Oh, the section line shows, I believe, half of the right of way. And it should match what the dimension is on the actual cross section diagram. Number three, verify if there are two sewer lines. Number four, denote all existing and proposed easements. Number five, addition of all standard street tree information. And number six, denote in accordance with plans approved by the Lexington Fayette Urban County Government, X number of trees or tree canopy, whichever is more applicable is are required to be planted on this property per the approved tree protection plan specifications. There are no waivers identified or requested at this time. Under design considerations, review all comments provided by the Division of Engineering. And then plan questions and concerns discuss the inconsistencies in the legal description and the deeds. When we looked at the current deeds in the PVA, the calls don't match what's depicted here. It actually shows. What is it? Lots. The call here is 87.43 feet. And in the deed, it's believe 180 or 178 feet. So there's just there's some questions about what what's actually. Depicted on here versus what's in the deed. And for that reason, we're recommending postponement. There's some questions regarding inconsistencies in the legal descriptions. But then upon approval, the standard sign offs, engineering, traffic, engineering, landscaping, addressing urban forester, environmental quality, bike, ped, open space, addition of a utility and streetlight easements is required by utility companies in the urban county traffic engineer. Number 10, documentation of the capacity assurance program. 11 is the postal service sign off. And then 12 is to correct all noted deficiencies listed as requirements not met herein. We have requirements not met. Denote name and address of the owner and developer. Correct lot numbers to match the previous plat. B, slide 347. Addition of address on adjacent property. Denote location as street cross section on plan. Correct lot numbers and purpose of amendment note. Document compliance of common wall for firewall for the building codes. Because with the duplex that should be built with a firewall if not they have to show proof that they have that firewall there. Denote all existing proposed easements. So, when I filed this plan. The main reason of filing it was we want to dedicate. This. Right away for. A Hagerman court, which comes down here turns. Currently it goes up to Maxwell. We've. Now we've built this connection over to stone road. And so the main purpose of this plan is just to dedicate this. And. Also, we wanted to consolidate lots, but. The old. The old right away for Hagerman court has not been released by the council yet. And it's my understanding they want this plat. Certified before they'll release it. So, at the time I did the plant. But. Now we know. So it's important to get this plat. Certify as quick as we can. When we did file, we filed it as a public acquisition plan. We weren't 100% sure what. The plan title would be and now we know. It should be a final record plan. So, I mean, that's a simple change on the plan. A lot of these conditions are related to. We had it as a public acquisition plan. And now that we're going to file a record plan, it's just delete and some of. Signatures we had on the plan and and. And some additional information changing the plan title to find a record plan. Everything you see on here is something that can be accomplished in maybe an hour of surveying our. Drafting pretty simple stuff. One of the things I question was, there's a maintenance note that engineering is saying number 17. What's that note? Referencing I mean, typically those are associated with. Private access easements and we don't have that. It's written in the land subdivision regulations that it's needs to be noted on the flat that maintenance. I mean, easements are to be maintained by property owners. A landscape easement, a utility easement, all of your easements, not necessarily. It's not just access. Okay. It's a standard. Okay. Tree mitigation proposal, so. The only trees we're going to have are street trees on this, and we can get you our street tree plan. We've prepared the bond for the project and what. You know, the street trees will be bonded, but we've turned in the. The bond to engineering, you know, so we can go ahead and get that paid, but I'll get you a copy of. Of our proposed street trees, and if that satisfies that. Because this is going to be our last final record plan. That goes through on this property. The next one would be a consolidation minor. You know, if we go with postponement, it puts me off a month and then it pushes back when the council can approve it. So it's. Really cramping our. Our time. The only question I had remained because it was that be aware of lack of existence for more infrastructure there. Is that indicative of anything in particular or no? So. We've actually. Are making public storm water improvements. We're running the new storm line. Down Lexington Avenue and. Those plans are approved already for engineering and so that's been addressed. It, it was it really. On the development plan, there was some discussion of it, but as we got into final design, we realized. There were some issues with some of Lexington storm sewers. And now we've upsized some pipes and we're making improvements on that. So. Those plans are approved and. You know, ready for construction. But anyway, I built to the committee if I could get a. Approval recommendation, it will help keep this project on schedule and. Like I say, everything on here is. Drafting I mean, 