I'm the council person in District 10 and we're in the heart of District 10 in Southland Park and today I am here with Ken Cook who is with the Friends of Wolf Run. Ken, thanks so much for being here with us today. Glad to be here. Yeah, tell me Ken, tell me about the project that we're sitting in the middle of right here. Well we're looking at a stream restoration where they fixed this creek And they, being Fayette County Public Schools, got a grant from Lexington Fayette, Urban County Government, to hire a design team and a construction team to come out and restore what was heavily impaired, heavily incised, bad ditch, essentially. And they turned it into a really interesting neighborhood amenity, water quality amenity, a creek that's here the school can use, park users can use, and it's really gorgeous. Awesome. Thank you. And you live in the neighborhood around here, right? I live 500 feet from here. Oh, that's awesome. That's awesome. And Friends of Wolf Run, tell me a little bit about what Friends of Wolf Run is. And I think you're a trustee with them, right? I'm an officer with Friends of Wolf Run. We are a nonprofit group. Basically, we're pretty much all volunteers, though we do hire contractors to do work. Our mission is to improve water quality, habitat, aesthetics in the stream, increase our property values, and turn essentially polluted little creeks into something that's valuable to the neighborhood. I mean if for example in Town Branch we're spending millions of dollars to restore a stream there because we recognize the value of that. Here in Wolf Run we have creeks that we don't need to spend a million dollars on, we just need to recognize that we've got a pretty cool asset right here in a park or in our neighborhood. And so our group works to work with neighborhood associations and individuals who own property along Creek to do what they can to improve things. Awesome. That obviously takes a variety of money. So, and since you're a nonprofit, why don't you describe for our audience kind of what the funding sources are that are available when we're dealing with stormwater and this type of improvement project because you obviously are an expert at acquiring those funds through a variety of processes and I'd just like to share with our audience how you do that. Well here in Lexington we are really lucky to have a stormwater grant program that is run by the city of Lexington by the Division of Water Quality and And this particular project here has involved a number of components of that. For example, Fayette County Public Schools was able to ask for money to hire the design team to do this. Basically, the Neighborhood Association was able to ask for money to plant trees and shrubs along this particular stream. The stormwater management fee that all this is funded by also helped with constructing some stormwater management that not only is going to handle flooding, but also improves water quality in the creek. So fortunately, we have a really good source of money right here in the Water Quality Incentive Grant program that people, neighborhood associations and other groups can avail of itself. Cool. Is there three types of grants that are out there that neighborhood associations or organizations could apply for? Yeah, there's three types of grants available from the city. the biggest pot of money commercial organizations can apply for, such as apartment complexes, shopping centers, churches, schools, institutional property owners. And that has a significant budget that you can request. And we get this money every year. So, you know, you can apply once a year for this kind of funding. A second kind of funding is what we call our Class B or educational grants. And these are available for schools, for educational institutions, things along that line. And the cool thing about the educational grant is it's a direct grant that you don't have to provide matching fund for. And I'll explain what in-kind matching is later. But you don't have to, so a teacher or a school can apply for that and get money for educational materials, curriculum, activities for their students. The grants that my group gets and any neighborhood association that's incorporated in the state of Kentucky can apply for and get funding for water quality projects in their neighborhood. So that's to me that is the I shouldn't say the easiest money but but that is the most available and the the one with the fewest strings attached. We also have other grant funds that we can get through the state, through private corporations, things along that line. Essentially we've gotten funding at this location from Kentucky American Water Company. We've gotten funding from Toyota Together Green, from Ottoman, from other organizations like that to work here. There's probably not a typical water quality project, and this is a little bit of a larger one, I would think, but your typical grant size is somewhere. So you can ask for money from, well, from zero on up to, for example, for the neighborhood grants, the budget is $120,000. You can ask for up to $120,000 for a neighborhood project. Some neighborhoods have done what I would call capital construction projects, where they've gone in and fixed a creek that was eroding. They've helped with stormwater basins or with ponds on their property that they're working on. They've also done tree planting campaigns, rain garden installation, rain barrel, rainwater harvesting. Anything that you can show improves water quality or reduces flooding is eligible. And there are a few other eligibility requirements to think about. Great to know. Great to know. I've done some of these projects before, before my life in council. And I've worked with the Friends of Wolf Run. And they're an awesome organization. They do kind of help facilitate things. Give me an idea of what are the typical deadlines every year. So every year, usually it's the first Friday in May. You have to turn in your application. So, the one coming up is May 5th. By 4.30 p.m., May 5th, you have to have seven copies of your grant application into the Division of Water Quality. And you can either drop it off in person or you can mail it to them. They do need hard copies. So we're still in that? Yeah, we're still in that. And the application is not that arduous, meaning that you have to tell them what you want to do. You have to tell them what you want to use the money for. And you have to tell them what your buy-in, what your skin in the game is, because there is an in-kind or match requirement of 20%. Which is, if you've worked with grants before, 20% is, wow, that's easy. Because usually federal grants are 40% or higher. And so basically, and they will allow not only cash, in other words, if you get a bill from a contractor to do work or you buy something, you can either pay part of the bill or you can use your time as a volunteer or donated professional services or donated materials and supplies as long as it meets what we would normally pay for that in this market. So it is an easy mark to hit in terms of getting the volunteers out and engaged and having their time count towards getting funding you need to do the work you want to do. Super. If somebody wants to get a hold of Friends of Wolf Run to help, because you actually have a method of you apply. I'm just about to lose my mind, honey, honey, yeah. Mr. Clark, if I would add, we just moved our offices into the Brand Borrow House on 4th and Martin Luther. So the son that built Rose Hill, his son built Brand Borrow in 1840. We've restored the plan back to its original plan, got rid of all the bed and breakfast stuff, opened up the hallways into the original plan. But staff will go first. Good afternoon. Megan Jennings with planning staff. This application is a variance to reduce the front yard setback from 30 feet to 0 feet in order to provide a circular driveway in the