What I'm concerned about, not concerned, but like to know about, everything that's on the other side of the greenway, has the development plan expired for that? Yeah, so this piece down here has been, I believe, built out. This other piece kind of to the back there, and if memory serves, they were showing a roadway connection that was going to extend further back there, and that may have been part of the complication as to why it did not get built out. But yes, the portions in the rear have since expired, and I think that was a 2018-2019 plan, so it just sort of hit that five-year window. So they would have to come back and really respond to whatever happens on this side as well. The reason I'm asking that question, I see where that Tucker Crossing sub-street comes across there. When they were developing those townhouses down there, the thought was that they would expand the road and it could come through the Tucker Crossing and develop that piece of property. Would that still be the plan? So yeah, this is an interesting exercise, and you know, there was a plan that showed connections to Tucker's Crossing. It curved a little bit differently, right? So it stubbed into the subject property here at a different location, but when your plan expires, that's when the new applicant coming in here is saying, well, we would like to relocate this roadway basically a little bit straighter. I think the original configuration, Tucker's Crossing, would curve somewhat. So the two, when you put them side to side, do not necessarily match up. And so that's going to be the fun of if this development would be approved and kind of taken through the rest of its process, the conversations would need to be had. And I think that's something that the applicant can also speak to as well. Any conversations with sort of Anderson on making those a little more intentional? I've been around too long. It's just I know the history of that. And I was just trying to get up to speed. Thank you. We did have a meeting with the other developer last week, I believe, and made them aware of this plan and that their plan had expired and that they would have to respond to this plan if approved. So they're aware of it. That connection over that greenway was just never going to happen. It was too expensive and they had to figure out another way to do it. Thank you. I probably should have asked this earlier, but just those two, we're looking at density. I'm seeing density, but also I'm concerned about green space and open space. So I'm assuming the floodplain is going to count as a lot of the green space, open space for this development. Is that correct? I think part one of the comments that was within staff's report was, I think, asking for a open space exhibit and kind of very clearly counting that out. Part of what we're looking at sort of on the zoning side of things is going to be the relationships here, like a very small portion of the sort of drive aisle for these lower units is actually being shown in the floodplain. So we had some questions about that. And so how this is going to be sort of accessed, how that's going to be sort of an amenity, how that's going to be responded, protected, I think is information that we're looking to kind of flesh out a little bit further as we go along, especially on the zoning side. And just one other question. This is probably as much for you as anybody. When I hear Andover Creek, I think flooding. Are there issues regarding flooding in this area? I'm thinking Andover development, not necessarily this part. I'm not aware of any existing issues in this specific location. I did have some just not really concerns that can't be are insurmountable, but there's things that aren't shown on this plan that should be related to the vegetative buffer, the greenway. There's a farm pond that they're filling in to build the townhouses on the south side, which were not on any of the previous plans. And there's not a significant area upstream from the farm pond, but there is an area that drains to and through that. So I'd be interested to see how they're going to manage that through the townhouses. All right. We'll hear from the applicant. Rory Kaley with EA Partners. I would like to start by asking that the U.S. Post Office sign off not be a part of my two week window, please. Yes. Yeah, I would say people have been around this as long as I have never thought they'd see this piece of ground up here on the screen. Yeah, Chris explained it very well. We've got a long, skinny piece of ground, two streets stub into us. We extend those two streets through the next parcel over built by Anderson. This open one that puts us about 200, 250 feet from Dixon Park. So there's proposed but not built a trail off the side off the street, but not necessarily impacting floodways, I guess. Something to come through here that will connect all the way down to Jacobson Park. We'll add that to our next revision plan. Both sides of us were developed by Anderson. I believe there was notes to that effect on his plans. He follows us out front. We can add the requested sidewalk out to Charlesburg. I don't believe Charlesburg itself will have any improvements. That's one of our scenic roads that are not to be expanded upon. Part of that was also in my statistics. I have to. It's been a while since I was an expansion area. I got to go in there and list this. Your scenic overlay was 60% and 40%. There's a lot of restrictions along here. We're at 67 townhomes. I know we're recommended for postponement discussions. We're trying to set up a meeting with planning staff to go through some of those access points and such. Let's see if there's anything here that has to be discussed. A lot of notes. A lot of statistics I need to add. No, I don't think there's anything on there that's insurmountable. I do have Nick here if you have any questions about