## Contested Items

**Bluegrass Roots Farm Foundation, Inc. Grant Application**

A heated discussion arose regarding the grant application submitted by Bluegrass Roots Farm Foundation, Inc. Concerns were raised during the meeting about the nature of the proposed project, with participants questioning whether the application represented a legitimate water quality initiative or was primarily an irrigation system project. The distinction was significant, as the grant program's criteria and funding priorities appeared to focus on water quality improvements rather than irrigation infrastructure.

The disagreement centered on how the project should be classified and whether it met the stated requirements for funding consideration. No outcome regarding the application's approval or rejection status is documented in the available meeting materials.

How do you consider real time for the need to ensure all permits are received prior to any stream-based stabilization. Applicants are included with all permanent branches. The sections have been issued with all the current projects. Since the applicant does not include project elements and appropriate activities for citizens involvement, applicant will need to clarify item 16 of the budget for the fiscal overall project budget $72.50. If the applicant does place new activity, We need to submit a revised letter for inclusion in the Commonwealth's region. We have to get to that. So we are advised to be directly checking the business so it's red. Okay. Mr. Charles, I wanted to clarify the first one. The Bluegrass Fruits Power Foundation, that's not a signed recommendation. I wanted to have some conversation about what the components of that and the intent was. I just wanted to clarify that. Thank you. So I guess we'll go ahead and go through the project individual and just the first student. My read of it was that it was a well-crafted grant request. When it boiled down to it, it was an irrigation system. And I'm not so sure that's really the intent of what we plan for the water quality management fee grant program to begin with. That's just my opinion. So that's why I was reluctant to sign it either way. My concern is that without having some clear guidelines as to what is a reuse of water as opposed to an irrigation system, you'll have every golf course and almost association in town deciding they want you to put in their irrigation system. That's my concern, basically. Isn't there a water quality component from the standpoint of reducing the amount of water going into the schools? Yeah, what gave me pause was that there's, that upstream of it is agricultural as well too. is that you know typically we would see those kind of things that have a water quality feature that was removing trash read the stuff that you see more in an urban they said you can get you it's like sustainability you can stretch that word and all the different ways you know it is buzzword that gets people's attention a lot at the end of the day is that you know I guess my purpose of not assigning this and bringing this up to the board is excited to make sure that we go into this eyes wide open if we do decide to fund this one how does that then wait so the ones that I gave you examples I have a friend who's a He's a member of Lexington Country Club. He's been after me for years about trying to help them figure out a way to be able to load their water. He's the first person I thought of when I read the test thing. Can I say something? Certainly. I pulled up the ordinance just because I wanted to see when the grant program was set up in the ordinance. What's the ordinance say about the purpose? and the ordinance says and I'm going to read it but I'll read it slow there is established a stormwater quality projects incentive grant program to provide funding where urban county and monetary participation is justified for the following a cost-sharing assistance for stormwater projects or programs on residential and commercial or industrial properties with existing stormwater concerns and B grants for community-based stormwater projects. That's kind of the purpose that's set forth in the ordinance for this. It sounds like what Charlie's describing doesn't really fit into either of those. So it doesn't fit into the A part of it. I'm not sure what the let's say the B part of it. Grants for community-based stormwater projects. Generic. Yeah. It's kind of over the world. Is this a pilot program to see if you're going to mitigate the agricultural runoff? It's crafted that way, but at the end of the day, though, it's also used to be able to irrigate crops. That's our method of mitigating the situation. They drew it up to improve the stormwater quality in North Elm Street. So it was a way to remove pollutants and what have you. But without an established stormwater problem, it seemed like to me the driver for it was more about irrigating the crops and less about the stormwater. But, oh, by the way, we're lessening the load onto North Elkhorn Creek. Except it's a slippery slope here. That's why I didn't sign it. I was torn because I wasn't sure that there was a bright line to say, no, I'm not going to recommend that. But at the same time, I had a lot of pause about it going forward because how do we then deal with the future ones that come in that have that same kind of thing? Yeah, I'd like to reduce the amount of nutrients that run into the storm sewer at my house. Would you put in an irrigation system for me? I mean, I'm being facetious there, but I mean. It's essentially a farm. I don't know how much impact we have on the rest of the community. It's not like that. Bill, there are similar elements to this when we did a Lexmark. With the exception of Lexmark, they used the water they got for cooling the water. So UK did that as well. They did it to supply their chillers. Okay, so that's a different situation. It seems like when I first came on early several years ago, we funded something out, I want to say a horse park or somewhere out of that area, something very similar picking up runoff in animal areas. Thoroughbred center. Yeah, I recall that. The thoroughbred center on Paris. Okay, so what were the elements of that? And did those elements come into play here? I know they have some forest asphalt which is irrelevant to this. They ended up installing painters down the middle and they have sent them down to the basin area. Yeah, it wasn't exactly a line up. I don't want to muddy the waters. I don't want to muddy the waters. It seemed like it was a lot to speak. In a school water quality program I don't want to muddy the waters. Well said. However, maybe the way to do that, and I think there are, I think it was very well put together with elements and they got a pretty decent score, is the way to address the concerns that you have for future to tweak the criteria that we have in the point selection process. how's that is that a way to to control any future I don't know if it's that or to try to adjust it it is no I think it's more the programmatic changes that we talk about in January of each year it's sort of similar to how we have that one stipulation that we won't fund a project that's going to