front yard of a property located at 1221 Indian Mound Road. which is zoned R1C. Looking at an aerial of the vicinity, we've got some crossroads here. Cooper Road, or I'm sorry, Cooper Drive runs up here on the north side of the map. We have Romany Road cuts here, then Indian Mound Road with the subject property highlighted in red kind of comes down here parallel to Cooper Road. Cooper Drive. I keep doing that. My apologies. The subject property is a quarter of an acre in size, and it currently contains a single-family residence with a detached two-car garage. Zooming in a little bit to the property, the applicant states that the existing two-car detached garage, which is located back here, just under that tree, the garage and the driveway are not sufficient for their off-street parking means. They are proposing to pave a significant portion of the lot in front of the home in order to provide a circular driveway. They opine that the circular driveway would provide additional off-street parking in order to address their existing and anticipated additional need for parking. This is the site plan that was submitted with the application. Here you can see the proposed circular driveway. They opine that the design of the driveway and garage don't allow for enough parking for their needs or for space for their vehicles to turn around in order to prevent backing out onto the street. They also state that there is an existing fence that runs the length of the property along the driveway here that significantly restricts their ability to exit their vehicles parked along the driveway in order to get out and kind of circulate around the vehicles. Furthermore, they state that having any additional cars parked in the driveway prohibits them from easily being able to back out. They have to do some shuffling of the cars in the driveway. And they argue that the circular driveway in the front yard would provide safe and convenient off-street parking for the owners and their children. With their site plan, they did point out that they are preserving existing trees here down along the right-of-way. And they are proposing to kind of adjoin the neighboring property's curb cut, their drive aisle there. but there is a two foot distance from their property line to the pavement which is required from the zoning ordinance and they are proposing this design in order to minimize the number of curb cuts along the right-of-way as well as preserve that existing tree they are proposing an evergreen shrub hedge to kind of screen and buffer that driveway from the right-of-way and staff has received a letter of opposition from Miss Nancy Waller who's the resident here to the west of the subject property at 1213 Indian Mound Road. So I'll zoom back out here to the area to show there are some existing circular driveways and if we could have the lights dimmed just a little bit. A part of their justification the applicant stated there are some existing circular driveways, a total of four, along Indian Mound Road. There are three kind of in this immediate vicinity, right in here, and there's a fourth one further up Indian Mound Road. So they use those existing driveways as an argument for why their proposal is not out of character with the existing neighborhood. However, the proposed driveway is significantly wider than the existing driveways. the proposed driveway is 18 feet in width here, and the existing driveways are only, I think their average width is only 12 feet wide, which is just one lane kind of for the parking of the vehicles in the front yard. So the proposed design at 18 feet allows technically for two lanes of parked vehicles, while those existing driveways are really just a singular lane for additional parking. Additionally, all of the existing circular drives along Indian Mound Road were paved before additional parking areas were prohibited from being located in the front yard. The zoning ordinance was updated in October of 2022, so just last year, in order to modernize Lexington's parking regulations in a way that balances the needs of parking demand and supply while also creating a safe, walkable, sustainable, and livable community. So the existing driveways were approved before the regulations changed, and staff is not in favor of the requested variance. We don't believe that the applicant has provided sufficient justification in order to meet the requirements of Article 7 of the zoning ordinance, nor of KRS 100. There does not appear to be any special circumstances that are unique to the subject property. I'll go back really quick. I apologize. I forgot to state Indian Mound Road. It kind of dead ends here on the east side and then ends right off the map there and is not heavily trafficked and does allow for parking on both sides of the road. So staff feels that the applicant is able to meet their parking needs by parking on the street, as well as using their existing facilities of the two-car detached garage, as well as a significantly long driveway, which can hold approximately up to seven vehicles. And yes, shifting cars around is annoying, but it doesn't constitute an unnecessary hardship or really justify the need for the variance. So staff is recommending disapproval of their request, and we'd be happy to answer any questions the board may have at this time. Do we have any questions for staff before the applicant speaks? Okay. Okay. That's, is that the, That's fine. Yeah, there you go. All right. This is, looks clearer on Euro's map than that map, so this is better. Or image. This is Indian Head Mound. This is their, the Heck Martin residence right here. And Megan summarized pretty well what we were proposing, but I just wanted to make a couple of clarifications. What we're asking is very similar to what is being proposed or what exists on these three locations. Just a couple of doors down, and then there's another one down here. these may be narrower that would suit us as well we could do we we proposed 18 i i didn't think it would be a big issue but if a 12 foot driveway width is is acceptable we can work with that as well but one thing that i want to clarify is the the location of their existing garage is not under the tree it's not back here this is the neighbor's house behind them that's their garage this is his garage it's right at the back of his house and as he comes in there's nowhere to to turn around we don't have a t in the back where you can turn around or even a landing a two-car landing area it just kind of goes right off into there from the back corner of his house into the garage there's there's really no there's just enough room to kind of squeeze a second car in uh at the uh at the garage entrance and then this is pretty narrow drive between the uh between the house so he's really pretty restricted as to uh i mean obviously there's not going to be a way to pass on the on the uh existing drive and be a matter of maneuvering in and out so that would that was kind of the the the initial interest in having a circular drive you know seeing his neighbors with them uh and and the the threshold is you know will it change the character of the neighborhood regardless of the of the sequencing of the of the change in the ordinance no it's not going to change the character of the neighborhood there's there's several of them already in the neighborhood so that was our perspective that it it's not a it's not a character change it's only changed to what was recently adopted in the ordinance it's not going to you know you still have the same number of vehicles entering and exiting uh so i don't see it as as a pedestrian issue uh the the other uh uh draw for for the proposal uh that we were looking to have is bringing parking closer to his front door his parents and his wife's parents uh elderly senior the closer we can get them to the front door the better they have a hard time getting in and