In each case, we'll have a presentation by the staff and we'll hear any additional comments from the applicant. The board will then ask questions or make comments regarding the application and then hear comments from any other interested parties. The chair will then ask the board members to enter a motion. The background, the applicant had a conceptual review with the BOAR for this project during the August 17, 2022 board meeting and submitted a proposal for a certificate of appropriateness, which was heard during the December 13, 2022 board meeting. With the board requiring that additional information be submitted to complete the application. With submittals received in the Historic Preservation Office January 10th and 11th, the applicant has now provided the necessary revised and new documents for the board's consideration. The proposal includes the renovation of the historic Woodland Christian Church and the new construction of a three-story senior living apartment building, the flats at Woodland, that will be connected to the church by a three-story connector. The exterior repairs proposed for the existing historic structure, which will be handled by the staff and not a part of this. We'll need to review the conditions and determine what can be done. The proposed three-story apartment building is to be constructed in the green space that lies to the east of the church. That is all this area. This is the open space looking at the rear of the church. The front mass of the proposed new addition is perpendicular to the historic church and connects to the side of the rear mass of the church's east elevation with a glass wall link. The connector is set back from the north or front elevation of the structure, approximately 71 feet. The high street north elevation of the front mass of the new structure runs parallel to the east-west axis of the church, and it's set back approximately 40 feet from the church's north elevation, and sits approximately 17 feet off the church and is set back about 40 feet. I'm sorry. The proposed new structure measures 81 1⁄2 feet and is parallel to the front of the church. Located behind the front mast is a wing skewed from the front axis to run parallel to the east property line. So as you can see, the existing church, the front facade of the proposed addition, and then the portion skewed back to parallel the property line. The exterior materials that are proposed for the construction of the apartment building include exterior number one, exterior insulated finish system known as EFAS and is indicated in all four elevations of the new construction. The one 20 to 30 inch diameter pin oak near the existing entrance of the parking lot needs to remain and be protected from any construction impact. The proposed three-story structure will occupy a site that historically had a residence built on it before and is appropriate to become the site for the new addition. So these are the Sanborn maps, or this is one from 1907, and this is one from 1972 that indicate the church and the previously existing residents. However, for this proposed new addition to be constructed in a location 17 feet from one and a half and two and a half story historic residential lots, the scale of the new building will potentially overwhelm those structures. as the design does not meet guideline 2B1B, which states, scale, height, and width. New construction should be in keeping with adjacent properties in height and width. In general, new construction should not vary in height more than 10% from the average along the block and within the historic district. Therefore, it is important to address the challenge and meet the intent of the design guidelines by creating the divisional bays or other design breaks in the plan as called for by guideline 2B1F, which states, Location and proportion of entrances, windows, divisional bays and porches, openings such as entrances and porches and architectural features such as divisional bays, porches are design components that help establish balance, rhythm, scale, proportion and emphasis in a structure. Patterns of these components and buildings along blocks and within districts create a characteristic rhythm for streetscapes and neighborhoods. It is very important that the new construction respect the balance, proportion, and scale of existing buildings along the block and within the district in regards to these components. Guideline 2B1F also continues. Entrances and divisional bays. Entrances shall be compatible in scale and size and proportion to the established patterns of openings in adjacent and surrounding buildings. Divisional bays are where the facade of a building is divided into a series of vertical bays or sections using designs such as pilasters and columns, projecting and inset sections. Divisional bays and new construction should be compatible with the balance and proportion of divisional bays in existing buildings on the block and within the district. To comply with the guidelines, some form of detailing is required to break up the flat walls to create shadow lines and interest in the walls, as well as vertical breaks to lessen the adverse impact of the mass of the proposed new buildings. Additionally, the parapet height should be varied. Such architectural design solutions need to be accomplished on all four elevations of the proposed new addition. The proposed design of the glass connection is compatible and within the design guidelines. The front yard setback reflects respecting both the historic structure and the historic residence immediately to the east, resulting in green open space consistent with the character of these properties, the block and historic district neighborhood. The proposed aluminum clad windows meet 2B1J windows. The use of wood or anodized or baked enamel aluminum windows is appropriate. The minimal detailing of the ephos and the similarity of the proposed stone in the historic church's structure creates a false sense of history and does not meet guideline 2B1K, which states, details. Architectural details help give building character and scale. Details include, but are not limited to, corner boards, rake boards, cornices, brackets, downspouts, railings, columns, steps, door and window moldings, and decorative elements. Architecturally, details may be appropriate when they may be appropriate when they give the building on which they are placed a good sense of belonging on the street and within the district. Details should be appropriately scaled for the proposed structure and compatible with adjacent buildings in the district. The proposal includes a small square or plaza of concrete widening on either side of the proposed entrance sidewalk, going from the public sidewalk to the front door of the residential units. Considerable landscape plantings as well as appropriate side and rear fencing is strongly recommended to further address the new addition and its placement on the site compatible with the adjacent historic residential properties in accordance with the design guidelines included in the report. The proposal meets guideline 3-5-D. Parking lots should have parking located in rear yards and be screened with hedges, shrubs, or fences as appropriate. and parking on vacant lots between buildings should align edge screening with the front elevation of facades of adjacent buildings. And on the corner, lots should have edge screening on both primary and secondary street. The proposed location of the dumpster is not within the design guides, as it is located in the front yard setback of Kentucky Avenue. This corner property is having two front yards from a planning perspective, both East High Street and Kentucky Avenue. The currently proposed dumpster location is literally in the front sight line of all the residential properties on the east side of the block of Kentucky Avenue, especially adversely affecting the home immediately next door facing Kentucky Avenue. The proposed removal of the three healthy red maples in the parking lot on the east side of Kentucky Avenue and the two in the pin oak adjacent to the church does not meet guidelines 36G and 36H, which state trees with trucks greater than 10 inches in diameter should not be removed unless diseased or unsafe. And new construction or rehabilitation activity should work around the trees with the trunks greater than 10 inches. Design plans need