the legal side of all this. Look, he's coming up here already. This is not legal side. This is nosiness. Okay. Given that we're going for townhomes here rather than apartments, so we've got somewhat lower density. In the last one, we heard a conversation about price point. I'm just curious. Are there thoughts about what the price point of these would be? We do not have price point right now because a developer can't tell you what a house is going to cost three months from now, much less three years when these are actually going to come online. There's just complete instability in the supply chain right now, and so it's very difficult to tell you, though. But I do want to point out that these are going to be sold, and so that these will be kind of owner-occupied units. It's not going to be what Ball usually does, which is own the entire complex itself. This has been kind of very successful. I think it was the potential that we did that first, and so they're kind of doing that on this as well, and that is also kind of in line with what the Anderson property was originally proposing as well. Since Daniel kind of brought it up, from a neighborhood engagement, he did a really good job explaining what a lot of the concerns were. I think we talked for 70% of the time about, well, this isn't just for you. This also brings the Anderson property on, and yes, that is absolutely correct. This enables him to actually come back and bring a plan that does take away the kind of roadway through the floodplain that I would agree is not very realistic. And so they just had a lot of questions about that. What does this mean from a traffic standpoint? There was a lot of consternation that this means that dumpsters, or like the waste management, will be driving through their neighborhood, not just to pick up their trash, but also the trash in this type of unit. Same with emergency. It was kind of one of the concerns I think we hear a lot in the expansion area. The width of the road and how people are parking on both sides leads it to be very difficult for fire trucks to kind of get through. All 100% legitimate points in part of the discussion. Daniel is also right. We spent a decent amount of time talking about activities at Jacobson Park and how they want the city to, I guess the city recently allowed it to be open 24 hours a day. And it has led to some very interesting things, including a fire pit that was in the middle of some pine straw, which doesn't strike me as the best idea in any way, shape, or form. But I kind of encouraged them that this is exactly what their city council leaders need to hear about is what is going on in their neighborhood and how that is impacting them. As far as the kind of overall design, we kind of requested a meeting with staff to talk about it. It's mostly kind of related to how the units are oriented, while also making sure we're in compliance with pedestrian rules that require basically a path to the front door for each unit. How that works with driveways and all of that jazz. And so we are happy to sit down and talk to them about that. Otherwise, it's a fairly simple plan in the grand scheme of things. But I also understand kind of neighbors concerns on what this does to a traffic impact standpoint. You may. I guess you said these are going to be sold. So is it going to be subdivided into parcels? So then my question is, who's going to own and maintain the storm sewers? So there's going to be basically a condo association and homeowners association that is required to kind of own all open space, maintain all open space. So it functions just like it would with if RML was the owner of everything. This just allows actual ownership opportunities for the units themselves. And the only other comment is, I don't know what the circle drive is on the bottom section. But it looks like it encroaches into the floodplain. Or the question is, how are you going to build it without doing that? You don't have to solve it now. This is preliminary, but we'll be looking at that. OK. I didn't think I'd ever see this done, to be honest with you. If you all had any preliminary discussions with Mr. Anderson to where his development would be complementary to this one, because you both got long, narrow pieces of property there. I'm not saying it's a joint venture. But have you had any discussion with Mr. Anderson? We have. And it kind of got left at, well, let me look at your plan. Let me look at my plan. OK. But yes, Paul and Anderson have talked about it. Everybody's kind of aware of the situation. And specifically, what this will create is, one, honestly, it's in his benefit because he doesn't have to build that road anymore. But it does lead to basically kind of a circular pattern that can occur between the two roads that we're showing, the Andover Creek and Tucker Crossing, that I think would be a major benefit to him. One of the aspects of his plan that I thought was, one, well done, but also I think one of the major reasons why he got the zone change is he did a single-loaded street onto Jacobson. Right. And so that, I think, would work out kind of perfectly with regards to how these two access points are shown right now. Well, I mean, if you're looking at the whole picture, then how it ties into Jacobson becomes a real question there. That was another neighborhood concern. If we're putting in a trail, does that mean people will park on our streets and walk to Jacobson? I got you. Thank you. I didn't want to mention that. But we are proposing a trail there. It makes us all a little uneasy as to the considerations given to the plan, how best we can understand what's going on. And all of this happening in a very short period of time for us presents communication challenges. It occurs to me that these plans are in violation of the COMP plan related to density of the area. And that's something that