out of of the car and getting up to the house so in addition to the know the the young driver which kind of initiated uh the request uh the the challenge of the of the seniors coming and going as they visit uh only provided that much more of a opportunity or or an improvement uh that they could utilize the circular driveway for i have a an exhibit that that shows a narrower driveway if if that were were of interest that i could pass around but But that's pretty much the case. There's nowhere to turn around. There's no pad to park and for cars to maneuver even in and out of the garage area. It's really just you come in or you go out one at a time, and that was our interest in wanting the circular drive. Glenn, do you have anything you wanted to further add? But that's our position. Is it a hardship? Yeah, he can park probably seven cars in his driveway. We're not asking to do that. We're just asking to allow him to, you know, every time somebody comes in or out, we don't want to have to have the whole family come out and move cars. This just enables them to live their life without jockeying cars, keeping a car off the street as much as possible, just for the convenience and the security of having the designated spot and also for the benefit of the senior parents coming and going. So we appreciate your consideration of the request. Oh, and I also want to clarify the setback from 30 feet to zero feet. I'm not asking for a zero feet. I mean, you know, as shown on the sketch, on the exhibit, our parking space is 17 feet. So it's a 17-foot variance with building line, or if we reduced it, it could be as much as 25, 23 feet behind the sidewalk. so that was i didn't want that to mislead that we're not asking for the whole front yard to be paved it's it's as shown on the exhibit and can be narrower if if that would be acceptable so thank you no mr barrett just a quick moment um so you're amending the request it's not from 30 feet to zero feet it's from 30 feet to a lesser well that was how i was instructed by staff was was to make it zero because that was cleaner uh my interpretation is is where the parking is and you know we're not going to park we could park right now at zero feet in the driveway so what i'm interpreting to be the the parking area is the area that's parallel to the house which is 17 feet behind the sidewalk So, you know, the driveway, the driveway obviously goes from the street forward. So staff can clarify how they believe it to be zero feet. But I just didn't want to imply that I don't think we're asking for zero feet. I think we're asking for more like 17 feet or so. So, okay. And then I had a quick question. So just describe your thoughts on this curb cut and how you want to share it. Well, that's just where the flare of the apron is. The flare of the apron exceeds the neighbor's flare, projects over to the straight, the extension of the heck property. And we would, our flare would extend over the extension of their property. so uh it would we're not sharing any part of the driving surface it's only sharing what would be perceived as the flare the area between the sidewalk and the street so it's not a shared driveway it's just uh it's just where the flares meet at the street and just another question has the applicant spoken to the neighbor about it to miss waller they've spoke i've spoken with her she's here today she has representation so she'll uh we'll talk sure she'll have her comments as well so any other questions of the applicant i had a question um so how wide is the current driveway it's nine feet nine feet is that pretty standard for that neighborhood it is yeah thank you thank you this sir come forward hi good afternoon members of the board my name is eric eaton i'm here on behalf of nancy waller she lives at 1213 indian mound road which is the house immediately to the left of the applicant's house if you're facing it from the road The main features of the requested variance is they're applying for a semicircular driveway that at the mouth shares an entrance with my client's driveway. It buttresses into this double lane, rather large parking area type development that takes up what appears to be a significant portion of the front yard. I think the staff did an excellent job identifying how this application does not present special circumstances that are unique to this property owner or to the property itself. I think one thing that's important to remember is there's no deprivation of use being articulated. There might be a deprivation of the way they want to use the property, but that's not a deprivation of the use of the property itself, which I think is what the zoning ordinances require. I mean, the ability to park seven cars in the driveway, the ability to park it in the garage, and the recent advent of the ability to park on street addresses all the concerns raised by the applicant, such that a variance from the zoning ordinance is not necessary. So disapproving the application would not deprive them of use of the property, But on the flip side, approving the application would impair or impede my client's use of the property and that now her driveway is at least partially shared with a driveway that did not exist at the time she bought the house and that buttresses into a parking area in the front yard. as to the size of the amount of paved area in the front yard I think the application has deficiencies in that way it reduces the front yard, we're talking about of a lot that existed in the 1950s, the surrounding houses were all built in the 1950s so this is an old neighborhood that is materially reducing the amount of front yard space, I think in contravention of the zoning ordinances or the import thereof. What the application doesn't tell us is two important questions. One, does the paved area of the parking structure, is that going to be 60% or greater of the front yard space? The application as it stands now doesn't say. And I think there's also concerns as to water runoff when so much of that front yard space is paved now, particularly as it goes to be shared with my client's driveway i think there's a concern as to water runoff that's not been addressed by the application i would submit to the members that the two or three other houses in the neighborhood that do have a circular driveway the driveway is considerably smaller particularly in the parking area designed at the crest of the semicircle and the lots themselves are bigger compared to the lot of the applicant's lot and of my client. And so for those reasons, I'd ask that the board adopt the staff's recommendation and disapprove of the application. Thank you. Thank you. Good step. I just wanted to clarify two things. First, the variance request to reduce it all the way to zero. So the changes in the zoning ordinance, it is the very last bullet there on this slide. Article 16.5A states that no parking, loading, or unloading space shall be located within any required front yard or side street side yard. On the site plan, what exists today, the driveway that leads to the existing garage does not need a variance to exist. Any driveway leading to an off-street parking space is just a part of that system. The additional pavement here and this additional driveway access point on the left side of the lot, that's all requiring a variance. So that is why we need to reduce the front yard to zero to the lot line because all of this additional paving area requires the variance. So I believe Mr. Barrett was stating the distance from this parking area to the front line is 17 feet. But because there's an existing driveway leading to the off street parking, the garage, this additional curb cut on the left side of the property requires a variance. I also wanted to clarify the 60% item that Mr. Eaton brought up. The 60% lot coverage for paving in the front yard applies to paving in the required front