The first item on our agenda today is a request by UCD Midland LLC, and this is to rezone the property at 610 Winchester Road. The applicant is seeking to change the current zoning of the property, light industrial I-1, to a downtown frame business B2A zone. The applicant is seeking this in order to expand a mixed-use residential and commercial development. A little over a year ago, there was a request to rezone the adjoining parcel to B2A that was granted, and so this is really just expanding and building upon that same project that you all reviewed in the past year. The applicant, in their justification, has identified this as a place type of a downtown and a development type of a high-density non-residential mixed-use. Staff agrees with both the choice and place type and development type. So just to orient everyone to the location of the property, the subject property is shown in white in the center of the screen. This is Midland Avenue as it heads out of town. The subject property is located right at the bend where it transitions into Winchester Road. I'm going to zoom in a little bit to give everyone a little bit better idea of how that geography works in this area. So once again, we have the subject property shown in white. And then the adjoining piece here with the pinkish B2A zoning is the cutstone development, the UCD rezoning that took place about a year ago for multifamily residential development. This section of Winchester Road historically was more of an industrial area, so industrial and warehouse uses. However, as there's been shifts in those industries, the area has began to change. So in the immediate vicinity, we've got along National Avenue here, the adaptive reuse development and the commercialization of that area. We have the adjoining across the road on Midland here, the Met, which was rezoned to B2A in order to accommodate multifamily mixed-use development. There are some areas of existing residential. There are townhomes that are located to the rear of the subject property across the old railroad right-of-way, as well as several existing areas of single-family residential further up East 3rd Street and within the Bellcourt neighborhood and further down Walton Avenue. The applicant has made significant outreach toward the adjoining neighborhoods, having conversations with the Mintel neighborhood, the William Wells Brown, the adjoining townhomes, as well as Bellcourt. Staff was present at those meetings, and they were generally supportive of the projects and had some questions and concerns over traffic and safety on Midland Avenue. But the zoning of the property is currently zoned I-1. They're seeking the same B2A in order to incorporate it with the rest of the development. The development of the property as it stands today is primarily a single-story industrial structure. It would be removed and incorporated into a larger development. You can see once again townhomes in the vicinity, single-family residential, as well as residential development further down. Here is a view of the subject property, and this is taken from Winchester Road, so the existing structure being used for storage and parking. This is the view on Winchester Road as you're headed out of town. The intersection, the subject property also has frontage on Owens, which is a local road there, but that's the nature of Winchester Road as you're heading out. Looking in the opposite direction, you've got Midland as it transitions, as well as Third Street. Here the Town Branch Commons ends at this part, and then there is a crosswalk here. There's planned trail connections that are planned to be made further out that will incorporate into the Liberty Trail. So here we have a rendering that shows the rough development of the property. As always, Mr. Martin will be on after me to go over some of the specifics of the development plan. You have on Granicus as well a non-color-up version if you'd like to get some additional detail. But the bulk of this development is similar to what we saw in the previous rezoning request. So we have two sets of structures here with a total of five stories, the first being first floor parking that is then four floors of residential above. As far as a unit count, this is essentially adding this portion of the development here. So this was existing or was previously approved under the first preliminary development plan. This is adding this general chunk here. So this allows them to increase their unit count from 182 to 266, as well as provide corresponding parking in that area as well. It also helps reinforce the streetscape along Winchester a little bit more effectively, so it's additional building with much of the same plan as the rest of the development. First floor parking with residential on top. There are planned amenities with this, a small amount of commercial space that will be located at the corner here. It has been relocated to face the street based on some comments that the planning commission committees provided to the applicant. They are also proposing a trail type network that will run along the edge of the roadway and connect in the future to planned improvements further down that will become part of the Liberty Trail in the future. So they've got activated open space with benches, bike parking, other amenities, landscaping that has helped reinforce the streetscape and provide a superior pedestrian experience. Access is going to be derived from Midland with a refined access point located there as well. So parking underneath these structures, parking located to the rear, but really it's structures