It has three 2,000-gallon old water separator tanks plus an optional sand old water separator. But we'll look to schedule that meeting and try to get that taken care of. On the plan, so we have Yorkshire that comes in here, and then Palumbo, they connect here currently at this curve. So Richmond Road is off to plan left a little ways. This is the existing Dabney that will tie into the development here. Dabney will come through and then intersect what will presumably be Palumbo on this section here. um the uh to plan north uh this area is uh proposed as townhomes um with a uh what looks to be a cul-de-sac that comes in with presumably the access easements off of that uh for the townhomes and then the to plan south we have the multi-family um portion with the uh parking lots and drive aisles circulating through there. There's detention plan south. This is the golf course here along the bottom. Currently, this is undeveloped agricultural, and then there's residential that surround the property. This is the townhome portion, the multifamily portion. And then just for reference, this is the aerial of the current, what it looks like now. It's currently undeveloped. Okay, I'll come back. All right, under requirements not met, provide lighting plan with larger font for clarification that meets all requirements of Article 30. I could not read the numbers on the lighting plan. They were just too small. Number two, correct commission certification. number three depict townhome driveways paired per zoning ordinance article 16 5b 3 number four denote public versus private rights away and access easement on plan face and in cross sections and again we just need some more clarification on the extent of what will be right away and what will be access easements number five denote the adjacent public park that would be counted as open space. Number eight, change the apartment building numbers. Number nine, include open space requirements and site statistics as a percentage. And that is where Dabney comes into the property at an angle. The transition between the existing cross section and the proposed cross section that meets our current regulations, there needs to be a transition area from the existing to the proposed. Number 12, depict all existing, oh, sorry, number 14, ensure proposed lift station does not impede pedestrian access, and that is, I believe right here, shows what looks like a concrete pad with the sidewalk crossing that, so we just want to make sure that the pedestrian access stays open and unimpeded. There are no waivers requested at this time. Under design consideration, see all ASELA comments provided by the Division of Engineering. Under plan questions and concerns, number one, discuss access easement terminating at dumpster locations and traffic pattern for trucks. So we have some questions about how that's going to be handled. we have the standard sign-offs for engineering traffic engineering landscaping addressing urban forester environmental qualities approval of environmentally sensitive areas bike ped open space division of fire division waste management water qualities approval of the cap requirements u.s postal service division of parks and rec for their approval to the of access to jake's jacobson park and then finally to correct all noted deficiencies listed as requirements not met herein and that i'll turn it over to the committee for questions and discussion yeah this eric with water quality here um if you want to move your bubble to that corner again where that house is on tyler court yeah that that home and as you just mentioned gives us a lot of concern because the outfall of that pond is right above that home. And that home actually extends into that property a decent bit there. So, of course, during a major storm event, if that pond does overtop, even if it is a designed spillway, you're going to have a huge amount of water right onto that person's property. It just gives us a lot of concern and pause. And like you said, it is commented. It's just one of those things that you better be pretty darn sure what you're doing there to make sure that that home does not flood. I would just be curious of where they plan on trying to tie to the sanitary system at. I know we've got it noted in here, but you're talking about an area that is really kind of non-sewer on it. So we're going to have to leave the property and possible easements. Anything else from the committee? All right. Applicant? Good morning. Brad Boaz with CMW. And this plan we saw earlier this year with the zone change, it hasn't changed much and so going through the requirements not met I think all those are pretty straightforward should be able to pick those up and clean those up pretty easily discussion items the two I think that caused a postponement were the I guess talk me through the possible need for a waiver for the lift station isn't that a requirement Tracy so we'll need a waiver to say if it's private Okay. And then on the stormwater, as we talked, yes, that is where the site naturally drains. So what, I guess, alternatives should we look at to, you know, do a lot of grading, removing trees and put it toward the golf course? I mean, I get that it's an existing ditch now, but it's virgin land. It's untouched land, so the runoff is way less than it will be after all this land cover change. I mean, I just want to make sure that that pond is sized accordingly to not over top during even a 25-year storm event. You've got to follow the manual, of course. Of course, the two-year storm will make sure that nothing happens here. But the fact that that house is that close to that outfall, that should make you nervous too. Of course. I mean, no, the basin is huge in that location to try to ensure that even the craziest rain event would handle it. And so I don't know what, at this point in the development plan, we need to provide engineering calculations to satisfy. That's what I'm trying to make sure for this stage, what we do to get past this to move forward toward