This is an amended final development plan for property located at 409 Laredo Court. the next item on our consent agenda this afternoon is just below that on our regular agenda page two item c it is pln mjdp 18-38 and the application is for bluegrass business park lot four also known as pemberton farm or burke hawkinsmith and maggard and the applicant is wayne supply this is also an amended final development plan for property located at 1900 jaggy fox way third item on the consent agenda appears on page three of the regular agenda it is item d pln mjdp 18-39 application for bluegrass executive park unit 1c block e sections 1 and 2 also an amended final development plan and that property is located at 2205 thunder stick drive and then the last item on our consent agenda this afternoon appears on page four of the regular agenda it is item g this property is also located in the expansion area so there are a few extra items i will note with it it is a development plan pln mjdp 18-43 for new market property unit 6 and that property is located at 1263 angus trail because it's in the expansion area it does require an expansion area master plan compliance statement and the planning commission does have a memo from the division of planning located at your seat the purpose of this particular development plan was not to change any of the overall physical development but to amend the design standards and so we made a finding that that did not change their previously identified compliance with the expansion area master plan so the planning commission is not in need of making any new findings related to that on this case that property did require a sign to be posted again because it's in the expansion area and the engineer associated with said plan has provided an affidavit and a photo of the sign that was posted on the property again I will ask if there's anyone present in the audience today or if any of the Planning Commission members would like to have any of those four items pulled from the plan from the consent agenda and have a full public hearing on those. We'll get the presentation slides up, and it does start on page, I believe, three of our agenda today good afternoon we are looking at major development plan 18-40 interstate service center for McDonald's this property is located off of Stanton Way the Stanton Way and Newtown Pike loop for the 7564 interchange McDonald's is currently located down here in the rear portion of the property they're proposing to build a new McDonald's closer to the Stanton Way and consolidate the property with the adjacent property and have a larger parking area for those coming in on buses and trailers with this plan well the subdivision committee has reviewed this the first eight conditions are typical sign-offs this plant this property being within the Newtown Springs world aquifer the plan went in front of them on June 5th and they were approved with no other conditions. We have several cleanup conditions on the plan and the last condition number 19 it says discuss the vehicular and pedestrian access to Stanton Way. When this plan was originally filed it had three access points to Stanton Way. They have been in contact with KC Coucher with traffic engineering and they have reduced the number of access points to the two that you see above. Enlarging this one so that they can have both, they took out the one access point in the center that was going to go right to the McDonald's store and combined it with the other one that was going to loop around the outside so they only have two points. So we believe that after talking with Casey, we believe that this condition can be changed to resolve there's still a little bit a couple tweaks that they want them that she has one such as pedestrian access from the hotel into the restaurant going across the property parking lot like in this location a lot of times you have people that are just going to come out of the hotel and go directly there instead of walking around on the sidewalk so casey would still like to work with them on getting that connection as far as a pedestrian if it has to be with steps the ada can go out to the sidewalk and make it into the restaurant with no problems so with that i'll leave it open to you all if you have any other comments or questions any questions from miss gall i have one the in the subdivision committee we talked about the sidewalk outside coming from the hotel to mcdonald's is that in the plan now no that's what we're saying that casey still had a couple items that she wanted to tweak and that being one of them she still wants to see their sidewalk from the hotel to the restaurant within the parking area whether it be crosshatch so that people know that they're going to be crossing the parking lot or the drive lane the access going away from McDonald's does not go through the hotel property on this plane? Correct. No, that is going to be removed. That was something, my understanding was an agreement with McDonald's and the hotel that they remove that access through the parking lot from the hotel. All right. Any other questions from Ms. Gallup? Applicant? Good afternoon. My name is Greg Kowalski. I'm with McElroy D.D. on a Mox, a civil engineer for the development. We do agree with the conditions that have been proposed and wish to continue to work with Ms. Kochner regarding the access from the hotel to the McDonald's restaurant. Are there any other questions that I could answer for the Planning Commission? Any questions for the applicant? You want to ask? If there's not, I'll ask you this question. What about the radius turn off Newtown Pike into the McDonald's? Has that been widened? Is it any farther away from the Town Pike? Yes, the radius has been expanded. The reason for it and the entrance is a little wider than the other access. This is to accommodate large tractor-trailer vehicles to enter to get to the rear parking lot. and also vehicles towing trailers or campers, and also for buses. You will see on, there's the hatched area on the, I don't know, on the left side. You'll see a sidewalk, which is a pull-off that is proposed now for bus passengers. So a bus can pull off and allow traffic to pass into the rear lot, and that way the bus can unload their passengers and they can have access through the ADA stalls, which are hatched in blue, to enter the store. The very next item on your agenda, it's Hillemeyer Property. Bob, page three. Mr. Chairman, members of the Planning Commission, Turn your attention to page three, it's item F. This is a major development plan, 18-41, Hill and Meyer Property West, as amended. This is property that is located out at Sandersville Road in Citation. Here is your area, of course, of the amended plan in this location. Here is Citation. Over here we've had the B4 area that you recently rezoned. It's going to be developed for many warehouses. And then on back here, you just recently approved a subdivision in Sandersville Road. We'll be coming through here and connect at this location. It currently extends on up through here on over into the Masterson Station development. This is Mabel Lane at this location, providing