Brian Ward is our engineer, but he is stuck in traffic on 64 to a wreck over there, so maybe he'll get here and maybe he won't. I think we've resolved maybe the biggest concern I had, which is the need for a preliminary subdivision plat. We'll need to work over the next week with engineering just to talk about the infrastructure. As you all may recall, this is a project that involves the old Vaughan tobacco warehouses and two other parcels we've added in, which are this parcel here, which is 1305 Main Street, and then the parcels up here, which are on Forbes Road. The infrastructure has all been installed on this. We've planned, I think, three different development plans as we've sort of tweaked the project, and so we'll get the engineer to work with Vaughan and her staff on the roads and the sewer. The road's been in there since day one. The final code was actually put on last week, so we have a little bit we may need to bond, but we need to provide the as-builts to show that the sewer connections are to each proposed lot. On the waiver, I think more technically is this road was approved in the original development plan not to put sidewalks down both sides of the road and instead to have a multi-use trail, which has been constructed and is out there, and it's actually various points along that road because it was taking the old Vaughan tobacco access road. It was widened to meet the width of the local street standard, but it doesn't meet all the other technical requirements at various points along it, so it's not just one single point. There's probably five or six different places that it meets it, and sometimes the sidewalk is right on the curb rather than, you would call it the landscape buffer. I call it the utility strip, but that's what's been on the development plan since day one. If you haven't been out there to go look yet, you ought to see the movements that are going made. Really, the two big things when we did this were we had, you know, we've been trying to get this done since September, is that every lot has to have frontage on this private street that we've shown, which has been shown on the development plan, and the second is sanitary sewer connection to each lot, which is shown. All that is done, I'm told. You know, I'm not the one who puts the stuff in the ground, but I'll have the engineers work with Vaughan with as-builts to prove that's done. I think it's, you know, we postpone it right now, but next Thursday we'll have this ready for approval. Any questions I can answer? So just to clarify, the waiver is going to the Planning Commission, but the plat will actually go back to TRC for its final approval. And this is located at 121 Prowl Street, 118 Montmolan Street, and 545-553-563 South Limestone. The purpose of this plan is to depict a multi-story mixed-use building utilizing the neighborhood business form-based project provisions of the B-1 zone. The plan includes 155 residential dwelling units and non-residential space. Let's see. So, on the overall plan, this is Limestone, Montmolan to plan north, and Prowl to plan south. The plan depicts the ground level here, and then, let's see, I can't read the labels, basement and first floor, and then the upper floors above that. So, this plan changed a little bit. Previously, there was an entrance off of Montmolan, and then another entrance off of Prowl, and they've consolidated a vehicular entrance, pardon me, and they've consolidated those into a different entrance off of Prowl Street, and now the parking structure, I think before the levels didn't connect, and now they have ramps that connect the different levels of the parking structure. So, that was kind of the main change between the preliminary and the final. As far as the footprint goes, they really haven't changed the building any. Under requirements not met, oh, sorry, I'm going to go a little bit farther. During tech, there was a question about, on the preliminary and in the zone change discussion, there was some talk about the width of the sidewalk and that there would be an overhang, so I provided the cross-section to show, just for clarification from our discussion previously with tech, what that cross-section looks like. And then they did provide an updated area character study with new renderings, and we'll have a packet for you all with that in it that's got the full study, but they did update that to reflect the entrance changes, which were, I believe, the only real changes to the exterior that affected those cross-sections. So, under requirements not met, number one, denote no building permit should be issued unless and until a final development plan is approved by the Planning Commission. Number two, denote the development plan shall comply with the area character and context study as approved by the Planning Commission. We have an update. Oh, sorry. Sorry about that. Ah, there. They submitted a revised plan on May 5th, and then based on that, we have the following revised conditions. Number one, submit an open space exhibit that matched the site statistic box on the development plan. Number two, provide bicycle parking facilities that comply with the zoning ordinance. Number three, commercial driveway entrance shall comply with standard drawing 307-2. And number four, label the existing retaining wall at the rear of the property. And number five, update the note under the limestone cross-section. There are no waivers requested at this time. Number two, if a sewer capacity application has been filed, it will have to be updated prior to the issuance of building permits. Requirements not met number five, we had removed the note from the limestone section, so I'm not sure what I'm still supposed to be doing there. So oftentimes planning reviews the revisions and the other divisions don't, so we usually just keep them on there just to cover our bases. So if Vaughn is comfortable with that, she'll let us know today. Okay. The street well, I guess we'll start there. So before we had on the zoning development plan, we had a five-foot deep planter and we had them in boxes. Now in the revised plan, we've taken four feet wide so we can make sure we get the eight-foot sidewalk in, and the four-foot wide planter runs pretty much the length of the block now to deter the students crossing not at the intersections. I don't know that that's a problem. As far as the utilities go, we talked to TRC, and we believe all overhead poles and lines along limestone at this point will be removed. So this is a small planter box. It's in the public right-of-way. No street trees are required at this place. The clients want to add these in here so it'll be a small species, no conflicts. I'm hoping that answers all the questions about the planters and the trees there. I've asked the urban forester if he had recommendations on what species. I'm just waiting to hear back. When you say the poles and lines will be removed, are they going to be buried? Do you know more than me? I think there was a project that UK was working on to bury some poles and some lines, but I think you're all probably going to get to it before they do. There's really only lines and poles serving Ural's