engineering drawings. Have you worked with any of the adjacent property owners regarding easements at the very least? Well, in our zone change, as some of you all know, that neighbor was the one person that showed up questioning it. And, of course, we understand the sensitivity of it. I mean, that house is built way too low, but it's in place. And so we have not talked to them about getting an easement. And is that an easement to pipe through their yard? Is that what you're saying in terms of an easement or just to allow water to flow? Is there an existing drainage easement? No. Anywhere? Not to my knowledge. On there, the back of their properties that run? Not a specific drainage easement. I mean, there's utility easements through there. There's that huge overhead transmission line running through there. That runs that way. Correct. I'm talking about perpendicular. Sure. Yeah, not that I've seen on any plat. So is all the water heading to the gulf course of that pond? You're going to have to make sure you're not flooding the... Of course. Yeah, so we have to handle it. The car paths and that sort of thing. You can't just sheet flow it onto the... We're not. Everything's being caught and treated prior to leaving the site. Even short, where it sheet flows now, the long-term or longer duration output still shouldn't be on that. Oh, sure. We don't want to hurt anybody. And so, again, that's where we knew this all along. The basins are located at the low points of the site. And, again, we're willing to do whatever we can to make everyone here comfortable, make my developer comfortable that we're not going to have any issues down the road with the city at the golf course nor the homeowner there on the street. I guess Brad before we sign off we might just discuss some of the precautionary measures you can take before you get into the design phases you know what we might be looking for but I think we can talk through that yeah we got in again try to understand we we do that too so we've we've got adequate space over there I mean these basins what was shown here is bigger than what we would need to meet the city's requirements so we have space to do some things differently if we want to try to come up with some different ideas for ensuring we're doing everything we possibly can to protect that situation. Do you anticipate that there's going to be just a dotting of detention basins along this property line with the golf course? No. I think if you look at the topography, there's really three points that along this property boundary, the eastern boundary that hits the golf course, there's these two, and then where the floodplain is so I mean in other discussions we've talked about putting in a regional basin to handle the rest of the water kind of where that flood line is and trying to concentrate that because everything else after you get past this high point it all flows to a one kind of central spot for the rest of the farm it's just this one had these this one high point in the middle and two low points on either side is what I hope now I can't promise you that truth I got a quick question for you. Waste management over here, Scott Burton. Thanks, Scott. For the most part, the dumpster locations, the enclosures look good. There is one on here that I'm kind of questioning, and that's the one down between Building 3 and Building 7. That right side of the enclosure, what would be the backing distance from the front of that enclosure back to that parking median? You don't have to tell me now, but I'm going to have to. Yeah, and I could see that we could even angle that, just get out of that little island there if we're not meeting it. I think we got some flexibility on that one in the top right-hand corner. We need as close as 60 feet as we can get. Just because getting the trucks, getting them lined up. Yeah, we got space to maneuver that. Okay. Make sure we get that right. I guess you're not sorry the townhouses are not going to be subdivided so we can remove number six questions and concerns and then I did have just questions about that townhouse area are those access easements are they just driveways yeah there will be access easements yeah so that that would all be private drive so the cul-de-sac will be public and then everything else Hicks Dorothy would be access these bits so the whole thing would be yeah yeah we'll add a cross section Do you have an anticipated location for your sanitary time? We do, yes, sir. So we're working on analyzing going down Dabney. There's two manholes down there. One's a little closer that has an 8-inch pipe that we're modeling now to see if we can get through that. If not, we'll go down to the next one further down where there's a much larger pipe coming through it. So we're confident we can make one. We know we can make the second one work. It's just the closer one we're working on right now, and we'll send you guys information as soon as we finish that modeling. so again we're happy to work with stormwater and engineering on the stormwater issue questions and I don't know that we would need to come back here as a group but see what you all say I will clarify just one point Sure, that was quickly brushed upon. A utility easement does not count for drainage. Just say no. I know. Okay, yeah. So do you all feel like your stormwater management and sanitary sewer connection questions can be properly addressed without coming back to this committee, or is that something that we need to see again? they have to get a waiver so when what's that process look like so a waiver application needs to be submitted by friday at 4 p.m and i would encourage you to speak with jeremy young in our office he's our senior planner that's facilitating waiver requests and then that information has to be submitted again friday at four and then it would go to the your plan would then go to the subdivision committee and then the Planning Commission for approval of the waiver do you think we could do an approval at this point if we as far as