## Contested Items

**Ordinance 1130-20 – Industrial Authority Membership**

Ordinance 1130-20, which proposed adding a non-voting, ex officio Urban County Council Member to the Industrial Authority, resulted in a split vote. The primary concern raised during discussion centered on potential conflicts of interest that could arise from this arrangement. Council members expressed reservations about the implications of having a sitting council member serve in this capacity, even in a non-voting role.

The ordinance ultimately divided the council, with members unable to reach consensus on whether the benefits of increased oversight and coordination justified the potential conflicts of interest inherent in the proposal.

We should thank God for the men and women who committed themselves to establish a new nation in which voting was possible. We should thank God for the courage of the women of the speech movement who pioneered the path to the 19th Amendment and ensured women the right to vote. We should thank God for those who risked and sacrificed their lives to pass the Voting Rights Act of 1965 to allow all our citizens, regardless of the color of their skin, to vote. We also pray for forgiveness that there are still some in the country whose votes are not allowed to be cast or counted. We pray for those protection of all the voters and the votes of this election. We pray for those who have worked tirelessly to offer the country the vision of the future they deeply believe in. Give them rest and a sense of peace. We pray for all the citizen volunteers. We pray for a microphone that works. No evil. Certainly we can make it through this time of disunity. No matter how we voted, hopefully it was for the visions, ideas, and candidates that best represented our best values. Voting is one of the part of the prophet's instruction to seek the welfare of the city where I have sent you and pray to the Lord on its behalf, for in its welfare you will find your welfare. there. Today, we also pray for those who voted differently than we did for their own reasons, and we pray that we will find the ways to build bridges and work together for the common good of the country we all dwell in, and may our votes be guided less by fear of our neighbor and more by a hope for the future. God has blessed all the nations of the world, not just America. We pray for God's special blessing on our nation and that the opportunities to fulfill our country's greatest possibilities might be greatly enhanced. Amen. Thank you, Council Member Mazzotti. It just came to my mind. If someone, and I should wait. Dave Barbary is coming in. So they don't miss the question. I know that's happened in the past. Mr. Barbary, are you, I see you're unmuted. Oh, now you're muted. and I see Ms. Speckert's on the commissioner yeah so I'm here Susan I just don't know what the deal with the video is well that's I mean my question has to do with the industrial authority and this just hit me to ask this question so if a council person is actually making decisions on the industrial authority to purchase property or anything, does that mean that they would not be able to vote on any issues? Would there be a conflict if they were to vote on any similar issues as it relates to the 250 acres? I don't think so. There may be a specific instance where it would present a conflict, but I think generally that would not be a concern every single time there was an action taken, if that's what you're asking. Yeah, I mean, I know that not with specific with every action, but I was just curious about the, there could be some actions. Sure, as with anything that a council member serves on, there could be a situation that arises where it would become a conflict either when you're voting on the board you're on or when you're voting as a council member and something related to that. Okay. All right. Well, again, I'm sorry I didn't get to this question before the, and that's my fault for having the last minute thoughts. So thanks, Mr. Barbary. And thank you, Mayor. You're welcome. All right. Let's go ahead and have first reading of ordinances. Yes, ma'am. Is anyone opposed? Same sign. That motion passes. Are there any others? Okay. All right. If the clerk will please give first reading to number 44. And when you're ready, if you'll please take a roll call vote. Ms. Higgins-Hord? Yes, ma'am. Vice Mayor Kay? Yes. Ms. Lamb? Yes, ma'am. Mr. McCurn? Yes ma'am. Mr. Maloney? Yes. Ms. Massadi? Yes. Ms. Plumman? Yes. Ms. Reynolds? Yes. Mr. Swanson? Yes. Mr. Worley? Yes ma'am. Ms. Bledsoe? Yes, ma'am. Mr. Fred Brown? Yes. Mr. James Brown? Yes. Mr. Ellinger? Yes, ma'am. Mr. Farmer? Yes, ma'am. Thank you. Thank you very much. That passes. Council members, first of all, for information only, communications from the mayor are there any questions and then just second i wanted to um recognize the passing of two of our wonderful community uh folks senator reggie thomas's mother many of you knew her as our director of adult services and she certainly served well and then the passing of bill mccord who was a as council member lamb knows a great fourth district resident for a long time um the interesting thing about bill was that um he was a descendant of the folks who came through the cumberland pass who settled goonsboro back in 1780 and um so he his family was one of the one of those who settled kentucky He is the father of someone most of you know, Mary Diane Hanna and Carolyn Resnick. So just wanted to keep them in our thoughts. And then, as you know, we do not have a police discipline or a fire discipline tonight. And so we'll move on to announcements. Are there any? Council Member Maloney. Thank you. I want to wish all my colleagues and all the citizens of Fayette