1 of our guys could have this. Cleaned up in 2 hours and resubmitted so. The question is, is is what has to be reviewed by the technical committee that's on this list of requirements not met. Right because the plan in front of us doesn't have the existing and proposed easements, which would need to be reviewed by the technical by the committee. So there's things missing that are just drafting that need to be reviewed and that's the purpose of the committee. So it's. It's kind of like, you know, I hear you. Right. I know you want to stay on schedule, but at the same time, there's 19. Conditions and then there's some stuff that has to be worked out with traffic engineering around the streetlights and things of that nature that we need to be shown on this as well. Right easements for that. I mean, so, you know. But, I mean, these are things I can. Like, like the draft, I can work directly with traffic and satisfy their easement. The only other easement that is even there is. Really no easements on this property. We're adding a KU easement that runs down. Stone road, and we've already got agreements with KU on that. So I just need to add that easement, but it's. That's that is the only additional easement we're missing. At this point, I do think I'm comfortable with getting to that. And I think, again, the other issue as far as traffic in the southeast west corner. We already talked, but they got through that. And then the other. I think if there's something on here that someone feels like there might not be an alternative to, then I think I would postpone it. But if everyone feels comfortable who's on the sign off. With coming to a resolution within, I think, I think I would be comfortable with approval with conditions myself. The purpose of this plan is to reflect the development of single-family lots on a public street. Under the requirements not met, number one, depict internal pedestrian walkways to connect to all adjacent rights-of-way. Number two, depict ungated pedestrian access from Liberty Road. Number three, remove the 10-foot gated vehicular access. So they're showing a cul-de-sac bulb and then with an access easement that comes in and turns, but then also a 10-foot gated emergency access. So that vehicular access is not permitted. Number five, denote arterial landscape easement for double-frontage lots. Under waivers necessary, there would be a waiver for lot frontage along a public street. For the lots beyond the cul-de-sac. Number two, then there would be a, it would be necessary for a finding for an access easement. And then also for connectivity under the land subregs. Article 6-8B. Oh, sorry, that was, we added that in the last minute. There's a third under the waiver about connectivity. 6-8B in addition. And then under design considerations, there would be a waiver for a 10-foot gated emergency access. In addition. And then under design considerations, Kentucky Utilities request utility easement along 20-foot building line in lots 14 through 16. And then under plan questions and concerns to pick the proposed cross section for Liberty Road. Number two, pedestrian access from Liberty Road should meet the location for a new multi-use path that will be on that side of the street. Number three, discuss location of second access easement location. Number four, discuss lotting pattern that requires access easement. And number five, discuss stormwater management plan, including location, ownership and maintenance. Number six, is sanitary sewer tap available for each proposed lot and where will it connect to the existing sewer? Number seven, discuss connecting to Girardi Road. Girardi is to the north. And we do want connectivity between developments. This doesn't show any connectivity onto either of the adjacent properties, either to the north or to the south. Let's see. We do recommend postponement. There are questions regarding compliance with articles 64C, 68M and 68Q2. What's that? And 68B. If the plan is approved, the following requirements or following sign offs, engineering, traffic engineering, landscaping, addressing, urban forest, or environmental quality, bike ped, open space, documentation of approval, capacity assurance program, and then provided the Planning Commission grants a waiver for street frontage and finds the use of access easements as appropriate and to correct all noted deficiencies listed as requirements not met herein. And then as far as the finding for the access easement, typically for single family dwellings, we don't allow access easements for sole access. The connection to Garrity, if I said it right, I don't quite understand. The big picture along through here is that there's plans for the Kingsbury roads to get connected within the neighborhoods. They get connected. That forms a new access point onto Liberty Road. And two existing access points, roads, are supposed to close. So north of us here, yeah, up there, north of page, it says 12. That area is all supposed to be reverted back to single family lots with that closure. So I don't know why I would try to connect to those lots. They're not built on today. So you can contact that owner and negotiate a street connection that comes around. You need to provide connectivity at least to the lot to the plans out here and continue your street. So the access easement for that, and this is what we're talking about, have a residential lot with one house on it now. And that requires me to provide a street access to it. At what point does a single family house not, I mean, how many acres? It's a single family home. Why do I have to give them a new public