dredge a retention pond you know so something could be added similarly here either you know the water quality management fee grant program won't be used to fund irrigation projects for irrigation projects outside the urban service boundary or you know something to that because if you think about you pays project and you think about the Lexmark project and I think even going way back coca-cola they installed some sort of water quality unit that took that collected stormwater and ran it through that water quality unit to remove floatables to let sediment settle down so that the water that was then going to be harvested and used for another purpose whether it was irrigation or flushing toilets or whatever was of higher quality whereas this project doesn't it's just going to use the benefits of a retention pond to get the settling component right okay let's do a little agree any thoughts comments I was also right I agree with Charlie tonight one thing to that and I thought about they're talking about training UK and I thought doesn't UK do that they don't need a special farm to do that but they don't already do that that there's something wrong but you know maybe that's beside the point but I thought that was an interesting taken didn't think it would be important in this project Also in the application, we didn't notice any commitments from UK, so that was a concern in the scores as well. They mentioned that in their narrative, UK being a partner, but we didn't see a letter of support. I didn't either. We didn't know. Yeah, is UK truly bought into this? That was my fault wanting this? Because you're right. I think they already have something similar somewhere. Sure. And we also had concerns over the remaining components of the system being built because this was just for partial. So we had concerns over how the grassland is going to be. Does the Bluegrass Roots Farm Foundation, do they pay in order to qualify for you? They do. Yes. Yes. I think the driver behind it was Manly Farm, who had put in last year for a Class B infrastructure grant and did not qualify because of the fact that there wasn't a Class B payer. And so they found a partner in the Blue Vest Farm Foundation. So was this recrafted to address that? Yes. So basically, you know, last year they were going after a $300,000 grant because that was the cap. That's the cap on the B infrastructure. So basically the program elements are the same, but they whittled it down to accommodate the $100,000 cap on the Class A projects in hopes that they will find additional grant funding to complete the project as originally envisioned last year. So this part is just going to construct the basin portion, not the actual harvesting. Right. Okay. Okay. That's what we're doing. So now that we've had the discussion, would you like to have a recommendation from Maine that would be a little bit up or down? Yes. I would recommend not funding this. i'll make that motion it's been moved is there a second it's been moved by harry sagan mcdonough all in favor of motion signify by saying aye aye folks like that motion carries so as a caveat follow-up to that suggest that we pursue maybe in our next evaluation criteria for next year to put some stipulations or put some language in there to address that for future projects to try to come through on a single type strategy. Okay, thank you. Our next project is Friends of War Pro. Pretty comprehensive list of project elements. I'm going to evaluate it. Any comments, questions? I assume this is kind of very the previous applications are just growing on that and they've all been followed through and they're doing what they're supposed to? Yes, and then we, of course, we cross-referenced with our projects, our current projects as well as future projects to make sure that there wasn't any conflicts. And so project elements remained along with stipulations that we came where we felt like it would have saved up. He would do it every discussion. I'll move and accept it. Okay. Thank you. It's moved by George. Is there a second? Second. Second. I'll carry all in favor of the motion. I'm not saying aye. Aye. Opposed like so? Motion carries. Thank you. Okay, the Girls Department of the Association, George, if you would take over please. Okay. Nobody here discuss the project. Would you like to amplify anything that's been included there? This project here is one that where it was already essentially built and it's a repair. of the unit. Sorry. So in this particular incident, they want to basically re-engineer the soil and kind of install a new piping system to allow the water to flow through. So this is essentially a repair job. So they had a choice in application and we wanted to develop it. We're moving it all together, but they elected to just repair the system as it is at the It looks like they had tried to do some work by themselves. Yeah, the water just, they're looking for funding to repair it. This is a motor grant from I believe 20... The original funding cycle. Yeah, the original, 2011. grant projects so they have by december of this year that project will have fulfilled its service life so timing wise if it's approved this wouldn't probably even go to council until early 2022 So we didn't feel like there was a conflict in terms of trying to go in and do something to a project that was still essentially under its original maintenance agreement. So that expires in December or so. So what do you say about time? Yeah, according to typically we don't get these on. I'm talking about a lot of agreement agreements through council. It's January and February. So it has served its purpose. Yes. And they've done some things in between to try to keep it up and running and maintenance. You know, it's near the end of this depreciation. So we felt like, you know, we were going to be a good athlete. We visited the site, I believe. We visited the site. Yeah, Charlie. Yeah, my view was is that because I questioned that same thing. It's like, wait a minute, didn't we fund this once before? But I think the intent, what has been met all along, and I think this maybe reflects some lessons learned over the last 10 years of how to be able to install soil that actually works as opposed to what doesn't. So I have the same reservations at first as far as this looks familiar, but I think the integrity of the grant requester is there to where I was comfortable with recommending that we continue to try to accomplish what we intended to 10 years ago. And another thing that kind of gave us good hope is the fact that the consultant that they're using have good track records and they tend to use eco-rooms and rest turdents are, I think this time they have the right team in place to make it successful. There's no more discussion. Chair, entertain a motion? I would move to approve the recommendation of full funding. Is it a second? Second. All in favor, signify by I'm seeing aye. All in favor. Opposed? Opposed? Motion passes. Okay. Next project, Neighbors United for South Oak Hall Creek, Inc. This is the feasibility study. Right. This is the basic feasibility study. which also includes education is this group ever receive funding for the day before leaving