County a happy Thanksgiving. And I also want to wish to employees that we're in a red zone. I will not be doing my walkthrough as I normally do on Friday. And I just want to wish them all a great Thanksgiving and thank all those employees who do come in every day for their hard work. And I hope they have a great, blessed Thanksgiving. Thank you, Mayor. Thank you. Councilmember James Brown. Thank you, Mayor. And I'll piggyback on Councilmember Maloney's wishing everybody in city government a happy Thanksgiving as well as folks in our community. The other thing I want to mention in CAO Sally Hamilton or Ken Armstrong, neither one of them have to come to the microphone or get chimed into the meeting. But if they're listening, I would just ask if they would take a look at code enforcement as we continue through this pandemic and the challenges with people being off work and investors not collecting rents in their entirety and residential folks that are dealing with other issues that we look at maybe doing something in regards to code enforcement fines. So if that's something that y'all would just take a look at internally, I think it's something that I've got calls about and emails about. I think we should just be as a city government, try to be sensitive to those that are dealing with other issues in regards to other things and not be so pressing upon the fine, the fine portion of it. Um, the other thing, mayor, is, um, I'd actually like to make a motion to reconsider, uh, ordinance number four, uh, in regards to our, uh, meeting, uh, that we had, I think it was last week or a couple of weeks ago. I think council members expressed interest with having a representation on that board, but shared concerns about it being a voting member, which, you know, with further consideration, you know, I think it's prudent. So with that, I'll make a motion to reconsider ordinance number four. I'm sorry, who seconded it? Council Member McCurn seconded. that is that was under second reading of ordinances this is a motion to reconsider yes all right okay um let's see where is our parliamentarian council member warley remind me is that debatable or is that not debatable motion to reconsider would be debatable okay thank you um all right are there any questions? Councilmember Fred Brown. You're on mute. I'm on mute. You went back on mute. Councilmember Fred Brown, I don't know what's going on, but there you go. There you go. I just, I was curious about what the, what the vote was recorded earlier. It was pretty close on the vote. It was, I believe it was eight to seven. Okay. All right. Is that correct? I'll ask our clerk. Did you have eight to seven? In favor? Yes, sir. Okay. So council member James Brown can call for reconsideration. Okay. Yes. Okay. Mayor, your vote tally was correct. Okay, thank you. Someone else had a hand up. Vice Mayor Kay. Thank you, Mayor. I'm just curious, Council Member Brown, the motion to reconsider, what's your concern at this point? I was actually going to, after we reconsider it, I was going to make an amendment to make that an ex officio, still make it a council member's five, but make it a non-voting ex officio member. Okay. Thank you. That helps. Okay. And someone else, Council Member Reynolds, you had your hand up. Thank you. I think that was the answer to my question why we were reconsidering exactly. So thank you. Okay. Are there other questions about the motion to reconsider? I do not see any. Councilmember McCurron. I don't think it's actually I think don't think it's the appropriate time. I think I'll wait for the amendment. Thank you. okay all right um any other questions all right the motion is to reconsider ordinance number four which was on for second reading um all those in favor please raise your hand and please keep it up All those opposed? Anybody opposed? All right. That motion passes. Now, Council Member James Brown. Okay. So now I make a motion to approve ordinance number four. is it appropriate to approve that motion now and then then make the amendment or make i would i would amend i would i would make a motion to amend the ordinance okay or yeah make a motion to amend the ordinance first okay okay so thank you thank you uh council member warland i so i make a motion to amend ordinance number four and ordinance amending section 2516 of the code of ordinance to add an eighth member who shall be an ex-officio urban county council member to subsection 25-5161 to remove subsection 2514 which makes a holder of public office ineligible for service as a member of the authority and to renumber the remaining subsection to be consistent with this change effective of the date of passage so move second all right council member mccurrin seconded that is there any discussion all right uh now some of you were on for announcements on the blue hands council member farmer are you on for this discussion okay council member mccurrin are you on for this discussion? Okay, you're up next. Thank you, Mayor. You know, after consideration, I think Council Member Brown has a good point. You know, I know this was debated back and forth, and I advocated for keeping us as a voting position, and I do appreciate the support on that, but after consideration, I do think that this is something that could potentially have influence to it and I do think that to leave us as being on this board better communication more direct communication with council being able to interject our opinions I'd like to see that seat still there that requires some one of us to be there but I don't necessarily think it needs to be a voting position so I will relinquish my opinion from before on to onto this amendment thank you Thank you. Council Member Lamb. Thanks. This is, you know me, I