This is Manor Warm Boulevard. Little Herb Way comes up and stubs into this piece of property. We have an apartment complex on one side. And then I guess it's independent living on the other side leading into the proposed apartment complex for the property. They brought us in a revised plan, did some cleanup. So the first 12 conditions are our typical sign offs. To pick street cross section up for Manor Warm Boulevard on the face. They showed us, they added the Manor Warm Street cross section, but we always like to see the location of where they took that cross section because it can change from one point to another point as you go down the road due to changes in grade. So we want to show that. The other side. Provide the planning commission finds the proposal is in compliance with the expansion area master plan. This is in the located in the expansion area. Denote exactions to the approval planning. Provide the planning commission grants, a waiver of the land sub regs for the appropriate termination of a public street. They're having this. See, they're having this stuff, the street step right into their property instead of creating a terminus of a cul-de-sac or hammerhead. So that's one and then public street improvements along Manor Warm. So we received the waiver request and we'll have that for you at the full planning commission meeting. With this, to note the cabinet and slide for the dedication a little early way. Another engineer is working on this process on the having that recorded. So when this is recorded, we want to make sure they have that noted on the plan to note the cabinet and slide for dedication of a drainage easement. There's a large drainage easement. That is to be dedicated over here to the city. They are showing off a little or way they're showing a 15 foot wide access over here to get into this detention easement. So there again, there's another plant for the dedication. We want to make sure we have that referenced on the plan. Dimension garages, maintenance buildings on the plan face and the height of all buildings in the site statistics. They have a clubhouse and then the garages. We need to know those heights also. And that's the next question. Next condition is completing required information. Picked all sidewalks to be five foot and with they are showing three and a half foot with sidewalks on the plan. But our zoning ordinance has changed to require five foot sidewalks across the board. And I spoke to them about this this morning being part of our zoning ordinance. So it needs to be five foot wide addition of a five foot building line setback along street frontage. You'll have that along a little hard way here and a long man of war. Those are public streets. So we need to show that setback to pick the proposed 15 foot permanent access easement to the approval of the division of water quality for access to drainage easement. I was whoops. So they will just need to make sure that they meet the division of water quality so that water quality is able to get in there and do any maintenance that needs to be done on that detention basin. So they we want to make sure that's met their requirements. Resolve resolve the proposed wall in the 25 foot floodplain setback. They have several walls that they have labeled around on the property. There's some walls that are coming into the floodplain here. And with that that needs to be reviewed with the article 19 with the division of engineering because that creates an issue of being built in within that floodplain. And then resolve Greenway dedication per article 23 of the zoning ordinance. The remaining portion wrapped around this development all the way around here going up to man of war is proposed Greenway. And so we just want to know you know working with the city to make sure that they're working with the city with resolving that dedication. So the 224 still triggers to access points for fire. And so the previous plan had parking lots. But the planning commission specifically required. The cul-de-sac turnaround and that there be an open connection because. If I recall from the public meeting wilderness road, residents came and expressed concerns about how they can get out on the Liberty road. At the board of adjustment meeting more recently, they are more amenable to this use than apartment, just standard apartments. So that was a plus in their mind. And they also thought the traffic would be much less. And so they did not have a concern about. Gating this. End of it and needing or for them needing to get through to the light. They, they, it sounded like they didn't have any desire to drive through the. A senior housing development. But again, that's the commission's decision is not just about what the neighbors want, but. What the public health, safety welfare needs are for the community. So if. If fire needs to access points to a development. With more than 200 dwelling units. We just, we have to figure that out. Yeah, and the neighbors have responded to the owners. Of this project that they do not want. Connection to that, like, they don't want extra traffic. And they are with the new improvements that are proposed on new circle. They're adding a. Roundabout on Liberty road, which gives them. Kind of the access they've been need, you know, easier to get in and out. So the improvements. That are proposed, there was two options and both of them included. Access to a roundabout and. Are you saying they'll be around about where wilderness connects to Liberty? Well, not right there, but