yard. And this variance request, reducing it to zero, that reduces the required front yard to zero. That 60% to the zero front yard equals zero. So that 60% doesn't apply because we're technically getting rid of the required front yard by reducing it to zero. And then Mr. Eaton also expressed concerns about the stormwater management, water runoff. Those issues are addressed and reviewed during the paving permit process. And so the Division of Engineering would be a part of that process and would look at how the stormwater management is handled with paving. Does the board have any questions about that clarifying information? I do, if no one else does. Go ahead, Brad. I can't, if you could help clarify this. I forget sometimes infield redevelopment has different standards in other areas. And we review a lot of cases, so sometimes I can easily mistake what's permitted and what is approved by us. are they allowed to let's just forget the circleness but if it were to stop it for example where the proposed sidewalk is and it was two parking spaces is that permitted or would they have to ask for approval for that also so this property is not within the designated infill and redevelopment area okay so you feel it if there's infill and redevelopment we could park there Could you clarify exactly what? Yeah, so if you look where it says proposed sidewalk and everything to the west next to Ms. Walker was to go away, all that paved area, and it was to stop there at the proposed sidewalk where it's really just two parking places. Is that, that's not permitted anywhere? No, that would still require the variance, but you could reduce it to that 17 feet. Okay. Okay, they still need permission for that. Yes. Mr. Gross, this property is not in the infill and redevelopment area, but I think that the standard that you're referring to, that there was no parking allowed in the front yard in the infill area, that was true. But with the Zota in fall of last year, that applies throughout the community. So it applies in this location as well, even though it's not in the infill. So that now applies throughout. Okay. All right. That helps. And just so, I mean, I live next to Lafayette High School. We have a long driveway. If I don't get out there by 715, all the parking spaces are gone in front of my house. And then my wife and I have got to do the shuffle with our cars to get me out if I happen to get in. The first went in on Sunday, so I understand the circumstances that they're asking for this. So, okay, that's all I have for now. I appreciate it. I do have a quick question, a clarification. So as Brandon was kind of cutting the driveway in half, any parking that goes in the front yard, you're saying, would still require variance? Yes. But the reason we're zero here is because the drive goes all the way out. Yes. Okay. I'm with you. I still don't quite grasp why the 60% does or doesn't apply because either it is covering 60% of the front yard or not. So I think that would more apply when there's a very narrow property and a very wide driveway. That may be permitted, but that parking area with the driveway that doesn't necessarily require the variance like this existing driveway does not, If that is greater than 60%, that is a problem with the permitting. So it just catches those other properties that are kind of funky. I remember now. I did have a second question. If you don't, yeah. The second question is, my recollection, if you have a double-wide garage, you can have a double-wide driveway? So the Zoda that happened in the fall, and Autumn was a part of it, so she may chime in, It changed that wording with the responsive driveway width to the width of your garage. It is now based on your lot size and whether or not you are in the infill area. For a single family detached home, in the infill area all driveways are limited to ten feet wide. Outside of the infill area, it responds to your lot width, which, is it 40 feet wide? Any property that's smaller than 40 feet wide, you're limited to which width? You are limited to, is it 10 feet? Anything greater than 40. If you're greater than 40, it's half of your lot frontage or a maximum of 24 feet. So that particular driveway width responding to the width of your garage has changed with this soda in the fall. So is this wider than 40 feet, this lot? I think so. He doesn't have it mentioned on the site plan. 60 feet. Okay. Okay. So in theory, they could increase the width of their driveway in the front. To 24 feet. Yes. To not have the roundabout. Correct. The circular drive. Okay. So there was a path forward for them, even if they were to be denied today. All right. Thank you. Even because that 24 feet would you have to come back over. He doesn't have that from the neighbors back to the garage. Because it'd be in the front yard. Yeah, you'd be in the front yard at that point. The maximum width for a driveway for this property, which is located outside of the infill area and has a width greater than 40 feet is 24 feet wide. So they would be able to pursue a paving permit to widen their driveway to that 24 feet, even if it has to taper to that 9 feet wide back next to the house. Could you turn your mic on? Even if it's still in front of the house at 24 feet? hear a lot of thinking okay is there any other questions i'll be right over there anything else does the board need anyone else to speak or any additional questions of the applicant would you come forward sir Thank you. um this is uh the just the alternative that i was making reference to earlier where we were reducing the 18 foot uh width for two cars to pass in front of the house to to uh i think staff indicated that the other driveways that existed in the neighborhood were circular driveways were 12 feet wide and we could do a nine foot or a 12 foot wide driveway option and then also this exhibit shows a little separation a little more separation from the adjoining property from two feet to five feet so there's a little more room to distinguish or further distinguish the uh the neighbor's driveway from the proposed driveway that comes out so I just wanted to offer that as an option you know maybe maybe we just do the 24 foot straight in up to the house or or whatever but this may be equal or or not much more pavement than doing that that. So from a from a purely a volume of of coverage, it's about a wash. It enhances the opportunity or the convenience, I guess, of my neighbor or of my client. And with regard to drainage the the the front yards drain to the street we we can put a little lip on the on the driveway to make sure that it does not drain towards the adjoining property and address that but predominantly it just drains to the street the house is probably 18 inches two feet above the street level so the whole front property just drains to the street and we can manage that pretty pretty easily to prevent any runoff from going to the neighbor's property so as far as the the lot sizes they're all generally the same uh uh same size uh with the existing neighbors having the circular drive and that's all we're asking for is something similar uh to what's already been done in the neighborhood it's not changing the character quality of life in the neighborhood from what's already there so i appreciate your consideration if there's any other questions i'd be happy to help Thank you. Thank you. This is not customary, but because there's a new proposal, will you? Thank you. And that's my point, members, is we obviously haven't seen that. There's not been notice to the neighborhood, to Ms. Waller, to address that specific proposal. I think procedurally there are certain notice requirements that have to be met that haven't been met if that is to be taken under advisement by the board today. and I would request that if there is a different or new site plan that the applicant is asking the board to consider that he