But we have a property across the street that the next plan, which is a secure justice, was CC also. And it took a little while for them to get the residential component to that CC area, too. So it's been tough to, I don't think they can develop any more of this property, because unless they do the residential component per the zoning ordinance. Okay. I'm just going to confirm that is, that's my understanding as well, that the entire parcel of the CC has a residential component. And sub-parcels can be developed before the residential component is completed. Is that correct? And so that's kind of what happened here. So you can see that the whole portion to the right has all been developed in commercial. So we just have that small sliver that runs along, there's a stream that goes along, and that's the last bit of the overall piece of property for this area. I'm not sure, I don't have my ordinance with me right now. But they just, it's still preliminary. They haven't asked for a final development plan on it yet, because they're not, they don't have anybody that's interested in it. So it's- Matt, what I'm hearing from you is there's not gonna be a residential in this component, in this one at all. Not in the, it's always been kind of planned to be in that lot. Okay. So, yes. This is the request today by D&J Realty, and it's to rezone the property at 125 Cane Break from an interchange service business B5P zone to a light industrial I1 zone. The property itself is approximately 0.99 acres in size, and the applicant is seeking this rezoning in order to establish a recreational vehicle storage use. Within the bounds of place builder, the applicant has identified this as an industry and production center, kind of citing its proximity to the blue sky industry area. And as a result, is choosing an industrial and production development type. Staff is in agreement with both the place type and development type designations. So here, we have the subject property, a somewhat irregularly triangular shaped piece that is located on Cane Break Drive. Here we have Athens Boonesboro, kind of cutting diagonally across the screen here. Vertically, we have the interstate. So this is really the portion north of the interstate that is included within what was formerly the Blue Sky Rural Activity Center until it was brought into the urban services area with the recent master plan. Zooming in a little bit closer, you can see the zoning of the surrounding parcels. So this line here essentially was the boundary of the urban service area prior to that expansion. And so coincidentally, we have AR zoning to the north. Across to the right side of the screen here is a block of industrial zoning, light industrial. That is what the applicant is seeking today. This orangish color was established around the 1970s, that B5P, and is really oriented towards businesses that are serving the interstate traveling public. So it is a very limited zone, allows for sort of gas stations, convenience stores, hotels. But otherwise, it's fairly limited in its other applications. And so the applicant is seeking to change the zoning of the property in order to establish this storage use. Here we have aerial views of the subject property in the surrounding area as it exists today. Once again, we have sort of the more intensely developed blue sky area here. We have hotel uses here and here. This is an adult entertainment use, and then we have more commercial uses to the west. The soccer stadium that was approved within the last couple years would be located across the interstate here on the southwest portion. So this is the piece that heads into Canebrake Drive. So further up Canebrake is kind of a mixture of some agriculturally zoned lots, kind of large lot residential, ten acre lots, AR and AB zoning. But in the future, that is proposed to be incorporated within the master planning efforts as well. Just noting that the Blue Sky Center is subject to its own small area plan that is kind of coming down the line. And it's going to be looking at those land uses as well. Really the areas that you see on sort of the right hand side of the screen with respect to sort of how they were contemplated during the urban growth master plan. Were set aside because they were sort of so different than the greenfield development occurring elsewhere. So that'll be coming later on down the pipe. But this particular property along with the other properties in the area have land use recommendations within that plan. So here we have some pictures of the site as exists today. We've got Canebrake on the right hand side of the screen that comes around here. No existing sidewalk infrastructure, it does have some old street trees. This area here is this lower topography that is a drainage basin that serves multiple developments there. That would remain, and it looks like the trees that were present on the property were fairly removed with some time within the past year or so. Our understanding this was prior to the applicant obtaining the property. Here we have the view once again. This is Canebrake as you're looking out towards Athens Boonesboro Road. We have the hotel uses sitting at a slightly higher elevation here. And this is the view once again heading towards the residential and agricultural component of Canebrake. So the regulating plan for area five, this is the property is located at the location shown on that star. That light bluish purplish color denotes areas that were intended as sort of flex industrial space. And really a lot of the land in this area was designated as such with some higher density residential mapped out. But really as an area that more industrialized uses could potentially locate. A lot of the areas included within the urban growth master plan outside of this were more residentially focused. Focusing kind of more of those town center kind of typologies. Here was really taking advantage of the infrastructure with Athens Boonesboro, with the interstate to try to locate some of that industrial space as the applicant is sort of requesting with this request. Once again, the area five plan allots approximately 60 acres of this flex space and light industrial land, which is in keeping with what the applicant is requesting. Once again, speaking to kind of providing connectivity to what's planned as mainly residential further north. But otherwise, the applicant's request is in keeping with what the urban growth master plan kind of predicted for this area. Once again, just kind of pointing out the connectivity. So, area five is where we're located here, but it is sort of serving as a gateway of sorts that is opening up to area four. So, Cane Break and the subject property would be located here. A little bit of a transition of, once again, those flex industrial uses that would then flow into the rest of area four and its potential connections interfacing further north. So, once again, this is sort of the very first step in kind of larger plans to potentially develop these areas. So, in a change from kind of our standard formatting, Chris Chaney will be on momentarily to discuss the development plan, so we're just going to speak to the zoning items. The applicant's request, generally speaking, is in agreement with the comprehensive plans, goals, and objectives. That's outlined in the updated staff report after the applicant provided