we're doing our best to understand. I'd like to kindly ask for a postponement until November that would give us an appropriate amount of time to organize some meaningful dialogue among the residents to help us understand what's going on. Again, for us, it's just, it's a lot that we don't understand and as much time as we can have to organize and understand what's going on would be better for us. Thank you. Any questions? All in favor. Okay. All right. So the next item this brings us to is P.L.N. M.J.B. M.J.D.P. twenty five fifty seven. So this is the Miller property. It is also a development plan that is being proposed in conjunction with the zone change request. And so subject property itself is this irregularly shaped parcel that's located. We've got Winchester Road here. And so directly across the way from Winchester Road, there is the Calgill development with the E.D. zone. And so this is a very interesting property because it is got areas that were both involved in the nineteen ninety six expansion area master plan. So kind of at a diagonal to the site here. So basically cutting through this portion here was recommended for E.A.R. ones that low density residential. The back piece was brought in with the most recent U.G. and P. master plan. So there is one recommendation for land use here and a completely separate framework and recommendation for land use here. So that is a kind of mechanically unique thing and is part of the reason why we have a total of twenty nine requirements, not met ten design considerations and fifteen plans, questions and concerns. So just off the bat, the kind of number of moving parts of this is rather large. So getting into kind of the specifics of the plan and and kind of the actual criteria description. So the applicant is proposing a residential development kind of located to the rear. So these one, two, three separate buildings are all multifamily residential with a small amount of commercial located near the front of the site showing an access off of Winchester Road and access easement stub into the adjoining property. And one of the most significant aspects of this development is this portion here. So this is a future proposed roadway that would serve and connect from basically Winchester Road extending north to provide access to those other areas, the other town centers. So it is only a portion, though, of the subject property. That roadway kind of needs to be shown and it is the responsibilities of the developers to construct. But kind of achieving that larger roadway network is going to require multiple different partners and buy in. So it is a little bit of an interesting aspect. So they have a roadway connection now, but we do have to sort of evaluate this with how it's going to kind of function in the future. So with all of that, getting into the notations and the comments for the kind of technical side of thing, the first four comments we have are various notes that relate to the building inspection process, alluvial soils, steep slopes, kind of our standard notes. Number five talks about depicting the existing easements. Six talks about the internal sidewalk connectivity must connect to the rear of the building. So there is a sidewalk network that extends through most of the site. However, the rear portions of the structures here and here do not feature that same connectivity, both kind of internally as well as connections to this roadway here. So most of the, the development here is a building kind of wrapped with parking. So the interactions between the pedestrians kind of navigating the site as well as sort of where we're putting our, our vehicles in our VUA areas is something that is kind of a larger theme throughout the entire video. Talking about item number seven, the access easement has to depict sidewalks from Hume Road onto the site and the cross of the drive aisles. Number eight is a dimensioning all walkways, driveways and parking areas. Number nine talks about adding stop bars at conflict points. So that's traffic engineering, as well as labeling a recreational area in the parking area. There is, I would zoom in a little bit. Yeah. There's a pickleball court shown kind of in the middle of this parking lot here. So there was some questions as to sort of how that would function be accessed and its location kind of on the site there. There were some comments from engineering relating to the floodway and greenway on the adjacent property that has implications with the buffer, kind of what needs to be shown, making sure that we're getting all of our all of our pieces on that particular aspect. So that's items 11, 12, 13, and 14 all deal with denoting that and making sure that we're, we're all in the right place on, on the vegetative buffer and the like. 15 fire says the note, no parking on the street cross section. A 16 talks about depicting the bicycle parking and storage that compiles with zoning article 16, 12, a 17 dimension sidewalks at five and seven feet at the appropriate locations. That wasn't initially clear on the plan where those varieties would apply. 