Students can come in, children can come in and learn how to do computer programming. They actually learn to code and it's an hour of code. Now is that taking place in this new building? Is that part of the programming in this new facility? It's usually done in the classroom building. Okay. The science projects though, even though last year maybe they were done in the biology lab in the classroom building, now they will be done here in the science center, the science education center. And we continually have events like that, small and large, and again, we invite schools, we try to get the word out to the community, and always looking for new opportunities as well. Okay. And what we'll do at the end is we'll share your contact information just in case somebody wants to reach out and partner with the community college. All right, Ms. Sheila, it sounds like you guys are doing a lot to support the surrounding community. Can you speak a little bit about how this new facility is going to help support the students that you have here on campus? Well, we do have, like I said, the biotechnology program and the environmental science program. For students who don't want to continue on to a four-year degree, they will at least learn the skills that they need to go into a laboratory and be in the workforce as soon as possible. And then for those, these classes also will support students who are going on to get a four-year degree, transferring to universities. Well, it sounds like there's going to be a lot of learning taking place in these walls and in this building. And the learning that's going to take place is going to prepare your students for job placement, workforce opportunity, and actually get them ready for careers in the real world once they leave school. We had a tour of the building. It's a top-notch facility. It looks like it has state-of-the-art equipment. Mr. Martin, Mr. Chairman, members of the Planning Commission, first item on your agenda is a final record plat for your review today. And as you all are aware, because record plats are now primarily staff items, one of the reasons that this plat is before you today is there's a waiver associated with property. in conjunction with that we have passed out nice pretty yellow piece of paper with revised conditions now this is a area out in Heartland the garden or gardens of Heartland depending on your which plant you look at that is an HOA property in this location it's on ivory bridge it's on ivy bridge drive which which is somewhat in the heart of Heartland as you get to the south portion towards the county line. The reason this is really before you today is twofold, and it's all connected to the same thing. The Ashland Oil Pipeline. This was an easement that ran through here and ran through large parts of our county, and that Ashland Oil Pipeline has been relocated, and in this area that easement has been released. so during the time period that that easement was located here this was an HOA lot now this little portion right here was created as an independent lot when all this property was planted but it was owned by the HOA this was the remaining green space HOA lot and what they're proposing to do is create this lot with the remainder with an access 10 foot access through the frontage up into the remaining HOA green space in this location and the purpose of the waiver is because it's zoned R1C that's only 10 feet of frontage so they need a waiver of the frontage again for the HOA green space lot this is not a buildable lot and normally staff isn't too concerned with green space and HOA lots but it is zoned R1C and by subdividing it it kicked in the subdivision regulations once again. And prior to that, it had the frontage. So they're reducing the frontage by creating this lot. And what's interesting, and what the difficulty is, is that R1C only requires 60 feet of frontage. And they have 122 feet through here. And by the way, you see that line right there, that odd line? That's the easement. It's the easement that created that line right there. That's why you have an odd geometry right there. That's why you have that odd geometry right here. That's the easement as it went through. Well, they could meet the 60-foot frontage for two lots. They can't meet the square footage. They don't have enough room. There's only 11,400 square feet here. Even if you added this little piece and brought it all the way over here to this existing lot, there's not enough square footage for two lots. So they are proposing a single lot. and obviously 11,400 square feet. That's a large lot for the zone along with the frontage. And again, they're proposing to maintain this 10 feet of frontage, which will allow easy pedestrian access along with they can get up in there and mow and maintain the property. The biggest holdup on this has not been the waiver. This was submitted to you back in the fall, and it was held up because there's no sewer available to this lot. Now, that was the biggest issue from your staff's perspective on this property, because you have to have public sewer to a lot. They have finally resolved that problem, and they are going to be able to provide sewer to this property. And I'm sure the applicant could provide you with details, but in essence, they are procuring an easement. on the adjoining property in order to run what in effect will be a lateral to this property to provide sewer. With that, your staff is recommending approval of the waiver, approval of the final record plat, and I would direct your attention