Before we start our agenda today, we do have one item that is going to be postponed. Mr. Gross. Or I don't know if postponement or reschedule is the proper term. Here on behalf of the applicant, this is on matter 3A, the ED ZODA. This morning we were at the Subdivision Subcommittee, and my understanding is that the Planning Commission members would like some more discussion time between now and us presenting before you today. And so with that, we are comfortable with a one-month postponement, with us being back before you in a month. We will also come back to the Subdivision Committee. We have also been requested to do that. And then there has been some discussion on us attending the work session. We will make ourselves available if you want us there, and so we just need to be told whether to show up and what date. Because I think this is a, is this a five-month Thursday? Jeremy Young from Planning Staff. This is PLN-MAR-26-5. It is for Anderson-Andover Country Club, and it's for one-third of an acre, and it's a portion of 3433 Country Club Drive. The request is from R1T to B1, and the intent is to expand an existing parking lot that is shared by three separate businesses. One of them is Carson's Restaurant, and there's also an athletic facility as well as an event space. And so you can see the subject property here, and it's roughly a half-mile from, I'm sorry, oh, there it is, Man O' War is here, and then you've got the interstate here, so it's sort of located in the middle, sort of where Andover and Autumn Ridge neighborhood all meet. And the zoning of the adjacent properties, you can see there's a variety of different zonings in the area. The orange area is R1T currently, and then the darker brown is R4, you've got the lighter brown which is R3, and then the green areas are agricultural urban. Those are remnants of the Andover Golf Course, or the Country Club Golf Course. And you can see here, this is part of the redevelopment of the golf course that was approved I think in 2019, and the existing commercial area, and then the adjoining neighborhoods you can see in the area. And for this application, staff recommends approval. We feel that it meets the goals and objectives. It helps ensure the viability of a neighborhood amenity. It ensures that the site remains accessible by various transportation modes. It can be constructed with minimal grading. They're already redeveloping the area, as you saw in the overhead, so the addition of the parking lot would not have a great environmental impact, and it should be noted the applicant states there won't be any trees removed in association with this project. We feel it meets the policies. The site already has multi-modal access. It invests in an existing neighborhood, and it increases access to that neighborhood amenity, and it meets the development criteria of land use. It expands the accommodation for vehicular access while maintaining multi-modal options. Transportation walkability, it's a shared parking situation, so as I mentioned before, there are three commercial uses on that property. The restaurant, the exercise facility, and the event space. It meets the environmental sustainability. Like I said, there's not going to be any tree removal involved with the addition, and it can be achieved with minimal grading. Meets the development criteria for site design. It provides an amenity within a neighborhood-focused open space. And it meets the criteria for building form as it maintains the scale of the adjoining residential neighborhood. And if you have any questions about the zoning, I can answer those. So the Carson's structure is the former clubhouse, so it's there. And their parking lot is built, as well as the kind of lower parking lot. So there's nothing built there, but they, as Daniel kind of mentioned off-microphone, they will have to have a landscape buffer between the B1 and the R1T zone. The image. Oh. So there is currently a buffer that was installed adjacent to the parking lot, and they'll basically have to either leave that there and double up, or move it to that outside edge. Okay. All right. Of course, Dick Murphy here on behalf of Anderson Andover Country Club Incorporated, and Tony Barrett is our landscape architect, and we agree with what the staff had presented to you on this. As you know, a couple years ago, well, probably more than a couple years ago, Dennis purchased this, the Andover Country Club building, and went on a quest to find the best possible user to be a welcome addition to the neighborhood, and I think he's found it through Carson's, and the proof is that they need more parking out there. They have parking all over the place, and they need to get it in a parking lot. So we're proposing this simply to support the success of Carson's, and Carson's has an event venue there as well, plus there's a separate fitness facility in the building as well to support those businesses, which have been, I think, very well accepted, very popular in the area, and have done well, and done what we want a neighborhood center to do. And I wanted to update the staff also on our community engagement. This morning at the subdivision committee, I mentioned that Mr. Anderson had had a meeting with the president of the association of the, that has the fourplexes, the one-story fourplexes, which often are called pinwheels, and that they left it that if they had any further questions or wanted a meeting, we would have a meeting. I updated that with Dennis over lunch, and he said that the neighborhood association had gotten back to him and said they were generally agreeable to it. They're still, Dennis may do some additional planting at their request for