18 depict the pedestrian connections to the Western road reservation and an ADA compliant access to the dog park. Once again, we've got this future roadway shown here. How are folks getting to that? How are the buildings oriented towards that? How is that going to play when that's actually constructed is, is one of the comments that kind of keeps coming up to pick the group residential exterior project boundaries. Once again, that's that 20 feet around the perimeter of the project just needs to be denoted on the plan. They need to provide an open space exhibits that corresponds to the site statistics. The front portion of the site has a completely different standard and threshold that 96 plan had it. It's own rules for open space. So we just need to verify that these numbers work and that these numbers work and have that denoted on the plan. 21 deals with the tree inventory map, having the correct certification at 22. Once again, that future Avenue roadway needs to be kind of shown what that looks like. They currently are just striping that as a road reservation at 23, depict all entrances to the structure. Once again, that future Avenue roadway needs to be kind of shown what that looks like. 23 depict all entrances to the structures. Once again, giving us an understanding of how these can be accessed and has implications on where they need to locate things like their bike parking 24, demote commercial and residential floor area for CC zone and the site statistics box. There are a minimum percentage of commercial and residential development when you're looking at that community center zone. So we need to verify that those are requirements are actually being met with this. Let's see here. We need to know the density and that same on item number 25, know the density to make sure that we are within the land use recommendation for the front and the back and to kind of have that conversation. 26 talks about removing a specific note on the plan. 27 deals with correcting the site statistics table for the floor area ratio. And then 28 deals with just providing the standard notes and sign-offs 29 is to list the interior view a canopy that's required and provided getting to waivers. None have been proposed at this time, however, if the applicant wishes to move forward, those could come online later. Design considerations. Number one is seeing the notes from the Division of Engineering. Number two, clarify who's responsible for building the access easement on that adjoining Kentucky Utility property. Three, consider speed tables or chokers along the southern and northern access, northern drive aisles. Number four, clarify if dumpsters are going to be used on the final development plan from waste. Number five, do the number of proposed structures. The plan will require the entrance drive from Winchester Road to be named, so addressing wants some further information on that. Number six, propose a connection from the northeast side of the property to the proposed greenway. Once again, the portions here are designated for conservation and for providing a greenway. Let's see here. Number seven, sanitary notes that the only sanitary sewer is a force main. Eight, KU requests utility easements along the front of the properties in Winchester Road. Nine, the UGMP Avenue location on the subject property and the connectivity that needs to be achieved with that. And ten, is considering the KYTC Winchester Road planned improvements and other improvements that are kind of anticipated along the corridor. Flipping over to the next chapter. With planned questions or concerns, traffic had a concern or question discussing the radiuses of the roadways between the open space and the courtyard buildings. Number two, engineering wants to discuss the preliminary stormwater report for the expansion area two. Engineering also has identified discussing who will own and maintain the stormwater management areas associated with this site. Number four, is they're discussing if a construction easement is going to be required. Five from planning side of things, clarifying some notes for the typical parking lots dimensions. Six is the multifamily design standard. So once again, we've got multifamily uses throughout this particular project. Those have their own design considerations, understanding that this may be sort of more conceptual in nature at this kind of phase. There are still aspects that speak to the site design, how that's laid out, interactions with open space and the like. And as part of the zoning recommendation for later to provide some more information on how those are being met. Number seven, discuss the CC zone maximum single use building size. So the CC zone on the front end of the property really is envisioned more as sort of like a town center. This is public space. This is mixed use buildings. This is sort of the mixing of the public, civic uses that was kind of basically the sole commercial areas for that 96 plan. One of the things that the plan called out at that time was we want to limit the size of single use buildings. So this apartment building that is located in the front of the site exceeds the maximum size that they're allowed to have in the CC zone for a single use building. If it was mixed use, multiple uses within that same building, that would not apply. But seeing as it is just a residential building, they need to reduce the size of that structure. Eight, discuss the parking areas between buildings and the public streets both existing and proposed. The expansion area master plan and the community design elements for the CC zone talk about not wanting parking between the structures and their roadways. And then that carries over as well with the expansion area master plan that was recently done. We have an anticipated roadway here, but the buildings are sort of recessed. We've got the parking and the garage areas and the VUA that's located between those. So that when those come online, there really isn't any direct relationship with that roadway. Moving on to the next items, discuss pedestrian connectivity to the amenity areas in the rear building. Once again, just making sure that that sidewalk network can kind of carry you through the site and get you out to the respective right of ways. Ten, vehicular connection to adjoining lots. The UGMP, the portions in the rear here, talk about when you provide parking lots of a specific size that you also provide vehicular connections to adjoining lots. This is an interesting scenario, though, as the adjoining lots here are mainly earmarked for conservation or have that existing roadway. So that may be something that the applicant has sort of