a greater justification. But really, we're talking about utilizing a underutilized piece of land in order to kind of provide additional jobs production ability in this location. So, once again, an area that, due to its location along a major corridor, as well as the interstate, is appropriate for some of those industrial type uses. So, once again, it's in compliance with those goals and objectives, matching the industrialized context of that adjoining blue sky area. The applicant will be providing some sidewalk connections with this. One of the changes that is necessary in order to get it certified will be extending those connections from the right of way into the plan. Those are part of the standard sign offs for any plan, it's a zoning ordinance requirement. But once again, it's going to be kind of expanding that sidewalk network where it's not currently present. The applicant has indicated that this will not be constantly lit. So, as it's a storage place for recreational vehicles, it's going to be somewhat infrequently accessed. And it will sort of be operating on a motion sensor based use. So, once again, contributing to sort of not over lighting and managing kind of the dark sky effect in the area. We found it was in agreement with the urban growth master plan, which is an adopted element of the comprehensive plan, which recommends this area for flex or industrial land uses. And is sort of serving as an additional piece that's going to be the foundation of a pedestrian network that will extend to the north that can connect with the residential development, as well as future commercial development planned there. Staff, in our review of the site, found it meets the criteria for land use, as it's establishing this new industrial land use next to existing land uses. And is utilizing a piece of land that, since the 1970s when this was rezoned, really hasn't had a former function there. Once again, meeting the transportation and connectivity criteria, they're proposing new street trees to kind of supplement what is existing, extending the sidewalk network. As far as the environmental criteria, this is not impacting any environmentally sensitive areas. It's once again limiting that lighting and its potential impact. We found it met the site design criteria, as they are actually not providing any on-site parking and are going to be required to extend that site network internally. So once again, the criteria for the industrial place type are somewhat limited compared to some of the other criteria that we look at for most commercial and residential development. It really is sort of a function-based system there. And then there are no applicable building form criteria that would apply to this particular project. So in kind of holistic review, staff is recommending approval based on the updated justification and the information provided. As always, it's subject to the approval and certification of the corresponding development plan that Mr. Cheney will be on momentarily to discuss in more detail. This is the development plan in conjunction with the map amendment request. On your screen, this is Kane Break, Athens Boonesboro is down in this area. And the interstates off to the left, let me see. The applicants indicating a 5,800 square foot single story structure here for the storage of large recreational vehicles with the access coming in at the northern portion of the property on an access drive into a large paved area for circulation turnaround for the vehicles. He indicates there will be a dump station for the vehicles there. And then, as Mr. Crum indicated, there will be a sidewalk connection and street trees along Kane Break. And then, I believe the applicant had stated he wants to improve the retention basin as part of the reason for the initial submittal. We are recommending approval subject to the following revised conditions. There are six standard sign-offs. And then, depict parking per Article 16 of the zoning ordinance. Depict sidewalk facilities extending to proposed structure from the right-of-way. And then, the place builder criteria, which Mr. Crum's covered. There's been some discussion about the parking and the need to indicate some parking on the property. The applicant basically stated that the vehicles are just going to come and go and be stored inside the building, and so there shouldn't be any exterior parking. So we've just had some discussion back and forth about that. But that's why we still have that condition on there to depict some parking. And with that, I'll turn it over if you all have any questions for me. Okay, we don't, are you going to say it, or do you want me to say it? We don't have this plan uploaded either. When we talk, we usually are talking in terms of parking lots with the landscape and parking requirements of the vehicular use areas. What are the implications to showing parking or not showing parking according to the ordinance and as far as the design would go? Well, from staff's standpoint. Let's say that this is, I mean, I'm just speaking from a practical perspective. Of course, people are going to park in the area outside the building. It's logical. I mean, the idea that no one is going to is illogical. So, assuming you depict it or not depict it, I'm not sure that I have a strong opinion about that just personally. But I'm curious what the implications of depicting it do to the requirements. So, I can speak to some of that. So, whether or not it's a parking area, whether it's a drive aisle, a circulation area, as you're being shown there, it's still going to be subject to the vehicular. It's vehicular use area regardless. So, as far as the amount of landscaping that needs to be provided, the amount of any internal, external screening, etc. That is all going to be present, kind of agnostic of whether or not there's a demarcated space. I think part of that discussion was just how the site would flow and function. Making sure there wasn't any conflict points or with that. It's my understanding that this is, the first motion is just to get it, the zone change, which evidently, according to Imagine Lexington 2045, it's already supposed to be that, as I understand it. And then the next step would be compliance with the development. The initial, I think, zoning had it where the building would have to, I guess, take up a larger percentage of the property. This zone change allows him to do a smaller area of the building. There was some discussion about the sidewalk. There's already a sidewalk running down, takes up almost half the property. If we're talking about a sidewalk running from the sidewalk to the building, we're going to be happy to comply with that, to get that, because there's still another submittal to go, as I understand it, to get the development actually approved. So does that answer any question? And in terms of the parking, it truly is. I believe there's going to be five, the idea is a building that would house five large RVs completely enclosed. Somebody would come into the property and park their RV and they'd leave. Does somebody have a car that sits along the retention basin for a few minutes while that's happening? It's possible. But yes, all the other, there's tree on that plan. There were, I believe, landscaping shown to meet all those requirements. As if there were striped parking located inside there.
