## Farm 6-2006 Easement Amendment Request

[timestamp: 01:12]

The Board took up a discussion regarding an easement amendment request for Farm 6-2006, owned by Brendan and Olive Gallagher. The item was presented as a request to remove and replace a tenant house located on the property.

Key speakers during this agenda item included Beth and property owner Brendan Gallagher.

The Board ultimately **approved** the request, with the approval contingent upon the following conditions:

- Removal of the existing dilapidated house on the property
- Obtainment of all necessary permits prior to proceeding

No additional concerns, debate points, or dissenting positions are reflected in the available record for this item.

## 2026 Meeting Calendar

[timestamp: 09:29]

The board took up the 2026 meeting calendar for discussion and approval. Key speakers on this item included Robert, Phil, and Hannah.

The primary point of discussion centered on a proposed modification to the standard meeting schedule: rather than holding separate meetings in both November and December, the board considered merging those two meetings into a single meeting to be held in December. This consolidation was the notable structural change from a typical annual calendar.

Following discussion among the board members, the resolution was approved. The 2026 meeting calendar, incorporating the combined November/December meeting in December, was adopted as presented.

## Treasurer's Report

[timestamp: 10:33]

Phil Meyer presented the Treasurer's Report to the Board. Meyer noted that there were no invoices for the month, and that appraisals have been ordered. The report was informational in nature, with no action required from the Board.

## Vice Chair's Report

[timestamp: 11:07]

Robert, serving as Vice Chair, delivered a brief informational report covering two topics: an upcoming program deadline and a recognition of a contributor.

- **Program Deadline:** Robert noted that there is an upcoming deadline associated with the program, alerting Board members to the time-sensitive nature of this matter. No additional details regarding the specific program, deadline date, or required actions were captured in the available record.

- **Recognition:** Robert recognized Maynard Ferguson for his contributions. The nature of Ferguson's contributions was not further detailed in the available record.

The report was informational in nature, and no votes or formal actions were taken as a result.

## Closed Session

[timestamp: 17:40]

The board entered a closed session to discuss potential real property acquisitions. Robert was identified as a key speaker during this portion of the meeting. The session was informational in nature, with no final action or decision recorded as an outcome of the discussion.

Closed sessions of this type are typically held to allow the board to discuss sensitive real estate matters — such as negotiating positions or acquisition strategies — outside of open session, as permitted under applicable law. The specific properties or transactions under consideration were not disclosed in the public record.