a, there may be some wiggle room on kind of within the future as to where those connections are possible or not feasible. Let's see here, the required parking, yeah, bicycle parking. The UGMP areas have a larger threshold for bicycle parking and has some more guidelines on where those need to be located, so those need to be addressed. The active debt standards, once again, talk about when you have these roadways that were laid out in the plan, how is the buildings responding to those, not locating kind of parking in those vehicular use areas between those uses. We're really wanting to see those kind of addressed a little bit more intentionally. All right, 13, 14, 15, talk about kind of compliance with our respective plans. Once again, the Urban Growth Management Plan and the 1996 Expansion Area Master Plan both play into this site. They both play into the zoning recommendations for later on this afternoon. And then, as always, they have to demonstrate compliance with the place builder criteria. And as I am also wearing the place builder criteria hat, I'll just go ahead and talk a little bit briefly about that. The applicant also conducted, around the same time that they met with the proceeding plan, also conducted a neighborhood meeting that they can fill you in on more of the details. Concerns largely similar of what type of uses are going to go on here, how is that traffic going to affect the surrounding areas. My understanding is that this one, this particular meeting wasn't as well attended, but Mr. Nicholson can kind of fill that in. With regards to kind of place builder and the choice of zones, the front portion of the site was not recommended for CC zones. That was that low density residential was recommended in the Expansion Area Master Plan from 1996. Staff has some significant concerns on locating a CC there, both from the perspective of it being able to kind of, A, not being in agreement with the plan, but B, really being able to fulfill what a community center is supposed to be. There are other areas within that, the portion north of Winchester Road, that are actually as a part of the UGMP supposed to be formalized town centers. So we are getting it in this area, but the kind of the development that's sort of proposed and shown really doesn't meet the intent behind the zone. And so we are recommending disapproval of the CC portion of the site. The rear portion with the UGMP is right in line with the densities that the master plan that was recently adopted called for. It's just a matter of meeting the different place builder criteria in tweaking that design. So a little bit of an interesting feature that we are at a recommending postponement for the rear portion of the site with the R4. But we have, once again, significant concerns with CC on the front end. So we'll continue to have those conversations kind of with the applicant. They have done some public outreach. But as far as their compliance with Place Builder, it is mixed kind of between the two zones that are requesting. So happy to chat about that. We'll do a much more in-depth discussion later on this afternoon with that. But just taking it to the rest of the actual subdivision report, the tech committee recommended postponement. Once again, there are sort of outstanding questions regarding the EAMP and the UGMP. But if the plan is approved, we have the seven sign-offs, including the postal service and a requirement to correct all noted deficiencies loaded on the plan. So with that, I'd be happy to entertain or any questions you all have about subdivision, place builder, the whole framework. Once again, this is due to the multiple plans intersecting on this one particular property is a very mechanically complex site. Thank you. Any questions? Daniel. Yes. I don't know where to start. But, you know, we could talk about this for an hour and a half if we wanted to do it. The question that comes here is how do we make this clear enough of what's happening that we can get any kind of coherent public discussion in our meeting? I mean, this looks like something like a dog chasing its tail. I think, you know, one of the benefits of just the timing on when the subdivision committees occur, unlike, you know, normal subdivision items, which would be heard next week, we do have that kind of three-week window. So I think at the bare minimum, we have a recommendation of postponement on one aspect of the plan, a recommendation of disapproval on from the zoning side. So I think some of these questions, some of these are just simply cleanup items denoting the right things, et cetera. There are a handful of kind of design considerations and things to kind of tweak and look at that I think can be sort of addressed during that time period as well. But there are going to be a couple aspects that the plan has kind of put forward, especially within that CC portion that staff is going to have a very hard time kind of dealing with. So I think that, you know, between now and when this is scheduled on October 23rd or kind of further, that we can kind of clean some of this up. But yes, it is. I don't know if it is the record, but it probably is fairly close as far as the number of conditions that we kind of just have to sort through, some of which are very workable. Before Lori gets up, it's almost a perfect storm. It's almost a situation where two things lined up, and I don't think we ever anticipated this happening, but yeah, let's hear it. Rory Keeley, once again, Nick's in the back to support me. Yeah, two different expansion areas. I want to show, I don't think you guys have the UGMP slide, so I know the cameras can't see it, but I wanted to give you a print of this page. So our site is right here on Winchester Road, just outside the interstate. That dash line through there is the difference between the EAMP out front and the UGMP in the back. We've