and additional housing units that are going to be activating this frontage moving forward. The applicant has provided some renderings to give you an understanding of kind of how this is going to flow and develop and to show how they're meeting the multifamily design standards. Once again, reinforcing the roadways, providing kind of a variety in materials, surfaces, and treatments to avoid kind of a blank, monotonous facade. They are going to be using glass openings and landscaping to ensure that that first floor is meeting ordinance requirements as far as articulation and making sure that that is engaging. Here we have a view, basically this would be at sort of the bend. So this is as Midland is transitioning into Winchester. You've got open space. You've got the trail facilities here, as well as some connections to these existing pedestrian networks and crossings that would take you to the Town Branch Commons. Here's a view going a little bit further down Winchester. So once again, you're seeing balconies. You're seeing some articulation that's called for within the multifamily design standards. And really just trying to bring eyes on the street and an engagement on both road frontages. This would be the tail end of the development of the property. So this here would be the Owen Street access and then the frontage corresponding there. Once again, first floor parking, residential above, buffered with landscaping and glass. Once again, as we stated earlier in the presentation, we are in agreement with the downtown place type. It's what they applied for previously with the rezoning on the adjoining piece. And that the development with five stories of residential, or the four stories of residential parking structure and small amount of commercial is firmly within what's recommended for that place type and development type. With regard to the multifamily design standards, we've got a number of them shown up on screen, but really we're looking at reinforcing the streetscape, creating visual interest, providing connections, and having pedestrian connectivity, all which are being met. From an open space perspective, this is adding additional green space, additional tree canopy, is using those landscaping elements to help delineate the streetscape and provide a better pedestrian experience. Architecturally, they're using kind of a variety of materials, different setbacks on the building facade itself, and some other elements to create interest with architectural design. There were comments at the zoning committee about ways that they can sort of better incorporate the frontage in order to create more visual interest. The applicants kind of since that comment have revised their plan somewhat, adding additional architectural detail, moving bike parking and other commercial entities further forward towards the street, while also being aware that the design of the building is largely dictated by this parking that's being provided on the first floor. So to efficiently use that parking, their ability to accommodate first floor units is a little bit more limited than under a normal set of circumstances. But staff finds that they meet all of those components of the multifamily design standards. We're recommending approval for this request. We find it's an agreement with the comprehensive plan's goals and objectives, talking about expanding housing choices, reinforcing corridors, prioritizing multimodal options. We find that it's an agreement with the policies of the plan for many of the same reasons. It's meeting the multifamily design standards. It's incorporating structured parking, providing this higher density residential development that our town has said is an emphasis for them. We find in its agreement with the policies and development criteria that talk about land use, transportation and pedestrian connectivity, environmental sustainability, site design, and building forms. So we find that it's meeting the criteria for all of those associated actions. As always, staff makes this recommendation subject to the approval of the Correspondent Development Plan that Mr. Martin will be on to talk about briefly. But at this time, I'd be happy to take any questions you have of staff. Staff is recommending approval. Thank you. Do we have any questions for staff at this moment? I'm not seeing it. Mr. Chairman, members of the Planning Commission, the preliminary development plan with this on changes on page four of your agenda, item B, and we have distributed to you some revised conditions on this particular plan and again I would reiterate that it is a preliminary development plan you will see this again as a final development plan I was checking to see if we had the non-colored up version as well but so again as daniel explained here's midland avenue transitions into winchester and here we have the area that is subject to the zone change again this was previously approved the the two buildings combined are going to be over 337 000 square feet they are four residential stories above the parking deck As Daniel stated, there will be a total of 266 dwelling units and there are 274 parking space being provided. As you can see, these are both external and in this color up you can't see but there's an internal layout where there's parking in the deck below the apartments, below the residential stories. There was considerable discussion when this plan came back in about meeting certain requirements under Article 16 and VUA, and that was particularly this access through here. They are going to access Midland. At this location, it's slightly offset. That