you you you you you you you you you you Welcome to the subdivision committee meeting for May. We'll go ahead and jump right in. All right, good morning. The first item on our agenda this morning, MJSUB 25-1 Lexington Center Corporation High Street parking lot property located at 371 South Broadway and 500 West High Street. On your plan to the top is High Street. Maxwell's along the bottom of the subject property and then Broadway is to the right side. This is Rupp Arena is just to the top of the plan there. The purpose of this plan is to create five lots and depict a street layout. We do you do have revised conditions in your your packet. We have sign offs for engineering, traffic engineering, landscape examiner, addressing, urban forester, environmental quality, bike ped, green space, and water quality. And then we have three say right yeah three remaining conditions after the the revisions. Number 10 provided the Planning Commission grants waivers for alternate cross sections. Number 11 provided the Planning Commission grants waivers for access spacing along West Maxwell Street and West High Street. And then number 12 was to discuss the access to South Broadway. The alternate cross sections there's a couple of the segments of the streets where they're proposing to not have sidewalks on both sides. One of those is along Lexington Center. On the right side of that as you look at the plan there are existing buildings and there's just not space for sidewalks. And then there's a couple other instances instances where there's not sidewalks on both sides but I'll let the applicant address those. And with that I'll open it up to you all for questions, comments. Any questions for staff? Thank you. Applicant? Thank you. I'm Andrew Walls with Gresham Smith, Civil Engineer for the project. So yes we talked about the sidewalks Lexington Center. So this is Lexity Live at the corner of High Street and Broadway and then there's a parking garage directly behind it. So we do not have any room for sidewalks along the right side of Lexington Center. And then same goes for the condition on Private Street D because of the condominiums and our road being so close in proximity to that we don't have room for sidewalks on the north side of Private Street D. We did add sidewalks on the south side so we have access from Broadway and then down Lot 3 to Maxwell. We met with the developer for Lot 4 yesterday and decided that we wanted to address the connectivity problem and I reached out to Scott to get his approval. So we do have a revision to this plan. Just wanted to bring it to your attention. So there is now sidewalk that connects to Private Street C. So we're going to have a crosswalk right here up the page. I started to hold my hand straight there. So we'll have a crosswalk here and then we'll have a 5 foot sidewalk on the back of the curb on Lexington Center. There's enough room there between the condominium building and our proposed curb and then we'll have a crosswalk to connect to Private Street C. We looked at the gradient in this area. It's very doable. So that's the connectivity we'll show. So we'll now have pedestrian access from South Broadway to Private Street C. I sent that on to Scott. He thinks that's a good change to the plan. So we have that included. That will be submitted before Planning Commission next week to get that on the final plan. The other waiver was for driveway connections. So there's an existing driveway connection to South Broadway here through the center of Lot 3. We're going to adjust that to the north. So we're actually going to improve that driveway separation from the intersection of Maxwell. Lexington Center driveway connection will remain the same. We made adjustments to align the curb to existing where we're showing that this is actually the rear of the proposed grocery store for Lot 4. So this is the loading dock area. So we've modified this to be a one way for trucks only out to Maxwell. So trucks will enter off of Lexington Center and High Street and come down to access the loading dock or they can access from South Broadway and then a left turn into the grocery loading dock there. So we've modified the driveway connections. We've added an additional one here for our main Spine Road. Patterson, we want to maintain the driveway connection off of Maxwell. So we're showing a private access easement through Lot 1, which will be a parking garage. So we're going to maintain that driveway connection and that existing left turn lane to that driveway off of Maxwell into Patterson. And then we're adjusting the driveway connection of Patterson on High Street and shifting that towards the west and the property boundary here. So that's our modification. So the driveway connections and the sidewalk only being on one side of the street for the cross sections. Is there any additional comments? Just a question. Yeah. My recollection is that a good chunk of this is going to be for housing. Is that right? Could you walk us through each of those lots and sort of tell us what the intent is? We've heard grocery store. Sure. So that is still to be finalized. We have a preliminary concept plan that we're not showing the final uses of each lot just yet, but preliminarily right now, Lot 4 would be the anchor tenant, the grocery store. Lot 1 would be a parking garage with retail on the front here, fronting our Spine Road. Lot 3 would be a multifamily development. Lot 2 would be a multifamily development with a parking garage in the center, so two buildings on either side and a parking