property with the exception of the streetlight. We can go underground with that. The streetlights can move to the university side later, and I believe for us there's some poles on Prawl and Mount Mullen, and I believe that will serve us. I don't think any of the lines that are existing along the frontage of limestone are needed anymore. Correct, and the poles on Prawl are on the other side of the street from Ural's property. The one question about a pole on Mount Mullen. Well, if it's in front of our building, I assume everything on that site will get reworked, but I don't have that utility plan at this point. Since we filed, actually, clients have been working with the architects, revising essentially the interior spaces for your next meeting Thursday. I'll give staff another revision to the layout. We've got the lobby locked in, the retail corner. The bike room now has access off of Prawl directly, so you don't have to go into the parking structure now, and we'll get those changes to staff. In talks with Scott Thompson about that, we're meeting the number of biking parking spaces required with that. The vehicular entrances that changed, so he was presenting it correctly. Before we had one on Mount Mullen and one on Prawl, and the interior, not every layer mixed. If you came in on Mount Mullen, you'd have to leave on Mount Mullen. So what they've done now, there is no light on Mount Mullen, so all the vehicles will be coming out onto Prawl where they have a light so that they have a much better chance of getting out onto limestone. Then all the parking levels are connected internally. It's a bit harder to follow on just seeing the sections themselves. If you look at the context study, they give you a section through the building, and you can follow where the ramps are to show how you wind the parking through there. If everyone's interested in how the floors go up and down for parking, we can do that if you don't care. It all works. It all works. Very good. I guess after that, stormwater. Stormwater management. The site is impervious now, so the quantity does not increase and does not need to be resolved. But there will be a quality unit that has to be an insert. We'll go in for the quality, and they'll figure out that location through construction plans. I think I got everything. Got any questions? I don't know. The timeline's tight as far as getting the project started. I do know that across the street, the Matthews Building is going to be demoed this summer by UK as well. So if your client was ready to go, that might be a coordination challenge. But then, of course, once you get into the school year, there's thousands of students too, so both will be challenging in their own ways. Is that across Mount Mullen? This is an old – this has been a restaurant several different times. I think it was pizza the last time. They've come in wanting to change this to a new restaurant and add a patio here. So they're revising the parking layout that used to wrap around the building and come back out onto Upper Street. So we're changing – adding the patio and changing the parking circulation. So with that, they brought in a revised plan on May 1st, and so you can see we have a revised staff report. They were able to, with the revised plan, meet all the requirements not met. So you can see we've moved all those. They do have a waiver in, a waiver for open space standards, which we will have that for you at the time of the full planning commission meeting. Design considerations, area of disturbance is over 2,500 square feet. A lane disturbance permit is required. Recommending the driveway use of a commercial driveway entrance comply with the standard drawing. Excuse me. Planning questions or concerns. We have discussed need for waiver for vegetated open space, discussed location of dumpster, discussed the use on the property in the B1 zone. Does the raised patio disrupt the drainage easement patterns? The staff had recommended postponement with the conditions from the Division of Engineering, sign-offs, traffic, landscape, urban forester, bike and ped, open space, fire, Division of Waste Management, Division of Water Quality, the U.S. Postal Service, provided that the planning commission grants the requested waiver and then connect correct all note deficiencies. So as you can see, the entrance for the dumpster is they would come off of Pine Street and down into for the dumpster. The Waste Management has a certain backup dimension that we believe exceeds with this. So that was part of our concerns because when it previously it allowed them to come in, hit the dumpster back up, and then be able to exit the property out onto Upper Street. So now with the patio that they're adding, that creates a problem there. So that was one of our questions, and that's kind of our concern to why it's being postponed. So I'll put it to you all to see if there's any other comments or questions. I don't know if this is the appropriate place to ask it, but I read something in the Herald-Later or heard something on the news about this, and there seemed to be a concern in the neighborhood about the addition of the patio, whether there would be live music, the hours, that sort of thing. Has that been discussed in this context? The TRC, just one of the questions to the applicant last week was what was your proposed use? And they indicated that it was a restaurant and not a cocktail lounge. The zoning ordinance does not have any control over hours of operation or any noise beyond a conditional use is required if live entertainment is proposed. And that's been communicated to the applicant both from building inspection as well as planning, and they have indicated at this time they're not requesting live entertainment. Now, live entertainment is defined by the zoning ordinance, so playing a radio where there's no DJ changing music is not live entertainment. Having a television on to broadcast a basketball game is also not live entertainment. So we have to follow the rules that are in place, and what I've said to the neighbors is there's not really a way for us to, other than telling the applicant, hey, these are the rules and you need to follow them, until they break a rule, then we can come down and say, okay, you've broken this rule, or you have a zoning violation and proceed through enforcement if that happens. I understand they're trying to be very proactive and are concerned, and I think we are concerned as well just about the location of the patio. I will say, Cheryl, did you mention that they were granted variances in 2002 or 2003 when it was rezoned, but there are some very specific conditions associated with the variances. So, for instance, there has to be a fence and there has to be vines growing. That's one of the conditions, so that's going to be something that we have to discuss with the applicant, and it's something we're discussing internally in terms of their open space waiver that they're asking for. And then on the left is my property, 509 South Upper. Behind that are other residential properties, the cream-colored building, the brick building in the back. This patio is, as you can see, already built. It's