the, but other than that, there was, seemed to be no objection to it. It is currently home to a church with an accessory child care center and conditional use permit. The request is to convert, or to rezone the property from R1T, I'm sorry, R1B to R4 in order to convert one of the structures to five apartment units. And they are also requesting a variance for a landscape buffer from 8 feet to 1.7 feet, as well as a conditional use permit to operate that church and accessory child care. So you can see here, it is in close proximity to New Circle Road. There's Clays Mill, and there's the park on Wellington Way on the other side of New Circle to give you an idea of where it's located. The adjacent zoning, it's all either R1B or R1D. The lighter is R1B, with the darker yellow being R1D. And you can see the location of the property here and where this would take place. They're proposing to convert a portion of this structure here, basically, or roughly from where this T forward would be converted to apartments. And the applicant has indicated an enhanced neighborhood, as well as medium density residential development type in their request for R4, and you can see that both of those are recommended in that place type. And staff recommends approval. We feel that it meets the goals and objectives of the comprehensive plan. It's to address the high demand for housing in Lexington, expands housing choice and variety in the area. It's generally dominated by single family homes, as you saw on the zoning map there. It's almost exclusively R1 zoning in the area. It would have a minimal environmental impact, as they're proposing to use an existing structure. I think really the only grading that would be involved would be the addition of the sidewalk from Claysville Road to the facility. It meets the policies of the comprehensive plan, complies with the multifamily design standards, it provides infill residential, and it's intended to meet a wide range of income levels. The applicant has indicated that they, while they're not pursuing any sort of official affordable housing status, I think they are going to indicate that they're aiming this toward lower income users. And they're using an existing structure, which would integrate well with the community. It's already an existing structure that's been there since the early 60s. It meets the development criteria for land use as it increases residential density with an infill project. It meets transportation and walkability by improving pedestrian access with the addition of the sidewalk. It meets the environmental criteria. As I said before, there'll be almost no land disturbance, and they will be increasing the tree canopy. It meets the site design by utilizing the existing parking. We have ample parking on site, and it will be used for the residential, for the church, and for the child care facility. And it meets the building form criteria. It's retrofitting an existing structure, and it minimizes contrast and scale due to the fact that it is already an existing structure and, you know, currently present on site. The associated development plan is PLN-MJDP-2616 for Clays Mill Baptist Church. So we've got Clays Mill on plan left, and then New Circle Road is to plan south. So this does show the existing church. So this is kind of the main part of the building. And then there's a wing here, and then the portion in question that they're wanting to convert to living units is this smaller kind of arm of the building. The daycare sits behind the church building, and then there's also a residence, and I don't think they're proposing any changes to the residence at all. And then the associated parking, there's parking kind of in the front, and then between the daycare and the church, and then there's a larger parking area in the rear. There is also a stub from Noel Court to the property in the rear, and I believe their detention is all back here in the, that's a regional, is that a regional basin? I don't remember if they said. They are proposing some new sidewalk connections on the plan, but they're not proposing any changes to the existing structures externally. It's going to be an interior remodel for the units, and it does look like they're proposing three one-bedroom units and two two-bedroom units, and again, all interior. Scott Chutey on behalf of the applicant. We're in agreement with everything staff had said. Like they said, we're not applying for any type of federal housing credits for low-income, but this is going to be geared to congregation members and people that work at the church currently. Just by the nature, the rent will be much lower than, I think, the average in the area. We're not changing anything to the building, just adding those five units, and the one variance request is not as a result of anything that's happening in the current construction, but just a result of the property as it currently sits. Yeah, we have some info on the variance and conditional use. Okay, so the variance request is for the zone-to-zone buffering, and the applicant is requesting a reduction from 8 feet to 1.7 feet to reflect the existing conditions on the property. I have a couple pictures here that sort of demonstrate what the current conditions on the property. So this fence line is roughly the property line, and so any reduction or any upholding the standards would essentially mean that they would not be able to use that drive entrance. Well, actually, it's an exit, but wouldn't be able to use that drive aisle for vehicular use. And then the other side is essentially similar. It's got the larger entrance there, and you can see what the current condition is with the vegetative buffer