to be revised to allow a successful retention of those specific trees. And since you have already stated the recommendations, I don't think I need to repeat those. They have to have one. They absolutely do. There is an opportunity to have a dumpster in a less problematic placement, several options in the parking lot on the west side of Kentucky Avenue. But that is not contiguous in the parcel sense to the apartments, and we don't misunderstand that is an issue. But the other thing is these companies, these dumpster pickup and drop-off companies, I do not pretend to know the ins and outs of their regulations, but there is a long list of where things have to be located for them to service these dumpsters. And it has to be sure that whatever is worked out meets those standards as well. So it's a little complicated, but it is a legitimate problem for this neighborhood's integrity as a historic district and, frankly, for people living there day to day. Well, okay. All right. Any other questions from the staff, from the board members at this point? Okay. Jay, why don't you go ahead and make your presentation and call on anyone that you need to call on to assist you. Well, since we're talking about the dumpster, I'll just kind of stick with that issue right now. Yeah, let's stick with these dumpsters. Okay. I've got an image on that dump drive that I sent you, and it's called Stonewall Dumpster. I don't know if this would help solve, but this is what we've designed for the enclosure. We've already built the exact same thing in a development here in Lexington for Sales Road. And this is what we detailed and drew on the site plan. and this is what we planned to, and you can't see the dumpsters at all. They're completely enclosed and they've got gates on them. So given that there's no good location, as you pointed out, we wanted to make sure that they were as invisible as possible. If you would make that photograph part of your presentation and exhibit, if you will, let's call that Exhibit 1. Okay. Because we may reference it. Sure. Okay. Just the mechanics, I'm assuming older people are going to have to get in and out of that gated area to dump their trash, or how is that going to work? There's a man gate there on the left side, so that's actually accessible to be able to get to with a wheelchair. The opening to the container is not so high up they have to? It's a lower, because the dumpster actually is for 88 people, has a lower entry into it. And so the trick would be when the truck comes in, they will have – how will that big gate work? Will it be automated? No. It has to manually be opened. And the dumpster people are willing to do that? It would probably be closed by staff. Okay. And this is done by a private company and not through the city, correct? Yes. All right. Other questions from the board members? Mr. Chair, the only thing the staff would note for your considerations, I appreciate and I think everyone appreciates the design detail that's gone into masking the dumpster. and it's certainly aesthetically much better than looking at a dumpster. The problem is if you think of this as a small garage, you couldn't build a small garage in this footprint either. Any mass built something and occupying the space something on a permanent basis violates the setback. I don't think so. All right. Newly noted. Let's talk about the trees for a moment. Okay. Our landscape architect, Scott Southall, can talk to the trees. Yeah, I didn't hear his name. Yes, Mr. Chair. My name is Scott Southall. I'm with Earth Cycle Design. Okay. Let's go back to the site plan, please. There's a PDF in there that has a full set of drawings. If you can tell me the page number you're on, that would help. Okay, can you enlarge that slightly? Zoom in on the plan? SD3. Yeah, thank you. Okay, the circles, do those indicate the maples? So, yes, the circles are indicating the trees. Yeah, thank you. The circles are indicating the trees that are proposed that are darker circles, the existing trees, and then the trees that have a hash associated with them are the trees that are proposed to be removed. because of either the condition of the tree itself that has been already identified or the conflicts that the trees pose in terms of the redevelopment of the project. That includes both essentially the trees on the west side that has been mentioned by staff as well as the trees on the east side as well as a few of the trees on the west side. And the part that we're doing here is a very delicate balancing act that we're trying to accomplish here, not only in terms of the redevelopment of the property, but also looking at it from the other aspects of stormwater management, traffic management, as well as the potential for reduction in terms of the impervious area of the parking lots. So currently what is shown and what is developed, we are, with the proposal here, reducing the amount of impervious area of the parking lots by approximately 30%. So in this particular case, all of this area right here on the west parking lot, you can faintly outline the area. That's all paved currently, as well as there's some other areas that are paved currently on the parking lot to the west. I'm just going to focus on the west parking lot for now. In order to get this configuration in from the standpoint of efficiency for the parking lot itself, it required some reworking of the pavement in terms of the reduction of that. So we are actually making this parking lot more efficient by reducing the pavement of the site than what is previously there. So basically the parking lot is very inefficient in terms of its circulation and parking capacity based upon the way they had originally laid out the pavement. Does that make sense? Sort of. Okay. Basically, it's never met the city's requirements for parking standards. Does that make sense? So we are having to bring it up to current code and bring it up to current standards. So by doing that, we've also been able to eliminate a lot of the excess pavement associated with that parking lot. But in doing that, we also needed to have alignment or approximate alignment between the driveways from a traffic engineering standpoint. Traffic engineering likes when cars are being able to face each other or see each other as opposed to having the parking lot drives offset. So if we were to keep the parking lot up here, which is where the parking lot entrance, where it approximately is, then we get into a parking lot conflict with the driving movements of cars coming out, not being able to see cars right across the drive. So in order to again, count balances, we're getting into this situation of trying to meet other city agencies, demands or requests or standards associated with these parking lots. Can I ask a quick question? Is there not parking behind the church right now? There is parking that's currently- Right now it doesn't align. I'm sorry, what? So, I mean, if there's parking there right now, it currently doesn't align. So the condition is it doesn't align. This is alignment. This one is up here. It's not in alignment. So we're making them so they are in alignment. Is that critical? Well, it's important from a traffic management standpoint. It's been out of alignment for almost 60 years. Well, again, we're bringing things up to current standards. So that's how these... My question is, is it essential? Traffic engineering would say yes. Well, preservation would remind you that the H-1 overlay is the more restrictive. And so we have to have these battles internally in the city. And that's part of the considerations is to work through the various different pieces regulatory process. So what I'm getting at is because of these other things, considerations that we've been making through the process, then that has led us to the area right here where we're having to remove some of the existing trees. I know one opinion is that they are in good shape, but they have been severely impacted by the electrical lines that run through there. And a recent photo showing just last fall from Google Earth indicates, or Google Street View indicates that one tree is in decline. So those are the three maple trees on that side of the street. Again, these trees have already been identified by the urban forester as not being in the best of conditions. This is the large pin oak that has been identified as being somewhat