eight feet from the bedroom windows on my property. Everything else you see in the background are mostly bedroom windows. Tracy Glass couldn't be here today. She's working, but she lives in one of those properties. Her and her husband are two kids, look down on this, and they're quite upset, as you can imagine, that this is their new neighbor. They have 200 signatures on a petition against this just from the surrounding people. I guess the picture, just look at that. Would you want a patio built eight feet from your bedroom window? Could you live with that? Even if it was a fine French restaurant playing violin music, I don't think I could. If it's Two Keys, open until 2 a.m. in the morning, the quality of life and my rentability for that building just is greatly diminished. And I don't see any reason to proceed with this at all. I'm used on the other side. I develop a lot of things, including two of those properties right there. Every once in a while, I get a bad idea, and I look at that and go, this just doesn't fit what you're trying to do here. I understand the desire to redevelop a property. We just finished redeveloping Dudley Square recently and putting in a millstone restaurant. I understand redevelopment and trying to make things better. This, I see, is a bad step, like putting in a drag strip next to your neighborhood and say, we're going to put mufflers on the cars. It'll be okay. Don't worry about it. That's about what this will happen eventually. Instead of reducing the landscaping, I would say the landscaping, if anything, needs to be increased. Maybe a brick wall like you might see on Interstate 75 might begin to mitigate the noise for the people affected. Otherwise, it's just going to be a mess that's going to get started. It'll end up back down at the city a few years from now. People will be trying to solve it, trying to figure out what can we do. I'm Mark Matthews. I'm a neighbor. I live at 500 South Mill Street, and I'm also a board member of the Historic South Hill Neighborhood Association. And I wanted to speak more specifically to the waiver that was requested on landscaping. I have to put things in simple terms for my mind, and I view this like I was adding an addition to my home, and that my home was built 50 years ago, and when I do this addition, I have to follow current code. It doesn't really matter what the rules were 50 years ago when my house was built. I think there's a reason that the ordinance provides for a required amount of landscaping. This lot in question should follow that new ordinance as it's being developed. There is plenty of space to the south and the west of this land. It's actually just parking and asphalt. That space would begin to provide the intended buffer to the residences that Mr. Burton spoke to. The key point here is had a development plan been submitted as required before this patio was built, this could have been dealt with, and this landscape requirement could have been met. A waiver should not be granted for a variance of a self-created situation. So I encourage the Planning Commission to not allow the waiver for vegetation. Thank you. We share a property line with this Two Keys property. It's been difficult, and we're just looking to continue to voice our concern. The reputation of Two Keys as an establishment, I believe, precedes itself. Whether they intend to truly operate as a restaurant or not is neither here nor there for the intentions of today. But the property as it exists is, and I think it should be brought into consideration, that they have already enacted several different blatant disregards for the city for ordinances and for zoning ordinances since this started. It took the city 16 days to respond to our notice that the patio construction had begun. From the time that we told them, hey, they're breaking ground, to the fact that this patio was laid, 16 days later, the patio was already installed. So I do urge you guys to also view this as something that was not properly approved by you guys, and this is now a consequence that we are dealing with and trying to, like we've said, like Mr. Burton said, just be proactive against. I understand that there's things that you all can and cannot do as a planning committee. There are not conditional use permits yet presented to you all to review. But what you can do is help us control what is available to them. If there's not a patio available, they can't have people outside. If they can't have people outside, that can directly protect our peace and our privacy. There is a full, unencumbered view of my bedroom window from this patio. There is a full, unencumbered view of my future child's nursery from this window. I refuse to live like that. I bought this home fully understanding the zoning ordinances that were afforded to me and protected by the planning committee and by the city. This is a B1 neighborhood business property. And we just really are urging that the committee look at it that way and provide protection for our peace, our privacy, for our neighborhood. And by requiring the landscaping to be properly landscaped, that could afford us quite a bit of privacy. But we do ask that, just in general, this patio be recognized as something that was not existing to this property to begin with. Hi, my name is Nia Gandolfo. I live at 429 South Upper Street, so it's right across Pine Street. And I'm here with my roommate. It's been difficult, especially with them building the patio. They actually got concrete on my roommate's car when they were building the patio. And we're really concerned about not only the noise level and them being outside, but also the precedence that 2 Keys comes with it. Just hearing from the student body perspective, they're very excited about 2 Keys coming back. And that's really concerning for us, especially being directly across the street from them. I've talked to my neighbors and safety concerns about the traffic, especially because they can't go through the parking lot. They're going to have to loop back around. And coming out directly where our street parking is for those properties. And just the disturbance and the things that come with bringing a place like 2 Keys into our neighborhood. We've seen things with the Hill and other bars that are closely located. So that brings a little bit of concern of us living so close. And I've been in that property 3 years. I have another year left. So it's just one of those things. We don't want to ruin our last year of trying to study. And my roommate's going to PT school of trying to achieve our goals and it being disrupted by us being concerned about our safety and the noise level and not being able to focus on our education. I am in medical school and I live right across the street. As it stands now, there is quite a bit of noise pollution from the bars a block over. And I believe bringing this restaurant that will more than likely operate as a bar or nightclub will not. It will only make that problem worse. I also would like to raise a concern over the parking where they've already destroyed about half of the parking spots available in the parking lot. And they plan to do nothing but bring more