in the, it's, it's not on this. Yeah, I think it's in front of the bus barn. Oh, yeah. So, I think it's in front of the bus. So here's our, if you go this direction, the West, that would be new circle. So between. Here and new circle. So, I think it's in front of the bus barn. But we do need to ensure that if the fire department. Or the post office or anyone that gets down that road. Is able to turn around and get back out. So. Even if it's. of it's paved okay okay and so they're proposing to basically add on to the parking lot there are 13 standard sign offs and then a couple discussion items to discuss stormwater management and discuss outdoor storage and sales of lot coverage for article 8-20 L2 of the zoning ordinance and I'll open up to you all the zoning ordinance limits the amount of space of your lot that can be dedicated to outdoor storage we we think that they need it by using the islands but we need some verification okay because you can go up to half yes so graphically it looks like you're at about 50 or 60 percent for the space of where you're showing activity but if you take out the islands we think you might be we under the 50 but the VUA number which is just the pavement is under the 50% of the lot okay we got that statistic in there Rory with EA partners yes yet again here we are expanding out here we're up to our eighth amendment the one question I do have is they had not intended to do lights so well if the lighting plan if they're they're not they didn't intend on doing lights so when I asked them about it they said well now we're thinking about it so if it happens down the road it does how's the only thing I've heard people complain about whatever that temperature light number thing I don't understand this yeah not purple like new circle no purple okay other than all this any questions eagerness morning everyone Daniel crumb planning staff as we're talking about place builder and kind of giving a preview what we're gonna be chatting about later on this afternoon just at first wanted to talk about public engagement the applicant has indicated they have met with the neighborhood they had some discussions part of the zoning staff report is just asking them to tell us kind of what those conversations were what the concerns from the neighborhood or comments or you know anything anything of the sort on that when we're looking at sort of place builder in the lens that we were evaluating this on the zone change side in a very similar manner to the discussions for the zone change that occurred right across the street so we considered this to be a downtown police type at the scale and scope they're proposing it's a high density development and so some of the comments that staff had in their recommendation for postponement for the zone change later on this afternoon is just discussing with the applicants some of the things that relate to the scale of the building ensuring that we've got walkability miss worth to to your point there are a couple of trees that we're kind of looking out on the site to see if there's any potential to kind of explain the condition of those if the they can be you know preserved or kind of incorporated into the plan so some of the things that we're talking about just you know once again scale scope walkability and an ability to kind of either you know retain or improve the green space that or a tree canopy that they're kind of showing now so those are some of the comments considerations you'll get the whole spiel later on this afternoon but at this point if you all have any kind of initial questions for that I'd be happy to entertain those we can always log in any other questions regarding placebuilder all right now the applicants good morning Rory Kaley and Nick Nicholson here let's see we advance the pictures to this this on the drawing we have you know it's multi-story so the big main one is the sort of the street level from Maxwell then we show that below Maxwell we have what we're calling on Lexington Avenue it's a lower parking level so there's two access points into the parking center parking two levels of parking both of them coming off the Lexington on this particular one this is where we show all the existing trees Eric Sutherland and I walked the site before we filed he was here at TRC and he did say that we met condition 13 we turned into tree protection tree inventory map to his satisfaction these are the trees located as well species size there are a few big ones they tend to be in the fence lines as you were asking everything out there looks like it's residential homes it's just turned into some commercial uses but it looks that way so the lot of the parking's in behind old fence lines is where you get most of your trees I guess the biggest one was out front was one big oak which is just a few feet off the sidewalk area yeah yeah I believe that was our biggest one there are overhead lines along Lexington Avenue as well so as we go forward dealing with the lines the setbacks and the clearance all of that will factor into what is our streetscape what can go in there what we can plant back Eric and I talked about it being smaller medium species trees something along there just to break that up if this is approved we'll be looking at improvements to the sidewalk and how that will relate to the trees in the space and the utilities so I know there's a lot of areas yet to resolve as we get into more finalized plans see we will we'll be adding the dimensions to the buildings of setbacks so the large plan in the