street access? You have to provide connectivity to adjacent lots that have development potential. And do we have an acreage size? At what point does this, I mean, it's right now, it's a lot, it's a home. So how will I know when my neighbor no longer has potential? They'll contact us and let us know they want to subdivide the property. If you provide them some frontage. But you're asking me to provide a public street stub to a single family lot. You also don't have a public street front for five lots. That's not allowed. So I don't think what we're asking for is out of the realm of a possibility, or what the requirements are of the land subdivision regulations. Okay. So in there, the use of a access easement, I submitted the findings letter. You can ask. Okay. That's fine. I want to make sure that that was still the correct procedure. That's what we've done in the past. We also don't have frontage, which is a different, that's a waiver. That one is a waiver. Yes. It's no longer just the findings. And. It is confusing, but when you don't have any frontage, you need a waiver. If you're using an access easement for your only access. And frontage. Then it's. No, the access and frontage missing is a waiver. Only needing access from an access easement. So you front on, we have one Athens Boonesboro road, and they have a side street. They have frontage. So they can be subdivided, but their access isn't coming from that corner. So they're using an access easement to get to it. Okay. That needs a finding from the commission. So. But the concern is, well, for one, the enclosure, the details showing it, a double enclosure. If that's the case, it's not large enough. I'm pretty sure it's going to be a single enclosure. But even a single enclosure, they've got it way too large for a single enclosure. The gates on it, if they went with this one, would be 8 foot 4 inches each and they should only be 6 feet. The depth of the enclosure is shown at a 14.6 where it should only be 10. Now I know what it is. These enclosures along with the coffee house, whatever, I'm understanding that they're prefabbed and they're shipped in like it's like in a kit. That's what I've been told. We had something similar out at Citation. And when we had that tech meeting on the one on Citation, I made a comment about that then and I mean, I was the last one to sign off on this plan and it took six weeks for them to get to where I could sign off on it. With the location of this, where the dumpster's at, our truck is either going to have a sitting line waiting to get to the dumpster enclosure and traffic is going to have to wait to back up for him to back out of there, to exit. So with the school traffic in the morning time, it's going to be over in that area and it's traffic in general, it is not a practical place to put a dumpster enclosure with our trucks the size that they are. At least, they will at least have to comply to our dumpster service guy and get that enclosure the size it needs to get, down to the size that it needs to get. It's way too large and that, with it being too large, that's like the one over on Citation, the gates was going to hang out into the drive-thru lane. Yeah. So we're showing directly off Childsburg, there's a smaller number of units here, and then off of Andover Creek Lane and Tucker's Crossing, there's a connectivity between those which access all the remaining parcels. And then there's an existing floodplain through this area as well. So you'll notice that in this representation, the new floodplains are for now flooded. I was really thinking that Tucker's crossing and the access easement would serve as a three-point turnaround for your trucks as, I guess I need to point to this, so that until Tucker's Way continues on to the next property, I thought this was a correct size for a three-point turnaround for the trucks to pick up the last roll carts and leave. This is for the Miller property, and this is also connected with a zone change request from a single family residential R1A zone to a community center CC zone and a medium density residential R4 zone. So this property is located out Winchester Road. It is somewhat unique. It is bisected by the areas that were included in the 1996 expansion area master plan as well as the urban growth master plan. So we essentially have two different frameworks that we're going to be looking at. So that kind of plays into the applicant's choices zone. What they're showing here is a mixed-use development, including a commercial development closer or commercial structure closest to Winchester Road with the kind of the rear of the site being used for a couple different forms of multifamily. Within the UGMP, there is a roadway that is showing extending to connect with the rest of the anticipated development that runs through the property in this general location here. There is also some other roadway considerations with Hume Road and its potential realignment, the impact on an access easement crossing the KU property here. So a lot of moving pieces. So we've got a number of different criteria and considerations to look at. So as far as items, requirements that are not met, the first four are notation relating to building inspection, building permits, alluvial soils, and steep slopes that are pretty much our typical notes. Getting into other aspects of the plan, they need to depict all of the existing easements that are present on site. Number six talks about internal sidewalks must connect to the rear of the respective buildings. And so a couple different places, the sidewalk connectivity is a topic of