go through the entirety of the application process rather than submitting a new site plan today without anybody's ability to review it beforehand. Our next item is PLNBOA 23-5, Jackson's Wine and Spirits. we will let staff bring us back up to speed for this is a continuation from a previous from last it was last month yes all right good afternoon everyone daniel daniel crumb planning staff um once again this is a continuation of the item you heard last month so i'll be a little bit brief on kind of the summary here but this is a request just to refresh everyone for conditional accessory drive-through facilities for the properties located at 1406 and 1408 North Limestone. So here we have the subject properties. As I stated, fronting on North Limestone here, it is these two parcels that are kind of divided and bordered by Bolzer Avenue, North Limestone, and Bermuda Avenue. Moving in a little bit closer, you can see the current location of the current Jackson's Wine and Spirits building. This structure has now been burned and demolished, so that portion of the lot is currently vacant. The applicant brought before you last month a request for drive-thru facilities. So staff's initial recommendation for this request was disapproval, and we had several kind of issues with how this site was functioning, and essentially the way that the site functioned previously was with multiple. Sorry, Daniel. I hate to interrupt, but Donna, can you get our documents up, the new case? oh it's okay all right we're still on the voting voting screen for the last case chad's chad's glasses don't work that far so raquel push the button open up the job Thank you. Thank you. All right. Okay, so just backing up a little bit. So this is the applicant's initial proposal, one that staff had kind of some issues with the site circulation, of the pedestrian experience and just sort of how it functioned. And so this initial plan had multiple access points. So it had a two-way access, full access point to North Limestone. Bolzer Avenue also had a second access point to the side, along with the normally flowing traffic here. This configuration kind of produced a couple areas of conflict. There was the areas where the drive-through facility to the south was merged into these kind of two different directions of traffic. This would create some conflicts with the existing parking at this location, as well as introduce numerous points that would conflict with the pedestrian experience for those trying to walk down North Limestone. As sort of noted in the staff report, this is somewhat a unique situation. There has been a drive-through that has been operating at this site since the 1950s. However, it's sort of out of character with the larger region, which really doesn't have those same facilities. And so when staff evaluated this, we really looked at that kind of pedestrian experience and seeing how that could be improved. The applicant, based on kind of the conversation and the board's direction at the last meeting, really looked at the access to the site, how the site would be configured, how the site was going to interact with the pedestrian experience. And so the applicant has come back with a revised site plan, which you see before you hear, and it simplifies essentially several aspects of the proposal. So gone entirely is the access from Bolser, as was directed kind of by the board at the last meeting. It has simplified the north limestone access. So instead of a two-directional access point where we have cars coming, going, and kind of more advanced movements, it is an entrance only. So under this new proposal, traffic would enter the site strictly off of north limestone, circulate around, access the drive-through facilities to the south, and then exit onto Bermuda, the public road. In order to accommodate this, they've changed the parking on the western edge of the site to that angled parking and configured this, as I stated earlier, into a one-way direction. So this simplifies a lot of the traffic movements on site, creates a situation where there really is one main area that pedestrians would really need to cross. So it really reduces the amount of pedestrian conflict on site and simplifies the movements. Staff, when we kind of evaluated this, one comment from the meeting and from our initial report that wasn't really addressed as much in the initial application in this revision was that pedestrian activation on North Limestone. So the small area plan, the comprehensive plan calls for sort of these neighborhood activated kind of pedestrian activated buildings. But once again, the applicant's current plan shows that kind of access and door on the side of the building. So staff is recommending as a condition of approval to have a door either located on the corner of the structure here or on the north limestone kind of facade itself in order to kind of create a more pedestrian activated experience. Included in some of the other considerations was prohibitions against loudspeakers as well as some limitations on lighting to protect the experience of the residential use that's located to the south. And so with this, staff is recommending approval based on this revised staff report and revised letter of justification. Staff finds that it won't adversely affect the public health or welfare, as this significantly reduces the number of access points and makes the site circulation safer and simpler for the pedestrian traffic. It should not negatively impact the adjoining residential use, as they are providing fencing, screening, and landscaping. And then with the staff's proposed prohibition against outdoor speakers and exterior lighting, should minimize any impact on that adjoining property. And then with the inclusion of a direct pedestrian entrance to North Limestone, the structure will activate that primary streetscape and will be a little more pedestrian friendly. Finally, staff that finds that all necessary public facilities and services are available for the use. This is subject to several conditions. several of which are kind of our standard conditions versus how the site is designed has to be approved by the Division of Traffic Engineering sign-offs for the actual structure itself these are the hours of operation submitted by the applicant in their kind of initial request and really adding the new concepts of the no outdoor speakers and the outdoor lighting kind of looking at that the last two conditions they obtain all necessary permits as well as the final kind of condition of approval there, that if the Jackson's Wine and Spirits no longer operate the drive-through, the conditional use shall be considered null and void. Staff really evaluated this particular proposal through the lens of this proposed use and kind of its impacts on a drive-through versus perhaps a more intense drive-through use at this location for a different type of service. So with that, staff is recommending approval of this request, and if you have any questions of staff, I would be happy to entertain them at this time. Thank you, Daniel. Do we have any questions, staff? I've got a couple questions. Sure. So on the hours of operation, are you wedded to those, or is that just what they said, that they are currently operating? What if they decide? That was what was submitted with the application as their proposed hours of operation. But the board can restrict those as they see fit to protect the J&E properties. and then on eight um what if jackson's wine and spirits wants to sell to doug's wine and spirits the way it's written wouldn't go away automatically if they're no longer operating it yes they would yes under that as currently written okay i understand why you would want to limit it to a liquor store but I think that's a little, I think that's too narrow. If your intent is to say we don't want a Starbucks here, which may be or may not be