had at least five meetings with staff trying to figure this out. No one could figure out a way to let this all fall under one review, one zone. What you have here is from the UGMP, and it shows that out front along Winchester Road, they want commercial use, but the EAMP wants you to have single family homes there, the EAR1. Our road reservation, you know Hume's been rebuilt. I believe everything on our frontage of Winchester's done now. So Hume is supposed to have a connection coming across from the Cowgill at that light, be built through the KU substation, and then runs along our property. And then we have a very large greenway, another pod, a greenway crossing, and another pod, and a greenway stream crossing. That road that is going to be on someone else's, that's why we're having a reservation, because if we were to build it today, it would go nowhere for quite a while, because I don't know how you build across KU, and a logical point might be here, but this area is listed as protected. So those homes are not supposed to redevelop and provide vehicular. So a lot of our comments in there where we talk about how we're addressing the perimeter of our site, we feel that our perimeter is not on the table. But we're not going to connect to it. We can run a trail to the open space of the floodplain. That makes sense, but we don't see that we're going to have roads expanding in any direction from us other than this one that we show as a reservation. And with that, we also centered our residential development in the middle, and we pushed the parking to the perimeter, because we don't feel as though we have a neighbor we would be imposing parking spaces onto. It's logical, and I don't think I need a waiver for this sort of layout. It's just not what they envision in their ordinances. Yeah, so there's, and one of the things to add as well, you all adopted the Urban Growth Master Plan. One of the kind of key components that is sort of still dragging on or is still kind of under consideration is the infrastructure funding plan and whatnot associated. So as it currently stands, you all have seen a couple of different plans come forward where basically their infrastructure was already, say, in place or kind of working forward. This is one of the first sites where we really have a piece that really is just a section, right? Having to kind of talk through what the appropriate, you know, we believe that this is going to get built, and the plan dictates, hey, you need to be showing these features and be designing to this. We understand the applicant's kind of position on this is going to take a lot more than them just to come online, and that is sort of the difficulty with that funding plan still being outstanding. So there are still some moving pieces to this, but we can't also, you know, on staff's end, disregard the plan that we just adopted. So we're asking for the postponement on the zoning side to talk through some of those implications, what needs to be shown, and that they are correct that, you know, we have one land use recommendation for the rear, but we have to play by the 96 rules on the front piece is the framework that we've got going there. So once again, very mechanically complex on this particular property. Sanitary sewer-wise, we are right next to the pump station. We've met with them. We can gravity flow to that pump station, so that infrastructure is fine as far as engineering design-wise goes. The road is another one. Stormwater comes through our site essentially in between the two zone areas. We've got a large stormwater management facility planned in there. You know, we have access drives essentially top and bottom of our plan because we're wanting more than 100 units. I've got to have two ways out. Our access onto Winchester is limited there. State just built it. That's our only right in, right out. With the state doing that, I know, Frank, you love the access easement, but this is a recorded easement that was from this property over to the new Hume so that there was an option as well. So, I don't know, there's so many things to talk about. Yes, let's remove the post office. That's the easiest one. Lots of notes, lots of cleanup. Floodplain all around us. There is no FEMA floodplain on this property. It's all in the green way off-site. Really, I guess I just need to open it up for questions. And Nick. This is pure curiosity because it doesn't sound like this is going to fly, but in the commercial area, the proposed commercial area, what you're thinking about what that commercial space would be used for in front of the apartments? Is that a drive-thru? What are you thinking there? It's to be determined. We're not showing any type of drive-thru right now. It's more of kind of what we're seeing with, you know, a couple of different retail spaces similar to what we're seeing. As just a general aside, if anyone was worried about that, we're going to see a rash of development in the expansion area or the new expansion area. I think that staff report should say it's going to be okay. There's a whole lot of design considerations that are going to be very difficult to meet across the board. Most of what is on that report are just kind of cleanup items as this is the first time we're going through it. I still don't know what the active depth standards in the urban growth management plan are. That was a first to see that in the staff report, but I'm looking forward to finding that out. Don't know. We'll find out. This one is a challenge. You have two maps, one from 96, one from this past year, that directly conflict. We understand we have to comply with both, but when they're direct conflicting, you can't. And so what we looked at it was you have an EAR1 recommendation. I personally think that if we brought an EAR1 on this piece of property, we would not be found in compliance with the