has been approved. It's subject to discussions with District 7 as well on how that access might impact traffic flow along Midland Avenue. Daniel already pointed out the considerable green space along that area, But they revised the plan just to show their access into the site and into the rear parking, which will then also be able to access Owen and then out to Winchester Road. They've added a little bit of parking in this area. The way the VUA requirement works is relative to the front of buildings. and those the front of buildings the side of the rear those wall planes are are very specifically defined in your ordinance so we worked with them and here's the front for building a and you can kind of draw a line down through here this is the side relative to building b and again as close as they seem you got to look at the street and how they're oriented and the ordinance has very specific definitions to define those those yards so they made this change to the plan staff is confident they can meet that requirement at this point this is the dog park it was over here on a previous plan they've moved it here in this little area of green space closer to the building I think that's so people can throw dog treats out their windows I have a baby dog now. I'm obsessed with dog treats and baby. But here, interesting, in Article 16 activation, and that was discussed at the committee, particularly the zoning committee, how to activate that parking space. Now, staff had exhibits, and staff had worked with them, and staff was confident they were meeting the ordinance and they were activating that space. However, due to some concerns they expressed at the zoning committee in particular, they have made some revisions that they're going to share with you to break that facade along Winchester up a little more and give it some more articulation. They have 82 parking spaces. Two areas are located in the buildings, and these are long-term parking space areas, which is good. And then they have some on the exterior of the building that are short-term parking. That's quite a few bicycle parking spaces. We generally don't have developers offer quite that many on a development, even one of this size. So again, they're trying to emphasize parking and pedestrian. As Daniel mentioned, they have a good sidewalk system internal through here with connections. And then out of the site, one change we're going to have to make for Article 16. and again this is relative to the parking garage they have access into the parking garage from the ground level pedestrian access article 16 actually requires that that be to the right-of-way so they're going to have to add a door pedestrian access from the right-of-way frontage into their parking garage that would be one more item just to ensure compliance with article 16 that they will need to do with that staff is recommending approval of this revised plan to you and be happy to answer any questions you may have okay thank you mr. Martin have done an excellent job presenting this as you recall we were here in april i believe of last year and the majority of this project was unanimously approved this zone change and revision has come about as you heard as the applicant was able to acquire additional property to expand this development they've made the appropriate changes in design and need the approval of the zone change for the additional property to go along with the project we agree with their interpretation and their summary of this project and we agree with the conditions other than that if you have any questions we're here to answer those thank you Thank you, Mr. Mayor. But we'll get to that point. Is that why? All right. Daniel Crum, planning staff. So the second item on our agenda here is a request by Pizza Pios, LLC. This is to rezone the properties at 469 and 471 Jefferson Street. This is once again changing from a light industrial I-1 zone to a neighborhood business B-1 zone. The applicant is seeking this rezoning in order to utilize the existing building that's on the property for a restaurant use. Staff agrees with their choice in place type and development type based on its location relative to the surrounding neighborhoods. So here we have the subject property. I'm just going to go ahead and zoom in so we can actually see. But two small parcels located on Jefferson Street as you head out. Here we have the intersection with Fifth Street. You'll see, based on that purplish-pink color, that the zoning in this area, a large amount of I-1. However, these are not actually I-1 uses. So when we look at the aerial photographs in a second, you'll see what I mean. But essentially, the only existing industrial building is this warehouse space that's located to the southwest. That's used and owned by Transylvania University. However, the other purple you're seeing in the vicinity either is a church use, residential, or a vacant lot. The surrounding area also has a mix of R3 and R4. So once again, the existing residential area with some former industrial components, they are seeking to better utilize the site. So here you can see how the area is actually laid out. Once again, the two subject properties located right there at the corner, existing residential development, a church use, as well as some recreational fields, and then the lone sort of warehouse structure on Jefferson Street there. There's also connections to a trail located slightly across West Fifth Street there. So this is once again close proximity to residential neighborhoods and has more applicability as a neighborhood business use rather than