your intent, you may not want to focus on exact users, but I think that the owner is probably, I don't know, I'm guessing 1, 2, 1, 5 for this building, and it seems like if they wanted to sell the business to a different liquor store, we may want to loosen that up. We are obviously happy with the staff's recommendation. I think, Mr. Gross, your comments on the, well, before I go there, all of the conditions, hours of operation are, again, what we proposed. The one and two, you know, the site plan is what we proposed, and we don't have any problem with two. And the hours of operation are what we proposed. We already offered no outdoor speaker systems, and so we have no problem with that. we discussed with staff and the staff raised that we have no problem directing outdoor lighting away from adjoining properties. Of course, you have to get all necessary approvals and permits in the course of constructing or developing the property. Mr. Gross, you did present, I think, an interesting issue with the last one, and you could do it, I suppose, a number of different ways if the event arose that you suggested. I might propose an or after the word facility or no longer used as a liquor store or some similar phrase there at the end. that preserves, I think, the ability for Jackson Wines and Spirits to be sold that way or some other, just preserving the use as it's being approved here today. But in general, I think if it pushed come to shove, we could live with eight, but I might propose a little clause after it that says, or otherwise, or no longer used as a liquor store operation or something to that effect. And, Michael, do we refer to these as package stores in Kentucky? Or are they just liquor stores? I can't recall. On the hot seat. I think we have package stores. Where do you think we are? I actually do not know. Okay. Brandon, if I could offer my client, who I think has certainly more experience with ABC than I do, as package stores is the reference. Were there any other questions? So I think the reason that the language is acceptable as a fallback is because it's the LLC and it's operating as a package store. but we just, you know, it has to, you know, I think there has to be some continuity or, you know, as long as it's being used as proposed in this application, that it's, you know, that the conditional use will remain in effect and force. But that's the only comment I'd have on that issue. I appreciate the time and the consideration. And we'd ask that the board adopt the staff's recommendation of approval on those conditions. So the next request on our agenda is PLN BOA 2332. This is a request by Keyhole Tattoo LLC in order to establish a tattoo parlor at the property located at 192 North Broadway. Subject property is shown here in blue. So here we have North Broadway as you head north. Second Street kind of intersects here, and it is this parcel here. So zooming in a little bit closer, you can see kind of a mix of uses in the immediate vicinity. Here we have Broadway Christian Church, the associated parking areas, a mix of kind of older established office and residential uses. This is located within a historic overlay. However, as the applicant is not proposing to make any exterior changes to the building, it doesn't really require any historic preservation review. The applicant is proposing to use 600 square feet of this existing building in order to establish a tattoo parlor use. Here we have the site plan proposed by the applicant. Once again, it's maintaining this existing footprint. So it is going to use existing space within this existing structure in order to accommodate their proposed use. So this proposed use would be comprised of four tattoo artists operating Tuesday through Saturday, 10 a.m. to 6 p.m. The applicant has indicated that they'd see approximately 10 to 12 clients a day total. There is no on-site parking provided at this location. However, the applicant has indicated that they have an agreement with the church in order to utilize some of their parking as part of this request. And also worth noting that since the changes to the parking ordinance, there is no parking requirement for the conditional uses. So they are going to operate with this existing space. They are going to utilize this kind of outside parking, and they will be utilizing the interior of the structure as is, without making any exterior modifications. Apologies. So staff is recommending approval of this request. It should not have any adverse on the subject property of the surrounding neighborhood. This neighborhood has a mixing of uses, several of which have similar or longer hours of operation than those being proposed. Should not have a negative impact on traffic. as this is expecting only 10 to 12 customers per day and are providing that parking negotiation off-site. Finally, that all necessary public services and facilities are available to serve this particular use. Staff is recommending it subject to the three conditions of approval shown on screen, that they operate in line with these submitted application materials, that they comply with any state regulations, including the health department, and as well as obtaining the necessary building permits. But we'll work mostly off of appointments and we'll have very few walk-ins. We're in a small space. This is essentially a residential area fronted by a church, which seems to be wanting to go along with it, and Milward's Funeral Home, which I know is opposed to it. I think there are tattoo parlors probably in their tattoo parlors. There's a reason that the category is excluded as a permitted use. I've gone around and observed some other tattoo parlors in the area, which seem to become sort of congregating points for people in the ink culture, which I don't think would be extremely appropriate on this particular corner. Megan Jennings with planning staff PLNBOA 23-35 Jonah Bell Farm. They are applying for a conditional use permit in order to establish a farm gift shop associated with an existing farm there at 3333 Bowman Mill Road. The existing farm, Joanna Bell Farm, is associated with the Dolphin Farm, a larger group. They own several other farms in the area. The subject property is outlined here in red. It is approximately 740 acres in size and contains several other agricultural structures. The subject property is located on the west side of Bowman Mill Road, which runs up here and connects Harrodsburg Road, which is down here off the screen, and Parker's Mill Road, which is up here. We are in the southwestern corner of Fayette County. Adjacent properties to the subject property are also all agricultural properties. since it's such a big property i zoomed in particularly to the structures and the part of the property where the gift shop is proposed jonabelle farm which is associated with godolphin currently does tours through horse country and they offer those on throughout the week and have about 20, I think they've been doing that for about 20 years. The gift shop will be open and accessible to those who are already attending the tours there on the farm. The site plan that was submitted here highlights within the existing building where the gift shop will be located. In the zoning ordinance, farm gift shops are limited to 500 square feet, and the applicant is meeting that size requirement. They state that their tours are attended by about 20 people per tour on average, and their general hours of operation are Thursday through Sunday. And the gift shop will be utilized for a half hour after each tour, or around 1130 a.m. to noon. The gift shop, which is outlined here in red, will be located within the existing client room of the farm's main office. and no additional public facilities or services will be needed for the gift shop in order to operate. There will be no new building additions, no new parking. The existing farm facilities