worthy, although if you look at it again from a street view, half of its canopy has been lost because of its impact to the power lines that run along Kentucky Avenue. With that being said, we are replacing the existing pavement with permeable pavement and can take under consideration that tree to take and preserve as best as possible, given that we're removing some of the impervious area and replacing it with permeable pavers. So this entire lot will be now permeable pavers. You're addressing the panel, correct? What's that? This is the pin oak tree? This is the larger pin oak, yes. You got the pin oak. Do you know how old is that pin oak? Do you have any idea? I can just tell you that the urban forester's evaluation is that it is healthy. And he has stood on site versus looking at Google View. He's been right there looking at these trees. Okay, better. And I'm sure he's very professional, and we respect his opinion. That is our record. I'm really sorry. I was looking down when you pointed out which pin oak was the right one. This is the pin oak right here. That has been, yeah, and we can work to protect that pin oak and preserve it as we move forward with the development. And again, the replacement of the parking lot that's currently asphalt with a permeable parking lot. So this is the 30-inch pin oak that we're talking about? Yeah, it's in the 20 to 30-inch caliber. Okay, it's right adjacent to the building, or it seems to be. Yes. Okay, second circle up from the... It's this one. Yeah, that one. Yes. And I think, just to make sure untoward, mistakes don't happen to be flagged in some way. I'm sorry. So that to avoid an accidental dismemberment of the tree. So in the process of producing the construction documents, we will have to produce a tree protection plan, erosion and sediment control plan, and that tree would be then flagged for protection and with a tree protection fence. Does you know how things can get chaotic on a construction site? Yes, that's why we'll have a protective fence. Not to be cynical at all. But landscape architect knows how to protect those trees and make the contractor responsible. So what we're talking about is not really the three trees on the church side of Kentucky Avenue we've now addressed, right? Right. So it's just the trees on the west side that we're talking about. And if I'm understanding the argument correctly, the only reason why they have to be removed is because there is a preference by traffic control that the driveways align with each other and be more safe for people coming in and out, correct? Well, there's that as well as, again, as I mentioned, redesigning the parking lot to meet current standards required us to take and, you know, this particular tree is in the middle of several of the parking spaces. And again, we've already had to acquire a variance for the reduction of parking spaces, and this would impact that as well to even reduce it even further. Explain that to me. Why do you have to get variance to reduce your parking? So because of the age of the church, established in 1926, there was no parking requirements associated with the church. bringing it up to current requirements meant that we had to meet the parking requirements for the assembly of the church, which is going to remain as mentioned previously as a church. And therefore, the number of parking spaces that were available on site and across the property or across the street did not meet the current requirements for parking just for the assembly space of the church. Therefore, when we went before the planning commission, in addition to the zone change, we also had a variance request to reduce the amount of parking that was required for this site. And did they condition the zoning approval on that variance being implemented? Yes. You couldn't get it grandfathered in the parking lot? So essentially that's what occurred with the variance. Our problem is this. From a historic district perspective, that parking lot was part of the historic district when it was created. And I don't, and especially with the trees where they're located, I'm not sure we can authorize a removal of those trees to facilitate a redesign of that parking lot. I have a few questions. Sure, go ahead. So we're really down to three trees that we're talking about. Right, yes. The three trees on the west side. And that have been deemed healthy and the trunks must be larger than ten inches. But we also understand that they've been, at least a couple of them, impacted by overhead utility lines. And they're clearly not of the age and caliber that the, what is the pinnop? The pinnop, yes. It's the 20 to 30 inch. I mean, that tree deserves a little protection on our part. So, but just to ask about the balance of how are you addressing the loss of some trees in terms of replacement of trees with the potential to gain that same scale. But where is that balance? Are you looking at two trees for one loss, or what is your design approach in dealing with those existing trees? We're probably looking at a 10 to 1 replacement. I mean, again, all these trees here are new trees. These are new trees. These are new trees, new trees, and new trees all along here. What caliber? Well, they'll go in a standard 2.5, 3-inch caliber initially, But over time, they will have an opportunity to grow and mature. One of the primary reasons is that we're giving them a lot more space to do that by removing the asphalt in the parking lot that's been essentially inefficient and not to standards. So the west parking will also be permeable pavement? or pay for it? We have not gone to that degree in terms of determining what the stormwater management needs to address. Again, like I said, we're reducing the amount of impervious area by just simply the redesign process. And at which point in time, if we need to go further in terms of addressing stormwater management, then it's possible that we can go to a permeable. But at this point in time, just the redesign has reduced the amount of impervious area. So there might be some potential within the area where the new trees that are part of the more paved areas might be accommodated to enhance their potential for growth and longevity to use permeable. Yes, as well as the trees that are going in along the perimeter will be designed appropriately to meet not only the city requirements for perimeter landscape, but also more appropriate trees to be placed under power lines. All right. So when you say you're bringing this parking lot up to standards, I'm understanding that to be stormwater runoff standards that are current in terms of collecting or not having permeable surface, impermeable surface, and also the number of parking spaces you need. What other standards are you trying to update this parking lot in order that you have to meet? Sure. Sure. So, great question because Lexington has assessed standards in terms of the depth of the parking space, the width of the parking space, and the width of the drive aisles. So, currently, the parking layout does not meet those requirements. This will take and meet those requirements in addition to the other requirements you mentioned in stormwater management. any changes to this parking lot, how many spaces are currently there and how many are you going to have in this new layout? We actually add additional parking space over what is currently there. So this is going to be a net gain in terms of parking spaces by one. By one, okay. But we will lose a space. You need to come to the mic, please. I apologize. I'm Zach Worsham with Winterwood Incorporated. We're the applicants. I just wanted to note that if we were just to re-stripe the existing parking lot, one, I do not believe that the drive aisles would be wide enough. The drive aisles would not be wide enough to meet city standards, and we would likely end up losing parking spaces, which has been a point of concern for several folks in the neighborhood. So I apologize. Well, I'm not sure what you're saying. Get back up. Slow that down a little bit, and let's start from the beginning. Sure. By reconfiguring this parking lot, the only other option in order to maintain the existing drive aisle is just to take the existing parking lot as it is currently paved and re-stripe it. Two things would happen there. One, our drive aisles would not meet city standards. What? drive aisles where the cars would