## Full transcript

Yes, I will go ahead and share my screen and provide their report. Let's see. Computer has chosen to freeze. Yeah, it appears you are frozen now. Recording stopped. Recording in progress. Sorry about that. Okay, let's see. There we go. All right. Okay, so this is Farm 6-2006. It's located at 3800 Old Frankfurt Pike. It is almost 81 acres. It is a horse farm owned by Frankfurt Parkland Inc., which Brendan and Olive Gallagher are the members. The date of the easement was October 14, 2009, and it was placed into PDR by the Gallaghers. It is a federal easement with an impervious surface limit of 2%. It has stone entrances and stone walls and fences that are protected in the easement, but no housing. They are requesting the removal of a dilapidated tenant house and to replace it with a tenant house that will be approximately 1,680 square feet of indoor living space. They are not requesting any paving, as there is already access to this home. The building plans and a photo of the dilapidated tenant house are attached, and it is a permitted use per Section 5B, Reserved Rights, provides the right to construct tenant housing and to repair and replace existing housing. The Gallaghers operate an active horse farm and need the housing for farm workers. The staff recommendation is approval of the request contingent on the removal of the dilapidated tenant house, and the Division of Building Inspection will oversee that. The farm is at its limit with three houses, and so they have a process where there has to be a requirement, and I think they maybe do a small bond, although this one may be a little different since it's going to be built on the same site, but they go through a process where they ensure that the other house is removed. And so the other requirement is the all-necessary permitting being issued by the Division of Building Inspection. The approval is based on the following criteria. The easement grants the right to tenant housing, and the request is in compliance with the impervious surface limit. The conservationist recommendation, Charlie Farmer, has no concerns with housing of similar size being removed and replaced, and that's especially good in his mind because you're not creating a new area of impervious surfaces. And then here in your packets, we had the entire text of Section 5B that allows the tenant housing. And then in your all's packets, we sent out one house, but they have decided to replace this one instead. So they sent us these pictures, so the one on your screen is the one they're going to replace first. And so this is the front view of that, and this is the rear. And they are doing that because they like the location of this one better. And so that is it. This is a rather easy one because it's a removal and replace. And so we can invite, Kara McDermott is here on their behalf, and she has another guest with her. And we can let them introduce themselves, and if they have anything to add. And also, if you all have any questions, please let me know. Let me see. You all are on mute. Hi, Beth? Yes. Yeah, Beth, my name is Brendan Gallagher. Oh, hi, welcome. Nice to meet you. I'm hearing there, I know Kara was dealing with this here. We actually have the wrong address. When you said 80 acres, that 80 acres, we have two plots. We have one plot of 140 acres and the other plot was 80 acres. OK, so these particular houses are on the 140 acres. OK, so that plot runs from Elchester to Old Frankfurt, and that is an Old Frankfurt address as well, but it's not the 3800. OK, OK. All right. I think the form said 3800 Old Frankfurt, but that's OK. We can work with you on this. How many houses do you all have on the property that this is on? It's just the three houses. There are just the three houses. OK, OK. So, OK, so. I'm pretty sure that this one, yeah, it's 2150 Old Frankfurt Pike is the actual address of the 140 acres. And that's where these three tenant houses are. OK, OK. All right. And that's the only housing on the farm, right? That's correct. That is correct. OK, so on that farm, you all could actually have four houses due to that size, one primary residence and three tenant houses. So if you're removing one and replacing it, you're well within your bounds. So I'm OK with changing this if the board is. Yes, are there any objections to that? What was the actual address? 2150 Old Frankfurt Pike. It doesn't make sense. That's in that's in town. That's closer to town. Olive, could you show me that? Beth, can you confirm that the easement terms are the same for this other parcel? I assume that they are, but just I think that we should get that. You know, OK. So. We have here, we don't use the second address as such, if you know what I mean, because. The two, the 3800 is actually, it doesn't adjoin the other farm. I'm not sure how aware you are, but when you go back, when we did the PDR, we put them on two separate paths. And what I have here is we have a location number one, 3800 Old Frankfurt Pike. And then we have number two, 2150 Old Frankfurt Pike stroke, 1575 Elchester Road. OK, I have pulled it up, Mr. Gallagher, and it is 4150 Old Frankfurt Pike per the PVA. So I will quick and it's under your name and it's 140 acres. And it does have, and it does have three houses. I will quickly look at the easement. Let me quickly find that. I mean, it's probably the same terms, but I just want to confirm that. Yes, and Robert, while I look, if you want to go ahead and do the calendar, the 2026, we could do that while I research this just a moment. OK, OK, I'm going to turn off my camera a minute. Yes, no problem there. And Mr. Gallagher, if you'll just hang tight while Beth does that research. No problem. Sorry about that. No worries. We'll go ahead and to our next item of business, the 2026 meeting calendar, which has been sent in the packets. Same same criteria that we've been using these past few years. Are there any concerns about the calendars proposed or any comments? And likewise for next year, we'll be merging the November and December meetings. To happen on December 9th, instead of at the end of the month. Looks good to me, Robert. Thank you. Looks good to me. And Robert, I don't know that Beth saw I got on, but I'm here now. It's Hannah. Hey, Hannah, welcome. Welcome. Thanks. Would either of you care to make that a motion? I'm so moved. I second. Okay, Phil has moved to approve the 2026 meeting calendar. 