look at the process and Council Member James Brown, when you were reading that whole ordinance heading back, you missed one of the numbers. And I'm not, I'm just being the legal person that when you might just want to say that you want to add that it's an ex officio instead of trying to restate the whole ordinance heading. Because when our clerk puts that in the record, you don't want it to be in there incorrectly and in and unintendedly be wrong. Mayor, I have let, sorry, Council Member Lamb, I let David Barbary in. He was trying to speak from the waiting room on this. Okay. Ex officio doesn't necessarily mean non-voting. So if you want to make it a non-voting ex officio, I would recommend that you put the non-voting language in there as well. Okay. so maybe in it just to restate the motion and just say that you're amending the ordinance to add that the urban county council seat the eighth seat is a non-voting ex officio just just for clarity so moved no that's it's your motion Councilman Brown, did you want to restate your motion to that effect? Were you going to weigh in? I was, just for simplicity's sake. And I appreciate everybody trying to be as clear as we can. And thanks, David Barber, for jumping in. Maybe this discussion, I think, was clear. It was clear what Captain Brown was trying to do with his motion. Madam Clerk, do you understand the motion well enough for the minutes? Yes. Thank you. It was non-voting, Councilmember Brown. I said it in the preamble, but I didn't say it when I made the amendment. So, yeah. So, a non-voting ex-officio member. Thank you. Thank you for clarifying everybody. Now, who else would like to speak to the amendment? Anybody? All right. So the amendment is to amend number four to add in that the council member seat will be ex officio non voting. That is the only change. so um all those in favor of the amendment please raise your hand and keep it up for a minute all right those opposed okay there's one no vote um that motion passes so mayor it would need it would need a new first reading and i think that um this is for the clerk i think abby you would put after in the title after it says who shall be it should be a non-voting ex-officio member of the urban urban county council member so you just would add those words right after shall be in the title. Okay. Thank you for that, Dave. All right. When you are ready, are you ready to give that a new first reading? I am. All right. Very good. Thank you. I am number four. in order to make section 5 5 2 dash 516 of the code of ordinances to add an eighth member who shall be a non-voting ex officio urban county council member to subsection 2 dash 516 1 to remove subsection 2 dash 516 4 which makes a holder of public office ineligible for service as a member of the authority and to remember the remaining subsections to be consistent with this change effective on the date of passage thank you thank you are there any motions to suspend the and give second reading. Council Member James Brown. Thank you, Mayor. I make a motion to suspend the rules and give number four second reading. So move. I'll second too. Council Member McCurn seconds. Is there any discussion? All those in favor of giving second reading, please raise your hand. All right, all those opposed. Okay, that motion passes. If you will go ahead, please, and give number four second reading. Yes, ma'am. Ordinance number four, an ordinance meeting section 2-516 of the code of ordinances to add an eighth member who shall be a non-voting ex officio urban county council member to subsection 2-5161. to remove subsection 2-516 forward, which makes a holder of public office and eligible for service as a member of the authority and to remember the remaining subsections to be consistent with this change effective on the date of passage. Thank you very much. Is there a motion to approve? So moved. Vice Mayor Kay moves approval second. Is there a second? Council Member Plumman seconds. Now, if you will call the roll, take the vote, please. Ms. Higginsward? Yes, ma'am. Vice Mayor McKay? Yes. Ms. Lamb? No. Mr. McCurn? Yes, ma'am. Mr. Maloney? Yes. Ms. Massadi? Yes. Ms. Plowman? Yes. Ms. Reynolds? Yes. Mr. Swanson? Mr. Swanson? Mr. Worley? Yes ma'am. Ms. Bledsoe? Yes, ma'am. Mr. Fred Brown? No. Mr. James Brown? Yes. Mr. Ellinger? Yes, ma'am. And Mr. Farmer? At last, yes. All right, that motion passes. Thank you very much. Now, let's go back. Are we under announcements? I think we are. And Councilmember Farmer, you've been waiting. I was going to tell Councilmember Swanson we don't get paid mileage, but I don't think he's on the call. I just wanted to update folks that by the end of the day tomorrow, they will have paved Euclid all the way up to South Ashland. Should be able to get it marked, too. So next week, they'll be doing the 800 block of Euclid and the area around the corner on the East High Street. so literally next Friday we will have Black Friday in Chevy Chase because it'll be brand new asphalt all over down here so that's going to be a great thing but previous to that is my personal favorite and others have made comment to it is Thanksgiving and while giving thanks will be different this year than ever in our lives it doesn't make it any less special or any less important. So take that time to be thankful for those in and around you, those that we worry about differently now and those that we see differently now. So thank you, Mayor. Thank you. Does anyone else have an announcement to make? All right. Do I hear a motion to adjourn? All right. Council Member Higgins-Hord moved. Council Member Plumman seconded. All those in favor, please show me your hand. Thank you. We are adjourned. Have a good, safe Thanksgiving, everybody. Thank you.