the process goes they don't need to come back just because they have a waiver only if this is right are you okay yeah I think what I think our discussions about the the neighboring pieces is it's there's two parts you know getting some type of drainage easement I think is part one and then the other part is just the realistic nature of the fact that you've got a home we need to be very careful and I think a lot of that would just have to be worked out with your calculation showing that you oversized the base and showing showing your grading how that all works and that would be more of an engineering document so yeah I mean I think that's okay for this okay all right yeah Brad I would also encourage you to reach out to Parks and Recreation and include them in your chats with engineering and stormwater so they can be included yeah yeah they they're gonna yeah definitely want to have discussions about the stormwater but they also at the previous plan level were clear that they did not want a pedestrian access to the golf course for obvious reasons but yeah so sorry man so you don't you know i just thought maybe try you know so you really don't need their um approval for an access to jacobson park but um in terms of reviewing with then they do like to be included just when they're an adjacent property owner. Here's a closer picture of this. So this is going to be a multifamily building. The requirements not met. It says, denote no building permits shall be issued unless until a final development plan is certified by the Secretary of the Planning Commission. additional general notes from the previous plan, correct plan tile to match staff report, shade out parking garage on plan face and remove from site statistics, because we no longer have a parking requirement, but they're showing a parking structure on the adjacent property, and they're also showing location of some bicycle parking inside. But this is not part because the zoning on the property is I-1, and therefore it's not required as part of the principal use in the zone, a parking structure is. So I'm not quite sure why we have the parking structure on the plan. Denote height of retaining wall. There's a retaining wall along Broadway, and then another one here. We need to know what the height of the retaining wall, addition of all existing and proposed easements, addition of conditional zoning restrictions from the previous plan, correct zone label and boundary on west side of the boulevard. The zoning information on the plan is incorrect. It does not match the zone map. At this current time, we do not have any waivers. Design considerations. See all the seller comments provided by the Division of Engineering. High pedestrian volumes at the crossing of South Broadway and Boulevard require a more standing room for pedestrians waiting to cross the street. This location here. Plan questions and concerns. One, discuss the storm drainage area for open space. Discuss the type of commission certification. discussed width of sidewalk on South Broadway for public safety and ADA compliance. They're showing the sidewalk along here, which is adjacent to the road and doesn't meet the requirements. Discuss property boundary conflict with the state right-of-way improvements. In this area here, you're showing the boundaries of the property. But then you're showing the right-of-way, the boundaries of the property crossing into the right-of-way. And so then you have a setback requirement, which is within the right-of-way. so there's concerns over what is the correct boundaries of the property and how close they are to the public street discuss tree planting conflicts with retaining wall location will this property have dumpsters or compactors upload open space exhibit to cela and include open space requirements in the site statistics as a percentage. At this current time, there's questions regarding the boundaries of the property versus the state right-of-way and the public safety at the sidewalk along South Broadway. Tracy, it's what staff prefers. We just wanted to demonstrate that there will be parking for this project on an alternative site. And just move, I would just leave it there. That's fine. Just take it out of your site statistics. Oh, yeah. It's not really your site. It should not be in the site. Yeah, I agree with you there. We'll remove that on the site statistics. And then I believe that Jihad has talked with David and Scott about the landing pad at Boulevard and increasing the width of the sidewalk along Broadway. And does that satisfy you guys on the pedestrian issue, traffic? I got a rendering yesterday, but I haven't seen an updated plan yet. So the rendering shows what we discussed. But yes, based on discussions, that seems. Okay. So that's the one item. And the second item is on the, so we've looked, we cannot find, I'm going to help you guys here. So it's this corner here in question where we've got a conflict between our property boundary that we own versus the right-of-way. And so I got two questions there. Number one is if we were to dedicate it, will we dedicate it to the state or the city? Bolivar's the city street now. But that's something we can discuss through the plan after today's meeting, but that's one question that popped up in my mind is if we do dedicate it, who wants it? We can talk about that after this meeting, but that's something you guys can think about. And it could be we split it. Part goes to Broadway, part goes to Boulevard. I'll check out the construction plans too because it's interesting that that would have happened. Yeah, things happen sometimes. But we're willing to... It seems like it's more related to Bolivar, because the curb line on Broadway is parallel to that right-of-way line or about. So it seems like everything south of that right-of-way line would be related to the side street, the Bolivar street. Either way, we've noted it. We're going to work with you to get it resolved where it needs to go. But the question is – That will change your setback. There