has significant cars and parking just from looking online here. And there's also one that's directly behind it with a large number of vehicles as well. so you know as I said this is the lesser of two evils and in adaptive reuse I'm gonna have to be okay with it anyone else on the place you have any thoughts or comments okay then in that case we're ready for a motion Yes, Mr. Chair, I'll move for approval of Plan MJDP 17-117, Charlotte Price Estate, Lot 61 and 62, being an adaptive reuse project with the 16 noted conditions.