to the yellow page. you can see that we have our standard sign-offs. We are requiring that the release of the ash and oil easement documentation be a part of the file, as well as we'd like to see that denoted on the plat. And then the resolution, 11 through 13, those resolution items all relate to the public sewer. and that is if it requires an engineer to design the sewer, it creates a little bit different certification. If an engineering design is not required, and at this point in time, they don't believe that will be required. But again, if they get into some issues on site, some other problems like that, they may have to change their strategy a little bit. The sewer will have to be provided, have to be in the ground, before they can certify and record this plant. So that staff is comfortable in talking with the Division of Engineering, that that certainly will be resolved in accordance with the regulations. So, again, staff is recommending approval of the plan. I'll be happy to answer any questions you may have. Any questions for Mr. Martin? Mr. Lawrence? Thank you, Mr. Chair. Thank you. mission the next item is a development plan on page two of your agenda it is major development plan 17-109 it's the fuller and other properties in meadowthorpe commercial business center lot 3 amended this is a development plan that was submitted for property located here at West Main Street it's on the east end of the Metathorpe shopping center near the there's a large insurance building in this location a contractor's office here and this was his own change to be for for these mini warehouses this is an existing building this plan was the zone change was approved and then a final development plan came in very similar to what you see here and it was approved by this body back in June of this year subsequently the applicant filed a plan that showed a gymnasium a private little athletic facility along with the many warehouses that change in the plan created a lot of concern on for staff for traffic engineering fire that all related back to the original issues on the plan that had been resolved when it was approved in June and that is access through the property this is an access easement it's one way it will circulate through here and come out again one way in this location that that original plan took months to get approved fire department went out with the big red trucks and there were site visits to try to help resolve the turning radiuses and how to best serve this property there was a another issue that was long-standing with stormwater on this property it was eventually resolved to the satisfaction of the Division of Engineering on how to deal with the stormwater and that relates a large part to the fact that there were outstanding problems that were known in the area when the change in the plan was brought to the subdivision committee the subject division committee expressed some concerns about those outstanding issues and the change in the plan and they recommended postponement now since that time in the several months weeks since that time staff has continued to work with the applicant there's been various solutions discussed and offered and what we have put up on the overhead for you is the resolution of those problems that's what that plan is that's what that plan illustrates is the resolution of the problems the gymnasium is gone that use is gone they're back to the many warehouses and with some office space to serve the many warehouses the access continued to be a large concern and it had to do with the need for gates to secure these many warehouses which as you all know is very common with many warehouses but that created a problem for those folks that might be utilizing that access easement and parking on the property that you can see that that aren't isn't subject to the mini warehouse and then what what would they do how would that function well after a lot of work and a lot of time we believe that we've reached a solution I can report that traffic is satisfied the applicant is satisfied with the resolution and is it the best of all worlds no but we believe it'll work in this case and it would be important to note that that plan was submitted this morning so obviously staff couldn't resolve or couldn't review it under your own guidelines however it is almost identical to the plan you approved in June and the key and we love the color very much and you're going to be seeing these in electronic version next month which is nice it's easy to see things at this location of yellow that you can see on this plan and you can see on the overhead and then the blue you move it back down into this area right here that's where the gate needs to go and that way all the parking that serves this development will be on that development now that doesn't mean that if someone comes up this access easement gets back into this area that they're not going to have an issue and they're going to have to move very quickly back out this access because they're not gonna be able to get through the gate unless they go in and get permission and get the codes from whoever happens to be working there that day that's a conflict that although of some concern to staff is one that just seems to be inherent in the property with no no real good solution the upside we don't really believe that there's any cause to be concerned about any kind of serious accident or real problems with a short distance that someone may be utilizing what in effect is a private driveway into the rear of the properties