there. So staff recommends approval as it is the current condition, and approving the variance wouldn't affect health, safety, or welfare of the community, and the need for the variance is not a result of an action taken by the applicant. It's unique circumstances on the property there with the existing entrance and exit, and the strict application would deprive the applicant of reasonable use of their land and the conditions predate the current zoning regulations. The zone change requires them to apply for this during this process, so staff recommends approval. We don't feel that this would negatively impact the area. They've got ample parking to support all of the uses that they're requesting for the property, and all the necessary public facilities are in place to support those uses. But we also carry over the conditions that were put on the child care center when it was approved by the Board of Adjustments. They must be operated in accordance with the submitted materials and the development plan. They must obtain all necessary permits for building inspection and the planning department, as well as comply with the Kentucky Cabinet of Health and Family Services requirements for child care centers. The property is approximately 0.6 net acres or 0.64 gross acres, and it is located at 456 East High Street. The applicant indicated in their application materials an enhanced neighborhood place type and a low-density, non-residential mixed-use development type. And the applicant is seeking to rezone this property in order to open it up to a wider range of uses. So this is a vicinity map. So we can see... No, I haven't done this before. Okay. And they aren't proposing any exterior changes to this property, so there shouldn't be any extra review that's required in that regard. And then this is just to show the property without the overlay so that it's a little bit more clear, but you can see that the building, existing building is here, and then there's parking on the south side of the building, as well as on the rear of the building. So this property line right here is where the variance request is going to come in. So they indicated, the applicant did on their application materials, that they are seeking an enhanced neighborhood place type, as well as the low-density non-residential mixed-use development type, as well as the neighborhood business or B1 zone. So staff is in support of those. As you can see, they're recommended for this place type. So staff recommends approval of the application for the requested zone change to a neighborhood business or B1 zone. So staff finds that the proposed development will respect the context of the area since an existing structure is being used. It will be introducing neighborhood-scaled and oriented businesses, and it will retain existing pedestrian connections, which are all in agreement with the 2045 Comprehensive Plans goals and objectives. And then, additionally, the B1 zone is in agreement with the Comprehensive Plans policies because an existing structure will be repurposed with no exterior changes. So the character of the area will remain, and pedestrian-friendly connections are being provided to other commercial uses that can be found in the neighborhood. The justification and development plan are also in agreement with the development criteria, with the current office space having, it will eventually have an expanded list of uses that will provide neighborhood amenities. And again, the pedestrian connections are available, and the property is in close proximity to transit stops, as well as the transit center. The existing tree canopy will be remaining, and native plants will be used for any new landscaping. Additionally, the existing parking area that was located on the side and the rear of the property will be used in no expansion as being proposed. And finally, the existing structure minimizes significant contrast in scale, massing, and design, which are all meeting the building form criteria. Staff does recommend several conditional zoning restrictions to limit the type of uses that are permitted on this property. So this list includes 13 uses, and these conditional zoning restrictions are the same as those that were approved by the Planning Commission in 2023, when the property that was north of this subject property was being rezoned, also from a P1 to a B1. That was the application PLN-MAR-23-3, Red and Roses LLC. And the conditional zoning restrictions at that time were derived from the, were those that were present on the parcel with the Kentucky Native Cafe and Michler Florist, and those were approved in 2013. So staff has an agreement that prohibiting the uses that are listed will provide development that's oriented towards the existing neighborhood, rather than the traveling public, and will provide safe pedestrian experiences in this area, while also protecting the character of the Aylesford Park Historic Area, as well as the High Street Corridor. So with that, I'd be happy to answer any questions you might have. Thank you, Ms. Browning. Do we have any questions at this time? I know for clarification's sake, when we were debating the parcel next door, Mr. Pohl was on the commission at the time, and he and I requested that tattoo parlors and funeral parlors be removed from the restricted uses. So these are not exactly what we discussed in 2023, because those two are still here. We can verify, yeah, we can verify that we're pulling forth the correct, the intent is to match the existing context of, so if we need to update that, we will. Do we approve it? Yeah, oh yeah, I mean, that would be my preference. If we recommend approval, that it be specifically on the record with those two. The funeral parlor would be necessary, because we just banned it. Ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha ha Okay, so thank you for that clarification, Mr. Forrester and Mr. Wilson. Okay, all right, if there are no other questions, thank you very much. Thank you. All right, the associated development plan is MJDP 2620 for the Red and Roses, and again, this is the existing bakery and Kentucky Native Cafe. This is the subject property with the existing structure and existing parking lot. And again, as Ryle said, the variance request is for this rear property line along the back of the parking lot. Basically, it's an existing condition, and they're requesting a variance for a reduced buffer. Really, again, they're not really making any changes to the site, and so the development plan just kind of reflects what's there, and so I'd be happy to answer any questions if you have them. Okay, thank you, Mr. Chaney. Do we have any questions on the development plan? Thank you very much. Okay, so in addition to the zone change, the applicant is also requesting two variances. Article 18-3A1 of the zoning ordinance states that for any office or business zone except for P2 that adjoins any residential zone, there shall be a minimum buffer area of 15 feet adjacent to all common boundaries located behind the building line except street frontage, which will contain one tree per 40 feet of linear boundary or fraction thereof, plus either a double row of 6 feet high hedge or a 6 feet high fence wall or earth mount. So the provisions of the ordinance were added in order to decrease light and sound impacts on adjoining properties that might be caused by events or activities that could eventually occur depending on whatever business were to occupy this property. So the applicant is requesting to reduce the required buffer area between an R3 zone and the proposed B1 zone from 15 feet to 4.4 feet, which is roughly a little less than 4 feet 5 inches. And in addition, they are requesting to eliminate the requirement for the 6 foot fencing along the rear property line. So here's the development plan again, but just with the red box, that's the property line that is in question. And the applicant touched on several points in their justification for the reasoning for their variance request. And some of those included that the applicant is going to be retaining any of the existing landscaping that's already present on site. And they argue that it will be sufficient to screen the use without requiring the full 15 foot buffer with the 6 foot tall fence. And they also note that installing the fence could damage existing trees. They also mentioned that the variance won't be an unreasonable circumvention of the zoning ordinance because the applicant is not seeking to make any new physical changes to the building or to the vehicle use area. They explain that their request represents a special circumstance that justifies the need for an ordinance because of the lack of physical changes that are being proposed. Additionally, they argue that strict application of the zoning ordinance would create an unnecessary hardship by requiring either a reduction of the paving that's already on the site or removal of the existing landscaping. And finally, they indicate that the conditions on the property predate the current zoning ordinance requirements and that they are seeking the variance prior to establishing the use on the property. So the applicant themselves haven't done anything to create special circumstances which would impact the property. So this is just a photo of the site to give a little bit of a clear indication of where we're talking about. So the property line starts at this rear corner. This is the retaining wall and then extends this way behind the property. So this is what the current screening looks like. And then staff does recommend approval of the variances. Approval of the landscape variance should not adversely affect the public health, safety, or welfare, nor should it create a hazard or nuisance to the public. The subject property has operated for over 70 years, I believe since 1954, without creating a hazard or nuisance and without the required landscaping buffers adjacent to the adjoining residential zoning. And additionally, the proposed fencing would disrupt the existing trees and the existing vegetation in this area will be sufficient to screen views of the use. With the lack of on-street parking on East High Street, the reduction in parking that would result from incorporating the 15-foot wide landscape buffer would unreasonably restrict the applicant's use of the property. And the circumstances of this variance are not a result of the actions taken by the applicant subsequent to the adoption of the zoning ordinance. Finally, this recommendation of approval is made subject to the following conditions. So number one, provided the Planning Commission and Urban County Council approve the requested zone change to be one, otherwise the requested variances shall be null and void. Secondly, the development shall be constructed in accordance with approved final development plan or as amended by the Planning Commission. Third, all necessary permits shall be obtained from the Division of Planning, Traffic Engineering, Engineering, Building Inspection prior to construction and occupancy. And then finally, action of the Planning Commission shall be noted on the development plan of the subject property. So if there's any additional questions, I'd be happy to address them. Oh, I'm sorry, Mr. Murphy. I'm entirely out of order. I'll be quick. You don't want to hear from me. That's okay. No, Dick Murphy here