garage. Lot 5 is kind of the mixed bag of hotel, multifamily, commercial, and retail space, so fronting the major Spine Road. So there's still some things to work out. Architect and developer are working through those numbers to finalize the final development, so it's not, nothing's official just yet. That's okay. But that's where we're headed, yeah. On your Spine Road, where it comes out on South Broadway, will there be enough usage of that to have to be a signal? So South Broadway connection right here for Private Street D? No, I'm not aware of that. What I'm trying to do is to figure out how you get from South Broadway to Spine Road. Is it that alley goes through there? Through this connection here? Yes. So that is the connection through Private Street D. This is the back of the grocer. So this primarily is going to be accessed for this residential unit here. There is an existing signal for Lexington Center off of High Street, so primarily flow will be through Lexington Center Drive, and then the primary would be the Spine Road as well. That would be the main access point to the development that would facilitate vehicles and pedestrians to access each of the lots. So that was another topic to discuss on South Broadway. We had previously showed a left turn there. We went ahead and striped that condition because we don't want to promote that as an everyday movement, turning movement. So that would only be utilized on game day through controlled access through police or whatever security for the lot would direct traffic on a left turn movement on South Broadway. So that's where we show that left turn. It also provides us with a widened up movement for trucks to turn in at that point. Thank you. I've got one question. Problem not really to remain to you, but knowing that all of that has been for Rupp Arena parking in the past, where will that parking go, do you think? Yeah, so there's an agreement to maintain parking throughout the phase construction, which is why lot one is the parking garage that will be developed first. So there will be three garages on the site, one on lot one, lot two, and lot five that will add parking from what's existing. Right now there's about 1,700 spaces on the lot for Rupp Arena and also the Hyatt Hotel parking up here. All of that will be added back and more for the development because obviously I'm sorry, there will need to be parking for the people that live there for the apartments and then also the grocery store will have their own parking, hotel and such. So there will be a drastic increase in parking. So once this is built out, so to speak, they will still be available parking for Rupp Arena? Yes, that's the plan. Just curious. Yeah, and I'll comment that we've seen an interim plan for basically a new striping plan for the existing parking lot and then so that'll increase the spaces and so that when they go to start constructing the parking garage, it'll still be basically, I think what you have to maintain a minimum the entire time. So exactly, yeah, LCC has a minimum they must maintain throughout the process. So yep, thank you, David. I really got a different answer than I was expecting, but that's good. Yeah, that's all to be finalized, but they're multi-level garages and there'll be three of them. So there'll be a significant amount of parking. We also have a traffic consultant involved that's going to do all the traffic analysis at all the entry points. That's a big concern for us is how we accommodate on a game day, everyone that lives there, everyone that's shopping there. Where is everyone going to go? We want to officiate or make it as efficient as possible to get people in and out of the site. Okay, sounds good. Any other questions for the applicant? All right, thank you. Thank you. Madam Chair, I move for approval of PLN MJSUB 25-1, Lexington Center Corporation, with the now 12 attached conditions. Okay. It's on. We can hear you. Miss Paula will come over here and she'll survive. She'll get that taken care of. So we're going to move down the agenda to the next plan, which is PLN MJDP 24-91. And if you look in your package, you'll also find revised conditions on this. This is for Lexmark International, Company Section 1, Lot 7. This property, this property is located off of Setzer Way. Setzer Way, let's see here, Setzer Way comes through up here to Freight Boulevard, which then takes and leads us over to Newtown. But if you follow Setzer Way, which is a private street, it'll take you down here to Loudon Avenue. So this is the property within this whole development. We'll zoom in here. They are proposing, they've come back in and we have taken it from four lots. Now they're proposing three lots with a building here on this front one. You can see the dash lines where they're wanting to remove that and create a larger building across this way. And then we have a third lot over here, which we have a two-story office warehouse over on the third lot. So with this revision, because they had proposed four buildings previously with four lots, and now they're combining one lot or combining two lots to make one. So now we're three buildings on three lots. So this is revising it. They're adding square footage to the buildings. So with that, the first 12 conditions are our typical sign-offs with everybody included, engineering, traffic, landscape, addressing, forester, environmental quality, bike, green space, fire, waste management, divisional water quality, U.S. Postal Service. Then we had some cleanup conditions. Improve legibility, shading, and