a small industrial use. Here is a view of the structure. So once again, it is two parcels. The first parcel has the existing structure. This has been several things over its lifetime, none of which were actually industrial uses. So it's been a liquor store. It's been a place of religious assembly. Most recently, it was a coffee shop. However, in order to accommodate this restaurant use, requires the rezoning. The adjoining parcel here is historically served as sort of the parking areas of the VUA for the adjoining parcel. Once again, this had a single-family residence, but it was demolished back in the late 60s, so it's been vacant since. They're wanting to utilize this structure in order to accommodate a pizza parlor restaurant. So this is the view of Jefferson as you're looking back towards town, Tulane, existing residential neighborhood, existing warehouse building. Looking the opposite direction, you see residential as well as the church and associated parking for it. and here you have a view of the rear of the structure so once again structure is here and then this is the the entrance to the the comprehensive trail network that extends further out the site plan for the property is much of what you see existing the the biggest change really is in the nature of the vehicular use area they are taking what was previously parking and impervious pavement and are utilizing it for outdoor dining and patio space They will also be adding some additional landscaping around the perimeter of their property there, additional plantings. Once again, Mr. Martin will be able to go over this in a little bit more detail, but much of the same building, but just accommodating a new use and taking the emphasis away from vehicular travel a little bit by removing the on-street parking. Once again, when we're talking about place builder, this is an existing neighborhood. This is providing an additional commercial component, a walkable restaurant use that will be appealing to the neighborhood. So the applicant's choice for place type and development type and zone all are agreed upon by staff. Staff is recommending approval of this request. We find that the zone's in agreement with the comprehensive plans, goals, and objectives, neighborhood scale uses that are walkable and are going to activate the street frontage and the streetscape a little bit better by providing these outdoor dining options. We financed an agreement with the comprehensive plan's policies, many of the same reasons. Reexisting or utilizing these existing structures for a more beneficial use, providing that use in a walkable type scenario with extreme amounts of connectivity to the surrounding area. We financed an agreement with the development criteria of the comprehensive plan, speaking to land use, transportation connectivity, environmental sustainability, site design, and building forms. So we found that it meets the relevant design criteria and development criteria for a neighborhood scale use in an existing neighborhood. And we recommend approval subject to the approval of the corresponding development plan that Mr. Martin will be here to talk about in a moment. So staff is recommending approval, and I'd be happy to entertain any questions that you have with staff. Thank you. Any questions for staff? I see any. Thank you, sir. Mr. Martin? Mr. Chairman, members of the Planning Commission, the development plan for this particular zone change starts at the bottom of page 5, with the conditions continuing at the top of page 6. Now, this is a final development plan that you see before you today. And the reason simply for that is I think Daniel made clear. I still instinctively turned back this way. Don't have to do that anymore. Again, as Daniel showed you with this development plan, this is the existing building, 800 square feet. It's not changing. It's not being modified. They're going to utilize that existing structure. The patio area is where they did have parking. So, again, that parking is going to go away. They're going to have a patio in that area, along with additional landscaping, which will certainly help the site as they buffer this area. There's an existing tree. They're going to add some trees. You can see the bike parking that they're proposing at that location. And, again, this is one of those final development plans where they're changing the site somewhat, but they're not really doing anything to the building. and they're just again utilizing the site somewhat differently than they have in the past. With that, staff and your subdivision committee has recommended approval of this plan to you and we'll be happy to answer any questions you may have. Excuse me, I just thought of something, Mr. Wilson, I wanted to add very quickly, and that's as much for people we have that are interested. This is a non-conforming structure based on the setback. So it would be very unlikely in the future should this become wildly successful and there be just a huge demand and people flocking there. They would have to overcome that challenge of a non-conforming use in the zone on the building. So, again. Well, Mr. Chairman, my question. I did have one other clarification, though. On number conditions, number 12, do we need that one? Division of Fire and Water Control? Oh, it says discuss place builder criteria. Oh, I'm sorry, number 12. Yes, you can remove that. That has been discussed. The reason I mentioned number seven, I believe the applicant had expressed some concern about having that removed, that condition, because fire did not have any concerns at technical committee.