we go. So the question becomes if we were – But if you're providing more pedestrian area there anyway, is that changing your building at the corner? We could go into the roadway for a bulb out in space. I don't know. I haven't seen the rendering. But my question is we average a 10-foot setback along Boulevard. bowl of ours so do we get a here's the thing is we're willing to dedicate it we don't want to get in a situation where there's a potential prescriptive easement in favor of somebody we do the right thing and we give it to the appropriate jurisdiction and then we're penalized or have to go seek a waiver because we've done the right thing um so we're just trying to figure out a way to work through that issue. I think that's something we can get to. But right now our setback is 10 feet, and do we get to take the average of that? Isn't the requirement 10 feet? Mm-hmm. And if you're at 10 feet? Yeah. There's no... Yeah, we are. But that corner, you won't be at 10. Yes. You'll be at, like, 2. No, actually, if we... Depend how we kind of resolve the corner, if we go to the back of the sidewalk, it would be more like 5 feet. instead of behind the sidewalk, or if it's keeping it to the back of the curb and show an easement for the sidewalk, that way we'll meet the 10 feet requirement at that time. So there's a way to kind of work it out to get 10 feet. And on average, we will be more than 10 feet average the whole entire Bolivar. Well, at some point, in order to average, you have to be beyond the 10 in order to count 5. You'd be 15 somewhere, right? Yeah, we are beyond the 10 feet everywhere. Yeah, point out where. So this is the 10 feet. So we are beyond the 10 feet, maybe a couple of feet, I guess. So the dashed line is 10 feet. And then that line over here, I don't want to go back, it's only shown on one write-away plan that has not been even labored or called off. But we were not able to find any deed. and the boundary survey has been done by Kevin, Andrews Engineering, and then our surveyor also went back and confirmed exactly what Kevin has found out. But you're not willing to take care of the infrastructure in that, right? So, I mean, let's be realistic. You're not taking care of the light, the mast arms, the electric box, right? Well, G-Hod, as we talk through that corner of Boulevard and Broadway, is there a way to remove that chamfer on that corner so that it extends, just extends the curb straight instead of a little chamfer and then a radius? That might help with this a little bit too. I mean, obviously, you see what I'm saying? You see how Boulevard kind of turns at like a 30-degree angle there and then makes its turn? So you're saying make this more of a right angle? Go straight, yeah. Yeah, I don't think that's an issue. Part of the issue here is that you've got this awkward little corner. I'm being told that's not an issue. Except that Broadway has narrow lanes. So when you're turning right, if you're a larger truck, when you're turning right, you may need that radius to make the turn. We want to decrease the crossing for pedestrians on Boulevard. We want people to go slow. I get it. We can look at it. But they have room. We can set the stop bars back. and there's ways to make sure that their Vegas is available. And again, y'all are working towards making more room for pedestrians. So we're trying to say, oh, we want to average here and be less than the 10 feet at the corner where we really need the most, more space for pedestrians. But we have enough room over here. I haven't seen, well, has any, I don't know who did the graphic. Brandon and I haven't seen it. The rest of planning hasn't seen it. So it would be helpful to know what that is. Yeah, I think for these two issues, what it would be great is if, because depending on how we resolve the right-of-way issue, ignoring that, the plan fits all the requirements on the ordinance. Along Plunkett, for example, the height of the retaining wall, the load that's holding is holding that side of Plunkett, whereas on the lower side, there's basically no active retaining wall or load. so that the trees will be located in that area and then on the other side on Broadway this is where the sidewalk will become eight and a half feet wide and then the trees they have to be removed now since basically relocated to different location because there's no room for them anymore the retaining wall is holding the side of the building not not the sidewalk so we have to replace them or redistribution use small small tree or something like that but this something definitely it can be worked out so you increase the width of the sidewalk because that was one of the concerns we discussed so yes okay so how closer then okay the sidewalk is going to be eight and a half feet along Broadway and then we're going to widen in this landing area over here for pedestrian crossing and that landing area here for pedestrian crossing and the retaining wall has to be pushed closer to the building by i don't know a couple of feet whatever it takes to kind of keep it on our property and it will be maintained by this development because it's not on public right away so and then definitely there will be some railing along this side of Plunkett Place, Plunkett Street. Okay. I guess I'm just not seeing it, but okay. The retaining wall is below grade, the existing grade, right? Okay. On both sides? No. Over here we are basically the roadway is going to be higher. My name is Charlie Hall with Thoroughbred Engineering. We're aware of some of the site additions that were put on the site without approval, and we talked with Planning earlier this week about how those can be remediated on this plan. One of the main ones being the parking within that 25-foot buffer zone will need to come out. There are also some different interpretations of the 30% rule and the ordinance we had hoped that we could add. add less than 30% and leave the parking to its current condition. This is an old site that was designed to old regulations, and