drive through the lot and we would end up losing spaces due to lot efficiency. Do you know how many spaces you would actually lose? One. Well, one at this point in time and it depends upon the number of handicapped parking spaces that we would have to put in as well as losing possibly a second one. Let me make sure I hear this correctly. If you re-stripe to conform to normal existing standards? No, I'm sorry. It would be just to re-stripe it as is. So it would not meet Lexington's standards. Alright, my question to you is if you re-striped it to meet standards? I don't have that answer in terms of... Well, it would be significantly more than one space. Two? Three? Again, I I can't answer that without having to go through and performing the operation. That was part of this process, I mean, all right. Well, getting back to the tree conversation, it does, to me, we want to protect existing healthy trees. We also don't want to have a net loss in trees. And clearly this proposed new parking lot greatly enhances the tree canopy from what currently exists. And that is a direction we want to head. The problem is the design guidelines do not address mitigation, if you will, although I think probably it should. And sometimes you can warrant losing a couple of trees if you're going to have a net increase in tree canopy. But the guidelines do not give us that option right now. The guideline is fairly specific about the 10 inch parameter unless the tree is diseased or- It is. Is the terminology shall be removed as opposed to should be removed? It's just a nuance and I don't want to get into equating should and I don't want to get to the point of saying should is not the equivalent of shall. Because that argument can be too easily used in too many other contexts. The problem is, and that's why I was asking about the age of the trees. Some trees are more historic than others. And I was just wondering how long have those maple trees been there? Do you have any idea? And whether they're about ready to age out is what I'm trying to get to. Well, I mean, in terms of their placement in, within, underneath power lines, these trees have exceeded, because of, again, all of the trees that are along this area that we're discussing, are trees that are essentially they're good trees in the wrong place because they're underneath power lines. And so they've been compromised significantly by the removal of limbs over time by the utility companies to reduce the conflict between the trees. And so from that standpoint, they have exceeded their maturities in terms of being kind of urban street trees, which is kind of the conditions that we're talking about. The trees themselves, based upon the survey, range from 15 to 20 inches in diameter. The landscape requirements for the residential zones based upon the current requirements will have us give 30% tree canopy coverage or achieve 30% tree canopy coverage as a minimum under the residential zones that we've got an R2 and an R4 zone. So we're talking about a significant increase in the tree canopy coverage of both of these sites or both of these lots as a result of bringing these properties up to current conditions that, again, fall back to the requirements from planning. Could the trees be considered unsafe with respect to their placement by being underneath the utility lines? These particular, let me put it in the terms of these particular trees would not be permitted to be placed under utility power lines as if they were to be new trees. if the new trees were to be placed, these would not be appropriate trees to be placed under the utility power lines. But are they unsafe to the power line where they are right now? If you can answer that. Are they unsafe to the power lines? Well, it's evident by Kentucky utilities coming in and removing the limbs over the years that have demonstrated that they pose a risk. okay so we haven't looked at pictures of these trees recently and i don't know you know what limbs so i'm going to ask about two particular trees one is the one that is furthest planned north it looks like it's in a sidewalk area and could be the sidewalk could be reconfigured to save that tree i don't know what else the existing condition is around that tree but it's not actually in the parking area so i i question that one and then The one that's further south seems to be set off the road quite a bit and probably wouldn't be as impacted by those Kentucky utility lines because they're going to run right along the street. So I'm just wondering about the condition of, it seems to me like the two that are close to the street are likely, chopped up from the Kentucky utilities, but is that southernmost one also in that condition? Well, I just had a Google map street view pulled up from this fall, and it indicated that the tree to the north that you were speaking of has appeared to look like the top has died out of it. Is that the 18-inch red maple? That would be the 18-inch red maple. I'm going to call that one. And if you give me just a moment here, I will pull this up. While you're looking for that, would the board find it helpful to know in terms of the planning commission's decision on the parking configuration and numbers and so forth and so on, How many parking spaces were deemed necessary to serve the residential new build? And how many were allocated to the occupancy of the church and its programs? The parking requirement for Kentucky Housing Corporation is one per unit. So 38 spaces? And we meet that requirement. for that and then and does the Planning Commission in their review do they count those spaces twice use on Sundays versus you know the church is a no they were independent rhythmic yeah rhythmic use okay so so you have to have a baseline of 38 for your residential project and the balance one assumes if you agree is allocated to fulfill the balance of the needs and reflecting I assume the church. Yes. The church. What's the head count for the number total number of parking places? The church has an occupancy of 420, of which a ratio of one per five was to then equal 84 parking spaces for the church. Was the Planning Commission aware that this congregation is about 50 people? The planning commission does not look at capacity of any given congregation. They look at the capacity of the space. Just bear it on square footage. The unit count, because this is affordable senior living housing for parking, was 38 units times a multiplier of 0.75, giving us 29 parking spaces as a requirement. That equaled 102 parking spaces. We have 61 parking spaces. That was a net gain of one parking space over the current configuration of both parking lots. Yes. The tree. You need please to bring that to Elmo or to, that'd be the simplest. Hand it to our tech, thank you. And you might need to stand there if you need to change screens. We're on the high street church. And we can give you a portable microphone. We've got a microphone. Check one, two. We're actually down to just a discussion about the trees. And the dumpster. We haven't really finished the dumpster. I can't tell you how science fiction that looked. The giant hand. Let me do it this way. We'll have it as an exhibit on Elmo, And then I'll take and bring it around so that you can see what it looks like. But what you're seeing in- And for our record, let's just call that exhibit two. Right here is- There's nothing- Right, what you're seeing right here is the top of the tree to the north that you were talking about its condition. This is from three months ago, and it's indicating that that tree has some type of issue associated with it because there's no leaves on it. I'll take and bring it around so you can see it. It is fall. Well, the other trees have leaves. I think if the staff could suggest that the urban forester is the government's professional counsel on these things as far as the health of these trees. And I don't think, certainly the staff of preservation makes no suggestion that we are the professionals about trees. And I think that we need to take into full account the board, please, the urban foresters' report on the health and condition of these trees. In that he's been on the site, he's looked at these trees individually, talked about them to the staff. And, you know, going back to computer images in the past and whatever is all very interesting. but I think we have a professional who