middle is our and the one to the bottom left these are the parking levels these are the wider units they are on a zero foot building line with the condominium building the biggest one right there thank you Nick there's a five-foot space between the condos property line and the structure so there is room in there to get in there with equipment work with the neighbor and for the construction the other edges of this development they are keeping a 10 foot setback and I've got to work with them to get the numbers right but it appears to be 10 to 12 feet setback from all the property lines from from the building as you go up from the parking the residential footprint sits inside of that so along the condominiums property line the apartments sit in they will not be right on the property line it's just those two essentially lower level and subterranean level parking that's the only one that's got the zero foot building line and as you come up it'll step in and then you will have more space between the residential units and the existing residential units nearby should be 15 feet of airspace give or take there and there discuss the drop-off location there is one on the yes Oh drop-off is interior on the l1 garage level actually I think well I don't know that we have it we did not label it as as a drop-off area but we can do that to help someone out if they need it the drop-off basically will be right we'll have the ability to come in here and have a turnaround and this is the access that is basically closest to Maxwell and it goes to kind of the first floor not the subterranean parking parking further back on Lexington this basically goes directly down into the subterranean because of the change of grade that is pretty steep from Maxwell as you head back to your initial question there are three open-air courtyards areas that are being proposed in both basically both of these stacks and then also this is on I believe the second or third kind of level on Lexington and so they're basically we are incorporating green space into it but it's having to be inside of the kind of building itself in order to kind of have the units so this is essentially to shield all of Lexington we are putting units on Lexington in order to not have any parking that's visible and so it is truly you'll see the kind of ramps into the parking areas but we are putting first floor units to make sure that Lexington is retaining that kind of residential feel as far as the club alley we know that that has to be released that basically would occur after the zoning process prior to kind of final development plan and building approval because you don't if the project is basically turned down that wants to basically be retained because it does access a rear parking lot that's part of this project and so if this is approved that will then be released and as far as a lot of the issues that are kind of in the planning staff at the end of the day the development plan itself is fairly simple that's that's the kind of goodness this we know there's gonna be a lot of discussion items that we're going to have to get through with regards to planning staff and a recommendation of approval on the zoning change on the zone change itself this isn't kind of new territory for I think the Commission with what we just went through on the adjacent Maxwell property we know that building massing pedestrian improvements the how the kind of traffic flow will work the number of parking places that are being proposed all of that will be kind of heavily discussed as we kind of move forward and work with staff to make sure that they're very comfortable with what we are proposing at this time we have met with the with we had a neighborhood meeting prior to filing number one issue was parking without a doubt it was like you know we're worried about parking because of what we saw with the hub we are part adding more parking per units basically then the hub and so we do believe that we are addressing that it's also kind of right online with where we where subtext nationally has been and specifically with around the proximity to universities and so we believe that we're kind of spot-on with regards to parking because also the downtown area does have the specific kind of directive that we're supposed to minimize parking with this type of development so we'll continue to kind of work with staff and the neighborhoods in order to kind of balance that just yesterday we met with the Maxwell Church that's directly across the street we met with the City Courts Condos Association and with the Bluegrass Trust in order to kind of sit down and discuss what we're kind of proposing what their kind of concerns are with regards to the two kind of structures that are on Maxwell everything else to be kind of rear is mostly kind of more recently built I think there are some that was built as late as 2014 in this kind of area towards the back it is all existing multifamily housing this corner is existing multifamily housing there's one building right here that is office space and everything else is parking lots right now so we are we're feeling you know very optimistic about this project we also think that it's in the exact right location because at the end of the day the directive has always been we need to find a ways to connect the University and downtown while also staying out of the historic districts and I meant to bring a PowerPoint but this will show what seems to me to be the exact right place along a major corridor to handle density while