The next item on your agenda is at the bottom of page one. It is Major Development Plan 18-22, Lansdowne Subdivision Unit 18-D Section 2, also known as the Townhomes of Laredo amended, and we have passed out for you some revised conditions. You can see the plan before you up on the screen. It is a lot that was previously used for the amenities, the clubhouse for the neighborhood. It is now being proposed for 17 townhouses. The typical townhouse is 1,275 square feet. They're two stories. They're going to be 28 feet in height. They're providing 16 parking spaces for the townhouses, or 17. There will be one per house. and this is an R3 zone. Your typical lot is about 25 feet by 90 feet and that's just typical. There'll be some slight variation. You can see that by the odd shape of the lot. As I said, this lot was the lot where the amenities for the neighborhood had existed. Originally, there was some concern, as you all can see, with Laredo Drive. This is an amended plan. Laredo Drive is heavily traveled. collector. There's some speed issues in the area. Access is fairly well controlled from neighboring properties and townhouses and apartments in the area. There are some single family homes with driveway access immediately adjacent to this property. Initially, staff's concern was with the driveway access to Laredo because of the curve and the high speed in the area. This amended plan is a compromise between issues and concerns. They have shared driveways, but they've limited the access. Originally, every townhouse was going to have an access along Laredo. They're now sharing access, so they reduced the number of access points on Laredo. In conjunction with that, we had a large meeting, and we actually got water quality involved as well, along with traffic and discuss the issues. They have agreed, the applicant, to work with traffic engineering on some additional measures that could help slow traffic in the area and raise drivers' awareness to help with these access points. One of the issues we had originally discussed with them would have been rear loading. That would have required more pavement. It could have required underground detention. we are getting a lot more green space their ability to meet the required water quality standards and detention standards this is over an acre they have to meet the requirements of the stormwater manuals so there was a lot of discussion on balancing the various demands placed on this site and what you have is a new plan a revised plan where staff was able to work out the issues to everyone's satisfaction You can see from the handout, there's all sign-offs or standard sign-offs. We do have a couple of cleanup items. Correct note number eight, the state Laredo Court. The original plan stated that construction access would be off of Laredo Court. This particular version of the plan just said Laredo Drive. No doubt that that's a typo, but we just want it clear. Construction access will be off Laredo Court. And then delete note number 12. Note number 12 is just a statement of a requirement that they will address improvements on the improvement plan. Well, yes, they will. And that's just a statement of how our regulations work and doesn't really need to be on the development plan. I do what she used to do before she was promoted to her position now and it is my pleasure to present this case before you today Thank you So to get started here, let me see if this looks All right, well good afternoon Chairman and council members Our first and I believe only zoning change case that'll be heard today is in your notebooks behind tab three It's also accessible on your screen, of course The zone change request is for case number PLN MAR 18-5. It's for Clay Ingles Company, which is both the applicant and the owner of the site. The zoning request is to change the zone from two-family residential R2 zone to light industrial I1 zone on just under a quarter of an acre of the site. The site is located on both 910 and 912 Delaware Avenue, but the two of those parcels are presently being consolidated into one parcel. The proposal is to rezone the site in order to construct a wider, realigned main entrance driveway to better accommodate the truck traffic to and from the Clay Ingles site. The driveway improvement is intended to replace an existing narrow driveway on adjacent I-1 site which is also owned by the Clay Ingalls company. Here we've got the zoning map area presently along with the 500 foot notice. The subject site is the white area and it's on the south side of Delaware Avenue. It's directly adjacent to an I-1 parcel. Let me see if I can point that out here. So that's an I-1 parcel that it's directly adjacent to which is also owned by Clay Ingalls as as is the site to the south, which is a large I-1 parcel. To the west of the subject site, you can see that that is B-4, both on the south side of Delaware and the north side of Delaware. There's an R-3 parcel directly across the street, and that's just a parking lot for the B-4 parcel next to it. All of the R-2 over here is the Liberty Heights neighborhood, and as I stated, that is R-2. All right. That's the larger area map of the zoning and the area. So here you can see where Delaware Avenue intersects with Winchester Road. There is a traffic light right there. So that's mainly, I believe, where the trucks exit and enter onto Delaware. There's also a railroad track that comes up here. Across the street from the site, which is I-2, or I'm sorry, I-1, that is the GIF plant. there are other industrial uses all around the area along with some warehousing in the before but the majority of this area is I won and before on the aerial photograph it's a little easier to see what's going on and you can see the brickyard and all of its activities going on to the south of the subject site that narrow driveway is on the I won directly beside the site you can see of course the neighborhood I know there's a fast food restaurant many storage warehouses and a bunch of other industrial and warehousing uses there are three entrances to the Clay Ingalls site that I wanted to point out one is here on Winchester Road right adjacent to the railroad tracks the other is the main entrance with the traffic light and then if you go all the way south there is also an entrance but it's kind of shared with an Italian restaurant called the Italian pasta garage. That is the site itself. That is the two lots. They look like one lot, which is why they're being consolidated. And you can see all the activities for the brickyard behind it. And then next, you've got the site, of course, over here. This is the narrow driveway that exists right now for the trucks. And that is the brickyard behind it. That's a B4 warehousing property, and you can see a little bit of a corner of a privacy fence for the R2 beside it. And here we're looking west along Delaware, and those are all B4 properties, and that does lead you to Winchester Road and that traffic light. Here we're looking east along