people to the property. The overflow of cars will go directly to my house on Lawrence Street right across from 504 there. And that's already a problem experience now because there's not much parking in the area. And I think that will just make it worse. On the weekends when it's not permit controlled, it's very hard to find a parking spot if you leave. So, yeah, I just think that overall this restaurant or bar, whatever it wants to be called, is not a good addition to the neighborhood and will bring more hurt than good. Thank you. It's simply the name that carries great weight in the community. And so we understand the concerns, but we think some of those may be misplaced. Can you speak to the building of the patio without a development plan? Sure. With what I see, I presume it's going to be fenced to some degree? That's correct. I think you can already see the wood posts that are in there that are going to be that fence. Is that going to be two sides as far as that fence? I haven't asked that question. You've got wrought iron or something on the one side. And then this is Strawberry Fields down here. Yes. Sorry. North Broadway to Paris Pike. Strawberry Fields. Forever. Yeah. So, let's see. The development plan is depicting two buildings along the rear of the property with associated parking in the front. The applicant indicates that these will be used for incubator spaces for contractors and tradesmen. Showing an entrance off of Old Paris here, and I believe, we've got an aerial, I believe that's where the existing entrance onto the property is. It's also showing a more narrow entrance at the far western end of the property. Yeah, I'll go back. Yeah, sorry. So, yeah, this shows a little bit better. We've got North Broadway, and then here's the railroad, where the road goes under the railroad and the intersection. Yeah, it's residential here and across the road, and then this is residential as well. Okay, so, under the requirements not met, number one, denote all buildings, paving, signs, fences, walls, and retaining walls that are depicted, described, or required. Most development plans will require a separate review and building permit from the Division of Building Inspection prior to construction. Number two, denote no building permits shall be issued unless and until a final development plan is approved by the Planning Commission. And number three, denote no grading, striping, excavation, or filling, or other disturbance shall take place prior to the approval of an erosion control plan. Such plan must be submitted in accordance with Chapter 16 of the Code of Ordinances. A sanitary sewer analysis is needed to evaluate the additional flow on the existing system. And then finally, number nine, the standard discussed place builder criteria where this is a zone change. The technical committee did recommend postponement. The plan cannot be approved in its current state because of numerous requirements of articles 16, 18, and 21 of the zoning ordinance have not been met, including a filing requirement for the parking demand mitigation study. And then in addition, the applicant didn't post the sign on the property at least 21 days in advance of the TRC meeting. And we've talked to him about that. He's gotten the sign now, and so he'll be able to have the sign posted prior to the next TRC meeting. And then if the plan's approved, the following requirements provided the Urban County Council approves the zone change to B4. Otherwise, the commission action of approval is null and void. And then number two, sign off for engineering and then traffic engineering, urban forest, or open space. Department of Environmental Quality's approval of environmentally sensitive areas. Okay, and then the second question asking about, is there an office requiring water and sanitary sewer? Wouldn't all of those require sanitary sewer? But generally speaking, the area that's around this is residential in nature. We have the single family that's existing further along the roadway. We have the strawberry fields development. So staff is really looking at this as more of an enhanced neighborhood where the applicant's choice in zone, the B4, is not recommended. And so we'll get into that as the applicant kind of goes through the process. And so we'll get into that as the applicant kind of fulfills the kind of necessary statutory items. We'll do our full review and then give out a zoning staff report then. So nothing more at this time, but just wanted to get you all up to speed on that. All right, thank you. You know, this property doesn't physically adjoin any residential areas. There is a transmission line to the west that serves the whole section of Lexington. So that's I-2 by anybody's standard. Okay. So building houses here would be suicide because of the high transmission lines. The R-2 behind it is a railroad. And then you have the bottleneck here going under the bridge. So the challenge for me is trying to find a way to make this fit into some kind of cohesive use. That that as a steward Would enhance the quality of life Not only for the residents and the neighbors who are all in agreement with what I'm doing I'm trying to finish that up with some block letters being signed but for the whole the whole community These spaces are not for warehousing They are for specialty contractors and those are little guys like me, you know I come to my little storage bill and I get what I need to go work on my property. They're gone. Don't come back That day it's like one time traffic event You you drive around this town. You can see where these guys live. You know, they clean out drains They do roof repairs. They're plumbers or HVAC. There's no place for them These spaces are about the size of a two-car garage and the goal there Is to give them a business identity in a location that doesn't clutter residential areas So so each one of these units will have a restroom or a rough-in for one Each one of these units will have their own waterline. They will have their own electric line. They will have their own Communication lines and probably the great greatest thing about this project If you haven't been to this site, and I really wish you'd go if you're gonna pass judgment on this and I'm hoping you'll take your time and go to this site and sit there in Your car or you can walk the property if you want But what you realize is the sound coming off the interstate that's the rubber tires hitting it, you know the road and then the railroad Six trains a day. What's really needed here is a sound wall. These buildings have a dual function as a sound wall Okay, so Once you consider everything at like I do I must consider everything Once I consider everything Including what the neighborhood wants This is the best fit for this property So I'm open to questions Have any questions for the applicant? We can talk about that a little bit as we go on Let me back up there for now So they're showing a multi-family structure Between Oliver Lewis way and chair Avenue, and there's quite a bit of right-of-way. That's around the parcel itself I Believe this is Emma line That connects between chair and Oliver Lewis way And then they're also