on behalf of Bread and Roses LLC. And as you know, Bread and Roses LLC is a company owned by the Mickler family. I'm pleased to have John Mickler with me today, who is the fourth generation of the family involved. And, of course, Robin Mickler is the fifth generation of the family to be involved. I just want to give you a little background on why we came in for the zone change. Mickler's employees have parked on this property for several years. They leased the spaces from Hubbock, Hubbock Interior Design, which was the current tenant. Hubbock had been there for, I don't know, 20 or 30 years, but they did not own the property. They leased their space from somebody else. The property came on the market for sale late last year, and the Micklers put in a contract to purchase it, thinking that Hubbock could be there for a long time, and that would give them time to choose, find out what the future use of the property should be. Well, two weeks after they signed the contract, Hubbock came up and said, by the way, we're closing our Lexington office and moving out. And they, in fact, have moved out as of end of February. So we want to get the correct zone for this so that the Micklers can tell tenants what they can and cannot do with the property, hopefully in a B1 category. P1 is a zone which is not a highly demanded zone right now for pure professional office. As you know, B1 gives you the ability to do P1 uses plus commercial uses. So that's what we're looking here for. No exterior changes are proposed on the lot. We are asking for the variance, as was stated by the staff, because we feel that we want to keep the landscape area where it is now at its current width and that putting a six-foot fence down the property line would not be in the best interest of the trees because there's a lot of significant trees that straddle the property line. And the only other thing I wanted to mention is we have had public engagement on this. An open house for the neighborhood was held a couple months ago at the bakery building next door, the one we got rezoned a few years ago. And three or four neighbors did come, and it was more informational than anything else. I don't think there are any major objections raised. I have not had a chance to talk over with the family the conditional zoning restrictions. I'll do that, and I know staff will be looking into that too if we have any issues with those. we'll talk talk those over with the staff on it so with that with that little caveat want to state we do generally agree with what the staff is proposing to you thank you thank you mr. Murphy do we have any questions for mr. Murphy mr. Murphy would you be opposed to recommending if this committee recommends approval removing the the tattoo parlor and funeral parlor from the restricted uses no none whatsoever all right thank you very much just want to check yes sir mr. Mickler okay hopefully our final item on the agenda today is PLN MAR 26-8 South Broadway project owner yes good afternoon everyone Daniel Crump planning staff the request before you today is a request to rezone a little bit over a five acres consisting of three properties located on South Broadway so that's 1021 1057 and 1059 South Broadway currently these portions of these properties are zoned before the wholesale and warehouse business zone they're seeking a b1 zone specifically with a form race project which we'll get into a moment the intent behind this is to establish a mixed-use building that is going to consist of 262 residential units within a 75 foot tall structure so about six stories it's going to have integrated parking within the center of the structure as well as approximately 900 square feet of office space on the first floor with respect to place type and development type they're seeking to kind of locate this on the corridor context and so the corridor as it's transitioning into downtown and campus where they they opine that sort of higher density is appropriate within the corridor the place type and development type are recommended as well as the applicants choice and zone as long as they can make the context argument of that to the Planning Commission from a public engagement perspective staff attended the neighborhood meeting with the Gulfview Neighborhood Association the the Neighborhood Association had several comments pertaining to the asking questions about the size of the structure number of beds screening and the relationship to those surrounding properties there were some questions about access and traffic to the site as well as a question on if these would be of any of these would be affordable housing units so staff was there the applicant and his their team took that feedback and we do have a representative from the Gulfview Neighborhood Association in attendance today if you'd like to ask some further questions so without further ado the site itself once again a little bit over five acres here located on South Broadway this is near the intersection where Red Mile transitions the to Virginia so here we have sort of downtown in the University of campus east of that site and this being a before formerly the the Avis car lot use so zoning in the vicinity you do have kind of a mix you've got these business zones and former before existing before is this light purplish color so this is what that existing area was we have some commercial across the way with recent rezoning some to the b1 for a form-based project directly across the street that was the old Grogan site that was recently within the past couple years rezoned for a six-story form-based project to the rear we do have some residential so the subject property does directly adjoin single-family