Delaware, and that is the Liberty Heights subdivision. So now we're on to the justification here. The applicant states that the comprehensive plan does not speak toward this type of rezoning, and that is true. Staff concurs. Therefore, the rezoning can't be justified by the comprehensive plan. However, there are other ways in which to look at rezonings, and the one that we're looking at today is appropriateness versus inappropriateness. The applicant justifies the appropriateness of this rezoning request by stating that the I1 zone is appropriate and the R2 zone is not appropriate due to, and I will outline these, and they are in your staff report in your book. If you want to look at them detailed, I'm going to kind of abbreviate them a bit. And it's due to the location of the subject property being surrounded on three sides by B4 and I1, and, of course, a road on the fourth side so you can get there. It's also due to the fact that buffering has been historically nonexistent between the R2 lot or lots and the B4 and I1 that are beside it. The third reason is due to the years of vacancy of the residences that had been on those lots. The houses have since been demolished due to disrepair. and they determined that these homes are not being occupied because of the close proximity of the active industrial uses and warehousing wholesale uses in very close proximity to those residences. The fourth is that there's the access to an industrial zone is not permitted through a residential zone. Therefore, in order to better their access, they would have to rezone the site to something industrial so that they could get to the site and obey all of the ordinances. So the recommendations, they're detailed in your packet, and I'm not going to go through them in detail. But staff does recommend approval, and there is conditional zoning that is included, and we will get to that, but when we do, it is on your blue sheet that was handed to you before the meeting. the approval is based upon the following reasons the requested light industrial zone is appropriate for the subject site for the three reasons that are in the staff report in your binder the existing two-family residential zone is not appropriate for the subject site for the two reasons that are in the staff report in your binder this recommendation is made subject to the approval and certification of the development plan of course as usual the conditional zoning restrictions that are proposed include these two any outdoor lighting shall not be directed toward nearby residential properties and that just makes sense because of the proximity obviously of the residences and the second conditional zoning is any freestanding signage shall be limited to one freestanding sign not to exceed 15 feet in height and 32 square feet in area and these restrictions are appropriate and proper because the site lies immediately adjacent to existing single-family uses across Delaware Avenue and that concludes my presentation if you have any questions any questions nice job applicant oh I'm sorry I forgot about the development plan okay she did such a wonderful job I didn't think we needed you this is one of those that you may very well want to forget about this this body has in fact been asked to review boulevards and large roadways on development plans in your expansion area well the development plan that you see before you today which is on page five of your agenda is for a driveway for an industrial access it's about 130 feet long across that existing property it's 30 feet from back curb to back of curb with a 40 foot apron being proposed again to allow access for the large trucks that serve the site staff is of course along with your subdivision committee has recommended approval subject to four sign-offs and in one number five condition on the top of the next page is just to denote the proposed land use in the site statistics, which is, of course, industrial access. Nick Nicholson here on behalf of the applicant, Clay Ingalls. As the staff has very eloquently put it, there is not much to this. This is simply a zone change request to kind of widen and realign an existing industrial access point in such a way to direct the traffic that is coming to the site in a more efficient manner and the trucks that are leaving this site directs them towards Winchester Road and away from the residential uses that already exist. it is not introducing any type of new use is not introducing any type of new business to this area is not going to increase traffic it is not going to increase noise in any way this is simply an existing business owner that is trying to make his property more efficient and also do this in a way to basically help a known issue and help solve kind of the residential concerns that are right next door we'll continue working with the staff in order to make sure that any landscape buffering that needs to go in will go in and we're certainly in agreement with the restricted zoning uses that were proposed by the planning staff. Is there a fire hydrant in the way that drive? We need fire to come down here. I can tell you I don't know. What did you get up for? Because everyone looked at me. We will relocate the fire hydrant if that comes into play. That is for sure. We're already having issues hitting curbs. We don't want to hit a fire hydrant. I think so. This fire hydrant is located all the way over here. It is not on the corner where we are talking about the actual access drive. And so we will make sure that all appropriate testing is done. Ms. Plumlee. just double-check and you are gonna do a buffer yes we are yes we are and we'll work with staff to determine what exactly it is it's kind of a little unusual because the area that's actually right next to the residential is already zoned I want and so we are essentially going to put put in I want to our to buffering even though that that is not actually part of where our zone change request is. Our request is technically right already next to I want, but we're agreeing as part of this final development plan process to make sure that the appropriate buffering goes into place and the applicant actually owns the R2 parcel right next door as well. So there will not be an issue with any type of neighbor dispute. Mr. Lawrence. Thank you Mr. Chair. Nick you made a comment statement that said that traffic accident would be directed towards the winchett so is this going to be one way in it is not it is essentially what this what I'm saying by that is right now it is straight and it is takes a full 90 degree turn and so essentially trucks are also incentivized to take a 90 degree turn into the residential if they're going out towards basically Liberty all the way out to New Circle this is directed so it basically it is a more natural turn to be headed to to Winchester Road in order to kind of hope that more exiting traffic is headed that way and not to the neighbors okay thank you anyone else thank you anyone else who would like to speak to this agenda item.
