I'm going to call to the order of the agenda of the Board of Adjustments meeting for November 12, 2018. The first item of business will be approval of the minutes. Staff has made a couple revisions that were circulated to the members. Did everyone receive those? and does anyone have any additional items to discuss on the minutes before we all right hearing none then I will entertain a motion second I have a first and a second any discussion on the motion hearing none then I'll call for a vote please register raise your hands I'm sorry Okay, it's unanimous. So the motion is approved. Just so the audience knows, our voting system is not working currently, but we're going to proceed forward since we have such a light docket today. So Mr. Clark also voted yes, and Mr. Needham is not present yet. The next item is for, I'm going to sound the agenda. We only have one case today to be heard, so I'm going to go ahead and call this case and let the gentleman just be sworn in, unless the staff thinks it wants to testify today. Okay, come on up, sir. This is for PLN BOA 18-66, Berea Christian Church. Please state your name for the record. Sam Broner. Thank you, sir. and would you raise your right hand so I can swear you in? Do you swear to tell the truth, the whole truth, and nothing but the truth? I do. Thank you, sir. The staff has circulated revised findings and conditions. The conditions are for the recommendation for approval is subject to the five conditions. Have you seen those, sir? Yes, sir. And are you agreeable to abide by those? Yes, sir. Thank you. And once again, I forgot, what is your position with the church? I'm a deacon. Thank you, sir. um so with that being said the staff has recommended approval the applicant has agreed to abide by the conditions is anyone on the commission i mean on the board have any questions for the applicant mr brauner uh it looks like the changes that were made uh simply straightened up the parking places to be perpendicular uh rather than slanting is that that that was the main impression i got uh no sir uh actually the the main thing was uh having only two access points uh we are eliminating if you look at the first page uh we're eliminating one of the access points and then when the parking lot comes on around that'll be our second access point that's the the main thing so there are two ways in and out well yes one way in and one way out that's correct okay thank you any additional uh questions or discussion at this time okay thank you sir um at this point um i will you need discussions or does anyone want to entertain a motion Mr. Chair, I would, I'm not sure I understand the change. If we could have a little more clarity about the picture and so we can see specifically where the change has been made and what the final plan is. It's not clear in my mind. We're going to put up a copy of the new site plan. can see the highlighted portion there on the Berea Road side that is currently an access point to Berea Road one of the issues that we had in traffic had with the previously proposed plan was that there was going to be an access on to the ironworks service road and a third access on to Berea Road so in this plan the applicant has discussed with traffic engineering these options and they're leaving their first access point onto Berea Road which is above that yellow highlighted portion it's a little bit hard to see here but that is the entry and then in the new portion where the new parking spaces are there will be another access point onto Berea Road there will not be an access point onto the service road and this existing access will be closed off And there was also some concern about the parking on the diagram that is on the computer right now. There still seems to be diagonal parking with parking right behind the... In the site plan that I handed out at the beginning of the meeting, and this one here, this is the current plan, and we have a condition that the plan will be finalized with traffic engineering, but this is what they had recommended that all of the spaces be sort of perpendicular and do away with that diagonal line. So here we have 18 spaces that are all straight perpendicular spaces. And, Harry, I think when you hit revised plan on our documents, it pulls up the old plan. The old plan. Yeah, so it has that. The diagonal parking shows up on our system, even though that's. There was a plan in between the original plan and the plan that you see on your screen was an update to that. And then this is our most recent one that we just got this morning. So if we approve, we'll be approving based upon the plans that have been shown overhead today. I understand. Good. Any additional questions before we entertain a motion? then if somebody would propose a motion mr chair i move we approve pln boa 18-66 berea christian church's request for a conditional use permit for a conditional use permit to expand a church parking lot in the ar zone at 3894 iron works pike uh aka 2689 berea road for the reasons uh discussed for the reasons recommended by staff and subject to the five conditions listed i'm sorry the revised uh yeah i just want to make sure we mentioned the revised version yes the uh the revised findings and conditions that were handed out today to the board members mr glover moves for a first do i have a second second the motion miss whitman seconds at this point all those in favor please raise your hand the vote was unanimous thank you sir good luck with your project thank you very much appreciate it so that was the only conditional use appeal we had on today's agenda we have no variance appeals