2nd is by Hannah. Is there any discussion? All right. All those in favor, please say, or give me the show of hands. Opposed anyone. Motion carries, thank you all. Phil, if you'd like to go ahead with the treasurer's report. Just to give Beth a little more time with the research there. All right. Hang on just a 2nd. All right, we didn't have any invoices this month. Charlie submitted his September invoice early and we included that last month. He's taken a. A break from November to February due to the weather. So, so I don't have any bills to talk about. Appraisals have been ordered and those invoices will be coming in soon. That's all I've got. All right, thank you. And I can deliver the vice chair's report. As it is basically, um, our, uh. Our deadline for the program is November 14th. So we're under a month away from that. So, if there are any last minute contacts that you all can make. Or any questions you can answer for people out there, please keep that in mind. Try to make a push to get some more people in. Also, just personally, I should say the county farm Bureau. Honored Maynard Ferguson at our annual meeting last week. And he has served as the director for the program. He was the 1st director of the program. He's a longtime county agricultural and natural resources agent with extension. And someone who's been very involved with farming and county for many, many years. And so we honored him with the title director emeritus. Is a pretty exclusive club of farm Bureau members who have gone above and beyond. And their commitment to agriculture in this county. So we were proud to recognize him. So, I will just go ahead and call on some people if there are any reports you have to deliver. 1st, I'll start with our chair, Miss Gloria Martin. Thanks, Robert. I hope you all can hear me. I kind of come and go here. I'm a long way away and 7 or 8 hours different. So, it has been an interesting time for our both of our programs. And I have had questions and I do think we're going to have a great turnout. And some people who are still very interested in our small farm program. The alliance who works closely with us and is very supportive of what we do opted to have their farm tree week that they were doing on it. I think she was going to say they had their tree walk on their farm. Yes, I'm not sure. I wasn't able to go, but the next day. I guess I was gone. And so, I think that I think they were happy, but I don't know because I haven't talked to anybody since. So, but I am happy that they wanted to do it on a PDR farm. Yes, that's very good. Very good. Okay, so, yes, so we do have this 1. It was placed into PDR on January 29th, 2010, shortly, just about a year after the other 1. It does cover 4150 and 4160 old Frankfort Pike as well as 1353 Elchester. And it does allow for the removal and replacement of housing. It does not have any protected structures. Even the other 1 had stone fences and a stone entrance and things. This 1 only protects the natural elements and does not protect any structure. So, I think that we are fine to move forward if you are okay with that. I'm fine with it. Beth, thank you. Okay. Okay, are there any other questions? Oh, let me quickly. You know what, Robert? I will grab the number for you all. It is farm 3, 2009. So, we're instead of 6, 2006. Okay, are there any other questions for Mr. Gallagher about farm 3, 2009? Are there any questions for Beth? Okay, do I have to ask the question or will someone oblige? I make a motion to approve the request to move and replace the tenant house on farm 3, 2009. I'll second. Thank you. Motion has been made by Margaret Graves and seconded by Gloria Martin. And a last call for discussion. Okay, hearing none. All those in favor, please show of hands. All opposed? Motion carries. We'll have 1 extension, please. 1 abstention. Joanna abstained. I wasn't able to follow all that. So, I'd rather not put a yes or no. Just want to thank you. Thank you, Mr. Gallagher for joining us here and good luck with the construction. Thank you. Thank you very much. Thank you all. Yes, take care. Robert, I will try to continue to vote. I realize that I think maybe I'm coming and going because sometimes I can see you but can't hear you. So, I'll try to vote each time to make sure you have a quorum. Yes, thank you. I realized as the chair, I'm technically not supposed to vote, which I have to pull my hand down, put it up. But we will pay attention to make sure we see your hand or not going forward. So, next on the agenda, we will just move into the closed session. We have some members who may have time commitments coming up, and we want to make sure that they are here for the votes that come after the closed session. So, I will ask for a motion to enter closed session pursuant to KRS 61.8101B to discuss the potential acquisition of a real property interest, the public discussion of which is likely to affect the value. Is there a motion? So moved. I move. Okay, I'll second then. Okay, Phil