conversation. That access easement that's shown here on this parcel needs to depict sidewalks from Hume Road onto the site and the crossing the drive aisles. Throughout the plan, number eight talks about dimensioning all of these different walkways, drive aisles, et cetera. There is some typical notation, but there are some areas that look like do not necessarily follow that standard notation. Number nine talks about the additions of stop bars at traffic points, as well as labeling the recreation area in the parking area here. So this portion right here is what traffic engineering is referring to. Eleven through 14 are courtesy of engineering that talk about depicting the floodplain on the adjacent property, and then that relates to the elevations, the 25-foot building set back from the floodplain, as well as the vegetative buffer. So not necessarily on this parcel, but we want to make sure that all of that is being accommodated appropriately. Fire on number 15 denotes no parking on the street with a cross section AA. And then number 16 depicts bicycle parking and storage that complies with zoning ordinance article 1612A. Once again, the sidewalks depicting sidewalks at five feet at seven feet at the appropriate locations, and then depicting pedestrian connections to the Western Road reservation and an ADA-compliant access to the dog park. So once again, this portion here that is designated to be developed as a part of that UGMP roadway system, making sure we have the appropriate connections there. This is a group residential project, so they need to depict that standard boundary along the portions of the site where that's applicable. Moving on to the backside of that page, item 20 talks about providing an open space exhibit that corresponds to the site statistics and the applicable sections of the zoning ordinance. 21, the tree inventory map has to include the correct stamp and certified arborist name and certification number. 22, once again, working back to the area that is noted as a reservation, we need to have that actual roadway shown. You need to have those facilities, understanding that this is just one piece of a larger system that will be developed in sort of a piecemeal fashion. But at the preliminary stage, we need to see what that roadway is going to look like, what that interactions are going to be, and that's going to play into not just here, but within the place builder as well. So we need to, item number 23, as depicting the entrances to structures, that's relevant for things like the bike parking as well, ensuring that those are meeting the ordinance requirements. 24, to note the commercial and residential floor area for the CC zone in the site statistics box. The CC zone, that front portion there, it has specific requirements relative to the amount of commercial area you can have, the residential area. So we need to have those brought out separately to make sure that we're in agreement with that. To note the dwelling unit density, once again, the areas that were a part of the 96 plan with the CC have a different density recommendation and threshold than the areas that are R4 in the back. So once again, breaking those out to make sure that we're still in line with what they are looking at there. Number 26 is removing note number 10. And then 27 is to correct the floor area ratio in the site statistic table. There's some areas where it's area versus the floor area ratio. So once again, just identifying those and breaking those out and making sure that those are denoted correctly. 28 is to include all the required notes for the preliminary plans as per article 21. And then number 29 on that list is to list the VUA interior tree canopy that is required by the zoning ordinance. At this time, they hadn't identified any waivers necessary. There are a number of design considerations. Number one is to see the Asselo notes provided by the Division of Engineering. Number two is clarify who is responsible for building the access easement on the KU property. So this easement here. Number three is to consider speed tables or chokers along the southern and northern drive aisles from Traffic Engineering. Four is they're asking from Waste to clarify if dumpsters will be used on the final development plan. Number five, addressing says that due to the number of the proposed structures, the plan will require an entrance drive from Winchester Road to be named. So submit that information to addressing. Number six, propose a connection from the northeast side of the property to the proposed greenway. And that's from Bike Ped. Number seven, that the only sanitary sewer is the force main in the vicinity. Number eight, the Kentucky Utilities request easement placing or utility easement along the front of the properties and along Winchester Road. Number nine, the UGMP Avenue location on the subject property and connectivity. Once again, connectivity between the adjoining parcels as well as a part of the UGMP discussion. So when we we have that, that's need to be shown as well. When we get to plan questions or concerns, number one from traffic, it's discussed the large radius between open space and the courtyard building. Traffic, did you all want to go into any more detail on that? Just just between there, there's like a stormwater area. I think maybe between in a radius look larger than typical. So it's just a question. There's a necessary or just want to look like the others to the left and right. The next three questions or concerns come from engineering. So number two is discuss the preliminary stormwater report for expansion area to bond. Do you