some color because some colors do not reproduce in black and white. So we want to make sure that they have a lot of color on here, but sometimes like the yellow won't reproduce that. So we need to make sure that we get it where it can be reproduced. Denote no outdoor storage on lot 7D until approval of the amended final development plan. When they first came in, they were talking about having outdoor storage here on lot 7D. That's why they're going to have an office here. So we want to make sure that should they decide that they want to have outdoor storage, they make sure that they have the correct paving, asphalt paving for it to have equipment stored out there. Remove consolidation lines from plan face. We only want to see the property boundaries. Clarify lot coverage and building square footage and site statistics. They're adding the second floor to all of these buildings, so therefore that increases your square footage. So we want to make sure we have those numbers corrected. Clarify all site statistics for vehicular landscaping. I went through several of them and they didn't come out to the right totals at the end. So we want to just make sure that's done. Denote planning commission action on a waiver from the final record plan. We'll have a final final record plan here. We'll show shortly that they're doing a continued discussion on it because this is where they were creating four lots and they're coming back and they're wanting to do three lots and they're wanting to revise the access driveway that that you all had approved previously when it was four lots and like I said they're converting it now into three. So we want to make sure we have that note on the plan. Denote the release of the sanitary sewer and storm sewer easements prior to plan certification. We have several easements that are running through buildings and we want to make sure that those are removed prior to construction because we don't want to have that conflict. Clean up text written over text. Some of the text is over top of other text. Therefore it makes it hard to read some of the numbers. So we want to make sure that this is kind of cleaned up so that we don't have any problems and also improves plan legibility when you have numbers written over numbers. It makes it harder to see. Provide lighting plan per article 30 of the zoning ordinance. That's a new requirement. We need to have that. Denote location of parking for lot 7d. They're calling for this 7d to be an office warehouse. So if you have an office you typically have one parking space for your office. So we just want to have it denoted. Resolve timing of the plat recordation which is the one we're just talking about as far as continued discussion. Correct. Note number 40. Discuss note number one in the site statistics box for outdoor storage on lot 7d. It was kind of a unique note so we just wanted to have it discussed. It says natural trees save is provided for outdoor storage area asphalt which is not considered BUA. So I'm not quite sure what it means. We need to have that clarified. Discuss lack of landscape islands on the southeast side of building 7a, lot 7a and non-compliance with article 18-3. As you can see there's landscape islands on most of the property here up along the top here but for whatever reason we do not have any landscape islands on the portion on the back portion here of this what shows of this building. So that's a new part of the zoning ordinance that we have those and it's required in the zone because this is office space and warehouse. So we require that. So if there's any other comments or questions. Any questions for staff? They currently have they currently have a development plan that they can pull a grading permit on. So that's fine. So that gives them the ability to go in there and do the work to create the new access easements to go around the buildings because that's what they're wanting to do is to take this access easement and reroute it around the building. So with the current development plan they can get a grading permit because it's signed so that they can do start the work to do the new sewer line and while they're doing that then they can work through the process through the council to get this one released. And so then once we're finished then they can come back and create the new easement. Yeah we don't want to have buildings over we don't want them over any easements truthfully. Cheryl you're still in postponement mode on this? Yeah there's still some questions on some of the things. The applicant's here so maybe she can help but we're just kind of concerned on a couple different issues. Okay all right. Thank you. Applicant? Morning. Abby Jones. Abby Jones Consulting. We got Cheryl's updated comments yesterday late afternoon and I believe we'll be able to take care of those and get those back to Cheryl to her satisfaction probably tomorrow. So I think that we're pretty close. We were able to talk before the meeting to understand what she was looking for on a few of the items. So I believe we've been able to get through those items. I'm trying to think of anything else that is just worth mentioning besides the fact that we're going to clean up or adjust numbers and charts because that's what most of these are is adjusting little numbers and charts. I believe the one specific thing on number 25 will remove that note and on number 26 your request is to add islands there so we'll add four islands since that's a new requirement. And we're glad to add two parking spaces on number 22 as well. So all of those