and have an open grant right now don't they they're doing sort of an entry-level type grant to generate public support for working on this particular park area it involved redoing a sign that had faded an educational sign and getting folks involved with street leanups and things like that What's the low of the group? Any comments, thoughts? I don't have any objection to it at all. I think it's a good feasibility study. I was a little, not concerned, but a little bit surprised that they were so far along in establishing what they wanted to do, like they're already in the feasibility study. study. Maybe I'm wrong, but they've done a lot of work to determine the feasibility before they ask for the grant. So I thought that was a little bit too. I think some of it is because the consultant that they're using, I mean, essentially they got it down to a science I just don't think they're not recreating the wheel for each other. They're not starting from scratch. But I think the fact that they aren't pretty far along is reflected in the amount that they requested because it's really a lot less than we see requested for a lot of feasibility studies. Let's go on break. I have a approval. It's been moved by Harry. Is there a second? I have a second. Seconded by George. All in favor of the motion signify by saying aye. Aye. Opposed, like so. Motion carries. And the last Class A neighborhood is the Creswick Condominiums Association with the project. And I'm confused with the $58 difference between the request to grant them out and the funding record. Was there something that was ineligible? Yes, I believe it was $72.50 is the difference. And that's because they didn't incorporate, they had a line for citizen involvement in that budget, but they didn't have anything scheduled or included in the narrative. They didn't give us any details about it. And so we elected to just going to get it all together. Well, you reached out to them. I did, and they didn't really have it. I thought they had a place that they were asking. I could have fit there because of our template, but they didn't have any intention to do anything with the citizens. So the overall budget line was for $72.50, but the grant request was 48 I don't think that will spell the project all right any comments thoughts discussion Close the road and right. your recommendation it seems like I read back in there is a report in here I believe and I read some place that somebody was guessing about pipe sizes I'm guessing we put in this size pipe I think it was this project check me on that You are correct. I'm correct. And it wasn't that somebody wasn't assuming any response. I think it was a contractor's proposal. And I had a concern that somebody was going to come through and check it before we build it. With a consultant project, Centera Corporation, I believe Chris was there. And so our hope is that we would provide them more clarity. Yeah, absolutely. Did you find the wording? Yes. On the second to last page, it says, parentheses, 24 inches is just a guess on size. It is twice the size of the existing with no guarantees. No guarantees. So there? I assume somebody is following them up. Check it. Yeah, we'll make sure that the grant manager gets a clear view of what we're doing. It's the lags though. It's the second to lags. Okay. I was rather brazen just saying. George, right now everybody's guessing whether they can even get by. Right. Yeah, that's a very good point. We'll take whatever's that. Yeah, duly noted. That's a big catch. Well, we can certainly add a stipulation that the pipe size be verified before it's ordered. Very good. All right. Next dish now. Make a motion. Next second. I'll second it. Did David say that David? All in favor of the ocean sea. If I say aye. Aye. Votes like so. Ocean carries. Very good. Very good. Good catch. Thank you. Okay. All right. That's all of the class settings. That's all of the class settings. I'm going to start out probably. The first application of the number one for the class of education is Arlington Law, LLC. They have a request of grant number $35,000, a cost of $8,350, which is 20.4%. A total project of $43,500. That was out of the corner. Yeah, I think. Are you looking at five next? Yeah. That's Wimber. So it was originally. Oh, because of the half of the time. Before prior to drafting the grant award, we would be the applicant to provide other KCG with more information about how applicant plans to expand the audience with this grant as the credits of the FY17 grant awarded to UKRF. No PM1.5. Would the applicant expand the reach of the audience of the FY17 grant to educate more of the same audience type or are additional audiences going to be targeted with this grant? Okay, let's go through each one. First project is the Arlington Heights, Arlington Loves LLC project. I think, and I should have said this last, but I think we provided you with a memo kind kind of dressing the ones that you didn't saw and this time the one that didn't work with and I think it was dispute tonight yeah I was going to provide some insight beyond what the market said in the memo now I you look at the other four candidates here as far as bluegrass resource vacay schools UK and they have a demonstrated history of educating people. Arlington Law. So it got my attention. And so when I started researching and I couldn't really find that they had any type of educational background whatsoever. And in particular the person that they identified, you know, their nerve surgeons don't always tell you a lot, but the person I found that had that name was Chet. If this were a culinary grant, it might be I just I just couldn't see how we could say that this fed into the educational class without having at least somebody that had some kind of history of educating K through 12 folks that was my that was my concern you would think they would include the rest of the I mean they had a pretty extensive application as you can see. They copied a lot of other people's material. That's what it was. It didn't look like anything that they had developed on their own. I think one of them was already about this spot coming to the board all the time, but it didn't look like they were putting any work in terms of developing a curriculum to specific points or anything. Joe, did you answer for more feedback? We did and I mean we didn't receive, I mean it was just he pointed me back to everything that he had submitted in the application. He said oh we have this, we have this, we have the facility and what not. You know the facility actually is at Embrace Church. I don't know if you remember that name. It's one of the, it's been a really long time. They're actually a tenant in the downstairs portion of the Embrace Church lost that they live in front of the parking lot. That's part of the church. That did not enter into my view of it. I didn't even know there was a relationship with that until I said I don't like this. So that's the reason that Arlington Walsh is signed on because they didn't qualify on their own as a class being female. So they partnered with Bruce Nichols and Arlington Walsh to sign on. Okay, so what is Arlington Walsh? What do they do? They