residential uses to the rear that was a big point of discussion with the neighborhood and it's something that we're keeping an eye on as well an aerial view kind of shows how this property is is currently being utilized and it's based on the aerial imagery you can see that there's not really a much efficient use of that five acres of space they have an existing office buildings located down here that were associated with the Avis use but largely has been sort of vacant or used for a sort of automobile storage once again you can see the single family within the golf you neighborhood kind of located to the rear and then a smattering of commercial uses on the opposite side there do appear to be despite being zoned before a couple of residences one of the things that staff would like to point out and it would be kind of a discussion point as we move through this process currently the site fronts on South Broadway and only is deriving their vehicular access from South Broadway during the pre-application conference and earlier today during the subdivision committee staff noted this parcel to the rear which to be clear is not owned by the applicant but staff looked at that the density that we are looking at at this site and asked the applicant to explore or check into the feasibility of coordinating with that property owner to potentially get a second access to help disperse traffic get folks that are wanting to head across South Broadway towards Virginia provide sort of alternative paths if possible to sort of explore those and kind of bring that into the conversation with staff so from the once again the place builder perspective corridor Harrodsburg Road is slash South Broadway is one of our highest travel traffic corridors it's an area that the comp plan tells us moving forward with redevelopment we should look to try to prioritize higher density where it makes sense incorporating that additional residential where it makes sense the applicants choice in development type with the high density is recommended as is the form-based b1 code as sorry form-based b1 project as a part of that the applicant has submitted a character study that basically details where in the surrounding vicinity basically from here to campus and downtown are similar buildings present and it kind of informs some of the design choices that they're choosing with the site so we'll have some of the renderings and information from that presentation well right now so basically the the product that the applicant is describing once again is having that first floor office and leasing space and then the rest of the building being wrapped in multifamily residential they will have once again internal parking for these users as well as a small turnaround area in front of the lobby as well as an exist I mean not existing a proposed parking area surface parking to the side for visitors and users of that that commercial space here they also have to kind of set the context for some of these discussions they provided this sort of aerial rendering or view so once again we are talking about a large singular structure that height wise matches up with the the grogan property development across the way once again as you go further into campus you get more of these examples of buildings of that size and scope but wanting to also be aware of the interaction between this building here and these single-family homes to the rear making sure that that's being respectful and being considered with all of this and so there are a handful of aspects and I'll actually go back to the site plan to kind of or the front piece to kind of talk through some of the aspects that we were looking at staff is looking for a little bit more information with a couple of aspects one namely being the utilization of sort of the front part of the property so due to the presence of a significantly old oak tree in the front part the applicant has chosen to step that building back they are providing a tree protection zone and open space in that area staff is looking to see if that area can be better connected and more integrated within the use as the only entrance to the front of the property is through that lobby so there isn't you know long that's pretty significant frontage other ways to access or use that amenity so we wanted to provide some feedback to the applicant to explore the feasibility of that seeing if there was a way to change or otherwise improve that that turnaround in front of the the building it's sort of the first thing that you interact with on the site other than this beautiful oak is this this vehicular use area so seeing if that could be either a better transition or relocated and that use for extra building space open space amenity space etc once again conversations about potential access both you know with pedestrian connections kind of along the frontage of the site but also exploring the potential to disperse some of that traffic and provide a secondary access that would help guide folks in a couple different directions we're also looking for some responses to while they have provided renderings just written responses to some of the multifamily criteria so otherwise this does meet a lot of the the aspects of the comprehensive plan goals objectives and policies but we're looking for just a little bit more information on some of these aspects but at this time staff is recommending postponement Chris Chaney will be on to discuss the site plan which may help make some of these comments make a little bit more sense but for now I'd be happy to answer anything on the zoning side of things okay thank you Daniel do we have any zoning questions mr. Cronin thank you no thank you all