stood there in person in the last month and that's what's on the record. And I think I'm hearing another professional saying that in his estimation this tree may be in decline. That's the purpose of a hearing. The evidence can be conflicting. I think we're going to have to move on though. We've got other cases that we need to address. So we're down to two issues. One is the dumpster. The other is the trees. There is traffic, like you wouldn't believe congestion in this area. Has this been addressed? I don't know. That is an issue that's really not before us. That's actually a planning commission issue, if any. What we're dealing with today is whether or not this design... It's fitting the historic and the... Which it's not. That's okay. It's not. Thank you, Ms. Gensley. I can't see how the other part, and I guess I'll look into that, can justify this. When people who live there have guests, where are they going to park? I can't answer that. All right, so I'm just going to open up the floor for a discussion, starting off with Ms. Hill. I actually have one more question. Sure, go ahead. I'm sorry. For the applicant, and it has to do with the comment of the location of the enclosure. It's not about the enclosure itself, but about the location. Sure. When I look at the site plan, and I think this was related to the dumpster trucks, but just to make sure I understand, is that shifting that back off the kind of edge of the sidewalk, pushing it back into the site a little bit, is that an option? Yeah, what we were attempting to do with that was, you know, Lexington has a requirement for backup. That backup distance continues to shrink over the years. It used to be 150 feet and then 75 feet and now it's about 60 feet. So that is from a safety standpoint. They don't want to have vehicles backing up too far. And we were trying to take and balance that in terms of the backup, knowing that they're having backup onto Kentucky Avenue. With that being said, we also thought we had it set back far enough beyond the building lines of the adjacent houses, so that it was not going to be intrusive. If we need to take and push that back a little bit more, we can do that from that standpoint. But again, we're dealing with a condition where we're trying to strike a balance between all these design requirements. Okay, and that is helpful. And the downside to backing it further up is you lose green space, but you also create more paving requirements. Exactly. Yeah. Okay, thank you. Yeah, all right. All right, any other questions? Okay, let's start off with a conversation. I'd like to get this wrapped up if we could by 530, because we do have two other. Okay, all right, Ms. Hill? Any other comments or? Given to address item number seven about the dumpster and the screening and location, given the balance point of getting it off the street. and having it recessed but having it fully enclosed, I'm comfortable with the proposal as shown. The tree canopy, the thing I'm struggling with, and I understand that we've addressed the pin oak, which is a really pretty wonderful tree. So I'm delighted that there are ways to be able to address that and to protect it. Given that the number of trees that are going to be added into the parking on the west side of Kentucky is a huge enhancement to what currently exists. And given the nature of two of the three trees in conflict with the power line, so as they grow will only continue to be more of a conflict, I find the offset of the additional trees to be more than a balance point to losing them. All right. Sarah? Okay. I think you should continue to work with the staff to really figure out where we can put this enclosure that will meet the guidelines and not have it right off Kentucky Avenue. And I realize that that means that you're going to lose more parking off of that parking lot. And you guys are really struggling to get as much parking as you can. But I think there is a better solution that can be found. And I'm not going to say, I don't know what that is. But garbage trucks come through parking lots and do that all the time. So I just, I don't know what the requirements of the company you're working with and stuff. But I think you should continue to work with the staff on that. On the trees, I agree with Susan that I would rather just see the parking lot left behind. But I think for me, putting that dumpster there is more of an eyesore than adding more trees to the site on the other side. Okay. I'd rather not lose the trees, and I'm not sure it meets the guidelines to cut down the trees. So I don't know. I agree with the staff, but actually I would approve this motion as exactly how written by the staff for them to continue working on both items. All right. Or you want to make comments about the trees at all? I think the recommendation for the staff is for them to continue to work with them to come up with a solution to try to save the trees, and I'm in agreement with that. All right. Do you want to participate? I think the enclosure was an excellent first step. I think you can probably make it work better by pushing it back, as Ms. Hill has suggested. Dumpsters are problematic. I don't think you're going to have a problem with your tenants there, overloading it. My concern, unless, well I didn't ask that question. Is there going to be a lock on it so that it's only accessible by the tenants? Jay, do you know that? It's not locked because for the dump truck to be able to get access to it, so it's just not locked. My concern is nearby tenants may avail themselves of it. But its placement doesn't matter. Okay. I think you need to push it back. I think Ms. Lemire has made it clear that you need to work with the staff. I think the enclosure is an excellent solution, but it just needs to be pushed back a bit. On the trees, the guideline is fairly inflexible. And personally, I have a whole different attitude about historic trees. And I think it's unfortunate that when they adopted the guidelines, they really didn't differentiate between truly historic trees in the sense that when you look at it from a national perspective, there are some trees that, by God, you die to keep them from being cut down. That's not the case with these trees, but that's not how our guideline is worded, unfortunately. I think the guideline needs to be more definitive in terms of what is a historic tree. These trees are not historic, but the guideline says, if it exceeds 10 inches in caliber by god you know they stay so i think you're going to have to continue working with the staff on saving these trees i'm not terribly impressed with your argument that because the planning commission would like you to upgrade the standards that that that parking lot has never been a problem that's right i don't think there's ever been an accident on kentucky avenue involving that parking lot that i know of and i live in that area so i don't think it is terribly persuasive that because the planning commission would like to see you redesign it that it has to be redesigned and that's my final take on that so i think i think we're ready for a motion we can do this one of two ways we can either take make a motion on each individual item. I'm assuming that we don't have to recite back into the record all the other conditions. We'll just refer to them by number. But with respect, do you want to go ahead and do a single motion? And I hope I picked up the updated one and not the old one. Okay, one, break up all four exposed elevations of the new addition structure using design solutions such as pilasters and columns and projecting and inset sections. Two, vary the heights of the parapets to provide some movement to the top of the structure. Three, change the stone stem walls to be dissimilar to the existing church, so as to differentiate the addition and not create a false sense of history. Four, to redesign the proposed east and west parking lots to avoid the removal of the trees greater than 10 inches. And that's the pin oak on the east side and the three maples on the west side. Five, increase landscaping and add appropriate site perimeter fencing on the east and south property lines to further lessen impact of the new addition on the site and impact compatibility with historic residential properties. Six, provide location and details of property perimeter fence and landscaping for the required separation of