on today's agenda and we have no administrative views on today's agenda at this point any board member want to bring anything to the board or the public's attention um thank you mr chair i do everybody gave me a extra looks when i walked into the chamber with with a hat on and uh so i had two things to say about the hat the first is probably more obvious than than others this is veterans day observed and so i'm wearing it to honor veterans who have served in conflicts in america for the last 200 and something years um i don't this is the first time i've worn this hat actually uh it it looks or i feel like it looks a little pretentious uh to wear a hat i'm not really bragging uh but i'm just wearing it to to honor veterans day observed uh and it i have a suggestion to the assembled of ways to approach Veterans Day or Veterans Day observed is, what do you say to a veteran? And I think the overused phrase, thank you for your service, is still okay to use. But if you want to go further, you're certainly welcome to ask that veteran what branch of service he was in, when did he serve, where was he stationed, and anything else like that. the phrase thank you for your service although it is overused is probably still appropriate and to the veterans out there the appropriate response when somebody says thank you for your service is you're welcome the second reason i'm wearing this hat is because uh is is pure vanity but not the kind that you'd think uh the uh yesterday being actual veterans day the 100th anniversary of the end of World War I. There are several businesses in town and all over the country who honor veterans and Veterans Day by providing free services and meals and such to veterans. I took advantage really for the first, maybe the second time. One of those that I took advantage of was a haircut. I got a free haircut. And the barbershop that I went to was one I'd never been to before. The barber, the more she cut, the faster she talked, and the faster she talked, the faster she cut, and the faster she cut, the more she cut. So by the time I was finished, my free haircut will last me until 2019. And that's the vanity, is I'm wearing this hat and I may wear it until 2019 or at least until my hair grows back but so that's the end of my tail thank you Mr. Chairman for the opportunity thank you Mr. Glover and I would say Mr. Clark and I do not feel bad for you yeah at least yours will come back mine will not in 2019 but once again we would like to thank all the veterans and I'd say something about Tommy he has not only did he serve our country but he has served the Fayette County Bar Association as a lawyer practitioner for a number of decades and after that he was with the Kentucky Bar Association and served ably there as the general counsel and he has served on this and many boards so not only has mr glover served you know in the military but he has continued to serve through today so once we appreciate all that over the decades Tommy thank you you're welcome that sounds like a eulogy just for your hair sure yeah yeah you're welcome so that takes care of board items I do know for staff items we have been handed out the proposed meetings for next year and do we need to put those on the board I mean I don't think we need them but so we're gonna continue with the same second Monday of the month for 2019 I believe there was discussion about changing the time period from 1 p.m. to 1 30 I don't know and we still have time to do that today if we so choose okay and staff has said not yes we do but they do want us to decide today i am comfortable with the 130 given that mr glover's conflict has been resolved and i think it will give people an opportunity to have lunch before they come to today's meeting i think the reason yeah the reason i suggested 130 uh was that that gives the board and maybe staff as well time to have lunch not only have lunch but to have lunch and then travel to the to the board meeting so I if we need a motion to amend the proposed schedule to make the hearing time begin at 1 30 I'll make that motion I'd say if someone just wants to make the motion to adopt this time period with the revised date I mean the revised time I think that'd be appropriate okay so if there's no discussion that I'll entertain a motion term you made the motion not yet i move that we approve the board of adjustment meeting and the filing scheduled for 2019 with the provision that the meetings begin at 1 30. mr glover has a first miss meyers a second um any discussion on the motion hearing none then please raise your hand to vote unanimous vote this may be the first time we've gone through a meeting with unanimous votes um let's see here so we're going to have um any other items from staff to be discussed nope um this is a reminder that i believe um is it january we need to vote for officers or do we need to do that next month mr marks unless tracy knows we'll get back to you on that okay Well, while they're looking at that, and we don't really need to know the answer today other than to inform the board that we will be making. We need to, every year, put secretary, vice chair, and chair. So we'll need to do that sometime between December and January, depending on what the staff tells us. We want to wish everyone a happy Thanksgiving holiday coming up. And our next meeting is going to be on December 10, 2018, at 1 p.m. still. and the first meeting in january is when you all elect officers okay so our january meeting which will be on the 14th will be when we elect officers and since there's no more business before the board i will adjourn us thank you
