## PHELPS PROPERTY

**Agenda Item:** PLN-MJDP-25-00042

The Commission took up the Phelps Property as a discussion item, with Dick Murphy identified as a key speaker on the matter.

The proposal involves a master joint development plan depicting a mixed-use development that would include:

- A convenience store and gas station
- A restaurant
- Multi-family residential units
- Townhouse residential units

The discussion also addressed several requested waivers from the Zoning Ordinance, specifically:

- **Article 16-6(a)(1)**
- **Article 16-6(a)(2)**
- **Article 23A-9(k)(4)**

Ultimately, the item was **postponed** and did not reach a final decision at this meeting.

*Note: Specific timestamps, detailed debate points, and additional context from the discussion are not available in the source materials for this item.*

## GAINSWAY MALL SHOPPING CENTER

**Agenda Item:** PLN-MJDP-25-00052

The Commission took up this agenda item as a discussion item concerning the Gainsway Mall Shopping Center. The plan under consideration was intended to depict parking and circulation arrangements for a new multi-tenant retail building proposed for the site.

Key speaker Mark McIntosh was identified in connection with this item. The discussion included consideration of waivers to two provisions of the Zoning Ordinance — specifically Articles 16-6(a)(1) and 16-6(a)(3) — though the structured record does not detail the specific arguments made for or against those waivers or the particular concerns raised by commissioners during deliberation.

**Outcome:** The item was **postponed**. No final determination was made on the proposed plan or the requested zoning waivers at this meeting.

## 1234 SCOVILLE ROAD

**Case No. PLN-MAR-25-00012**

This agenda item involved a petition submitted by Vince Thompson for an amendment to the Montclair Neighborhood Design (ND-1) Overlay zone within the Single Family Residential (R-1C) zone at 1234 Scoville Road. The proposed amendment sought to increase the maximum allowable building depth from 55 feet to 82 feet.

The item was listed as a discussion item on the Commission's agenda; however, it was ultimately **withdrawn** before substantive discussion or deliberation took place. No transcript timestamp is available for this item.

No additional details regarding the rationale for the requested amendment, concerns raised by commissioners or the public, or the specific circumstances leading to the withdrawal are reflected in the available record.

## BOONSBORO MANOR

**Case No. PLN-FRP-25-00014** [timestamp: 10:19]

This agenda item concerned a proposed amendment for the Boonsboro Manor development. As presented, the amendment sought to accomplish two primary objectives: the creation of 15 lots and the dedication of right-of-way for Hat Trick Way. The applicant had also requested two waivers of the Land Subdivision Regulations — one pertaining to the cross-section design for Hat Trick Way, and a second addressing access to lots provided solely by an access easement.

Key speaker Traci Wade was identified in connection with this item. The case was ultimately **withdrawn** before substantive discussion or deliberation could take place, and no action was taken by the Commission.

Thank you Mr. Thompson. Thank you. Chair Davis we do have one more item on the agenda today that needs your attention and that appears on page two item a. This is a final record plat that was sent to the planning commission because there were waivers requested and if you remember we actually started well maybe we didn't start no Chris said we didn't start a discussion but it's for property related to an address at 5354 Athens Boonesboro Road for the Boonesboro Manor plan. They are asking to withdraw the waivers completely and so they will then just go back to tech committee for final review. Okay so we need a vote on approving the withdrawal of those waivers is that correct or is it just I think the staff prefers that you do take action on it just because it has appeared on this and there were notice letters sent out and all right and is this what we discussed in our bylaws? The bylaws specifically say for a zone change that a withdrawal has to be acted on by the planning commission. It's silent to that in relation to waivers and variances and other things but since there is a notice letter that was sent our the staff prefers that there be an action by the commission for that. Well if the commission sees fit the floor will entertain a motion if not we will it'll be on the record from the applicant. Chair Davis I make a motion that we approve the request to withdraw PLN-FRP-25-00014 Boonesboro Manor located at 5354 Athens Boonesboro Road. To clarify it's just the waiver associated with that not the actual plan. Let me correct me I studied to correct something. The way you worded your motion it sounded like we were withdrawing the entire plan. Oh I'm so sorry. But it's really just a waiver request associated with that. May I amend that to say that I'm making a motion that we approve the request of the way the motion to withdraw the waiver. And how many waivers were there Ms. Wood? We started with two they were through one about halfway through so currently there's one still. Okay the one remaining waiver. All righty and then I had a second from Commissioner Jonathan Davis do you are you are you okay with the amended motion Mr. Davis? Yes. Okay all righty. Thank you. Now we'll put that to a vote. I'm sorry is there any discussion? Seeing none. Okay that carries unanimously as well thank you. Do we have any other postponements or withdrawals from staff? Okay so I suppose is oh are we on page six at commission items now? Okay so the planning commission is to appoint one of our members to serve on the floodplain appeals committee. Is there any discussion as to who may wish to serve or I did take the liberty of talking to Commissioner Molly Davis briefly about the position but the floor is open for any motion or discussion in that regard. And Commissioner Davis is willing to do it if asked. Yes I should have clarified. I make a motion that Ms. Molly Davis. I wholeheartedly second. Okay thank you Mr. Forrester for that motion and thank you Mr. Davis Jonathan Davis for the second. Do we have any discussion? I would be happy to serve. Thank you. Thank you. Though I would be coming into it with a lot of not a lot of knowledge except that floodplains are important and keeping things out of them is also important and protecting them. Thank you Ms. Davis. If there's no further discussion we can put that motion to a vote. All right that carries. Mr. Duncan do we have any any staff items? Thank you Mr. Chair and I don't want to prolong this because we may be setting a record here but do want to remind you all that we have a planning commission work session next Thursday September 18th in the Phoenix building third floor. This will be the affordable housing roundtable discussion that we've been talking about for a couple of months. We believe we'll have good participations of good information and exchange of ideas so look forward to seeing everybody next Thursday at 1 30. All right. May I ask a question? Sure. Mr. Duncan is it correct that any one member of the public could also come to that roundtable? The public can certainly come in over here. They will not participate in the roundtable. That will be between you and the and the invited guests but the public can certainly come in and over here. Thank you very much for that clarification. Okay do we have anything else? Seeing none without objection we are adjourned. Thank you. Thank you.