also connecting downtown and University and respecting the historic neighborhoods with that I'm more than happy to answer any questions you all have Mr. Kaley apologizes for failing to put the north arrow on this one as well you heard about it at TRC but luckily for at least this committee's perspective it is a fairly simple development plan in the grand scheme of things all right we have any questions for the applicant another question but something I mentioned in TRC I know the the traffic study indicated that like there was a signal warrant down for Lexington and it doesn't meet vehicular warrants but I would it's likely to need some some sort of attention probably signalization due to the bad traffic not just your your unit your development the one at the south so taking that combined we'll probably need a look at something so keep that in mind and then something again like bulb outs at the intersection just to narrow the street as you can best you can just at the corner so so the Maxwell did something similar but we can take that a real quick question the second parking there was I see C and S which standard and compact there was a T oh so like so historically we haven't allowed tandem because it well you can't count it towards your your requirement now that there's no requirement it's really a management issue yeah for those spaces because if you're in the back assume I would assume that you are at least in communication with the person who has the space in front probably live together you know share an apartment so that you can maneuver you know in and out okay yes first I've seen that okay cool there's a couple parking lots on Short Street that do tandem parking behind the lion building and also across from that restaurants called Cortalima so kudos for putting in the parking garage and putting the living units out on the street thank you and elevations are kind of a first pass we'll be working on those with staff to address any of those concerns and also give you kind of better views for what this is gonna look like I'll ditto the comment as to parking appreciate you doing everything you can to provide something other than service parking and I do appreciate the rendering suit but one question I heard Rory say where the residential part would have setbacks I'm not necessarily seeing that on the rendering so it is basically on this rear property line so this is the area that is kind of being discussed right now because this is where the city courts existing multifamily the four stories that's on Martin Luther King and so what it is is this kind of the parking extends the subterranean level kind of extends closer to the property line than what the building itself will and so while the parking expands closer to the property line the building itself is set back off of that and that's what but it's not necessarily on the Maxwell Street side not on Maxwell Street side on the building face side one to clarify running I think we are supposed to be establishing the vertical building face close to the rose according to place build in b2a the front setbacks are 10 but the side and rear zero so our question was just really it not you know we want them to acknowledge that being right on the property line in the back could have either construction issues with footers and whatnot and or maintenance in the back there so they need to be in communication with the adjoining property to ensure that that's speaking out the 10-foot setback we met on site with KU yesterday in order to go ahead and get it ahead of that issue that came up with the Maxwell where suddenly that 10-foot became 20 and so we know where all the utilities are is that right thank you for what those listening what he said is part of the meeting with the city courts condos Association yesterday was to address the very issue that miss way just brought up with regards to how does maintenance work once this buildings constructed how does access work all of that so you had year multifamily structure along Versailles Road that will only or have pedestrian connection down and into an adjoining property off of a cul-de-sac and I can't remember the name of the cul-de-sac hill rise court yes so this structure exists this one is being constructed with and shared access out to Versailles Road sidewalks etc just an extension okay it is affordable housing so for those watching since Rory didn't come up to the microphone mr. Cayley is telling the subdivision committee that there are some other issues to work out in terms of affordable housing and those I guess agreements related to funding and so it's while you have the sign offs needed you aren't quite ready to have the plan certified so you're asking for an extension of a year he said yes okay do we need to put in a specific date for the motion no it'll appear on your agenda next week for an extension and it will include at that time the conditions that were and again mr. Cayley's saying he's he's met all the conditions but what when we extend or reapprove we just you know adopt those same conditions going forward so that'll be on your agenda with the standard conditions but the staff would recommend approval of the extension for the subdivision committee to consider I'm ready for that okay madam chair I move for a one-year extension of peeling in JDP 2415 withdraw that which they have done this week so 1a is yeah MJ as you be 24-11 for Hoover Ford Phil pot has been withdrawn moving down the list the distillery district West has been continued so that one hasn't