I was lucky enough to get promoted to commander and oversee the special investigation section and really taking a large push with the team to get this technology, newer technology for our city to help us protect the community. Well when we talk about technology, your name always comes up. And actually it was either the second or third episode we ever did of the show was talking with you about where we are today, the Real Time Intelligence Center, and all about technology. So now we're talking about another area of technology that's being utilized in public safety, both police and fire, all across the United States, and that is drones. And so we're going to be talking a little bit about that today and all the different ways we use it. So how did this whole program start here in Lexington? So right around 2018, the police department, well I guess drones as an entity to be used for public safety, started to really come into public safety for policing. The Hazardous Devices Unit, which I'm the commander of also, started looking at that as how could we implement a drone to help us on a scene, make sure that all the scene is completely safe. We can put people in certain places, which is fine, but I can only see one plane of sight. And if we're doing any kind of countermeasures or anything like that, it needs to have a third view and it's much quicker for us to be able to look at an overall safety picture for whatever that scene is. We started looking at that in 2018, like I mentioned, 2019, we did some exploration to get a grant to fund that. And then COVID happened in 2020, it kind of slowed us down. We purchased our first drone at the end of 2020 and implemented it in early 2021 for the bomb squad. And what that did is allowed us to support not only what our operations were, but we also support our Emergency Response Unit, which also has the crisis negotiators with them also. So any kind of call we go out, we provide that third perspective, an overall view of the overall scene for the commanders there to make the decisions to help protect our folks that are on the ground, but also the people who are responding to help. So you had mentioned some of the areas in the police department where the drone is used. I'm still on patrol, so we also have some drone operators on patrol. Do you know how many we have across the board? So when we finally, we saw how it works so well with us using it, the hazardous devices unit and also with our ERU response that we knew that we probably wanted to start migrating and allowing it to get out to patrol because that's where people needed the help. You're responding to calls for service where things are happening in seconds and they need that backup. If our airship is up, our Air One unit is phenomenal. We don't ever want to get rid of that one. They have much more capabilities than we do. They can fly farther and longer and fly higher and do different things. The drone is there to provide that immediate response. So what we did see is the need for that and we implemented a patrol drone program in 2024. So when the drones were put into patrol, we put one in each sector. They've been recorded. We have a copy of that in the file. The next step would be to demo the existing building prior to certification of this plan when it's approved. And then after that, they'll do an ADU pre-conference and then they can obtain their building permits once they've satisfied all those requirements. So I just kind of want to give everybody kind of a picture of what's going on on this site, what their final intent is. Okay. And back to the staff report. Under requirements not met, number one, denote this property will be developed under Article 3-6 of the zoning ordinance to take advantage of the workforce and affordable housing bonus provisions. The provision allows properties in an R1C zone to be developed using the R1T zone standards The declaration of covenants and restrictions signed by LFUCG and the applicant and recorded in deed book 4166 pages 735 through 738 shall continue in effect from December 1st, 2025 to November 31st, 2040. Only LFUCG or its successors and assigns have the right to release said declaration of covenants and restrictions. Number two, depict all existing and proposed easements. Number three, denote addresses for each lot. Number four, depict front yard building line based on existing location of principal structure. And that's under zoning ordinance Article 15-2A1. Number five, denote easement maintenance note. Number six, correct zoning and site statistics to R1C. Number seven, correct purpose of plan to match staff report. Number eight, denote all missing land subdivision regulation standard notes. Number nine, minimum lot frontage is 60 feet per zone. Subdividing lot would make it more nonconforming in the R1C zone. Number five, verify if there's a known lowest adjacent grade or flood protection elevation for engineered swales, constructed channels, detention basins, surface inlets, or street sags. Number six, are there any environmentally sensitive areas on site, stream, floodplain, wetlands, sinkholes? Seven, discuss workforce and affordable housing bonus. And we did initially recommend postponement because we didn't have all the information, but we do now. So as I said, because we got new information from the initial submittal until this time, we left it as postponement. But we do feel like the plan can be approvable if the conditions are met. And then if the plan is approved, following sign-offs, engineering, traffic engineering, landscaping, addressing, urban forester, environmental quality, bike ped, open space, addition of utility and street light easement as required by the utility companies, and the urban county traffic engineer. Number 10, documentation of division water qualities, approval of the CAP program requirements. Number 11, U.S. Postal Service sign-off. And finally, number 12, correct all noted deficiencies listed as requirements not met herein. And with