comprehensive plan. We might be found in compliance with the 96 expansion plan, but it would directly conflict with place builder. It would directly conflict with what we're trying to do on corridors, on arterials, putting density on those areas, especially up front. And so we didn't go that direction. We went CC because what else can we do in the 96 plan? I was hoping that because this sliver is so small, that we would be able to do some type of zoning that's from the traditional kind of urban, inside the urban service B3, for example, where we would be able to have residential. You could have commercial, but apparently that was going to be found in violation of Article 23 of the zoning ordinance. So we're left with, do we want to do entirely residential up front, even though the urban growth management is very much encouraging, especially on the arterials, a mix of uses? Can't do TA, transition area doesn't work on this piece of property. Can't be economic development because it is not a large enough parcel, and so it's automatically disqualified from that zone. And so that leaves us with CC. CC has a lot of challenges that comes with it, namely the size of the building. We've only seen one CC residential site actually built. It's tough. It can be done with regards to kind of pockets of apartments. You know, I think actually not two, well, one's built, Dennis is building the other one kind of currently. And so we think it makes sense from a standpoint of we're trying to show a mix of uses. We're trying to have them kind of integrated, and we're trying to focus on residential because the new plan that just got passed called for this entirety to basically kind of be residential with a commercial component. And so we brought a plan in. We got some design work to do, to say the very least, but we'll keep working on it. The road reservation originally came from a conversation with staff that it kind of made sense to show it as a reservation as opposed to actually build it out at this time because of the difficulties that Lori kind of pointed out. You're T-boned into a KU substation and a greenway. So that would be an interesting roadway. It's also right in the back of the Hume Road neighborhood, and so it would be truly building a road in their backyards. And so that is certainly a concern. And by the way, I think this has always historically been pointed to this would be the easiest piece of parcel to be developed that was not being developed because of where the 96 line kind of cut off. I just find that kind of just comical. And so we'll keep working on it. Neighborhood engagement. I had a meeting with the Hume Road kind of Neighborhood Association. It's unaffiliated, but they're a very tight-knit group, as I'm sure some of you all know. Most of the conversation was around stormwater. And folks that kind of ride in this area, they definitely know that there is a lot of stormwater that goes across this property into the floodplain, and that's kind of why we're showing the large management area that we are. Other kind of concerns were mostly about the realignment of Hume Road and kind of the impact that that was going to have on their daily lives and what the plan was to kind of tie that tie into that for this site. One interesting comment I actually got was that we should go ahead and build a podium and go taller on the apartments as opposed to kind of spreading out the multiple different buildings around the back. That's the first time I've had a neighbor suggest that we go up next to their property. But that's about it from what we've kind of heard from neighbors so far. This one's going to be fun. In the form of vernacular, and this is a damned if you do and damned if you don't, this is where the staff's got to earn their money. And the lawyers. And the lawyers. And the engineers. Well, I don't consider Rory a lawyer. But my point is this. Whether there's a will, there's a way. But it's going to have to be on both sides of the fence. And I don't know how much leeway you have with two different complaints. You know, I mean, that's, I've never seen us get in this box before. I guess we have. I don't remember anything like this. There weren't many split parcels in 1996 at all. This is one of the few. And one of the kind of, you know, I hate to use the word comical parts, but one of the interesting parts is the reason why this got brought in in the EAR1 is because that was supposed to be the path where Polo Club was going to continue over and realign Hume Road. The only reason why that's not happening is because LFECG built the pump station directly in the path of that road. And so, once again, it's just a litany of circumstances that have all kind of brought together. Well, I think, you know, we'll work something out. Yes, sir. It's just a question of what, legally, we can do and what we can't do. That's exactly right. Yeah. Well, and the other complicating factor out there with the expansion is who's willing to sell and who's not. I mean, that drove a lot of that. I mean, truly, so the parcel just to the east, not the LFECG, but the ones that basically, you know, is next to the rear part of that, that is what I think we looked at. It was like 75 percent floodplain, like an overwhelming amount of floodplain on that piece of property. And it is also owned by someone that is not too interested in developing it. Is the hill road on the other side of Winchester Road, is it set in stone, it's what it's going to be? Yes. So, I think that light. So, you've got to tie it to it. Yes. It's what it's meant to. I think that light is coming online within weeks. And that's one reason why we're showing the right-in, right-out, as opposed to kind of a full-access point on Winchester. Okay. The next item on the agenda under the postponements, the FRP-2514 Boonesboro Manor, the applicant had postponed to come back and