had any changes on paper but we will address that next week with you all red mile is also a continued item again we can address that next week at the full meeting and then that brings us to the final development plan for the Hoover and Ford Phil pot evangelistic association property also known as the fountains at Palomar and this is now a combined final development plan preliminary subdivision plan and Chris has that all right so this plan MJ DP 2474 fountains at Palomar 3855 out in Blue Lane the purpose of this amendment is to add building square footage and revised parking circulation so this is the Firebird restaurant we've looked at that before so we've been working with the applicants to they have they're proposing a reconfigured lot or a lot different lot configuration so basically this will be lot 4b along man of war and then this will be lot 4a with frontage on Harrodsburg let me go back in so we've got man of war here and Harrodsburg Road here so previously this was a one lot it was a corner lot and so to solve their corner lot problem now they're proposing this this new configuration so this lot 4b will be parking in the fountains and lot 4a will have the restaurant so we do have 12 standard sign offs and then one additional condition to correct the building square footage noted to match dimension structures and reflect 30% lot coverage so we've been working with the applicants to just make sure that all the numbers match and that they meet that 30% lot coverage that's required in the zone so that I'll open it up to you all discussion we just we got the corner lot problem solved right it appears so well yes they the corner lot is now parking which is a principal use in the b3 zone and we discussed internally that a parking lot would not be would not trigger a lot coverage adherence because it doesn't have a structure associated with it so the applet that was what the applicant was asking for in terms of more information about in our interpretation of the ordinance so we did come to that agreement and this is the configuration they're now proposing in terms of the lots that was going to kind of be my question the building itself has a 30% meets a 30% of 4a it does not the combination of 4a and 4b correct yes well it will we are still working with the applicant to ensure that the numbers all so it still needs to be the combination of 4a and 4b or just 4a 4a okay just okay Brandon gross on behalf of the applicant and yes we right now we're in discussions with Tracy Chris in vision on making sure we've got the lot coverage at the 30% they say we're a little bit short we think we hit it but we'll be able to if we are short we'll be able to make the building a little bit bigger they can't the lot coverage can't abuse or whatever a little bit bigger to meet that number so we're gonna that's gonna happen I've talked with Tracy I think they're comfortable with that being worked out during the certification process is technical in nature and it won't make any significant changes to the actual plan itself I think we're like maybe 50 or 100 or 200 feet off and so it's not a significant number so we need to have them update those numbers and clarify building square footage for the out lot 6 across the page they have several different boxes on the page and they have a couple numbers so the building square footage changes because they show a calculation and they have one number and then they have it in the site statistics is another number so we just want them to clarify that information so with that I will open it to you all to see if you have any other comments or questions so 15 that should say lots 9 and 11 I don't see 11 anywhere that's why I'm sorry I thought us this one says Wendy's this one says Wendy's on the top just the pedestrian pathway from the sidewalk is that it's not clear I think there I think it is they I think that's it but I just want we can get some clarity we need to have one the adjacent all the adjacent lots have yeah cross access as well point out at least for that the engineers Wendy's well Brandon's represented them but did I go I went too far now I can't get out of there what I did now I get out just that the the access drives didn't quite line up so we're gonna make sure that the access drive on the approved plan will line up with that in the parking and access drive into Wendy's at the closest to citation Boulevard all right on the city barbecue that's what we can't remember who all's in there yeah somebody whatever lot 5 is yeah city barbecue from lot 5 into lot C 6 we need to make sure that those that cross access along the front there all lines up at the top of the page yes okay all right we'll have the applicant good afternoon Brandon gross on behalf of the property owner and I'm we work and we're working with Wendy's and Brownville come up and ask specific Wendy's questions but we're gonna have another plan come up we've got the lot coverage issue and so we are adjusting a couple lots to make sure we qualify and get that information so for condition number 13 some of the at least one plan maybe to have been certified and they seem to be updated and added to this plan and so that well not a clerical it's we just need to upload that information and we're working with Brad Boaz and the Wendy's team to get that information the CAD sent so it can be uploaded and added on 14 I've reached out to the Royal Spring well head for a meeting I'm just waiting to get a response and let them know we don't expect any any issues or special