with that your staff is recommending approval of the plan subject to the conditions that you see on your agenda with the revisions to 13 and 14 being resolved the stormwater problem as well as the access easement and proposed gate and again the gate is the remaining issue in the state in the in your staff's opinion it's the gate is the key and I can report to you again that engineering has reported to to planning that they have reached an agreement on the stormwater issues so it took some work took some time but we believe we're there and so again we are recommending approval of this plan to you I'll be happy to answer any questions you may have for staff that's Monday Tom will there be signage on that ingress to say that it is one way only or there certainly could be there's absolutely no reason why they shouldn't be willing to sign that property and state that it's one way I think it ought to have signage on it mm-hmm and certainly that that could be something this body could require yeah okay thank you as a part of the report miss Casey culture would you please come forward on that I know that you all have an issue with the traffic I just want you on a record you're saying that it's okay well I get that taken care I think your point is well taken. I just want to call it back and see what she's got to say. Good afternoon. All right. So I did. I'd expressed to you all during subcommittee that I had a concern. And basically we've resolved it because we have backed off that use. So where the concern came about is when the applicant requested a heavier traffic use on that back lot. And so we've went back and worked together and went back to the original just mini warehouses in the rear, and that's made traffic comfortable with the ingress and the egress movement. You know, the amount of traffic that will be going back there to the mini warehouses will be minimum compared to other uses that could have been back there. Any questions for Ms. Coucher? Yeah, I've got one. Okay, Mr. Penn. number 14 talks about angle parking which i already talked about the gate and access easement is that a one-way in and out it's got to be two ways doesn't it so um there was angled parking on a previous plan this plan does not show angled parking so it will function as a one-way in and then a one-way out on the other side okay and so we can do away through angle parking Yes, I thought the conditions were up on the screen. I don't know what the exact condition says, so I don't want to speak too soon. Okay, thank you. Okay, resolve angled parking. So it says resolve, so it means you're going to work that out. Mr. Mark. Mr. Chairman, members of the Planning Commission. This next item is Development Plan 2011-41, Blackford Property, Phase 1, Unit 5, and Phase 3 as amended. this is of course property that is located out in what is known as the Blackford development it's in your expansion area the here's Walnut Grove Road in this location here of course is the Blackford Parkway which runs all the way through the entire it's the major collector as you all are aware for the Blackford development This is the Greenbrier neighborhood and the country club in this location. And I'm sure you all recall that when this plan was originally going forward, there was a lot of discussion about the orientation in this area in particular with the floodplain and Greenbrier and the country club. It was a tremendous amount of discussion. We have here now a single-loaded street that you can see in this location through here along with an HOA lot. You may recall, and that's what this signifies right through here, this line, is EAR1 and EAR2 density differences, number of units. And that was one of the reasons that ultimately when this plan was being approved by this body, they brought in and incorporated this entire eastern section. and that their staff actually recommended that and it was all part of making sure that we got the right number count on the lots because we were getting into an issue with this change and how things were coming in that it was determined uh the applicant along with staff determined it would be best to go ahead and and just demonstrate the single family lotting pattern that they intended over here and make sure that the numbers were going to work without a reconciliation you know every time we also tried to demonstrate with these lines that these are recorded these are plats and they've been recorded and there's housing out here now we didn't update this for you today because we didn't anticipate having to present it to you obviously and one of the reasons is if you'll look at your agenda not only was this approved in 2011 it was reapproved in 2014 and at that time there was only one issue and staff went out and made a field inventory to check and make sure that all the appropriate infrastructure was in place for that reapproval as a condition of your reapproval by the way in your regulations when someone comes in for a reapproval of what in effect is a preliminary subdivision plan and of course out here a final development plan that they've made progress on their infrastructure and that is again the very reason that is back before you today because they are developing out here they're building infrastructure and they build off of this plan so they need to have it reapproved as so they can continue to build the infrastructure which is at this point in time just streets utilities and then the sewers that will provide storm and sanitary they'll just provide local service to the lots