bringing the site up to the new regulations changes how the parking lot is being used, mainly losing some spots to landscape islands. the client is wanting to renovate this conference center to facilitate larger events, regional events, and he really needs parking to be able to do that. So we're trying to thread the needle between the client's desire to have parking and a plan that is acceptable to the committee. for the plan questions concerns there is some detention up in the plan northeast corner it is probably not sized to what's been added over the years we'll need to look into that as far as the volume it takes and will probably be required to have some kind of underground detention added to the site. I discussed the parking within the buffer zone. We'll make that right. And then any changes that have been made that haven't been on a development plan in the past, we'll need to document on this. And if anything was not up to code, we'll need to make those changes. The two existing dumpster locations are staying the same. There is the one right up next to the building that I believe is being reangled to, I think, probably be serviced better than it is at its existing state, but we can provide details for what the enclosure will look like. And then the sidewalk improvements along Coleman Court, I'm unsure about. So if anyone has any more comments on that, we can discuss. Just a quick clarification for me in water quality. So the dash line is the existing building and the thick line is the proposed building. Is that right? Mm-hmm. Okay. We were just a little bit confused by that. I can kind of see that now. So you are connecting that one building with that acute angle. Okay. Mm-hmm. So it's currently not connected? Yeah, it's currently two separate buildings. Now it's kind of stopped short of that, and there's no real, you know, access at this point. So you're going to need to show how you do that. And so one of the ways to do that might be adding a sidewalk to Coleman, you know, adjacent to the curb on your side. I mean, it's really kind of up to you guys, but that's where the comment came from, is how are you going to address that issue? I think our plan is, and it could be we move that sidewalk or add on to it, but we'd like to connect across the street at the entrance to the new Tom Pike expansion with a crosswalk. Yeah, put that together or if you want to have a discussion offline about that. Charlie, we had obviously met out there and looked at trees. I'm still with that janky kind of left leg there of the building. That's like the nicest tree on the site. You know, still like, hey, if there's a different way to connect it up in that V somewhere that preserves that, that would be great. also on your TPP because you all are taking out a pretty significant amount of trees if you could provide on the TPP just a justification for that and then any proposed mitigation of additional tree plantings that would compensate above and beyond the 26 requirements that would be good to see on there I guess one more thing on waivers. We met with Eve. We may be able to not have a waiver for open space, but we most likely will need to request a waiver for some other items on the site. Does the parking lot cleanup you had mentioned there, You're trying to balance the need for parking and the current regulations around tree planting islands, but it also sounds like you're removing a significant amount of trees, so it's like a double. You're taking out a bunch of trees. You're not mitigating those trees, and you don't want to mitigate them in the parking lot. To me, that's concerning just in that it doesn't comply with the regulation, and it kind of compounds the issue that that regulation is meant to resolve. so that's difficult to understand on our end um we understand the client's desires but we also have a ordinance that guides how that should be done so i think coming back with something like that would would be an easier ask then um we're going to get rid of trees and not put any trees back and not mitigate the heat island effect that's caused by the parking with trees yeah so just something to think about. Yeah, I think we had hoped to stay out of the existing parking the way it was and showed the landscape islands and where we're adding parking, but you're right, there wasn't any extra, so that can be further discussion of how we can make that right. In the definition, it lists balconies with a minimum dimension of 5 feet. Yes, but they need to be accessible to the public. I don't think that's the common open space is accessible to everyone. So this plan is depicting a street coming in to a cul-de-sac with parking and drive aisles off of it accessing multifamily structures, and then also an intersection here to a stub into the property there and a stub into the property there. The purpose of the plan is to depict a group residential development with 560 units in support of the requested zone change from agricultural rural AR and B5P to a medium-density residential R4 zone. Under requirements not met, number one, denote all building – oh, I'm sorry. The other – this is the first plan that we're looking at that's in the urban growth master plan area, and so that will – oh, right, right, right. First today. Yeah, this is the first one we're looking at today. There will be two others after this that are in the UGMP. Under requirements not met, number one, denote all building paving signs fences. Require a separate review and building permit from Division of Building Inspection prior to construction. Number two, change note number 11 to read no building permit shall be issued unless and until final development plan is certified by the Secretary of the Planning Commission. Number three, denote the development plan is located in a known sinkhole area. If any construction is to occur, a geotech review will be conducted on the site before the issuance of any building permits. Number four, denote no buildings or structures shall be located on any land