own property off of old Georgetown. So they found somebody that was a rate payer and pitched their star to that. yeah he's a developer and has done several development projects on north limestone i don't know if they actually qualify as section 8 housing but it's low income subsidized housing so there's one next to the to embrace church and then I think there's one a little further in the north, yeah, or blindstones. Okay. So bottom line is the proposed individual as being shown as being the author or the leader of this. We have no information on background experience or past performance. Both the applicant and the applicant's team just didn't, I didn't see education there. They had no connection with school systems or anything. Yeah, they didn't present qualifications or any experience or they proved that they had done this before. They stood out when you look at the other four applicants. The other four applicants have a demonstrated history of educating people in environmental matters. You know, be a non-profit or being recognized as an educational institution in Bay County. County that was absolutely thank you any comments thoughts suggestion I don't see how we can go any further yeah well and then you know I put the notice out No, we're having a meeting today with a lot of people who want to come and represent themselves and speak. And of course, we're trying to get represented. We have to go to both of them. Alright, that's the whole room. I would move to accept the recommendation and not fund it at this time. I'll second. It's been moved with David, seconded by George. All in favor of the members will signify by saying aye. Aye. Those like saying? Motion carries. Okay. The next project. Okay. The next project will be the blue-ray inscript source. Is that it? Yes, sir. Okay. It's a good project. Comments, questions? I'll move we accept the progression of the proposal for the recommendation. Second. It's been moved by George. Seconded by Harry. All in favor of the motion signify by saying aye. Aye. Opposed like say. Motion carries. The next project was the Fayette County School District Finance Corporation, which designed by the Constructor Linker at Whitford Middle School. I have a question on this. On projects that are for construction rain gardens, do you provide the rain manual? Is that on the menu? Yes. Yes. It's on the main floor. Oh, okay. Got it. Because I didn't realize that existed. Okay. Any comments, thoughts? That's one of the situations, by the way, that they use the plants as the end of the way. It's not the same as the first information. So that's the way you see the first information. Okay. Okay. Yeah, I saw that. I'll move week 17. recommendation of the fifth and a school district it's been moved by george second it's been seconded by harry all in favor of motion signify by saying aye So she carries the Green Parks and Science Center, Inc. They also have a number of successful projects. They've completed all the previous grants and some have kept a great track. The program has been satisfied with the progress, and they also presented on our April meeting. They don't speak for us. They had a presentation. Progress. The time. Comments, questions? Yes. To what degree are we concerned about the first stipulation? shall specify educational materials and budget line four that are water quality related? Well, yeah, I think our concern there was just wanting to make sure that the focus, our funds were going to be focused on storm water related, whether it be promotional materials or, you know, we just wanted to make sure that it wasn't going to be used for any other programs other programs that they you know because they provide education other than water quality materials as well so we want to make sure that we're funding we're all focused on water quality whether it be the messaging or what have you and we have that stipulation yes on their prior grant okay so it's not because i'm trying to play down like what if they stipulated like half are related, but if we've definitely gone through this, please wait. Yeah, once we put it in there, we kind of leave it there just to make sure that they understand the message every time. Understood. Thank you for that clarification. Any other questions? How many? Okay, what is the rule of approval? Move to support the recommendation to full fund. It's been moved by David. Is there a second? Second. Seconded by Donna. All in favor of motion signify by saying aye. Aye. Aye. Those like sudden? Here it is. The last one is the University of Kentucky Research Foundation. Right. The training on the university on how long can't you? Right. Unfortunately. For this one, I would say, as you can see in the stipulation, Our concern was what's different with this one. And that's why we provide the stipulation for them to clarify what the difference is and propose a question for them to expand the reach of the audience in the FY17. So we want them to let us know up front when we're getting our set of attention. So, is this being done over at the Arboretum? Is this just a home room or? It involves some additional surveys of homeowner practices, dog owner practices, and measuring. So how would they get that information? Where would they go to get that information? Well I guess they're just putting out surveys. Well they're bringing in somebody from Henderson? Isn't that right? Oh yeah, the specialist from Henderson down in general. Yeah, to do, I don't know exactly, was it some sampling or something? Yeah, it was like some sampling that they're planning to do. And then with those quantified results, then from creating messaging to provide to the audience. Now, we're not sure if that's the same audience as their 2017 grant, and they're just going to try to reach more people within that particular audience type, or if they're looking to reach just a broader range of audiences with this new data. So, if any deliverables on the previous project was funded? Yes. There was a brochure. It was pretty catchy. How would they disseminate that? I believe they had a webpage. And then I think their extension agents would provide those whenever they gave presentations. that were similar in topic or relevant to that topic. In fact, we had a stack of them out at our reception area for a long time. And they provided us with copies of the survey results. Okay. And they provided us with copies of all the materials that they sent me and me. All the materials. Okay. We followed up with them to make sure that they were actually confirmed to us. Okay. Any questions, comments, thoughts? Can I ask a question? So this grant is for surveying educational purposes and it doesn't actually do it. I mean, I'm just kind of... It's a campaign to make sure that they're trying to put out awareness, to try to keep people from, you know, to try to lower phosphorus in place they didn't go, you know, groundwater zone. They try to make people aware of their land walkers, cats and dogs and stuff to pick up after themselves and things that are interesting. Psychopolitan race. I'm glad when I read it, I'm like, even after reading, I didn't really understand the whole purpose of it. I mean, you