showing on the corner of chair and lower another multi-family structure that's connected to the the other one with a pedestrian bridge at the fifth level and then there's a Separate parking structure that's also connected to the middle residential structure with a with a pedestrian bridge And then they're also depicting a little bit of surface parking across lower And they've changed the layout there just a little bit because of the Scott Street They were originally proposing some townhomes and they've taken those off the plan Under requirements not met number one ensure that the driveway apron matches engineering standard Drawing 3072 or 3073 is applicable and Number two modify interior landscaping and interior tree canopy for lot four to meet the zoning ordinance And then this is this is lot four On this on the other side of lower Number three upload open space exhibit to a cella and include open space requirements In the site statistics box as a percentage number four provide dimensions for driveways and walkways Number five depict termination of Hayman Street and lower Street per the land subdivision regulations There they have submitted a waiver request for an alternate cross-section And then under design considerations number one alter Hayman Avenue to ride in ride out and proposed median controls number two coordinate coordination with the design team for the Scott Street Extension project is imperative number three phase construction for the relocation of the town branch culvert is required And under plan questions and concerns number one discuss incorporating transit facilities Number two discuss lack of direct vehicle access access to a building on lot one And so currently on lot one. So Part of the conversation this afternoon is what kind of transit improvements or changes are we going to see on the site to kind of? Accommodate that some questions about how these buildings are going to function The applicant has provided some renderings of the proposed buildings that kind of help understand those a little bit better But really just trying to see how those kind of play into a site that's going to have higher density And it's planning to kind of incorporate more intensely with transit So it is recommended for that place type of development type, but we'll get into that a little bit further later on this afternoon Thank you Any other any questions about place builder? Yes And Scott Street it appear based on the conversation was engineering capital project Right now they are in the design phase and maybe acquisition of right away But there is no funding for the construction and most probably what looks like So at that time what that the existing streets are going to be operating at the normal condition So we're not going to change any we're not terminating any street or any of this So it's going to be operating at normal condition. And then when when Scott Street kind of Get constructed. It's going to be open. So we're not going to change any we're not terminating any street or any of this Condition and then when when Scott Street kind of Get constructed and then there's a retaining wall. This will be part of Scott Street We are proposing to terminate to terminate Hayman We are not proposing. We are providing an option for determination of Hayman was a cul-de-sac and that location and also making lower street as Private access to me since the developer on on both side of the property and this will become like private access into the project itself and As part integrated as part of the project and Hayman will be terminated with cul-de-sac or Hammerhead whatever option the city decided at that time. So that's why so this is what our our Vision for how we want to terminate Hayman Street and lower street On on the waiver request as Mr. Cheney mentioned that we are proposing that the eight feet sidewalk to be running along Chair Avenue and then also trees and landscaping Along the frontage of both buildings Design consideration Alter Hayman Avenue to right in right out We We So basically the way Hayman Avenue It's kind of it has the option to have the left and left out and left in into the site we will work with traffic engineering and about how we can work it out, but based on the traffic studies that we did is that the impact basically is on the left out Or left end is very minimum very minimum delays And we can discuss further and also we look into the accident for the last five years as only I mean two accidents at a rear end and non-injury accident the last five years But this is something we can discuss further The coordination with the design team for the Scott street And we have multiple of meetings at least two or three maybe Uh the first proposal what we have When we met was planning before we met engineering We were planning to have townhouses in that location The parking garage was supposed to be in that location And there's one large building Over here. So based on the meeting with lfucg and we learned farther about the alignment of scott street So we rework our site layout we eliminated all the townhouses Move the parking garage from that location to this location and then we have two buildings Over here, and then we add sky bridge to kind of connect Connect all the buildings together So we have been working with engineering. I will keep We'll keep the conversation going on and phasing construction of town branch Uh, yes, the first first thing will be relocating of the box culvert Which is the box culvert kind of bisect the property along 441 hayman avenue So our proposal is to kind of basically straighten it up and connect back And to kind of create the buildable area same thing apply to the sanitary sewers There's 18 inch sanitary sewers that it will be relocated in that regard So Planning question incorporate the transit facility so There is two transit facilities, there's one Next time bus bus stop over at that location over here and there is one bus stop at that location and we'll we we will talk to lectrin to see how we can Incorporate if there's additional bus stop need to be done along chair avenue We'll be glad to kind of incorporate it Uh discuss lack of direct vehicular access so the revision Uh that we had we kind of basically this area over here is going to be A compactor And we have connection over here for a compactor. There's a bunch of That's one vehicular access to the building And that location this is where it's going to be the electric room where the transfer the transformer and other stuff That will be kind of a way to connect as a building Through vehicular and then on that side This location over here is going to be the main interest to the building And that location over here is going to be another dumps. Another compactor is going to be in that location And other access there's multiple of access along the side of the building on that location There is one of the main entrance to that building It's going to be over here and there's another entrance along the side of the building on this building Along basically the east the west side of hayman. There's multiple of entrance along chair avenue So to kind of get the building more oriented with