with a slope greater than 30%. Provisions of Article 1611 of the land subdivision regulation shall be applicable. Number five, denote areas with alluvial soils will be developed in accordance with Article 6-11 of the land subdivision regulations. Number six, denote the location of fire hydrants, fire department, or fire service features, if required, shall be approved by the Division of Fire Water Control Office. Number seven, remove the aerial imagery to improve legibility. Number eight, depict zone lines. Number nine, depict adjacent properties with dashed lines. and that's in conformance with article 21 6a2 number 10 correct the title block to match the staff report number 11 depict project exterior yard for the group residential number 12 provide a 15 foot landscape buffer along the adjacent ar property boundary number 13 complete internal sidewalk network number 14 dimension all existing and proposed driveways walkways and pedestrian crossings. Number 15, depict and label the environmentally sensitive areas on the adjacent property. Number 16, locate stormwater management area on development plan. Number 17, second access is required for fire apparatus due to the number of units, and that's triggered at 100 units, and then at 600 units, there's actually a third access required. number 18 identify and label spring 9000 1226 on property as indicated by the kentucky geological map website number 19 identify and label the center line of the blue line stream number 20 amend open space exhibit to depict accessible routes to all usable and vegetative open space areas and describe how those spaces are being activated include open space and requirements, open space requirements, and site statistics as a percentage. Number 21, provide street connectivity to adjoining parcels, and that's one of the concerns that we have. The street that comes in off of Athens-Boonesboro terminates at a cul-de-sac on this plan, and in the UGMP, the street network is shown with that street connecting through to the adjacent properties with connections, and this connection is shown into the adjacent property to the west. We don't have any waivers requested at this time. Under design consideration, see all Acela comments provided by the Division of Engineering. Number two, add stop bars with stop legend at conflict points within the parking lots. Number three, consider placing street trees in seven foot right of way instead of a tree planting easement. Number four list VUA interior tree canopy required provided on final development plan. Under plan questions or concerns number one clarify number of bicycle parking spaces. Number two confirm this location will only have compactor and no dumpsters. Number three discuss access availability and capacity of sanitary service. Number four discuss ownership and maintenance of stormwater management areas. Number five, discuss need for a second commercial access point. Number six, will there be proposed retaining walls due to the topography? Number seven, discuss block grid roadway network. And again, that's related to the UGMP plan area. Number eight, discuss place builder criteria and UGMP. And under that, we have a typical intersection type for avenues. shall be roundabout, mini roundabout per the UGMP. Cul-de-sac exceeds maximum length recommended. Does not conform with roadway network depicted in regulating plan area 3. And again, that's this portion of the plan. Denote concurrency requirements for residential buildings within quarter mile of town center. Depict loading and unloading areas. F, demonstrate compliance with active depth recommendations and G, denote correct street types in cross sections to conform with the UGMP. We do recommend postponement at this time. There's questions regarding a second access point from Athens-Boonesboro Road due to the number of proposed dwelling units and the connectivity of the site to the adjoining parcels. Should the plan be approved, we have the standard sign-offs, the first being provided the Urban County Council approves the zone change, and then engineering, traffic engineering, urban forest or open space, environmental quality, and finally to correct all noted deficiencies listed as requirements not met herein. With that, I'll open it up to the committee for discussion questions. All right. Rory? Good morning, Nick Nicholson and Rory Kaley here on behalf of the applicants. I'm going to let this person that actually knows what he's talking about be able to answer these questions, but I did want to clarify something that I heard. We are only proposing a rezone for the AR property to R4. You had mentioned the B5P that is up front. We're not rezoning kind of that acreage. We're just having to utilize that as the access point since that's where the kind of R cuts are. And with that, I'll turn it over to, again, someone who knows what they're talking about. Good morning. So that's a good list. Easy questions. Yes, dumpsters. Maybe a compactor and not dumpsters on site. We're working with getting a second access point on your UGMP that you're showing. There's a secondary access point with an access approved out here. So this is our shown entrance lined up. And then there's supposed to be another entrance through the same parcel here off of this approved location. So we're looking at how to bring that in and make a connection. For our second point for the apartments, the... Yes, we're showing a cul-de-sac. And it's shown as local streets. the intersection with Richmond Road here has just been built this way. So this is not going to be lighted. This is not a full access point where cars are going to get to come out and turn left towards the interstate. So we did not foresee, and we also. You know that they go up and they do a turn and they come back. So they still can make lefts. There's an arc cut up the road. Sure, but it's not at our entrance. It's meant to serve that entrance. That's the whole – that's why they build them that way. It is a left. It's just distributed in a different