right okay the associated development plan is MJ DP 2661 for Parker tobacco company Inc so Daniel did a pretty good job laying it out but I'll kind of reorient you with the development plan so this is South Broadway along the plan South Red Mile is roughly here off of plan left or sorry plan right and then the single-family that that Daniel spoke about it's back here in the rear and then this would be that vacant parcel that we had discussed a potential connection out to Red Mile so what we have is the the structure itself with the associated exterior parking along the east side or I guess that would be the southeast side and then they're showing a significant portion of the parking internal to the building in a parking structure they're also showing a drive aisle that goes around the building and this will be one way counterclockwise their main entrance is they're currently showing it is unrestricted both direction and then this is an exit only on to South Broadway I do believe they mentioned this morning in subdivision committee that they're they've been in discussions with KYTC about the nature of the what they'll approve for the the entrances there is some concerns because of the proximity to the the intersection with Red Mile in Virginia that left turns are going to be problematic so that's that's something that we're talking through and that they're working with KYTC and traffic engineering and then again you know we've we've mentioned that it would be ideal if if there was a possibility for a connection out to Red Mile to provide that other access that would kind of mitigate some of the left turn issues that are going to occur on onto and off of South Broadway Daniel had mentioned the tree there's a large bur oak oak in the next yeah there we go hey it looks even better so there's a large bur oak that they're they're committed to preserving and it you know will act as a feature for the development but that did kind of necessitate them setting the building back from the street they're also showing a drop-off delivery area adjacent to the the front entrance of the building and that's also where the commercial portion is located and that's the wrong way sorry about that and if you have any questions I thank you yes sir mr. Wilson but or in me there was a rental you haul a Reynolds a Avis I believe not not Avis there was another color is that building on the corner of right there okay well I thought it was a building right beside the Avis some kind of rental there is so next door there's according to Google Earth there is an Avis and then there's a budget behind that budget car rental as well okay yeah oh okay boy I live I leave town for two weeks everything changes okay do we have any other questions for Chris I guess one question I have Chris is I understand I understand the concern about the left turn onto Broadway and I drive under that beautiful tree every day if somebody could wave a magic wand and have access Red Mile can you turn left on Red Mile I don't know that would probably be a better question for traffic engineering but according to Google Earth you can't right now because there's a median right right so there yeah there may I just I knowing knowing Red Mile yes I understand but if we have a concern about turning left on Broadway I think that concern is equal on Red Mile Road just because again I drive through that intersection every single day and I don't I'm struggling with the reasoning where it's acceptable in one situation unacceptable another or less than ideal I should say yeah I think this was really just speaking to the based on what the applicant has sort of submitted it's not limited to only UK students but in the event that this is a primarily student thing most you know with the relationship of where campus and everything associated with that that's where we really were seeing those issues so in a instance where say a student opted not to walk to campus or to take the bus they are going to have to if traffic permits you know try to make that left to try to get on Virginia heading out that way or they're gonna make a right and try to kind of come in the back if the Red Mile connection existed you could go through the back make a right onto Red Mile and you are lined up directly to go to campus and access that shopping and entertainment so that's where that's coming from noting that any left turn on a any type of really significant Street is gonna be you know something that needs to be looked at but specifically for the kind of clientele that this is most likely going to appeal to you that we think that that particular trip is going to be common and as of right now it is a little bit difficult with them only having that access okay do we have any other questions for Chris at this time Thank You Chris mr. Murphy thank you very much I'm Chris Glendon my law partner and I are representing GMH communities on this Brad Boaz CMW is our landscape architect and Brad knows I learned so much from him just by about burr oaks from this it's amazing the GMH is a developer of mostly campus properties some others around around the United States about two years ago they bought the stretch complex apartment complex which is up on Red Mile behind this it doesn't touch this property so there they remodeled that and they're so they're familiar with the area and they entered into an agreement with the Murphy family unfortunately I'm not related to that Murphy family with for this property and the when I first got the call about this from GMH they're outside of Philadelphia they called and said we're into we're interested in this property we think we're going to get it under contract and we know the first