for pedestrian access one location over here. There's Another location over there and plus this is the main interest to the building So this will be the main main access to the building Thank you Yes, the parking there's an existing business along this is 633 south of broadway. There's existing house of existing office with Multiple of parking spaces this will be all removed all the parking spaces will be eliminated The right-of-way improvement there will be a no improvement along chair on Emmeline I'm, sorry on south of broadway, but along emeline and and Chair avenue will have wider sidewalk and eight feet sidewalk along along the frontage of chair stormwater management capacity and ownership so the site is the site is Almost 85 to 90 percent impervious area at the current condition will be reducing impervious area And the water quality will be prefabricated devices to kind of treat the first flush Okay discuss proximity of the new building to scott street, so So this is a scott street over there. I think this will help us orient just a little bit better There we go, okay, this is sir barton way, um here where it's close to i-75 between winchester road and Man of war This is an existing office park Uh, the subject property is this vacant parcel, uh in the rear and they're proposing to access along this Existing drive to get into the property Um, there's a greenway along the the rear of the property uh down here so i'm gonna back up and actually so on the overall plan this is sir, barton way That wraps around with i-75 and then the subject property is this rectangle here Um with that access drive coming in off of sir, barton So i'm going to bump over to the detail. So, um, there'll be further discussion later on this afternoon But the overall framework, um for this is it's sort of within that regional center So we'll have some uh discussions later on this afternoon on kind of how all of that fits in Okay Great. We uh, what Chris Went through was the same recommendation as for the technical committee And we intended to file a revised plan As you know the deadline for doing that is 48 hours before which is 8 30 a.m. Tuesday Um, I was out of town monday and tuesday kevin filed a revised plan on a cella on monday But did not get paper copies to the staff So the staff was not aware that we had filed a revised plan So we were sorry for the mix-up on that um, we had Dealt with many of the concerns that the staff had um What what i'm going to do it there's no overhead here is there that I can use it's uh, i've got a I've got a little exhibit. We we had fun. This is a extremely busy plan with on the on the plan that's two feet by three feet our site is about Two inches by two inches. So it's it's it's real hard to decipher. So we had filed an exhibit I've got a copy. I just got to pass that out so we can I can Just wanted to go over a couple things on it we had um This is about a 3.9 net acre site Uh, we represent r.a.k properties r.a.k stands for retina associates of kentucky Many of us may have been i've been there for repair of a torn retina and they're they're outstanding and but the they purchased this property five years ago as I think this has been Uh, the area was developed about 24 four years ago And this lot has been vacant since that time Breton associates bought it about five years ago with the intention of building of moving over here and they've had some corporate changes and Several years ago. They decided they were not going to use this property And put it on the market for professional office purposes And had no takers so they're Were asking for a zone change to to Make this available for residential property If you'll see on this we had We have we had a discussion at the technical committee about the number of units and the significance of that is that Kevin had talked to officer Beatty in the fire Department and understood that Zero to a hundred or excuse me one to a hundred units requires one access point and above a hundred required to this has one access point coming in as you can see it's a Access easement coming in off of sir. Barton. It's between two banks. It's the west banco And the truest bank over on sir. Barton. This is the access easement which serves The two banks they go off on either side and then it stubs into this property and But the discussion at the so there's one way in and out on this that's why it's been designed for many years whether it's a A medical office or residential. There's one way in and out We have the discussion was that the ordinance the zoning ordinance says that Between a hundred and a more require two ways in and out We have reduced the number of units on this one staff doesn't know this to 99 units on it so that we meet those requirements the 99 units And we're going to meet the other fire requirements as discussed in the staff report as well the uh, there is a this the access easement is Very good quality if you're driving out there, you probably don't know that it's not a public street. It's a private access easement there's an access agreement between the Three owners, which is the two banks in this property About maintenance if there's ever an issue about maintenance There's a formula of how they work it out and pay to maintain the access easement. The access easement has a Curb gutter has sidewalk on the north side all the way up to sir. Barton way Uh, so there's sidewalk installed on one side, uh, we have had reach out to neighborhoods we've the uh This is part of the madden development and the deed restrictions Still place a lot of control in the madden family. We've reached out to them and they are generally okay with With this development they've pointed out. They they're sending they sent me a copy of the access agreement all that sort of thing The uh We wanted to show you how this agrees with the topography Sir barton way is up here Access easement comes down. We have two banks that are tall one-story banks as you enter into our property our Clubhouse and swimming pool are a one-story building On either side we have two-story Smaller buildings and we go on back to the rear the property drops off at least 12 feet from the front to the rear Uh when we had our pre-application conference, we were talking about having the buildings up closer to the front but it was pointed out to us that the City plans to build a multi-purpose trail through the rear of the property That will give us a connection to the ymca Which is across the stream We look back on our vista out. The back is a beautiful vista. It's the open space of the ymca across the creek and at the pre-application conference, we had discussion that Might be nice to move the buildings back so that our residents would enjoy the vista out over the creek on there So we have done that and we may need some waivers because we're discussing that the Waiver about whether we can use an access easement for access. Of course It's the only way we have it was established many years ago But this is a residential use so we may have to ask for a finding on the access easement there and about Uh parking in the front yard we have in the this zone, we're not supposed to have parking