Myers moved and Joanna seconded. Yes. All those in favor, please say aye. Aye. Show of hands. Any opposed? Okay, motion carries. Lex TV, if you will take us off the air. Okay, are there any motions from the closed session? I'll make a motion to approve the offer for Farm 3-2024 as discussed in closed session. Thank you, Margaret. Is there a second? Second. Oh, I saw Hannah's hand first. And I will ask our, I'll ask Gloria if she can turn the camera around on the phone so we can see her smiling face. But. Oh, there she is. Okay. Okay, good deal. All those in favor of the motion, please signify by raising your hand. Okay, any opposed? Motion carries. Thank you. Is, are there any other motions from closed session? I'll, I'll move that we approve the appraisal for Small Farm 20-2025. Thank you, Phil. Is there a second? Second by Steven. Okay, all those in favor, please show your hands. Okay, motion carries. Thank you. Is there another motion coming out of closed session? I'll move that we make an offer for Farm 21-2025 as discussed in closed session. Thank you, Margaret. Is there a second? Thank you again, Steven. Okay, all those in favor, please show your hands. Okay, all opposed? Motion carries. Thank you. Now, we had finished our, the chair's report and the treasurer's report on the farm. Chair's report and the treasurer's report. I will ask Beth if there's anything for the staff report now. No, nothing additional. Okay, thank you. Board members, let's just go round robin. I'm sitting in the catbird seat so I can pick on you all and call you out to see if you've been doing anything interesting lately. Let's start with Phil Meyer. Well, let me see. I have an activity that went on in the rural area last weekend. You all may not be aware of something that happens at the horse park. I'm a track and cross-country official in some of my spare time, and they had an event out there last Saturday, if you were to happen to wonder what the traffic jam was at the front gate. They must have had 4,000 or 5,000 kids, fourth grade and under, sixth grade and under, middle school, running, I think there was about 10 or 12 different races that went throughout the day in the back of the horse park. So something you might not realize that goes on out there. So they were running cross-country, open grass, or are they in a... Open grass, 1,000, 2,000, 3,000, 4,000, and 5,000 meter distances. All right. I did not know that you did that. All right. Margaret, anything to report? No, I've signed a couple of easements that I think will be recorded shortly. So as soon as they are, I'll let you know. Some in Oldham County. And so making progress, continuing to put more land under easement. So making progress, continuing to put more land under easement. Always. Thank you. Jonathan Disney? No, nothing to report. All right. Will Mayer? No report. Thank you. Thank you. Johanna? Yes, I attended the Kentucky State University Pop-Up Conference, and we had two new pop-up after, of course, I don't know if you know Dr. Kirk Pompa. He used to be the Dean of the Agriculture Department. They named a pop-up after him. We have three already named, and we named two. So he's number five. And then Alex Dunigan, which is my sorority sister. I have my Greek letters on today. She was the first Afro-American correspondent in Washington back in the, I think, like 1950s. And they named a pop-up after her. So there's five in the history of K-State. So there was number four and five was named during our conference. So that was something special to be there for those namings. And I was offered opportunity to grow pop-up, but I had to decline. I'm not going to be a pop-up girl. All right. Pop-ups are starting to hear more about them now. After so long. Yeah, and then K-State has the L.A. 8 that a representative from Winchester, Missouri, said that it has made more money than the strawberry or the blackberry L.A. 8, I think. It's really doing well, but it won't be anymore once that quantity is already made. They won't be making any more. It's a limited edition. So I hope everybody's got their case. I know Kroger's was selling it for like $3.99 about a month ago. So I don't know if they're still out there, but you might want to get in touch. It's really good. If you haven't gotten your Pawpaw L.A. 8 one yet, go stock up because it won't make any more. Thank you. All right, Hannah, anything to report? No report. And if I did, I couldn't even follow up that awesome report. So no report. Thank you. All right, Stephen. Nothing to report other than I have had a Pawpaw L.A. 8 at the country store in Avon. So it was pretty good. Pretty good. My wife really doesn't like me drinking L.A., but I got one because it's a flavor I hadn't had before. Good. Gloria, we already, you already delivered a report. I, and I don't see Council Member Morton on here right now, but if he is listening. I am listening. I do not have a report. I don't. Recording stopped. All right. Thank you. Thank you, sir. Well, that is bringing us to the end of our agenda. Of course, our next meeting will be the combined November-December meeting on December 10th at 3 p.m. So far, it looks like there will be a lot on the agenda that day. And as we wrap up October, of course, Thanksgiving is coming up. So hopefully you all have a happy Thanksgiving and a happy Halloween before that. And we'll all meet up again on December 10th. And conduct the business of the Rural Land Management Board at that time. So it is now 3.58 p.m. And is there a motion to adjourn? Stephen has made the motion to adjourn. Is there a second? I'll second, Joanna. Joanna seconds the motion. All in favor, please raise your hand. Okay, it's unanimous.
