This is a final record plat that was sent to the planning commission because there were waivers requested and if you remember we actually started well maybe we didn't start no Chris said we didn't start a discussion but it's for property related to an address at 5354 Athens Boonesboro Road for the Boonesboro Manor plan. They are asking to withdraw the waivers completely and so they will then just go back to tech committee for final review. Okay so we need a vote on approving the withdrawal of those waivers is that correct or is it just I think the staff prefers that you do take action on it just because it has appeared on this and there were notice letters sent out and all right and is this what we discussed in our bylaws? The bylaws specifically say for a zone change that a withdrawal has to be acted on by the planning commission. It's silent to that in relation to waivers and variances and other things but since there is a notice letter that was sent our the staff prefers that there be an action by the commission for that. Well if the commission sees fit the floor will entertain a motion if not we will it'll be on the record from the applicant. Chair Davis I make a motion that we approve the request to withdraw PLN-FRP-25-00014 Boonesboro Manor located at 5354 Athens Boonesboro Road. To clarify it's just the waiver associated with that not the actual plan. Let me correct me I studied to correct something. The way you worded your motion it sounded like we were withdrawing the entire plan. Oh I'm so sorry. But it's really just a waiver request associated with that. May I amend that to say that I'm making a motion that we approve the request of the way the motion to withdraw the waiver. And how many waivers were there Ms. Wood? We started with two they were through one about halfway through so currently there's one still. Okay the one remaining waiver.