kind of look at what, kind of address the couple of things that we had brought up. And if you'll remember, let's see, they were proposing for Hattrick Way to be a public right-of-way without an appropriate termination. So we've, they have submitted a revised plan and submitted a waiver. So I just want to kind of go through this. The applicant's not here and that may be on me. I think I told them that they need to come back to Planning Commission and really they should have come back to this committee. So I'm going to go ahead and present it with, or present the revisions. So right now they're proposing to create 16 lots and then they need a finding that access to lots provided solely by an access easement is appropriate. They submitted a revised plan on September 23rd and they informed us that they no longer wish to request that Hattrick Way be accepted as a public right-of-way. And then based on that, we're recommending approval at this time. So what they're actually proposing now is that Hattrick Way will be a separate parcel with an access easement across it to provide access to Tract 1E and I believe that's 1D. And then as we talked about before, Doe Run will be also a private access easement across a separate parcel. So in light of that, we recommend approval with the standard sign-offs. This kind of goes back before our House Bill 443 changes. So we're still kind of working from an old staff report. So what remains are the sign-offs for engineering, traffic engineering, landscape, landscaping, forest dressing, urban forester, environmental qualities approval of environmentally sensitive areas, bike ped, green space, addition of utility and street light easement as required by the utility companies and the urban county traffic engineer, documentation of the approval of the capacity assurance program, postal service. And then finally provided the Planning Commission finds an access easement as sole frontage for a lot is appropriate. And that mainly affects Tract 1E and this Tract 3, is that B I believe? And so with that I'll open it up if you all have any questions. Is this the one that originally had traffic going into the Starbuck parking lot and turning around? How does this solve that problem? It won't change the traffic flow, it just, basically now they're not asking for it to be a public right of way, they're proposing it as a private easement. They'll still have to, but what this eliminates is the need for a termination of a public street. Was that trick not already determined as an access easement on the plat for the first two lots? I mean, I think there's a plat that already had it as. Is it common for an access easement to be on a separate parcel all by itself so that, Usually I thought it, you've got two parcels and then the access easement crosses both so you have it, and I just don't remember I've seen that before. Yeah, I think, I had the same thought that typically your property boundaries would meet and then it would just be an easement maybe splitting the difference. I mean this is similar more to maybe like an HOA situation where the HOA owns the right of way tracks, you know, that in a sense are a separate lot. Yeah. Yeah. I think initially they had two, the section to the south was trying to dedicate to public and then the north, that access easement, they still wanted to gate the section to the south so when we said you can't gate a public street they took that off and then of course now they took the access easement off. So I guess this is just to dedicate the lot or to make the lots, right, create the lots. Yeah, correct. Any other questions for staff? Have we really solved anything? Well, it won't ever be a public street. But the way it functions from a traffic standpoint, I don't think it's going to change anything. I think the big, well, aside from the fires issue with the public street, you know, kind of precedent that was set was just bringing something in as an access easement and then trying to flip the script, you know, a year later and say now it's a public street was pretty, we did not like, you know, that was not a good method. I don't think it leads to a lot of moral hazard, you know, if that's an idea that's worth accepting. So that was probably as big a thing as anything, you can't just do that. Are you comfortable with it now? Yes, yes, you know, they prescribed it, described it as an access easement to begin with, we look at it as such and we can give, you know, feedback on it, but what we don't want is there to be the risk that six months later now it's a public street because then we didn't look at it that way. The most recent frameworks brought in the agricultural zones, so we had the urbanized, the standard urbanized zones, the agricultural zones. One of the areas that was not addressed at that time were the PUD zones. So those very, very site-specific, it's an incredibly small percentage of acreage of Fayette County, even within our urbanized areas. But they weren't included on the handy-dandy chart that allows for short-term rentals. So in order to bring the PUD 1, the PUD 2, and the PUD 3 kind of into compliance, or to give them the same framework that everyone else in Fayette County is afforded, we've got a staff alternative text here that basically allows the PUD 1 and the PUD 2 in the same places as they are allowed, because they're residential zones. And then the PUD 3, which is the Turner Commons development, that's like that entertainment district, commercialized area, ax-throwing, the distilleries, the whole nine yards, those to be considered within similar uses. So this is getting everybody above board to the same kind of standard, so staff is recommending approval. You've got the text in front of you, it's, you know, nine or ten words, total change, but really it just allows PUD 1, PUD 2, and PUD 3 to be treated similarly to the rest.