conditions from them given that this is not a hazardous material type of user 15 the open space I got an exhibit we're gonna be getting that to Boyd we're in discussions with Boyd to get that to him that's normally something we can have done during the certification process same thing the lighting plan we're gonna have that delivered that's being worked on right now they should have that soon and then on 17 and on 18 we'll get those boxes fixed up so that's all taken care of those are just making sure that the site statistics are all the same and part of the issue is is that we've got several engineers working for several different users and their numbers don't always they type in things typo so we're working with Cheryl and Tracy to get all those put into the appropriate location so if anyone has any technical questions on that side or process I'm here to answer if you have any questions for Wendy's specifically I could bring him the representative up for you just do you want to address the comment from this way to bed aligning the access from lots five to six we'll be able to fix that that's not an issue and say David's comments with the sidewalks that will will address that too yeah to make it it's hard as we do more and more items for our development plans it becomes harder and harder to follow with all the lines and so we'll make that clarification even if we just have to submit a supplemental exhibit blown-up exhibit to make it more clear David could tell us how he wants that shown yeah any additional questions oh yeah sorry yes yep that makes sense and my guess is that when the cats got uploaded somebody just didn't notice that they need to adjust the access lane for this property to match up with what's been approved for the barbecue restaurant next door okay any other questions for the applicant would that affect the number parking if you have to move that access we may lose a spot maybe two that doesn't matter well there's no minimums oh of course yeah we would like to have those two spaces but I can't that's just how that's how the cookie crumbles okay all right questions for the applicant okay thank you all right thank you did you have anything that can brown with design plus just representing Wendy's here no comments on the revised conditions okay thank you so so should the access drives be part of these conditions and the sidewalks I think I think the sidewalks are just kind of a shape it's just a plan thing like a different layer or something like that so I don't think that needs to be on there okay what about the line up the access you want it's a do you do you like us to add a condition that make sure that these line up I you know I think it's gonna be important to know that they've done the work we can we can always add condition number 19 saying clarify the connection between lots five and six clarify the connection yeah clarify rear connection between lots five and six okay I just don't want to lose it and then you know connection meaning sidewalks or driveway and we're agreeable to that condition being added I will say one thing we've gotten some guff about how hard we are in drafters but I'll note every out lot except one has a drafter and they're almost all gonna be approved I do actually I've used this as like if you want to see how many varieties of drafters there can be go to the Givens property they're all there madam chair I'm moving for approval of PL in MJDP 25 to Givens property with the attached down 19 conditions adding 19th to be clarify rear connections between lots five and six believe Tracy's gonna adjust it here so that we can see what 11 that we're staying with the Givens property with this being the b3 there was the lot coverage which was a concern that came in halfway through this project and so when this first came in this a lot 11 here off of Remington right here this was first proposed as a restaurant with the drive-through so they're coming back to increase the floor floor area on the lot with increasing the lot coverage so that we can get closer to the requirement and also to keep the square footage and lot coverage closer to the total number that we had when it was originally approved so they've revised this and they're asking for this to be reapproved or to be approved with the conditions that we have listed below first 12 are typical sign offs and the note from building inspection then we need to revise the purpose of amendment because as we said this was going from a restaurant to retail uses so they had a restaurant on there to note lot six and seven as preliminary they're showing proposed draw proposed layouts on those lots so we just want to make sure that they're noted as preliminary because at this current time we do not have those approved and signed so clarify square footage on out lot nine again we have a wrong number document lighting plan for article 30 of the zoning ordinance update information for out lot six and seven to plan certification if necessary we're just waiting on those to come through and I believe that is it and so I'll leave it to you all to see if there's any other comments or questions questions for staff brain and gross on behalf of the applicant and so the plan is going to be this plan is going to go through but it will be certified after the other lots get done so the Wendy's and then we also have a seven brew that will come through next month and so we're going to be working through getting our information updated as per the conditions and so the conditions set forth by