kind of will continue to exist as is. It's just the addition of the tour attendees to be able to purchase memorabilia. They state that the primary goal of their tours is to educate and grow future fans and that the ability to acquire physical memorabilia is a great way of increasing fan engagement for those on tours. The zoning ordinance here, the first item highlights that 500 square feet limitation in size, and then the second bullet highlights that the farm gift shop is an allowable conditional use within the AR zone. So staff is recommending approval. approval we find that the use is comparable for the area and the limited scale and size of operations will not negatively affect the subject or surrounding properties the zoning ordinance does not allow for additional signage for the gift shop along the right of way or the public road within the site they can have signs but that limitation is in order to minimize attracting more of the general public to the site and increasing the traffic impact in the area. We have submitted the following four conditions of approval, fairly standard conditions. We do clarify that the gift shop shall only sell farm or industry memorabilia, so they won't be expanding to other goods or services like food or coffee shop, that kind of thing. And then, of course, we list the no signage and they will have to acquire a zoning compliance permit in order to operate as well as potentially other permits with planning or building inspection is there any questions i'd be happy to help the board thank you does the board have any questions of staff okay thank you very thorough thank you and the applicant My name is Jim Cox. This application is a request to amend an existing conditional use permit in order to allow for drive through facility, there's an existing conditional use permit for drive through facilities. They are requesting to amend conditions which prohibit menu board, speaker and microphone devices on a property at 115 Southland Drive which is zoned B1. This map kind of shows the general vicinity of the area. Southland Drive cuts through the map down here on the bottom and Nicholasville Road cuts here just to the right of the subject property highlighted here in red. Back in 2019, this case came before the board and was approved for the existing conditional use permit for drive-through facilities. That case was PLNBOA 19-2. And the structure that exists there today and the existing lot layout are results of that 2019 boa approval currently the property is around a half acre in size and contains a 2500 square foot restaurant with a drive-through window they do not have a separate ordering point currently the subject property has frontage there on southland drive as well as a 30-foot access easement to the rear here for collins lane which is a public road the shell gas station is is located immediately to the right of the subject property and is at the corner of southland drive and nicholasville road and immediately to the west of the subject property is another retail structure with two separate restaurants tzatziki's and columbia express in their 2019 approval the The applicant was not even proposing a separate menu point and ordering point menu board and speakers. And so the applicant is coming in front of you today to request that those accessory uses to the drive through facility be allowed. The applicant does have a new tenant lined up. It is currently a LaRosa's pizza and the new tenant is a coffee and beverage shop, which they're interested in the property and need the separate ordering point with menu board and accessories. Oh, I hit the wrong button. There we go. So the, I zoomed in here just a little bit closer to the subject property. The applicant opines that the change in the user from the La Rosa's Pizza to a coffee and beverage shop, which will have minimal food provided, will allow minimal wait times and associated queuing. So they opine that the stacking won't be an issue. And they also state that the new user will operate between 6 a.m. and 6 p.m. with an expected 25 to 30 customers per hour or about 400 customers per day. They don't anticipate this volume to be constant and expects them to kind of ebb and flow similar to other service industry uses. And while drive-through facilities are not especially common along Southland Drive, there are a few in the area located along the Southland Drive corridor, including Donut Days, which is just to the west, Taco Tico, and as well as Central Bank. There was a case last year at 269 Southland Drive, which is slightly farther down the road, the board approved a conditional use permit for drive-thru facilities associated with a Little Caesars restaurant. Although that use has yet to be established, it was approved in June of 2022. So they are still within their one year kind of expiration time for conditional uses. This is the site plan that the applicant has submitted with their application. It's kind of been through a few different revisions, but this is the final one that we have reviewed and recommended approval of as you can see they're they're changing the parking layout just a little bit and i do in order to fit it better on the screen i did rotate it but just to reorient southland drive is here with the collins lane access easement on the rear here the building is staying the same they're not changing anything with the building but in order to accommodate the stacking they are kind of reorganizing some of of the parking here on this eastern property line currently this is where their pickup window is and they are proposing to add an ordering point here so they have illustrated on this site plan that they're meeting the five car stacking which starts here at the car behind the one currently placing the order so they are able to meet the five car stacking requirement per the zoning ordinance and along with kind of this reconfiguration of this area they're allowing for a bypass lane here between the parallel parking spots and the drive-through stacking so that customers who are coming to the site and want to come into the restaurant to pick up their order rather than go through the drive-through lane they're able to park at the parking spaces and then be able to exit the property out to collins lane without having to go through the drive-through lane. In order to prohibit some drive-through stacking conflicts off of Collins Lane, since the drive-through is kind of located back here on the rear of the property, they are extending a curb out to reduce this width to a total of 14 feet. So that is going to prohibit vehicles from Collins Lane to be able to turn into the property and make that angle to come into the drive-through lane. So in order to access the drive through, anyone on Collins Lane will have to come down farther past the property, come back to kind of an access drive here along the front, and then turn into the property. Oh, that's where the access drive is. Turn into the property and then stack accordingly so that there aren't conflicts back on Collins Lane. Along with this, they are also proposing to relocate the dumpster. It was previously on the back corner here. And in order to accommodate or fit that bypass lane, they're moving it up to the front of the property. It is not right up on the Southland Drive right of way. So staff does not believe that the relocation of that dumpster will negatively impact the pedestrian experience. And there are two parking spaces here which are existing that will kind of buffer that dumpster use from the pedestrians on the sidewalk. With that, staff is recommending approval. That past slide with the zoning ordinance just listed the use as a conditional use and then also details out that five car stacking requirement. So we are recommending approval. The drive through use itself has existed on this property for many years and has functioned