that, I'll open it up to the committee. You can take me off of them. Is that enough? Ashley Furniture is in here. We saw this a while back. Oops. They have a cul-de-sac with a hotel here. The cul-de-sac was built so that we had access to this piece of property in the rear. The purpose of this plan is to dedicate Lot 3, which is the cul-de-sac. They want to dedicate it, the access easement, to a public right-of-way, and then we need to add an access easement up here on Lot 1, because I'll show you the development plan after this so you'll understand. That is for the second access to the development in the rear because they're wanting to put in apartment buildings, and anything over 100 dwelling units, you have to have an access easement, so I'm explaining that. The applicant is also requesting a waiver for the construction of the sidewalk on the south side of the cul-de-sac. The cul-de-sac was built and it only has the sidewalk on one side of the cul-de-sac. So with that, it says, denote all structures shall have a floor that is not partially or completely underground, that is at least one foot above the elevation of the nearest downstream. Addition of utility easements and the access easement and correct title. On the previous plan, there's access easements through, and then there's a gas easement that goes through the middle of this. They hadn't submitted anything within the two-year window after the 2019 when it was last approved. So this needs to be a preliminary development plan for the proposed layout for the apartments and the clubhouse. So denote no building permits shall be issued unless and until a final development plan is approved by the planning commission. Correct plan type to be a preliminary development plan. However, there are a lot of concerns about this access easement, the construction of it, and stormwater from public streets is usually in a public easement that goes to an additional public system, but this one goes through a private, I think, underground system on the private property, which is not something we would ever want to own and maintain, so there's some conflict with that. Matt, before you launch into this, so my recollection, and I think the documents support this, is you originally wanted this to be a public cul-de-sac, public street. The reason it's recorded as an access easement is because you did a non-build plat to create the front lot, and we couldn't dedicate a street on that. So it had to be an access easement to basically leave this L-shaped parcel as a remnant, and it was a non-build. So we have a condition where you have an access easement, but I think document-wise, it seems like you intended for it to eventually become a public street. Is that? That's true. It's always been intended to be a public street. It was designed to public standards and built to public standards as far as the right-of-way width, the pavement cross-section, the cul-de-sac dimensions meet the public dimensions. The only exception is the waiver we're asking for the sidewalk on the south side. That's the only part of it that doesn't meet the standards. And Tracy, I'm glad you said why it was access easement because I could not find that in our records while we had done that. That's what I had anticipated was there was issues with timing of it and being able to do the hotel without the street built. To that point, to be a public street, we need the standard documentation that we would have for a public street, which I don't know if we have that. I don't know if we have CCTV for the storm, inspection reports, all the standard stuff. So we'll have to make all that fall into place to make this happen. So I don't know if that bond will count towards this being public or if there will have to be a new one issued. But I totally agree. We'll have to go through. And if as-builts weren't submitted before, all of our inspection reports, all that, we'll provide copies of all that to engineering. Matt, on the rector plat, you show one cross section for that sidewalk on that cul-de-sac, but it doesn't extend all the way around like it shows on the development plan. So that's the other question. I didn't look at the old development plan that actually showed this on there. So I don't know if you need to construct that or show a different cross section where that sidewalk ends. It doesn't go all the way around the cul-de-sac as it's shown on the proposed, what will be a preliminary development plan next go around. Does that make sense? It stops short. It may go to the back property line where it stops. Right. So I just don't know if you need to show that as a different cross section on the plat. Okay. Because with the section that's on there now, it kind of indicates that it's, I would think, all the way, at least around to where it would end. And number two is the property to the south is higher in elevation. So if you go out and look at it, it slopes up from the edge or back of curb. It slopes up into that lot. So Hagerman Court is higher in this area and slopes down So there's a retaining wall that starts about here Where it's between one to two feet tall and as you get down to here you get to about six feet in height So I What we were proposing would just be to exit the building out of the front door hit the sidewalk along stone Come down and pick up this sidewalk that runs along Hagerman Court I don't know if that would be an acceptable solution as opposed to having to cut through that retaining wall I think it's how you're showing your ADA Access is the one that's a requirement is the connection to all adjacent public rights of ways. This is weird because it's to Lots, so I'm not sure how that impacts that but you also don't have an ADA compliant access at the front of the building Which I think ADA requires it to be okay at your main entrance it can't be like a secondary entrance and and so that would also help you with you need a sidewalk going from Not Hagerman Court, whatever the camera the name of the