fashion. So you understand that, right? We all understand that there's not turning left out of that intersection. Correct. Yeah. But there is a way to make a left. Sure. Okay. That's that art cut. So, stubbing this here, this is also not greater than 1,000 feet. But the continuation of this crossed an area of, it was crossing the creek at an undesirable area. with the contours change, the width of it out there, and when you go back and see the overall master plan, we do not believe that that location is needed with looking at the grid pattern throughout all of this expansion area. So, yes, it's your brand-new plan, and we're up here saying that it may not have been right. When we talked about that plan early on, it was said it was done in 2D. Now we're looking at that third dimension, and we're looking at how it relates to the built situation on Richmond Road, which is why we've given you this road alignment. Division of Engineering asked a great question. It said, why are my cross sections not in the land subdivision regulations? It's not land subdivision regulations. Complete Streets is not ratified yet. I'm told to follow a lot of the UGMP. So that's why the sections aren't in the other ordinances or documents. We knew we'd have lots of discussions about this. The first 14 items are probably all cleanups, just labeling stuff. Certainly once we know we've got a plan that's going to go forward, a lot of this will get fixed. where's the one Nick I needed a definition of document active death recommendations yes demonstrate compliance active death so on guess what is it item 8 F so what Would you all like to document active depth recommendations? Because, again, I have no idea what that means. Good morning, y'all. So it's a little bit of a carryover of both what would be shown and kind of complement the zoning side of things. But there is a requirement that there be some notation or other documentation given for the pieces of the roadway that I believe are within a certain radius of the town center to the bottom left, which is just off screen. And I believe also along collector roadways. So within the scope of this plan, it would probably be a notation where that kind of corresponds or dovetails is information provided for the zoning side of things that talks about how those buildings are going to be meeting those requirements as far as viewable activity. So that section of the UGMP kind of lays out what those expectations are. So you'll just have to kind of document that. Once again, with a 2D plan like this, probably through notation, through the zoning side, more in-depth kind of conversation there. We'll get right on that. At the end of the day, we know that the big talking point is going to be on the road connectivity to the kind of, you know, plan north. At the end of the day, what we are hoping is that we don't have to make a very large crossing in what would be considered environmentally sensitive area. And so we're trying to do as little land disturbance in that area as possible. You kind of flood. I always do that wrong. So this is kind of where this flood line is, or the floodplain kind of area is. And so we're trying to get below the floodplain and then make that connection on this side of the floodplain in order to minimize the crossing is kind of the logic that we're going for. And so we're happy to kind of flesh that out with staff as we kind of work through this and see if that is a feasible kind of option. Because at the end of the day, we're trying to meet kind of two different, you know, masters, so to speak. where we're not supposed to get too much into the environmental sensitive area, but we're also trying to follow the urban growth master plan roadway that directly goes through that area. And so we think that there probably should be some way that we can kind of make sure that that property is well connected, that where we are achieving those kind of connectivity goals while at the same time kind of minimizing floodplain disturbance. So that's kind of where our heads are on that issue. But we know that that's going to be the big one on this one. I'm happy to answer any questions that I'll quickly just defer to Lori. So, Rory, you said something about the local streets and those meeting the UGMP, but are they not the same as the local street requirement and the complete streets manual and the UGMP? They should all be the same. Has the complete streets been ratified? No. So, okay, to that point, then you need to meet the subreg requirements. The question was asked in the comments, so I wanted to clarify that we were meeting the cross-section shown in the UGMP and not in the land subdivision regulations. But first of all, what's the difference? Is it the width of your utility, isn't it? Is that the difference? Planting strip? Yes. Which is more than what the subregs require. You have to meet the subregs, whatever they are, when it gets adopted. So when you get to the point where you're building something, the Complete Streets Manual will likely be adopted by that point, and we'll be going through the process to update the subregs. Those will be the street sections that we follow, and then the land subdivision regulations will be changed to match? Yes. Okay. But today, I think the question engineering is asking is under today's regulations, are you meeting those? And the answer might be no. For land subdivision, no. Because you're narrower? Because we're meeting the urban group. If you look at the page in the land subdivision regulations, I've got like four options and they're set. This one's not the same. Same one we did the cane break. We had some boulevard streets approved. that met the UGMP, but it wasn't in the land subdivision regulations. Yeah, and I think maybe a little bit of the confusion on this, too, is what the UGMP, like you're showing these as sort of local streets with a cul-de-sac where the UGMP is calling for this to be a collector extending through. So there may be some avenue. Avenue, yes. Yeah, new