all your EAMP components are in place the sanitary sewer collection line the parkway these elements are in place it's a regional basin stormwater system it's largely in place so it's there's not an issue with the AMP compliance this plan complies with the AMP there's been no changes they're not changing the thing they just are seeking your reapproval of of this preliminary subdivision plan so they can continue to develop the property and I'll be and of course staff is recommending your reapproval the only change that you can see is that we now have a landscape examiner who's in the division of environmental quality as opposed to the division of building inspection any question question for mr. Martin spin you keep referring to this as a preliminary plan yes sir in the expansion area all your plans are final development plans and preliminary subdivision plans that's what you build infrastructure off of okay and then you come back and file the final record plants that actually create the lots shown on the preliminary subdivision plan so they can pull permits and build the individual houses but they're putting the infrastructure in on a preliminary development plan a preliminary subdivision division plan yes and that's how it's always been done well i understand that yes thank you okay any other questions for mr martin okay applicant thank you Rory Kaley at the EA partners wasn't prepared for this either we turned in a sign affidavit we're in agreement with staff's presentation I think we'll let the gentleman speak and okay what we can do any questions okay thank you okay there was a gentleman had an issue with this would you like to come forward and give us your name and what wait you get to the microphone yeah sorry I'm just here in opposition of the development. I live across the street from this. It's already very congested on the Bay Springs Loop Group, very congested. There's people parked over the sidewalk. There's people parked in the street. The people that park on both sides of the street have already posed a huge problem with ambulances and fire trucks making their way up Hibernia. I'm concerned that if the population density here is the same we're going to have more more of the same problems we're looking at 440 units on 123 acres 440 units on 123 acres i know what this is going to look like i've walked that green space off a lot a lot of people really appreciate that green space it's a good buffer between us and Greenbrier between us and Walnut Hill or Walnut Grove rather and I do know that there's about three houses at Greenbrier that are completely ruined now and those are some of the better looking houses on I think the name of the streets Kit K they did have a lot of forest behind their homes now they can come out and spit on a glorified 250 thousand dollar apartment that's what these are they're glorified two hundred and fifty thousand dollar apartments minimum two hundred and fifty thousand dollars they're just glorified apartments they're seven feet between these houses seven feet there's a huge problem with drainage between all of these houses when i bought the house i'm married so i was kind of boxed in to buying the house So I got home every day, and I'm sitting in the living room, and I hear this. And this went on for months and months, and I'm thinking, my dog's right here. It's not my dog making that sound. My cat's right here. It's not my cat. If I'm lying, I'm dying. I can be in my living room and hear my neighbors coming down the stairs in the house next to me, just coming down the stairs. they're young boys and I used to leap down the stairs too but I think when you can hear your neighbors coming down the stairs the population density is way too high another issue that I have is the sign that was put up about this meeting was put up two days ago and everybody's at work that lives back there right now Everybody's at work. Nobody can come to this meeting. Nobody can oppose this unless there's something I'm not aware of. I know everybody in the Bay Springs Loop group. I'm the self-proclaimed mayor of the Loop group. Everybody knows me. And more than half of the people oppose this. We appreciate the green space. I'm a little disheartened that money controls all of this. ball homes have been around and around about and they're too big to take on they don't care about what I have to say they don't care about what's right and wrong they don't care about what's right and wrong I'm supposed to have a seven year warranty on my roof they won't repair my roof because I'm not the original owner I don't think that's legitimate whether it's six years or six sixty years eight years ball homes still built that roof they still owe me years of not leaking. They don't care. They don't care. Two days before is when that sign was put up. Two days. It's just disheartening. And the last thing I want to talk about is the intersection of Blackford Parkway and 1492. 