between the front of the building and the street But we don't adjoin any streets, but we'll work we'll discuss that with the staff some more So we think we've done a very context Sensitive design. We think we have a lot of connections pedestrian connections We will have one it's not built yet. We will have one into the Y. It's a very beautiful setting we have good connections to Sir Barton Way um Oh, we've we've discussed this with uh, Patrick Madden We've had further discussions with uh, there's residences Um Behind us over here The Y is over here I think there's San Marino Place over here had discussed some discussions with the neighbors there. They were concerned about two things traffic Because they pointed out that any development on this property is going to increase traffic on Sir Barton And of course I said, well, we're not putting any traffic into this neighborhood over here We have no connection to the property on the other side of the street Creek traffic wise vehicle wise We don't have any but they said that there's Anything that puts more traffic on Sir Barton? Is going to put more traffic on San Marino because they said that San Marino is used as a cut through for Sir Barton but I pointed out that that would happen for professional or residential on here um The other but we got discussion about the landscaping that would be along the rear And they expressed a desire for having at least half those trees to be evergreen trees And I don't think we have any problem with that So we we feel we transition well We were taking this property as it is We understand the staff recommendation for postponement. Coffee shop and record store, kind of bookstore, but rather than books, records that you would listen to while you're enjoying your coffee, I think, headphone centric. And our, you know, we're not proposing a five-story garage, parking garage. We're not proposing, although we have two points of access, we could have over a hundred units I guess, but we're just, we want the site just like it is. We like the vibe of the 1950s kind of almost Frank Lloyd Wright-ish building and turn it into a, you know, a neighborhood gathering place. We want to maintain the lawn. That's a big part of the of the site on either side and the rear. We'd like to minimize, you know, the site has functioned for 70 years, as is, as a bank and most recently as a medical doctor's office. So our desire is to do minimal, if anything, but recognize we need to do some to make it approvable, I guess. We've submitted variances in an effort to bring the property into compliance. I think we're fine with being a non-conforming existing property. We're just seeking to change the the use from P1 to B1 so that we can have the coffee shop and record store. So he has, Vinnie can address more, but they've had neighborhood meetings and they've been very successful with meeting the neighbors. We have a resident here. She may speak. I don't know. Are you, yeah, she's going to speak. So, but I can go through the items, but that's that's the intent. We've got some cleanup items. So, I don't know, you have any questions? No, we had no intention of a drive-thru. I was kind of curious as to how the drive-thru even worked, but apparently they had an addition. So that explains, I mean, I could hardly get my car around there, so I couldn't imagine having that as a functioning drive-thru. I'd probably put it in when Chevettes were pretty big. Hi, I'm Vinnie Pyle, the owner of the property. I did have a neighborhood meeting with the Mitchell Neighbors Association on Tuesday, I think it was. We met at the Good Foods Co-op, about 10 to 12 neighbors showed up, and we kind of went through just the zone change and if there was any issues with the use at all. And then just went through the plan and changes. There are a lot of questions about the variances and what we were requesting, but overall there was a lot of support from, I asked if there was any opposition or anything that they would like for us to change within the plan. One thing that the Neighborhood Association is, I guess they've received a grant to restore some of the tree canopy in the neighborhood, so we're going to work with them on the addition of the trees on the site. And just generally in terms of people in the neighborhood, beyond even the who got notices, I think there has just been a lot of support for this project. A number of people have reached out saying that if we wanted them to send in letters of support or anything, I said I hadn't gotten any pushback to request that. The neighbors mentioned that they may, they encouraged each other to reach out to planning and send emails. Whether or not they did that, I don't know. But overall it's just been a very positive perception of the plan, and I don't know if there are any questions for me. Just talk a little bit more about the record store aspect. Are you selling vinyls? So I'm just the property owner. The main function of the property right now is really just a coffee shop, and they are partnering with a group that does, that actually does sell records. I guess this is the highest grossing years for record sales since the last, I don't know, 30 years or something like that. I think it's just increasingly becoming more and more popular. There are, and I mean in other cities, there's like record bars where they just will play records and people hang out. So I think it's just a more and more popular thing, and I think a lot of people are really excited about that concept. And then beyond that really just, I think the goal that we've discussed, and kind of like what I would like to happen, as also I am a southern resident. I live two streets away from this property. I went to high school Lafayette. I coach soccer at Lafayette, so I'm involved in that community, and I think it would be cool for that part of town to have a space where people can go and hang out, and doesn't necessarily have to be, I don't know, just has a little patio people can go to and just exist, I guess. But I guess one of the important things about the neighborhood meeting was both neighbors that immediately had joined the property were there. I discussed the fence going in, a desire for that or not desire for that, the trees going in, and again they were in support of what we're doing and what it's going to be, and I think I'm hopeful that it'll be a cool thing for the neighborhood. I'm a neighbor just one street down from that property. I walk down there every day almost, and it's sad to see that there's nothing going on, and I'm really excited about what's slated to go in there with the coffee shop and the vinyl store, but really just some life on that particular corner. I've been in touch with Vinnie, and he has reassured me about the variances. My biggest concern about it was that there's in the variance a reduction of tree canopy from 30% to 0%. The plan that they show us, you know, is wonderful. It indicates more trees being planted. I would just like to have some reassurance that some future owner will not be able to interpret that variance as saying, oh, I can take down all these streets and convert all that into parking or something