want to? In the report, there was a stormwater management area shown in this vicinity. I just wonder where it is. OK. All right. If it's built, it's not built. Who's going to build it? Awesome. So that that relates to the item number three, which is discussed who will own and maintain the stormwater management areas. Number four, discuss is if a construction easement is going to be required. Going into some of the planning's questions or concerns, clarify that typical parking lot dimensions notation in the notation at the bottom, it makes references to a specific lot that doesn't correspond to this plan. So just look at that notation and make sure that there's not any just old information hanging out there. Discuss the couple different aspects of the plan that sort of relate to the zone change and the comprehensive plan. So the first is the request. The request has to meet the multifamily design standards. So those have some applicability as far as how the buildings are laid out interactions with open space connectivity. So that'll be a part of the discussion with that. Number seven, discuss the C.C. zone maximum single use building size. The residential structure that they show here exceeds the maximum size for a single use building in the C.C. zone. So taking a look at that requirement and either incorporating an additional use or reducing the size of that structure to meet the maximum for that. Number eight, discuss parking areas between buildings and the public streets. Once again, we have existing roadway here. The within the 1996 expansion area master plan for the C.C. zone. It makes the recommendation to not have parking between the buildings and the streets. The same goes for the rear portion here. When this is developed as an actual road, you'll have a substantial amount of V. parking in between the structures present and the roadway there. We have to kind of have this plan laid out, even though it is not being constructed at this time with the understanding that that road and that that access is coming from there as well. So the relationship here between Winchester Road as well as that future public street. Moving on, discussing the pedestrian connectivity to amenity areas and rear buildings. Once again, the the there is existing pedestrian connections kind of throughout the site. However, when you get to the rear structures, that's when sort of the vehicle connections that take you through the front portion sort of fall out. So the front portions of the structures have some. But the way that the garages are set up, the way the site's oriented, you lose those on those back buildings. Let's see other things. Discuss a vehicular connection to adjoining lots. Once again, the really focusing on the portion to the rear that twenty twenty four urban growth master plan talks about when you are providing parking lots of a certain size that you do provide, not necessarily roadway connections, but a vehicular connections to other adjoining lots. As well, in addition to the actual roadways that are that are required to be built, discuss the required bicycle parking. The expansion areas in the twenty twenty four urban growth management plan have a increased bicycle pedestrian or a bicycle requirement. And so we need to show those. That's part of why the the entrance requirements or the comments earlier to denote the entrances. There's new requirements that relate to where that parking needs to be located and how much needs to be provided. Number twelve, the active depth standards from the UGMP. Once again, that's a concept of when abutting and developing along the roadway, how those structures are oriented, making sure that those are active uses. It specifically calls out as parking not being allowed in those areas. Overall, kind of discussion points moving forward is going to be compliance with the master plan and the expansion area master plan. As far as a use perspective, the use and the densities being shown in the rear is in line with what the the urban growth master plan called for. However, the portions at the front are not in agreement with the land use recommendations. And there is some concern how that is sort of functioning as a community center in the way that the nineteen ninety six plan envisioned that. As always, the with the zone change, we'll have the discussion on police builder criteria. So all of that to say that planning staff is recommending postponement regarding compliance with the expansion area master plan and the urban growth master plan UGMP. And so I guess are there any sign offs that would like to be removed from this request? Rory, the partners, how you doing? There are so much to go over. I guess I'll beat the beat a dead horse here a little bit. The he said there at the end access vehicular connections to adjoining lots. The UGMP boundary, you guys actually have the overall plan. What you're looking at is an island. The property, all of this property around us on the UGMP is floodplain open space. There's no shown development. The only thing that would be happening is the proposed boulevard road here, as it was skirting the back of the existing homes, which were demarked as preserved, not a part of a future expansion. And up front is the LFUCG pump station. We have talked with. I guess it's they talk to you, Craig, someone we've studied it, and we can gravity flow our site into that existing pump station. So we have the sewer ability as it's right there next to us. And I believe everything else around us is negated as far as we're supposed to connect to it. There is a recorded access easement that comes off