substantive thing they told me said we know there's a big burr oak on the property and we're going to take care of it and they have I miss wish miss Davis were here today to hear this but the before we even filed this before we even filed the zone change we have consulted arborists Brad has looked at this we talked to Tim query the former urban forester who's now a private consultant we have talked to Eric Sutherland the current urban forester about this and we met with the neighborhood association we want to thank the Gulf you Estates neighborhood association we've had very good feedback with them Adrian Bryan is here who's the president of the Gulf you Estates neighborhood association we have we had a big meeting that mr. crumb went to with the association and since then we've had follow-up meetings between our architects and some of the neighbors who are back here they they're their houses at front on Duncan Road and back up to this so they've they've had a meeting at at the site with with one of those specially concerned neighbors on that so that the neighborhood interaction has been very good and I want to compliment the Gulf you Estates neighborhood association on that and give our appreciation to them the the borough being here dictates a lot of our design obviously we unlike the property across the street we're not going to be on South Broadway because there's a borough there this will be the this area which mr. crumb mentioned will be the focal point of our entrance and from the discussion this morning and today we know we need to show the staff a little bit more about our architectural plans for that but that's going to be what people see of our building from South Broadway because we do have the Baroque on the other side there so we want to make sure it's inviting and works properly with the with the development the other one other thing I wanted to point out to you is that this is this is our interior parking structure we're surrounded on all sides by a residential structure so people behind here are not looking at anything cannot see our parking lots here because it's a parking structure we will have residential units along the back and along the sides now we do have the circulation around as called for in fire code so we do have the the driveway going and we do have that for fire code but we do not have parking lots facing those neighbors right behind us there the those are the main things I wanted to discuss with you all the we're continuing to work with the neighborhood but this I think I've for four years as I've gone up and down the corridor I look at that piece and say not much is happening there that's an ideal parcel for infill and extra residential units we are cognizant of the traffic issues that's a very busy intersection we are looking into the possibility of having a connector out to Red Mile Road and we'll be presenting more more to you when we do come back to you we're we don't have a problem with a postponement recommendation I've told my clients that that doesn't mean we won't be heard on April 23rd if we work all these things out but it means we if we don't we may get postponed to May so they understand the status of them and thank you very much Brad's here and Sean Gallagher I forgot to introduce Sean Sean is here from GMH headquarters and he's sort of heading up the team at GMH on this and between them they'd probably be able to answer any questions you all might have about it Thank You mr. Murphy or his representatives at this time thank you dick all right is there anyone from the public who would like to speak to this application today hello commissioners Adrian Bryant I just want to say up front I'm not writing about this project for the Herald leader I've you know tried very hard to you know keep my place as a Neighborhood Association president and you know my roles at the paper very professionally separated but everyone summed up the Neighborhood Association's concerns really well and really you know our feeling on and we had a meeting last night where we touched based upon it is our neighbors who live to the rear of the property that background up to it if they're happy with what that landscape buffer looks like then the associations happy we know something's going to be built here we want something to be built on this property but it is you know those from those houses will back right up to this and so we've essentially deputized those neighbors to talk to the development team they feel very good about how those conversations have been going they've been speaking very highly of Brad Brad's been kind of point person for that and they're really enjoying those conversations so so those are on track we feel good about it right now if we end up taking any kind of formal position on it as an association we'll come back and let you know but yeah okay thank you Adrian do we have any other any other public comment okay do we have any Commissioner questions or comments I am comfortable with postponement as well I am struggling with access to another road via a parcel that the applicant does not own as a reason for postponement I am struggling with that I think the applicant has worked in good faith on every single front including saving a big old tree which we talk about a lot so I think they've done a very good job in that respect do we have any other thoughts or the floor is open for a motion mr. chairman and to the guest this postponement does not mean anything other than the fact that we know some additional work is going to go on and what have you so I move that we have postponed PL in the MAR 26 days no wait a minute 26 days 8 South Broadway project all righty Thank You mr.