well. with the change of use and the expected kind of customer volume they're able to meet their stacking requirements staff doesn't have concerns with the use as proposed in addition the separate ordering point with the menu board the amplified speaker and microphone devices shouldn't negatively impact the subject property or the surrounding properties as the closest residential dwelling unit is over 300 feet away so staff does not believe that that addition of those facilities will be create a nuisance for that area we have the following four conditions of approval and we did specifically date since the site plan has gone through some revisions the one that we presented today which is dated april 25th 2023 wanted to specify that in our conditions. And then we do list out that there shall be an interior kind of ordering and pickup space for customers so that it kind of meets the zoning requirements of what the definition of a restaurant with drive-thru accessory drive-thru is. And then, of course, the parking reconfiguration will need to be reviewed and approved by the Division of Traffic Engineering. And then, of course, all necessary permits and approvals shall be obtained from planning, building inspection, and engineering. If the board has any questions, I'd be happy to answer them. Thank you. I won't belabor the points. I think it's a pretty straightforward project. We were here in 2019 and requested the conditional use permit and were granted that request. At that time, we did not ask for the speaker system to really operate as a drive-through. with the intended change in use we do anticipate or are requesting that that be allowed now. We can tell you it's not a Starbucks, so that's not going to be the issue. As far as the neighborhoods, I think if you look at the Little Caesars application, their closest resident was about, I think, about 50 or 100 feet away. We're more than 300 feet from the closest residence. You have to cross that entire parking lot that's associated with the hotel there. And if you look at the site plan, if you could pull up the color rendering. Obviously with all drive through scenarios, always concerned about the queuing issues and the conflict points. And so to try and alleviate those issues working through with staff, as they said, we've extended that curve out of Collins Lane, so that will be exit only. that nobody is trying to come in that way and sneak into the drive through line. And we've also created the extra exit lane. So if you look at the last picture there that shows the parking today, it's diagonal pull in parking on what should be the top side of this rendering. And so by moving those to parallel points that allows for the cars to be able to get in and out without blocking people that are parked in those parking spots. And so we think with the queuing and everything lined up this way, it will reduce any type of friction they have at entrance and exit points, as well as people that are entering the store and leaving won't be hung up by the line for the drive-thru. The numbers, as far as the users, 24 to 40 per hour may seem high, but in reality that's only about four or five more vehicles per hour than what LaRosa's is currently doing. so we don't think this will have any drastic impact on the area. For those reasons, we'd ask that you accept the recommendation of approval by staff, and we're happy to answer any questions. Thank you. I learned last year you make me take this off, so I'll just do it ahead of time. My name is Tenley Terrier, and I live at 99 Goodrich Avenue. And my concern is I'm glad it's not at Starbucks. I mean, not that Starbucks is not a great place, but it's really hard. I live there. I drive on Southland. I walk on Southland. I never see hardly anybody at La Rosa's. There's not even anybody in my neighborhood that really goes there very much. So it's really hard for me to imagine there's 25 to 40 cars coming in there. Probably once a week, if not more often, there's an accident at Southland and Nicholasville, Southland and Goodrich, Southland and you name it. Or Nicholasville and you name it. I mean, it's like I go outside to walk my dog and crash. And there goes the ambulances, there goes the intersection, everything's blocked. To have more people in that area, I know you're going to approve it anyhow, but I still want to say I think it's really going to cause even more traffic problems. Southland is so much more congested than it was five years ago. It's really hard to get out. and the number of people coming off Collins Lane, whether they're Hampton Inn or wherever they're coming through, that you watch them turn left across four lanes of Nicholasville Road, and everybody stops and prays that they're not going to smack into somebody. I'm really concerned about the traffic. The speaker, I get it, but the traffic and the number of people coming, I really have a problem with it. Thank you. Thank you. Thank you for your time. The neighborhood did kind of reach out to me about this because I believe when LaRosa's originally went in, And it was okay to have the drive through and they managed to not get the speaker outside for that drive through. So there's a concern that I guess now we're going to remove that restriction and understand that it could be a different use. It could also not be a different use. Could be still LaRosa's. So I guess my question is, when I've gone back to that area, probably it is fairly far from the neighbors back there. There's a hotel between them. But the reality is that the speaker is in the back of the building. And my only thought would be if the speaker, if you looked at the picture of it, was along the opposite side of the building with the menu board, it probably like that just faces the gas station it may have less it may be less obstructive for the neighbors and i would just ask you to take the neighbors desires into account since originally you had said not to put a speaker there so that's it i appreciate your help thank you sir As far as the traffic goes, we're not changing the way that the site operates today. We're not changing the Southland Drive entrance point in any way. We're keeping it the same, and we think we're actually improving this lot in the Collins Lane issue by eliminating in and out on that entrance point and having it being only an exit. As far as the conditions that were originally placed on it, I went back and watched the hearing from that in 2019, And first, there was no request for the speaker at that time. So there was no request on behalf of the applicant. And it was simply a staff recommendation of conditions per their staff report. There wasn't a hearing on the matter. There wasn't a discussion. It was simply an acceptance of the conditions at that time by Mr. Murphy. Thank you. Real quick, Scott, I don't think you could put the menu board on the... You automatically adjust. You don't adjust it. It's like machine operated. It can tell how loud things are. It's AI. It's AI. It's coming for you, Mr. Clark. And one other piece we could add is a little bit of landscape buffering here. personally i'm okay with the sign menu board where it's located but if we wanted to if we were concerned about air noise pollutions i'm trying to think of some easy practical solutions to maybe mitigate that a little bit without the applicant having to do a whole lot i will say i think that the traffic from Nicholasville Road with this location being closed at 9 p.m. I think traffic on Nicholasville will likely drown out any sound from the speaker and I'm also comfortable with the distance from the residents so I don't want to be overly prohibitive it's not even you know if we're over 300 feet from the nearest residents and not that not that way closer I don't think there were any similar limitations on the Little Caesars and I would it much closer to the residents back there.