things were fine to to address. I guess I would also mention on number 19 new number 19 it's only a release of sanitary sewer not storm. And we have we have that on a new version and a new note that we'll have for Cheryl tomorrow. So again we're glad to address these to Cheryl's satisfaction here shortly. So I just want to clarify it's not Cheryl's satisfaction it's the ordinance requirements. Correct. So I don't want to mislead everyone to think Cheryl's like in charge of just making a list for you to correct. It's it's on it's the ordinance that requires these things. So landscape islands on the southeast side of the building you have none. We weren't sure if there was overhead door access or if there was some other reason why you didn't have landscaping. There are significant numbers of overhead doors on that side. But we were able to shift and adjust some things to be able to have four islands which I believe would meet your requirements. So you well you also have to meet the 10 percent. So in your site statistics you're not showing that you meet the 10 percent. You're at about two and a half percent. So it could be that you need bigger islands or more to meet the 10 percent. This is where some specific notes rather than just saying meet article 18 is sometimes helpful to be able to just understand exactly which section. But we're glad to make sure that the 10 percent is adjusted. Right so we I mean we want to encourage the design professionals to you know have a conversation. We'll have find the the space on their plan where they can fit that in as opposed to the staff saying you need four islands and they need to be 200 square feet each and then you know what I mean. They are going to do wood lots, storage of, I guess, mulch and that sort of thing in the back here. That way, when adjacent properties come in, they have to build their sidewalk to their property line, and that way, that's how we get our sidewalks along the roads. Then, on the back, the approved lighting plan in compliance with Article 30. They did submit something, but I have not had a chance to review it against our checklist to make sure it meets all the requirements. Denote the review recommendations from the Royal Springs Wellhead Protection Committee. My understanding, they went to that meeting a couple days ago with Tracy, and so we need to have any notes that they made with that plan, and then resolve compliance with Article 6-3 and denote asphalt or concrete pavement. Per Article 16-3, it states that the parking area and driveway shall be paved with concrete, asphalt, brick pavers, suitable hard surface materials, and so right now, they are showing asphalt millings, and when they went and took this to the Royal Springs, they weren't real, I don't think they were in agreement with this. I think they want to see asphalt paving. I know they said that they're going to have large trucks moving, so maybe they do a concrete with a thicker base, but we require all drive areas to be asphalt or concrete, so we need to have that changed here from asphalt millings. They said they've used it elsewhere, but the Royal Springs was not in favor of that, so with that, I'll open it to you all to see if there's any other comments or questions. Any other questions? Well, that's my, I mean, I would think you would want to have a solid surface instead of something that's going to be like gravel or millings, because when you go to scoop up mulch, you're going to be scooping up half of that, too, so my thoughts or understanding would be that it all be storage, would all be asphalt or concrete. Good morning, Joseph Browning with Contour Collaborative. The owner of this property, or the developer, is Dave Leonard, a tree specialist, so their current operation is on Old Frankfort. Moving this into town allows them to bring all their work they do on trees around town to a more local spot to bring that to the back of this property and process those trees and shrubs and all the stuff they rip out all over town into mulch they can reuse locally. The discussion that's ongoing with the pavement section is because that back half, the dirty half of this site, the front half is all totally good asphalt pavement, parking lot. Those are bins at the bottom in those squares so that they can sell decorative rock. And the mulch that they make, the back dirty half of the site is where there's large wheel loaders that have the big bucket on the front and load trees of large quantities into a mulcher machine and produce those mulch piles that they stockpile in rows there. So that building in the back is a shop for them to park those items. As discussed, the asphalt section, that's something that's in our court to provide maybe a revised section of what that construction is to engineering and traffic because the initial investment of a full asphalt section is still sacrificial for the weight of those vehicles. And so the owner would prefer to use millings as part of that section because when the asphalt does break down, instead of scooping up gravel that's under the asphalt, the millings are a finer material, they can still scoop their buckets across it. And that's how they're currently operating off of Old Frankfort Pike. So that item will remain to be resolved until we have those further discussions about what that section exactly is and have that approved with this process. Do we have any questions for the applicant? I think that they mix some sand into it, but nothing's there to rot or wait till the worms get in it kind of composting process.