road adjacent stone all the way back to your To your ADA compliant access from the public right-of-way, so I Think the way to well, I'm not sure on the access to Hagerman Court. Depict solid wall fence enclosure for outdoor storage area. I guess I'd like some clarification as to what's the definition between outdoor storage area versus VUA area versus accessory parking. Because I know there's some currently all this open space, the existing gravel area is used to park, you know, these folks operate a truck crane business primarily. So there's any number of large vehicles that come in and out of there as they're using them. So I'll let you tell me how you think that should be defined and whether or not that's accessory parking or VUA. Is any of it new? No, they don't sell any vehicles. New gravel? No. All the areas you've denoted on the development plan are existing gravel? Yeah, actually the existing or the proposed building area is currently gravel as well. I think you're fine to keep gravel where you are because it's an existing condition. I would say as you move forward if they want to do more of something, if it's gravel it has to be like where you're storing pallets. The pallets don't move, they're just there. Or you're storing windshields or something that's not movable. If you're storing trucks, instead of it being stored there, it's really parked there. So that becomes a parking space and a vehicular use area where you're driving. So in some cases you might have a drive aisle that's paved and then storage to each side of it where it could be gravel. Basically it's where you're driving. Over the years it's just like a lot of places in this zone, it's just evolved to be whatever we need to use. It's just space that we can use. The area that we're proposing building has some stuff that doesn't move there. It's not necessarily junk but just things that will be cleaned out and that's one of the reasons they want to build is get all that stuff indoors and just use the gravel area for their crane truck parking and access. That's a zoning issue but the storm water issue still has If you have storm water that's sheet flowing off of it or something like that, you probably would still have to treat that as impermeable area to make sure it's not... So back to I guess my question on the right depicts solid wall fence enclosure for outdoor storage area. Is there an area on this plan that needs to be fenced that you see that we're not showing? Because we're not adding any new gravel area. I guess that's what you're explaining, right? Generally outdoor storage areas are supposed to be fenced in the I-1 zone. So if your whole lot encompasses that maybe it's the side here where the gravel piece is that you would fence that off. So it's not bleeding over into... Number 10, denote construction access. We actually have a note for a construction entrance on there. Just wondering if you didn't like the location or maybe just slip through. Scott, the sidewalk I guess notes 13, 14, and 15. I just want to clarify on 13, provide sidewalk from the new building to adjacent right of way. So essentially you want to see sidewalk from our new proposed area all the way through the existing site all the way back to Duncan Machinery Drive. And I know you hear this all the time, but there's no sidewalks on either side of Duncan. I'm just trying to make sure that it follows the requirements of the ordinance. And we can work through this maybe one-on-one, but if there's hardscape that we could define an ADA, even an ADA path along it, but it's not a defined sidewalk with edges on each side, but most of that area is paved concrete. It's supposed to be grade separated so that it can't be parked upon or run into. And then the bicycle parking and storage. That would be for whatever your parking is for your new building. So you can kind of delineate what that is. So if you're saying we're only having 10 parking spaces or 20 parking spaces for this, then you could just... The way this would function is there's existing parking adjacent to Duncan, kind of northwest corner of the property, and then there's parking on actually the adjacent property. That's where all the employees park and there's not really any new parking being proposed adjacent to the new expansion of the building. It's just going to kind of function as it does now, just with more space. So we can add parking at the office up by Duncan? That might make the most sense. I think it would be more likely to be used there. Yeah, so whatever you think would be applicable. I was just saying I think you could go down to just one rack and two spaces because these kind of sites, we want it to function as it's intended, so that would probably meet the intention of the ordinance. And then 15 5-foot sidewalks to the limits of the property boundary along Duncan? Are you saying you want it parallel to Duncan? Yeah, generally that's how we start getting those connections on these roads where they're not there, is we start building that sidewalk in so it has the different properties come in. So the back of that sidewalk needs to be at the edge of right-of-way and the sidewalk constructed on right-of-way? It can be, yeah. Yes. Yes. Right-of-way. We've seen people do them on, depending on what's the most you don't want it too far off, right? But if there's grades or something that makes it more amenable in another location, sometimes it makes it so you don't have to have a curb, you know what I mean? So just, you know, sometimes they do it integral to the sidewalk, right? It just depends on what your condition is. This street not having any curbs, it's the storm water. We'll have to look at that and see what makes sense, but we'll figure something out. And then no new dumpsters are going to be proposed. Storm water management I think, you know, if we're allowed to count all that existing gravel as impervious area, we're adding very little impervious area, but we will have to demonstrate that, obviously.