some frontage for the development. This particular amendment is to change this plan. This original lot was proposed for all townhouses. It's just going to be the townhouse part of this development. This amendment, as you can see, is proposing 16 single family lots along Mabel Lane, with the interior being the rest of the townhouses, there are 24 townhouses that you can see within that development. They have an access drive proposed off of Sandersville Road, which will serve the interior of the development. When this was originally approved in 2013 with the townhouses along Mabel Lane, the access actually came off of Mabel Lane into the development to serve all the townhouses. Mabel Lane was originally Sigo Vista, and it went all the way through and was parallel to other streets in the area. It was terminated with a cul-de-sac when the assisted living facility, Magnolia Springs, was approved and constructed. In conjunction with this particular amended plan, there is a waiver request, and we have passed that out to you. And specifically, the waiver request is for this access. From Citation Boulevard to this proposed access point is approximately 350 feet, which meets the access standards. However, from this access point to Mabel Lane, it's approximately 168 feet, and the minimum is 250 on our local street and access standards onto a collector. The townhouse development technically is considered a high-density development, and so it is bound by those access requirements in your subdivision regulations. And those regulations state that they should not access local streets. And as a general rule, that is one that we have followed. In this case, they are allowed access to a collector, but they're supposed to meet the minimum standards. The issue, and again, it is in your waiver report that they have on this site, is one of topography. It's the grade. And as Sandersville and Citation were constructed, there is a 4% grade drop as you go towards Citation. And this, along with the rest of the site that they're developing, creates a problem for them to grade and to build the access drive and the pads for the townhouses without a lot of excessive grading. So by moving this access point closer to Mabel Lane, they actually will have much better line of sight and they will have much better ability to address their grade issues in this particular instance. They could move it closer to citation and meet this particular minimum standard, but in this case it would really create more difficulties with the grading of the entire site. So staff reviewed it with the applicant. We reviewed it with the Division of Engineering as well, and they concurred that there was, in fact, a significant grade issue on this property. And so with that, you see your pretty little pink handout, and these are the revised conditions. The applicant cleaned their conditions up very nicely, and you can see that what we have remaining are your standard sign-off requirements for a development plan, and this is a preliminary subdivision plan as well. And then item 12 is provided that you do grant the waiver to Article 6-8Q, and again, that is the access spacing requirement under your regulations. staff is recommending approval of the waiver to you today and I'll be happy to answer any questions you may have for staff any questions mr. Martin thank you applicant good afternoon mr. chair members of Planning Commission Nick Nicholson here on behalf of the applicant ball homes I think mr. Martin laid out the kind of issues with this plan very nicely and the reasons why a waiver request is required I'm happy to answer any specific questions you may have but this is one that clear hardship was based on this topography of the site and the only logical answer was let's put the access further away from the kind of collector collector intersection and closer to a local collector as opposed to the opposite especially when that intersection is going to be lit I think that this is going to resolve any issues that this may have so happy to answer any questions if you all have it, but we think we have a very good plan. Excuse me, Mr. Goff. This meant we're on the bottom of page four. But we have a yellow sheet for revised conditions. Okay, go right ahead, thank you. At the corner of Manowar and Nicholasville Road, this is Rooster's Restaurant, which is located right behind the shell, coming in off of Manowar. They're coming in to add a, they had a minor plan for a covered patio and now they're wanting to enclose that covered patio, so they're adding building square footage to the building. They have revised the plan, and they have just the typical sign-off conditions for the first seven conditions. And then after reviewing it, they had a few other conditions. I'm sorry. A few other cleanup conditions we needed a little more work done on with the larger plan. This here you can see is a blown-up version of the rooster property. the addition being right here facing man o' war boulevard so we have several cleanup conditions on the large development plan they go to the back we just with this being one large development plan that has been over and over again we're just wanting to have them do some cleanup conditions that's pretty much what's left here on the overall development plan just for their area of the amendment we're not asking them to do the whole development plan but just there so that we can read it better like I said there was nothing else really to be said about this they have worked through and the understanding we brought up at subdivision committee it was where they were and they said that they have not enclosed it they have stopped there so they're only doing the patio roof and walls so they will wait until this is complete and signed and then they'll pro they'll enclose it any questions from this call Any other comments? We've reviewed the 16 staff conditions, and we are in agreement with those, and we'd be happy to make those changes. we we might ask you to put that picture up that'll answer the questions the subdivision committee phenomenal you want to explain mr carter what we're seeing uh yes what this is this is the patio that was previously approved and they have a building permit to cover the patio and what they've done is is where they've got their columns here they've done those in such a way that if they wanted to come back in the future they could enclose the patio and this plan that we have here before you is the plan that would approve them going ahead and enclosing the patio so they've basically just they've built it to a point uh you know where they're permitted right now and they can't go any further but but right now they're just waiting for this plan to get approved to finish the job they could go ahead with it like this and just use it as the open patio but they want to go ahead and finish it the reason i asked him to do that is we had a lot of discussion at the subdivision committee about was this one of these beg forgiveness or ask permission type situations and he brought that picture today to show where we are and to clear that up so Any other questions for the applicant?