this realign Hume Road that services our property, I guess is a nice phrase. So we have our two points of egress. We'll be talking about how that's built and with who, because there was multiple entities in that agreement when it was established. A lot of the interior questions, I will deal with the architect, out of state architect who does multifamily housing. So he's not real up on Lexington's rules. We'll be discussing with him. Good afternoon, everybody. My name is Jennifer Reynolds. And I am the council member here in Lexington, Kentucky. For the 11th district. And I am joined today by some of my friends from Columbia gas. First we have Tim Vaughn. He is the executive director of Kentucky eight one one. And we also have Lisa Smith and she is the public affairs manager. For Columbia gas of Kentucky. So welcome. And thank you so much for joining us. Thank you. Hello, Lexington. First I wanted to ask off. What is it? What is the significance of eight one one or August 11th? So, well, let's let's two more questions. So let's take it. Eight one one is called before you dig. It is a. A vital part of any kind of construction project. And I say that, but, but when I use the word construction, That could be just my digging in their yard. Anytime you're digging, you're moving the ground for any reason. There could be utilities buried below that. So eight one one is a way that you can contact us. We notify the utilities in the area. We'll come out and locate your stuff. So that when you're digging. You know where that stuff's at. So your weekend project doesn't turn into some kind of catastrophe. Right. So if you don't call before you dig, what, what could happen? Sure. You could get into to a utility line. Some of them are enforced by different agencies throughout the state, particularly on the gas side. It's the public service commission could issue citations and fines for people who failed to get things located. Part of that. Part of digging. But, you know, you could cause an outage. You could get injured, which was certainly don't want that. It could cost you money. I mean, just think if you take out your own water line, You go inside and you don't have water in your house and how inconvenient would that be? And things like the fiber. Our whole house is run off of internet and fiber now. So if you cut the fiber line to you or to your neighborhood, you don't want to be that person. But with just the inconvenience of the outages that could take place. So if somebody is going to do any sort of project at all in their yard around their house, the first thing they should do is call eight one one. And can they report it online or is it just by phone? Yeah. So about 90% of the notifications that come into us now are done online. And that's Kentucky eight one one.org spelled out the word Kentucky. Yeah. And we'll take your phone call. We work 24 hours a day, seven days a week, 365 days. We're available. Obviously the internet is the same way, but, but yeah, you can go online and do it. It's very simple and easy to do. That's great. And so should we call eight one one just for a small house projects or should big development excavating projects as well? Anybody and everybody. If you're digging, the law defines digging as moving dirt with any tools or by any kind of machinery or hand tools. So you're using a shovel. You need to call the law requires it. And we're trying to prevent stuff like this from happening. This is a gas line where obviously it's a, it looks like a trencher maybe got into this or a backhoe tooth got into it. I mean, this is what we're trying to prevent. So what'll happen is we work with utilities like Columbia gas and all the major utilities around the state. They'll come out in above ground. They'll paint with a color code system. They're lying to code their lines. And you can determine what that is by going to our website and seeing like blue is water. Yellow is gas. Funny that the gas pipe is yellow. And that's what they located with is yellow. Right? So they'll, they'll locate where it's at. That way, when you start your digging project, you move over away from it. That's great. That's great. That's great. Once someone, you know, contacts eight one one, how long do they have to wait before they can find out if they can dig? Sure. The law requires that you have to wait too long, a two full business days, excluding the day that you make the request. So if you make that on a Monday, Monday doesn't count. You gotta wait Tuesday, Wednesday, you can dig on Thursday. So will they notify the person? Yes. You're clear. Or will they just not hear back or what happens? Yes. Yes. There's something called positive response, which is required by all the utilities who are notified when you call eight one one. And they'll, they'll send you a notification saying, I've located my facility for you. I've marked it in paint or something. There's something funny about, I need to meet you there, but it's that communication back and forth. So you'll know, you'll hear from all the utilities that are required to do it. You'll know what the status of it is. That's great. That's really wonderful. What is a tolerant zone? Okay. Perfect. Good. Good. So, this, this up gas line is located in your yard. Yes. A tolerant zone in Kentucky is 24 inches on each side of that, that you can't use any kind of mechanized equipment. You have to use hand tools within that. And that's just, that's just the tolerance on because although this, that I'm hold is pretty straight. Think of this as a fiber or a piece of cable. It could be snaking like that in the ground.