know, we're funding, paying money to find awareness for enough help, and that should really be an automatic thing. I know everybody don't, but I mean, how much more can you educate? If people see signage, and other people that champion it, then maybe they may look over their shoulders, and yeah maybe they fly well I'm sitting in the house in New York not open they just keep right on board I mean funded I mean it is kind of I mean I think really I don't know a lot of that I'm just kind of learning process but does it fall under the guidelines of what urban county government has a grand is useful as you say I mean I believe removing from the line definitely helps our water quality in much about so somebody's gonna come to school that's probably an ordinance that requires a thank you that I don't get you Charlie your own but Charlie did you ever come in well I think it's more than I think we've made we've got wrapped around the P.S. so it's also you know lawn application and stuff too as far as fertilizer and things like that too and so that that is even more subtle in because I think there's a consensus among the average person if I want my You are really nice. I need to lay it to it and you really don't need to do that Right, and then when they lay that to it then it all runs off The key for me when I looked at this because I had some pause about it a little bit is The idea intent is great How are you getting it out there for the average person to actually see this if I'm watching TV? And I saw this commercial put on by the UK that was advertising it I feel a lot better as opposed to we're just doing paperwork and setting it out on a table someplace for somebody to somehow pick it up. I think that's something we're going to look at here, because I think we talked about this before, is trying to make sure that as we continue to fund stuff through some of these organizations, that they're actually pushing that envelope more to be able to get the message out to people. They're a great conduit for us because they have an audience that we can't reach, but we want to make sure that they do it in such a way as that they just, like say just don't keep doing the same thing and it's not paying any dividends. We still think this would be can though. Charles reminds me of the tree canopy survey. It's a great idea, but if it doesn't change anything, it's kind of pointless. But if you don't stop doing it, I think the application of it and the results of it is the problem. where do they go with this? It's nice to tell people that it's a problem and then it stops there. Every one of the education organizations have got this challenge because COVID kind of has changed things and changed the way they've been able to engage people and stuff too. So we've got to be mindful of that. But whether it's UK or Bluegrass Green Source or even internally in our own organization is that you're right. We've got to continue to evaluate, okay we've done this program for three years what did we get out of it are there any measurables that say we need to continue this or we need to modify that that's going to be a key part of any of these ones that you if you prove them today I think it has the discussion before the application also incorporates you know what their measures of success and tend to be and so that's how we scored you know they receive us a sort of score for that it provided some materials and they were going to put out for the survey also they're going to measure the dog poop in the dog park how many pounds who gets that job no I was also a number of players for the participants so you know they provided some I think what's that concern we have that management I mean how many areas of We have four dog parts. It says measures of actual practices, so how are they going to do that? Well, they just have these four dog parts, and I guess they're going to just measure how many. I'm not necessarily an expert of the science of it. To respond to the honesty, maybe we need to set up a LexCol thing to where people can notify us how many times somebody's neighbor's dog is in the yard. I'd say if we see another one of these and then I think perhaps we'll have even greater pause. Because I don't know how far this will run. I don't think this would be like Living Arts and Science or Bluegrass Green Source kind of ongoing thing. I think it may run its course. Yeah, like I said, I'm very much about trying to revisit these things in a lot of different years. Not only here, but our new director of environmental services. and I talked about our education program as well. All right. Any other comments, thoughts? What's a little bit of approval? Okay. Thank you. Harry's moves or a second? I'll second. Second by George. All in favor of the motion signify by saying aye. Aye. Opposed like saying? Motion approved. All right. So we are approved the project review approval portion of the meeting. The next item is planning funds, recommendation, and discussion. For the class A, based on the recommendations that were approved, this pretty much follows suit. The remaining funds for Class A include $296,084.48. So that's how much is remaining in our Class A funds. Did y'all get a copy of this? Yes. Okay. Which also had a back portion to it. So I guess I should just start by saying what the funds available for in the first place. For PIS-A, of course, it's $100,000 maximum of grants. We have a total available for FY22, $461,000. We have even $55.48. And so, let me see. The award you were on to the UR. I'm sorry, I was actually reading this. Okay, all right. On here. This is the summary of the director's recommendations. Right. Right. So for Class A, we left for, after funding the five applications, or the four applications We left with $296,000. That's $296,84 and $48,000. For Class B, after funding four of the five applications, we left with $20,210.28. So, I guess the board would decide how to proceed with those remaining funds, whether whether or not we want to keep them right there for at least next year or whether or not we want to utilize them for the upcoming Class E infrastructure if needed. So would you give us again the numbers for the length of the amount of the remaining for Class A? Yes, it's $296,084.48. And then Class E? 20,000 is $210.28. We have determined that these funds can carry out. Yeah, the board can elect to keep them in their class, or the board can elect to class B if they're competitive and we need additional funds. So, haven't we done that in the past? You haven't used it for any of those? Yeah. And then we also have the experimentation funds as well to keep that in mind. The $300,000 or $700,000 for experimentation and innovation. Okay. So, we're working. They said, they need to vote. I think the board can decide that later. We can recommend to use those funds later and the board can decide whether or not they would agree. I think maybe the best thing to do is wait until the next round of projects, infrastructure, and see if there's some funding and we can make a decision. Okay. Those applications will be July 31st. So we'll table that until that time. The Senate Grant status update. This was always the part on the