the R4 zone from the R1 and R2 zones. Seven, relocate proposed dumpsters to an appropriate location and screen. Eight, submit revised drawings showing conformance to all recommendations to board for review and approval prior to the issuance of certificate of appropriateness. So this is the structure at 153 Pinmoken, and this is the parking lot that has been paved. You can see this lot was actually larger, and it was a graveled lot, and they went ahead and paved without a certificate of appropriateness. The lot you see, the parking where they paved now is 31 by 22, and Ms. Harp indicates in her application that the dimensions of the previous area was 42 by 26. And this is her looking from another angle of this paved area. She's indicated that she put a third space in there for handicap accessibility. Staff has cited this applicant as well as building inspection has also done that. These are some aerials. This paving was done without a COA being? This paving was done without a certificate of appropriateness and a building permit. All right. And so you can see this is from 2012, in sort of 2015, 18, and 20. And this is sort of the back side. This is a picture from when the property was made H1 overlay. You can see where the paving is now. but they did go back and pave that area. Guidelines are included for reference. Staff finds that the proposal to pave the parking area requires further discussion. Of course, staff does not condone work without a certificate of appropriateness. However, after review of aerials for the last 20 years, staff does find that this area has been graveled or a parking area. The staff does find the proposal does not meet the guidelines 3.5B referencing the parking area being too visually dominant and should be reduced to only having two parking spaces as it does not meet the infill and regulations area, which only allows for two parking spaces. The staff suggests that landscaping be added to soften the visual impact of the paving. Recommendation staff recommends that approval to pave the parking area with the following conditions. The parking area be reduced to two parking spaces. landscaping be added to soften the visual impact of the paving and number three and four are standard conditions and of course somebody is here to speak to this case I think I'll just go ahead and ask for questions from our comments from the audience miss Gillespie come on up I appreciate your patience no problem. My name is Jerry Gillespie. I live on Penn Moken Park. We're all aware, or I assume we're all aware, that our neighborhood has been designated as a historic neighborhood after concerted effort on all our parts who were involved in this. The rules and restrictions that are set in place by the Historic Preservation Office for any and all construction projects are clear. However, some property owners, including those who have rental units in our neighborhood but don't live there, choose either to ignore the said restrictions or are simply ignorant of the procedure involved to abide by historic requirements. I suspect after hearing that they declined to be here that the latter is probably the accurate one. The example here refers to 153 Penmo. Can they have a sizable parking area paved without any application for the construction? Now, if it were me, I think that's a pretty big gamble on losing some money to do that without approval or appropriateness. Just saying. We're basically offended by the property owners arrogance just to take it upon themselves and do this. all of us, my wife and I, if we've had fence repair done, we've gotten a permit for that. We had our shed redone. We got a permit for that. Other people in our neighborhood have had projects done. They got permits for that. This property owner did not. They denied even knowledge that it was in a historic district. We know that's not true. As I said, we're offended by the blatant disregard for adherence to the same rules that we're all expected to follow. Excuse me. We just feel like if the restrictions are in place, they should be enforced. And if the very department that created those rules does not enforce them, then what's the point? If there is no penalty for or deterrent against breaking the rules or not following the restrictions, it, in my mind, simply encourages others to do exactly the same thing. So my opinion is they should either be fined for not following proper procedure or rip that up and apply for an appropriate application and redo it. And they should consider themselves lucky because I feel like you all are probably fairly gentle compared to other places in the country that can apply a daily fine of $500 or more for the time that that is there. That's going to be one large figure if they start adding it up, because it's been there for a while now, without permission, without any consultation with you. We feel it's unfair if that's allowed to be tolerated with no penalty. That's my opinion. That's all I want to state. We followed the rules. We feel that everybody in that neighborhood, whether they live there or not, should follow the same rules. Thank you very much. Thank you for your time. All right. Ms. Curra, did you have a comment? Well, I just would echo what our attorney has reflected in that I think in this scenario, the property owner not being present should not inhibit the board going ahead and doing its work. And COA has, its scope of work is construct a garage. And of course, the COA has recommended, the staff has recommended this approval. Let's have a staff presentation then. Correct. And to walk you through, this is of course 606 West Short Street. And this application was approved for one and a half story garage back in August. And sort of walk you through the site and you can see that this lot is empty. It's got sort of a masonry wall in front of it. And then here is the area, the proposed area where the garage will be going. This is the neighboring garage. And this is the neighboring structure of the house. and this is the physical structure of 606 so it's going to be between these two because 606 has such a wide lot. I'm trying to give you some more indications and views of this. And also I want to give this perspective. So on one side of the street on West Main you've got large townhome buildings that have garages sort of built into them. And on the other side, on West Short Street, you have large two-and-a-half-story structures with small one-story, either more modern construction garages or outbuildings. As you see here, you can see two newer structures that were approved by this board and you can see an existing outbuilding which is actually attached to that main structure. And so I think if you could see where the black cars parked, this is the location of where that garage is going to go. And I think to point out staff's concerns to be a little bit more clear. This is a main structure and if you look at the proximity of where this garage is going to go, it's going to be pretty much catty-cornered to the structure. So staff's concern is that being two full stories that it would be the same level as this existing structure which is the main structure of the house with the big addition. So to be clear we have already approved a one and a half story garage now they want to make it into a two-story? Correct. So to give you the dimension so it's going to be at the height of the previous garage is 20 foot point eight inches and this is going to be 24 eight so it's only gonna be four a few more, but the roof is going to have a different slope and it's going to be higher. And these are some of the images that Mr. Williams is asking me to put in the staff report or your imaging to sort of look at both sides of this alley. And this is sort of, sorry, looking towards the sun, which is dismal in its approach. And what you're seeing is the backside of the neighboring structure plus the one-story garage and then the other garage will be on that other location. And to give you some of the renderings, and here's the proposed garage. You have in your packet, the plans that are in, I think, teal that are at your desk of the old plans. 