1492 is that section of Man of War. Got a bad problem there. I've always noticed it. I'm an auto enthusiast and a driving enthusiast, and so everything driving I pick up on. The problem we've got at that intersection is when you're exiting Blackford Parkway, which is a 1.5-mile road that's a dead end. It's a 1.5, it's a dead end at the end. I think it's going to inevitably go to Polo Club, but it's a mile and a half. So as you work your way finally to Section 1492 at Man of War, there's ball home signs on the left. You all can go check this out. If you care, you'll go check this out. There's ball home signs on the left, open house, model homes, all this stuff. And there's pillars on the right that say Blackford Parkway. The problem is you have to come all the way out into the eastbound lane on Manowar. You have to come halfway out in the eastbound lane of 1492 to see both ways. The problem is you're already out in the eastbound lane, and when people are coming westbound down the hill, down Manowar, Section 1492, and they need to pull into Blackford Parkway, everybody gets the bad mean mug face. Everybody gets the bad face because you're already out in their lane, and they have to come way out and go around your front bumper and almost double back to get back in Blackford Parkway. From what I understand, what's legal at a stop sign, what's proper is you stop behind the stop sign. Somebody missed the ball here on the engineering of this intersection. you have to creep up approximately 25 more feet past that stop sign to see if you can pull out on Manowar. This is not rocket science designing these intersections. The intersections of Bay Springs and Blackford Parkway, there's barely enough room for you to stop at the stop sign and allow another car to pull in. The intersections are too small. The roads are too narrow. I don't see anything good coming out of this. It's already too congested at the end of Blackford Parkway. It's just already too congested. And I'm disheartened that nobody wants to listen to the people that live back on that loop. Nobody wants to listen to anybody else that lives a stone's throw from all those houses. And that's all I have to say. Thank you. Just one quick question. How long have you lived there? Four years, sir. Four years. I moved there in 13. Okay. Were you aware of the fact that this has already been approved? In fact, twice, so to speak? I was. I was not. I was not. I do understand it's going to happen. I do understand when I bought it, it was already planned. I do understand these things, but I would be remiss if I didn't at least. And you have every right to be here and make those comments. I've never done anything like this. so well neither have I so we're the same thing and you're a wise man for doing what your wife wants you to do the applicant want to say anything good afternoon Nick Nicholson here on behalf of Ball Holmes I also was not exactly prepared to be here today but I do just want to point out some very quick things in rebuttal and kind of echoing what Mr. Martin said this plan is a re-approval that's in full compliance with the expansionary master plan subdivision regulations and any applicable provisions of the zoning ordinance everything that has been constructed to date whether that is infrastructure whether it's intersections whether it is side yards everything that has been constructed to date is as it was approved on previous develop development plans and has already been kind of reapproved twice on this plan as well. All of the notice requirements were complied with as the affidavit that Mr. Kaley submitted to the record test or basically testifies to and this is not green space. This was always meant for development has been slated for development at this density since 1996. It's been on approved plan since 2011. As Mr. Wilson pointed out, it's already been re-approved before and we simply would ask for re-approval we are not asking for any changes whatsoever not an increase in density it is exactly what it was already approved we'll have a question for you we just yes yeah mr. Nicholson is it fair for us to ask if ball homes the sign is interfering with the view of coming out of that road that they could look at that we certainly will look at that to my knowledge it is within the appropriate spacing that the sign ordinance basically allows but we will absolutely take a look at in remedy if it is not thank you sir you yes sir you okay the citizen if I may mr. pin I just spoke with traffic engineering miss Kalker and they would be more than willing to take a look at that situation out there and see if there might be something in terms of signage that needs to be addressed or I mean that's that's something they do and they're happy to they'll be happy to take a look they'll certainly listen to this gentleman's concerns okay sir you want to get to the microphone please I'm sorry this is green space this is beautiful green space I would encourage you to go out and look at it this is great green space I don't know why he's saying this is not green space this is beautiful forestry there's it's beautiful second of all I I understand it's been passed in 11. I understand it's been passed in 13, but that doesn't necessarily make it right. Just because somebody says, okay, we're going to do it, I get a few million out of it. It doesn't make it right. Do we not know what right and wrong is anymore? And the last thing, if you live there, you would understand. Okay. I know it's been approved, but you just have to live there. Okay, thank you. Karen Monday and second by miss Carolyn Richardson that we reapprove DP 2011 day 41 Blackford property phase 1 unit 5 and phase 3 as amended blackwood blackwood Parkway with the 15 conditions noted by staff adding with that the landscape examiner's approval landscaping and landscape buffers and yes and the EAMP compliance report included with that and added to that particular motion I'm sure with the second with the EAMP compliance report any discussion on the motion during now would you please vote when it comes up on your screens thank you motion carries thank you mr.