Zoom that was problematic to see what was going on. So the status of date you should have because the writing seems to get smaller and smaller. FY16 through FY21. So we're getting, and I believe we have them should be made front and back. Oh, you're right. Just for the . Oh, yeah. For FY16, there's just one project remaining in Peppermill. And according to the grant manager, . I did a punch list, a funnel inspection with the grantee, two weeks ago, I think. everything looks really good with all the pavers they've had them installed throughout the facility and they basically are just needing to compile and submit their final report and final grant reimbursement request is this James Pepper? is that what this is? the main part? goodfellas so yeah between the last part of the section of papers was installed on the back side of goodfellas that's sort of that courtyard area between the peppered story and they were what took so long is they were um they needed to install an outdoor elevator at the end of that courtyard and they didn't want to put the papers down and then bring in all the heavy construction equipment that could have damaged the paper so they've got the framework done for that elevator and then now they've got those papers and so on so this is the kind of the common area where people are it's not in the parking there is some in the parking lot that was done a while ago well it's it's under peppermint it was both entities very good and Chris and then and then there's some papers that are along town branch outside of Goodfellas on the south side of the railroad tracks the old railroad abandoned railroad tracks and then there's some new outdoor seating closer to Pepper Distillery where they have papers and then that last section was in that courtyard area between the two buildings. So we can spend all of it? At least probably what does it get to? Yeah, I'm anticipating that they'll spend all of it. Next we have FY17. This is one project the court. They found that the rain bar is doing an inspection, I think a punchless inspection that is carried out and they have requested to turn in the request for funds and final reports. We anticipate that to wrap up in the next month or so. Next we have FY18. FY18, this first one here we actually had a small issue with. Would you like to speak to them on this? I mean, just because I was going on vacation, I think. Yes. So we found out that, you know, they really drug this grant project along. They changed their engineering record. I think they even came before the board. They did. They were from before the board to modify their project elements because they wanted to add a piece off of Mumford Lane instead of focusing the entire grant project at Sebring that backs up to Cardinal Valley Park. So we started getting an influx of calls from various folks a couple weeks ago and went out there anticipating that construction had started, but they had failed to get their land disturbance permit. But when we got out there, all the construction at both locations was completely done, and the site was stabilized. So we were floored because the grant manager for us, Hunter, she had reached out to them many times over the past few months, you need to give me a heads up when you're ready to start construction because I need to sign off as grant manager that we are giving you notice to proceed to that next phase of the project and you can obviously to provide us a copy of your land disturbance permit so basically we met out there with the engineer record which is now L engineering and discussed you know like go ahead and submit a reimbursement request but you know you all did not follow the procedures that are included in the grant award agreement so we will staff will have to deny your grant reimbursement request so that's where it stands yeah in addition well in addition to the fact that the gentleman kind of talked to our grant manager like roughly Okay, with that, maybe kind of. Was this the applicant? Yeah. Yeah, Mr. Johnson. So, you know, she was just basically advising on procedures, how it should be followed, and, you know, it kind of roughed her up over the phone and whatnot. And so, you know, we're inclined to deny the request. If they do, just because it's been dragging on. We went over this a bunch of times with them. They just didn't follow protocol. So that would be an immediate thing, but if they haven't followed the procedures, they're possibly denying the grant since they haven't fulfilled the requirements. It's just that we're just going to deny their request because it just didn't follow suit. I mean, they're supposed to get permission to begin construction that's already built, so they didn't follow the guidelines. Yes, I mean, I guess we technically could terminate the grant. If you're denying payment, aren't you basically saying we haven't followed the requirements? Right. So I guess we can move toward... What are the legal ramifications of this? Well, that's where I come in. Charlie and I have written to discuss this issue before this meeting. So I need to kind of mull over what our options are, but that's something I'll be talking Charlie, if you all have a problem, you should. Legally or otherwise. It's a homeowner's association. Yes, Beaumont Residential Association. And the officers, are y'all dealing with the officers or the project manager, or is that one and the same? Well, we're dealing with the primary contact guy, so I guess he's the president. How do you think he's the president? He's a representative. He's a president of the Beaumont Residential Association. He should be aware. He's been in the line to get the rent and the conditions. He can read that. We've had several meetings with him. He just says, I don't recognize that. Well, he's a smooth talker. to be honest with you. He's a slow talker. He's just an interesting character. So there has not been a change in points of contact we're dealing with. We've helped the same representatives all the time and had several meetings with them. It sounds like it is. Is that the reason they changed engineer? Was he? I think they just wasn't giving any movement from the first one, I believe. And they just reached out to him. And there may have been some issues over payment terms between Bohan Residential and that first design consultant they had. They had a disagreement. Yes. Well, just so you all know, just kind of separate from this issue, there has to be a consequence if somebody does something like this, so that may be a programmatic thing that we'll talk about next year in terms of some sort of disqualification. If you've demonstrated that you've not followed the terms or conditions that were going to receive in the past, should you be allowed to get another grant? Right. Right. Again, that's something I'm going to kick around with some staff. But that's another issue. And like I said, that's kind of separate and apart from any bad actor. Anybody that comes to you all for a grant, you give it to them, and they just basically blow off your requirements. What's the consequence? Right. But the grant award agreement speaks for itself in terms of the terms. You know, what to follow, the timing