8 and half by 11. They're tucked into your 11 by 17 plans. This is the proposal. It's the floor plan, second story plan, and the renderings. Guidelines are included for your reference. Staff finds the proposal to increase the height of the previously approved garage needs to be further discussion. While the height increases is only four feet difference, it is significant because the increase means that it would surpass the existing structures. Rear Cornish line, it would be the same height as the neighboring property on West Short Street. In addition, this is different because the garage is not directly by the house, but located to the west. It's very close to the neighboring structures, which is not as tall as 606 West Short Street, which is the main structure. The proposed changes would be countered to guidelines 2B to A, which states, accessory buildings should be simpler in design and considerably smaller in scale to the primary building, as the garage would not be simpler or considerably smaller to the primary buildings on West Short. And all accessory structures on this alley are one and a half story. Staff recommends the roof line and design remain as it's approved in August of 2022. Staff recommends disapproval of the proposal as proposed. And Mr. Williams is here. Okay. I will note for the record we do have an email from a Charles Williams indicating he had no objection to the proposal. Making a comment that the garage would block most of the skyline view. So you had a story and a half garage that you now want to bump up to a two-story garage. Yes, sir. Good afternoon to everybody. Good evening to everybody. I'll try to make this quick. I know everybody wants to get home. Yes, we initially did the story and a half, kind of the same thing in my mind. But then we got into it a little bit, and it was getting expensive. It was limiting our space up there a lot because we had to clip ceilings and things. And I thought one day, I'm going to do a quick two-story version. And it fell together really nicely, and I thought, this is a lot better. It's a lot more usable space. and I was fine with it and you know height is a concern but I've you can tell on there we're way lower than the main house roof if it was seven feet lower than the main house ridge or something like that lower than the secondary edition on the house and a little higher than the third of which was an old detached kitchen I think at some point and then I put this pent roof over the garage doors so visually that's kind of where the lower roof if you're in the alley and you see it you see this lower roof and that kind of ties in with the lower garages on along that way. So, and it's four feet higher. So, you know, it's not significantly higher. Gives us way more room. Easier construction. I think it's a simpler structure, really, rather than having the dormers and roof planes shooting all over the place. It's actually a, it's a simple box now. So, you know, I'm interpreting the guidelines a little different than staff. You know, I respect their interpretation of them, but they are guidelines. They're not restrictions, as the other guy called them. So I'm interpreting them a little bit differently. They're also two-story, which we saw a picture. There are two-story additions on that alley already across the way from it. And, you know, that's pretty much my argument with there. The other thing I wanted to say, and it's getting in a little bit of a tangent, but the government, the federal government, the state government, local governments all across the country are revising these zoning laws. Get additional dwelling units in alleys and Louisville's doing it and Louisville's certainly not a progressive city and they've eliminated FAR in Louisville and they've started accessory dwelling unit proposals. Now we can, so there's no single family zoning in Louisville anymore. And that's pretty huge. And that alley could be, it's a big gaping, missing teeth right now. And that alley in the future with these laws as they're gonna be changing here, I'm sure, will be full of life and less crime and give you tons of affordable housing on these alleys. And that's happening in my neighborhood in Louisville right now. There was one, some of the neighbors were fighting it And it's up now, and it's like, this is great. You know, it's just great. There's a little life on the alley, and it's just turning out great for everybody. So, you know, I kind of see something like this as, you know, yeah, you're not bending the rules. You're interpreting the guidelines differently, but I think it sets a good precedent for future development on these alleys and these urban alleys. And I hope you will agree with me. To urban planners, comprehensive describes the interrelated nature of our physical environment and the collective vision of the community, all of which is woven into what we call the comprehensive plan. In Lexington, our 2018 comprehensive plan is called Imagine Lexington, and now, just a few years later, the city is again asking the community to imagine a future that serves us all. This plan represents a shared vision for community values, goals, and experiences by providing a flexible yet focused framework to ensure equitable development of our community's resources and infrastructure, all with the goal of enhancing our quality of life and fostering regional planning and economic development. Most importantly, the comprehensive plan and the process we undergo to create it gives you, the community, a chance to listen and speak on things that help us determine where we've been, where we are, and where we're going. Imagine Lexington is the most recent addition to a long line of plans that came before it, adding its name to the rich planning tradition of this community and recognizing the knowledge, experiences, and voices that have shaped that tradition, while at the same time striving to amplify the values and experiences of those historically excluded from the process. The current plan breaks our future vision into five themes that reflect how the community operates and interacts. These themes are neighborhoods, environment, jobs and prosperity, community, and urban and rural balance. So where do we stand now that another comprehensive plan update is upon us, and how do we set priorities for these themes moving forward? First, let's look at our neighborhoods, the building blocks of our community. Lexington's neighborhoods, and more importantly, the neighbors themselves, make up the foundation of our city. Any neighborhood, the heart has to be the people who live in it. And you have a vested interest in this neighborhood, therefore a vested interest in your city. So what, when paired with great neighbors, makes a successful neighborhood? I think diversity, just every walk of life, being able to be in that neighborhood together. We also need diversity within our housing types, housing affordability, land uses and transportation options. Being able to walk around, walk to a business, walk back to your home I think is really important. The demand for connected walkable neighborhoods is on the rise, which makes our investment in creating these spaces and making them accessible and affordable a top priority. Of all of the things that probably are deepest in everybody's mind these days is the availability of housing. Is it affordable? Do we have enough of it? The largest opportunity for development and growth in Lexington, I believe, is affordable housing and anytime you got more residents and more housing, that's better for the city. Just as we depend on our neighborhoods to house and support our growing community, Lexington also depends on its natural environment. The natural areas both within and outside of our urban area significantly contribute to our community's social, economic, and ecological well-being. Lexington is a beautiful city and I love the natural world that we have that surrounds us. In the future, providing more spaces for people to go out and enjoy nature is very important. The sustainability of the landscape and its natural resources is closely linked to the community's values and needs. Therefore, we have to appropriately address the impacts of development on the environment. There's more that we could do to provide an ecological component to development. That might include more trees or might include more native plants that help with flooding and habitat. we're seeing kind of a collapse of our ecosystem based on our land use practices over the past hundred years. Our natural environment is a very complex system and it's all interconnected and it takes