else. So that would be, that's my only concern. The project itself, I'm all for it, and as you heard, the neighborhood in general is pretty happy to have a place that we can walk past and stop, have coffee, and listen to some music. It just sounds great. So all in favor of this, but the variance is just of concern, because I don't know what it means for the future. Thank you. Thank you. I'm Brandon Gross. I live up on Lafayette Parkway next to the high school. I'm very excited about this project. Now this is anecdotal, but my neighborhood friends that live within a block or two of me, they're all very excited also. There's an email chain, a text chain that's going on about it. So everyone's really excited. This has been underutilized property, and this side of Southland Drive, really once you pass Southport, past the co-op, it becomes really dead. And so I'm thinking this will really bring things alive. Another issue we have on Southland is that we have a lot of longtime owners who are holding onto their properties, and so I'm glad Benny was able to get this one to bring this. So I'm very supportive. I was involved with Southland Association when we planted all those trees along Southland and along the high school, and I have all the confidence that Benny's gonna keep the tree canopy, because that's what's gonna attract our neighbors to this particular site. And so I just want to let you know that I've not heard anything negative about this project in the neighborhood. I'm 100% supportive, and I'm not being paid to be up here today. Not yet. I'll be up there in a few minutes. And then the second thing is, and this is just a commentary for you guys to think about, this is a good example of a project that you, the commissioners, and the staff, they want to think about. Is there a way for us to have a more, what I'm gonna call, zoning light process? Because here we have a small lot. It's P1. It's just going to a B1 on Southland Drive. Is it, you know, while we don't want just anything to go places, the B1 is our neighborhood. You can't have fast food drive-throughs. You can't have other things. And rather than an applicant spending and paying me and the engineers $10,000, you know, $15,000, $20,000 to get through all the process, we may want to think about for certain size lots in certain areas, whether it makes sense for, you're not changing anything, why should you spend that money and discourage us to essentially bring new uses to neighborhood areas? Just food for thought. Just putting that out there for you guys to think about while I'm up here. We had a work session last month about the ED zone text amendment, and Mr. Crum did a presentation. I think we're just following up from that. Yeah, so I will spare you a lot of the front end. So moving on directly to just refreshing everyone kind of about the applicants proposal. So once again, this is that text amendment for the ED zone. The applicant on this has trimmed down the request to essentially be looking for additional flexibility on how they accommodate residential on their site. Essentially, they have asked for additional flexibility in how they incorporate their mixed-use buildings. So currently, the mixed-use buildings count towards those supportive uses, so that that smaller subcategory really wanting to make sure that the intent of the zone is still the jobs producing uses. So they've asked for a text amendment to change how those are calculated, essentially allowing for the second floor and up of these mixed-use buildings to not count against their supportive use totals, but rather to be bound by this overall cap. You've shown shown this graphic to you a couple of times. There's no changes really to the existing potential to do just detached residential. It still plays by the same rules. What has changed is there's not an explicit density limit under their proposal, and that sort of is captured by this dwelling unit cap. Now, since we've had the last discussion of this at work session, Commissioner Mickler raised an interesting interaction that staff had not originally kind of thought through. So it comes with a very niche application when you are trying to use buildings that have podium parking. So when we're talking about a mixed-use building, the building can be any of those other uses. So we have this jobs producing portion that under the current set do, you know, and often 85% is residential per se. That parking, that's not a supportive use area for supportive use totals. So staff is currently trying to look at this particular interaction to see if there's a way that we, you know, we want to afford the applicants and the developers of these areas more flexibility, but having built toward supportive uses with only 15% potentially being principal uses, we want to make sure that we're counting that floor area at least on the first floor so that we're not providing sort of an incentive to do this larger style of residential development that is really kind of skirting the intent of these zones. So to address this, and so as we talk this through and bring this to the zoning committee later on this afternoon, we'll get any feedback from you all and then keep you on the loop as we kind of look to address this particular issue. But largely the framework of, hey, we will account for everything on the first floor and then if we want to go higher vertically, that's generally something staff is supportive of at this point, but we just want to make sure that those first floors are kind of being accounted for. So it's a little, this is one of our most complicated zones and, you know, this is just an extra added wrinkle to that. So any initial questions with that or anything that staff could help explain, but we haven't ironed out, you know, a particular solution to this as of yet. Currently, they're allowed to do a host of things as a part of their conditional uses, including serve alcohol by the drink. What they are not currently allowed to do is sell packaged alcohol. So this is intended to allow them to sell essentially commemorative bottles inside their existing sort of facilities. So, this is a part of a conditional use. So, if there were ever any facility upgrades that this would require, that would come back as conditional use. But overall, in the grand scheme of things, they're allowed to have a gift shop already. They're allowed to serve alcohol, food, beverages, etc. So, staff is supportive of the applicant's proposed change. And so, those three words or so in red are the only addition. So, it's a very limited minor thing, but they wanted to make sure that they were complying with the zoning ordinance and not kind of exceeding their requirements. So, well, not much more to be said about that later this afternoon, but any comments or questions from you all, I'd be happy to kind of answer now. This one seems pretty simple. Okay. So, all of that to say, we didn't want to get too specific and in the weeds with that, but the comfort in knowing that it's a conditional use, that they have to have conditions for review, and there would be a conversation about the appropriateness with the Board of Adjustment if that came through.