of it, you know, when the report should be filed, quarterly. It's all listed. So we have that as background. Are there consequences? Yes, it says the grant will be terminated in the grant award agreement. But to Michael's point, we just need to put something so they won't come back to apply. And the contractor, as far as you know, has or has not been paid? The contractor has not been paid. And that was one of those sort of oddball phone calls that got us going, what's going on? because the contractor's wife called and got a hold of Denise and said, don't pay Beaumont directly. You need to send their grant funds to me, the contractor. We were like, what's going on out there? So I was like, we need to all meet out there tomorrow. Yeah, he put the cart before the horse's thing, and if he had done it right, I mean, you know, I think our payment terms, we normally get it to between 15 and 30 days, But, you know, I mean, that's once we receive the report and it gets removed and everything's signed off on. But we just didn't follow it. And this is one unique situation that they haven't followed it in all the projects. Yeah, this is the first for me. This is the first seeing somebody not comply with, you know, the permitting phase of it and turning all the permits before getting permission from the grant manager to proceed. So, yeah, this is the first for sure. And just so you all are aware, I don't want to leave you all with the impression that we're necessarily going to terminate. That may be one of the options in our earth. But I need to kick around with staff what our legal options are in terms of I just don't want you to walk with me. Oh, we're going to definitely terminate this because there may be other considerations where we may not want to terminate, but there may be other recourse. You're not asking for action from the board today. No. Just kind of giving me an update. I'm sure we'll have a follow-up. That makes me. Well, that makes me interested. Okay. I'm not worried. Moving on to Cardinal Valley Association. That one is progressing. This event is almost wrapped up. They've got all the pollinator garden planted. I think they were just working on the silage. Yes. So this one is almost wrapped up. Next, you see Stonewall Equestria in the States and the Portion Agency. I was asking, do you speak to this one here? Yes. they have submitted sort of a draft of their final reimbursement request Frank and I evaluated it got back return comments to them they seem to be on board with our suggestions and so we're just anticipating receiving that final project report and grant reimbursement request This is one of those we can't wait to wrap up. Takes Creek High School, they had a delay because obviously the COVID, and so they, as well as Takes Creek High School is getting rebuilt, and so they asked to move it to Takes Creek Elementary to rain garden and improve, and so I believe it's constructed. They're wrapping that up, getting their final report in order to provide to the right managers. We anticipate that one is going to be by the next meeting as well. Bluegrass Green Source, this one here is according to Dimitri, oh no, this is the educational center that they proposed to build overall loudly across from the Hope Center. They had some issues with illegal outfall in their project area or on their property. And so they're in litigation with them. I think that a lawyer has sent a letter over to try to get that removed as well as to get some payment for the damages. And so we were communicating with them more frequently to try to get this moved along. But, you know, she said it's just going to take some time. But we certainly want to see it. We're excited. I reached out to the professional record but didn't receive an update in time for this. Okay, and UKRF, they put in an extension? And they just have their signage to produce and install. And they should wrap that up. It's parallel to that drive. Yes. That's up. Yes. FY18. FY19 is progressing pretty well. Friends of Wolf Run, they're moving along business as usual. They've just submitted a request for funds to Dimitri, the rent manager. The village of Rapid Run, the landscape contractor hasn't replaced a dead tree according to the grant manager. So he's in communication to try to get them back out there to replace a tree that didn't survive. And then he anticipates them turning to find a report after they get that back in the morning. North York LLC went to the grant manager. They put in a request for an extension recently and he approved it. The WP says it's progressing. Opportunity for work and learning, they had submitted a request to move the project, but then they elected to go back to the original locations of the project. If you all recall, approving them to move the lights slightly up the street at the end of that court. They pushed the codes that night, but yeah, I think they rethought that and then we had to go back to the original. We just wanted to be able to. Yeah, this is three years old. They've spent about 80% of the project. They had a change in personnel because they had a change in leadership. They lost their director. They lost their director. Oh, okay. That was the pause initially. Okay. But we certainly look forward to progress in the coming months, especially by the time of next year. So they're going to probably need to continue to revise completion schedule, right? Oh, yeah. That's it. Okay. All right. Thank you. And let's see. FY20 without going through each individual ones, those are progressing pretty well. Andover Forest Home Owners Association, I mean, they're progressive. They're almost completed with this project already. I think they just actually I think they submitted a contract with B at the end of the association. They just recently submitted bids for construction at the end of the fourth golf course. Handover Neighborhood Association. This is Grant Bounder email. Let me see. 611-4 update on phase one plan for the Handover Neighborhood Association. So yeah, they just submitted an update, and I gave them permission to go ahead and start phase one on that package. This is a wolf run. This is a progression. If you all have any specific questions on these, we have one of these individuals. Is there any one of them called that? I wish you might have a question about all of these and progress. Of course, Fayette County, or Fayette Cooperating, the city of Scrooge decided to cancel those and what else is usually paid out. I'd like to get information on number 17. That was at any paid project. There's a few things that have come up during design in regards to that water quality unit that they want to install to sort of pre-treat the rainwater or the water they collect from that culvert before it goes into the cooling towers. but they felt like they could get the kinks worked out over the next month and then hope to bid the project in August. So it's a couple months behind their original schedule but that's, you know, seems to be pretty common for most grand projects. Over 12 was kind of another interesting project in the Kentucky American Water Company Trash Collection System. Contract times is the real world time