many different types of people with many different perspectives and different expertise to be able to make plans that make sense and that affect all of us. Thriving communities achieve prosperous economies by using a multi-faceted approach, creating opportunities for both new and existing businesses, while also maintaining the community's overall vision. It's not just about attracting a company to Lexington, it's about what are the right types of companies that fit into our community, our goals, what we have for our plans in the future for our city. By being a city with a diverse economy, Lexington is an attractive option for both businesses and talent, but it goes beyond that. People are getting more concerned about what does my after work life look like as opposed to my nine to five life. While it is important to have things to do and places to go, for an increasing number of prospective Lexingtonians, it's also about how we get around. You know, amenities like multimodal transportation, where at one point separated you from other cities, now are kind of table stakes. If we want to have a vibrant young workforce, if we want to retain a vibrant middle-aged workforce, and then have people who want to retire and stick around, it's the stuff you have to do. There's many reasons why it's important to have walkability and have everything in close proximity to your urban core. You're going to see a lot more connectivity, and that's going to drive a lot more job recruitment and a lot more people wanting to live around it. With housing, transportation, entertainment, and other quality of life factors at the forefront, Lexington continues to be a desirable place for both employers and those seeking opportunity and growth in life and career. The question is never why come to Lexington. The question is always why not come to Lexington. We have it all here in our city. Support services and accessible well-maintained infrastructure creates a base for desirable communities to thrive. Most importantly these things increase the quality of life for the people who choose to live and grow here. Lexington is such an amazing place for people to grow up and grow old. To have a vibrant community, we need to ensure that we have activities and availability and housing and transportation and public spaces, all that's open, available, generally free for people of all ages. We think of our city parks, places like that where anyone can go and enjoy it in the same sorts of ways. The idea of access is important that they're open to anyone. Adequate and equitable access to community spaces is dictated in large part by the connectivity of our transportation network and ensuring that it serves all types of users. I think it's essential to plan for people of all ages and abilities when we think about infrastructure, whether it's bicycling pedestrian infrastructure, partly because it is people on both the young and old end of the spectrum who often maybe don't have access to vehicles and so they're the ones who are going to rely on it the most. When it comes to our discussion about urban and rural balance, smart growth and rural preservation go hand in hand. It is undeniable that Lexington has both urban and rural assets that are worth celebrating and enhancing in our city's future. I think we have a very vibrant downtown and it's ever-evolving and I think it's only gonna get better. I think that's pretty special that kind of mix of urban and rural that makes it an interesting place to live. You can be in a city and get all the feel of the city but then you can also go five minutes down the road and it's green pastures everywhere you go. That's probably my favorite part about it. These voices represent just a few of the many within our community and cover just a fraction of what's in the plan, but every voice is important. So you may be wondering, why should I get involved? It's important to hear your voice in the planning process because a comprehensive plan just isn't comprehensive if it's not representative of all the people in the community. We are a community. We all live and work together and the growth and the beauty of of this community is going to be when we all have our input into how we want our city to look and to grow moving forward. It's up to us to decide what the community looks like, what is it that we need, what do we want in order to again create a vibrant, livable community. Getting involved will allow for growth for Lexington and it takes its residents to do that. People's old experiences and experiences are all important and to find a balance is never easy but when you get there it's great for the city so everyone's voice needs to be heard when it comes to this issue. So if you want to be a community, be a part of a community, you've got to step up to it. As we reinitiate this process and look forward to Lexington's next 20 plus years, let's continue to imagine. I'm Neil Noah and welcome to Lexington Now for the week of January 16th, 2023. Fayette County Public Schools introduced a new way forward, its new childhood education initiative through First Five Legs. Mayor Linda Gorton joined school officials for the announcement. We appreciate so much the support that the community shows to our students across the district. As we discuss a renewed focus on our early childhood education today, we know that your support will expand to include our birth to five age group. That is so important to creating a lifelong learning experience for our students. In 2010, Fayette County Public Schools announced a new initiative, First Five Lex. The goal was to encourage our community to work with families and caregivers to read, talk, play with children in their first five years, those formative years. The city's been a partner in that initiative and in other early childhood education initiatives like Head Start. And we are here today, a partner with Fayette County Public Schools, committed to supporting our youngest learners. Early childhood education and kindergarten readiness, as we know, therefore, begins well before children start their first day in the classroom. Brain education research tells us that from birth to five years old, a child's brain develops more than any other time in their lifetime. By the time they're five years old, 90% of their brain development have occurred. As parents, caregivers, and community members, we can help children's brain to development, and it's not complicated, actually. It doesn't require hours of training. It doesn't require an advanced degree. In fact, it doesn't require a degree at all. It simply requires that we read, talk, and play with our students. Parents, families, and caregivers are our children's first teachers, long before they arrive in any of our classrooms. Therefore, this community-based initiative, First Five Lex, helps children, families, and caregivers read, talk, and play from birth to kindergarten so that they're well equipped when they head into our classrooms for the first time. So why now is there a renewed focus on early childhood education across our community? Well, in the 2021-22 school year, just last year, we had the lowest scores ever on kindergarten readiness. This year, we began the implementation of our five-year strategic plan, A New Way Forward. This title is just not a tagline. It's the direction in which we are going and it's the course of action we will take in order to get there. That being said, our goal is a bold one. By the year 2027-28 school year, our goal is to ensure that 100% of students who are entering kindergarten have the prerequisite skills to be ready from day one to begin their learning experience and move forward from there. One of the most important things we can do to improve early literacy is give our children access to books. Inspired by her father's inability to read and write, Dolly Parton started her Imagination Library in 1995 for the children in her home county in Tennessee. Today, her program spans five countries and gives over two million books a month to children around the world. With the goal of inspiring a love of reading, the voluntary program gifts books each month to children from birth to age five, free of charge to families through funding shared by Parton and local communities. Until today, Fayette County was one of only five counties in Kentucky with no coverage. Drill to an end.