for now. Not with us. Not with us. Between the contractor and the workplace. We still have him. I would like to church in Wipitu. That project is completely construction. They just turned in a final report. So that would be closed out. The grant manager just approved the funds. It's a payment of the process. So that would be closed out. Which is a process for you. So. FY21, we have all the grant award amendments have been sent to Urban County Council for approval. The last four you see in the bottom are in pink. That's the color code. Just because it's going to be a drafting phase for the grant award amendments. Those purchase orders are pending. and we will send out the notes received from those projects that are received from there. So all of those federal units are drafted, presented to Council. We're just waiting for this last form to get the purchase of those approved. Now we're headed toward FY22. Do it all. Go ahead. I'm going to come this way. All right, everyone. Thank you. Do y'all have to forgive me, I'm a little bit out of sorts because my grandmother passed. My friend had a stroke while I was on vacation and I'm like halfway this to the bottom of the neck. So it's kind of out of sorts to have my friend live this evening actually. So it's kind of like a whole lot going up. But forgive me. Right here. Any other matters I guess as to do business? I will, I want to say that we have unfortunately two gentlemen that terms are expiring. They're going to be separated so that we're certainly going to need the loops and so that will be both jokes. So we are communicating with the mayor's office to recommend replacements. But unfortunately, I guess we have two terms in it. We wish we didn't. Okay. But we just wanted to make note of that, and we have certainly enjoyed you. Thank you. You know, I hate to see you go, you know. You know, October, I guess, will be the final meeting, so. I'm glad you didn't feel it. I didn't realize we were getting ready to beat. Let go. I wish there was a way around. What is the term from? I think it's two-year terms, right? Two-year terms. Two-year terms. I've been here. I've been here longer than four years. Third name? I've been here longer than four years. Can I double check that? Is there two-year terms? I've been here longer than four years. I've been here longer than four years. Can I double check that? Is there a two-year limit, two-term limit? I have to. If we can get around it, I'll take it. I'll share my life. Let's look. Thank you. I have some other people. They have the opportunity, so that's not a problem. We certainly enjoy it. Thank you. We certainly appreciate it. We're all in your hands, James. Yeah. We're all in your hands. It's probably a place to do it. Okay. I start downtown on July 19th as the director of environmental services. Really? That's perfect. I was wondering who's in that position. Susan Pflueger was in that position. Okay. And she's resigned. So what will your new responsibilities be? That division oversees four programs, the urban forestry and street trees program. energy initiatives so retrofitting government buildings to be more energy efficient the public involvement and education group is in that for the Department of Environmental Quality and Public Works and then the fourth group is natural resource management so they take care of greenways mowing contracts throughout the city and they also are the enforcement arm for chapter 16 of the code of ordinances so things related to notices of violation and provision of water quality or division of waste management might issue if those escalate um up through the enforcement process they land in the division of environment services so will you still be in these meetings or will We'll be retiring too. July 19th. And they also help us out managing some more education. Yes, so I won't be too far removed. There are a lot of grant managers that are in the Division of Environmental Services. We hope the director doesn't change that for right now. So then you are in a different group, kind of parallel to the Division of Water Quality. probably seven divisions that make up the department of environmental which is right all right is the overall that's just okay congratulations I just resigned from the dream work I've been on three boards it's up and capital and finally decided to be started. I've been involved with all those folks for a long time. And now we've got along there. So, big job. And again, what will that position be? Director of Environmental Services. Great. Susan did a good job. Yes, she did it. She really changed that department. She really did. If you need anything legal, let me know if you're still my client. Yeah, good. My assigned divisions are water quality, environmental services, water quality, baseball environments. Okay, anything else? I remember back when meetings would last all day. That doesn't sound like that. I don't know, it seemed like what Jennifer got here, he got on the speed track. It was like, figuring out a way to, you know. Very good. We certainly appreciate that, yeah. I will share, Kentucky Stormwater Association is having their annual conference in Lexington next, end of next week. And there's a tour of stormwater, completed stormwater projects that include several of the grant-funded projects. the group's going to go to Grayline Station Lexmark to look at both the rainwater harvesting project and the Oscar trash collection pilot project that was done so it'll be a good opportunity to showcase the grant program next Thursday afternoon so this is Kentucky Strongwater Association Okay. And how do you go about attending that? Do you get a member of the Stromart Association? You don't have to be a member of... After me, I'd like to get some information about what it did. Okay, great. Jennifer, I think you're a tour guide or something, right? One of the tour guides. One of the tour guides. How did the meeting go on the tour of the Greatland? I really wanted to go and I had a conflict I couldn't make it. It was impressive, I tell you. And I got to perform there. I got a gig because of the tour. Because of the tour. And my fans showed up and we performed and it was a blast. It really worked out. It was a blast. So many people showed up. I was pretty surprised. And the food is good down there. The food is impressive. I'm really happy that it was a successful venture. I know that they came several cycles ago. They came in late and they didn't qualify or whatever. Yes, that's right. And we really liked the project, but they just didn't meet at that point in time. And I was happy that we could go back and support. I went over there three Saturdays ago, I think. I couldn't find a place to park. Right. We have a huge parking lot. A huge parking lot, yes. Yeah, that was the same the night that his band played. It was just like, oh my gosh, there are so many people there. And there's a restaurant that's coming soon there. He had a truck out in front that he was serving out of that day. delicious yeah I definitely recommend smoked salmon all right any other things for your emotion to adjourn it's been moved by Harry is there a second segment by everybody All right.