phrases. That may explain sort of some of the disconnect here of the plan calls for a greater intensity roadway than what you're showing. Is it sort of even getting the cross-section stuff kind of in a good place? So I'm sure we'll be talking about that in greater time. Yeah, the roadway, whether it's the local, I've got to remember this right, whether it's medium intensity, local, low intensity avenue, or high intensity avenue, the roadway is the same. 37 feet I believe it is to the curb faces and then all these different sections all handle where the bikes and people are outside of that so you know the Traffic engineering side of life every one of those roads is the same because of who they handle And and so you know where you say we're showing a local instead of the Avenue We're still giving them the same roadway, and we don't believe that the continuation of that or the the bicycle and the pedestrian side of it warrants a bigger activity serving this location and these apartments. And certainly I assume that the zoning portion of all this, where the UGMP and all the place builder stuff is discussed, is where I imagine it will be hammered out. And then we'll address the plan accordingly. It does look like you have a lot of open space on the plan, and we know that you're not meeting the density recommended by the UGMP. Is there a... We are the net. We turned in the exhibit that showed what we were counting and what we weren't counting because of the contours. when you see highlight for everybody so we have apartment building and parking and then this very large area yeah we don't need all that for open space we can meet at other places that's going to take up grading but across this site you know if you were looking at rock land you necessarily say that high-density residential is going to go in some place that had that much elevation change so but we are working to do that. And I do believe we showed, demonstrated areas that were not to count towards our net developable area so that the residential units do match. Just a big picture question from Water Quality. What's the plan for stormwater management for a lot of this development? bigger than our piece like this whole area out there just this for this discussion this piece but yeah i mean is there something mentioned and and i'm not super familiar with the ugmp i can i'll go back and check that on that too but i just wanted to see what the plan was for stormwater management and it can be you know i know we're high level at this point but just want to make sure that's not forgotten what you know it's not forgotten you're right we're just trying to get the zoning in place at this point but your stormwater management will basically be following all these areas you see that are crosshashes green. It's just going to be the areas where there's a creek out there we can't really build in there. So each piece that comes in will have to address whether it needs to handle quality quantity on itself, whether it can just be the quality on site and maybe the quantity is taken up in the stream beds or each piece is going to be reviewed and this doesn't even show the whole picture. There's a lot more. It extends all the way up to the guest property on all the edges there. Just to emphasize the capacity application requirements and everything, how important it is for the 100% of the whole area, our bank is low and there's a sanitary sewer implementation program taking place now, a study that will end at some point. But once that is complete, then an LFUCG accepts it. We will have to go but follow all those guidelines for the new procedures from that point on. Yes. So we've been talking to Charlie. Anybody else? This is Athins Boonesboro. This is blue sky. So we're kind of diagonal across that interchange. Now we're in the southeast corner of the interchange. The purpose of this plan is to depict a mixed-use development in support of the requested zone change from an agricultural rural zone and interchange service business B5P to a corridor business B3 zone. So this is showing an entrance here across from Canebrake, comes down and across, and then another entrance here off of Athens Boonesboro, and an entrance here as well. there are commercial uses around what looks like a hotel, I believe it's a hotel there and then this shows the street stubbing into the property to the south so just a little bit of a blow up here, again this is Canebrake the intersection there, and then the intersection with Blue Sky Parkway they're showing a large retail building here and again this is a hotel in the center and then multi-family in this area south of this internal street under requirements not met denote all buildings paving paving signs fences walls shall require a separate review and building permit from building inspection prior to construction. Rory Kaley the partners very similar to the last one which was just on their side of the interstate out there I guess under plan questions will cover a couple things we didn't talk about last time bicycle parking spaces I believe I show them correctly and I think maybe the numbers are is Is that something that is going to be changed in some future revisions possibly? Yeah. The UGMP, compared to the zoning ordinance, I think the zoning ordinance is based on 10% of the total parking. The UGMP has some mention about square footage that doesn't pan out whenever you. Right. You need a bicycle parking space for every 1,000 square feet of building under the UGMP. That is in addition to the bicycle parking space for every 10 parking spaces shown. So we have a note on here about 853, something like that, as the required parking. When we did the cane break development plan across the street at that time with the zone change, instead of trying to show some sort of bicycle symbol where we were putting all of these within someone's front door of their business and spreading across the whole site. We just had a note at that time of what the parking requirements were. And then I thought I'd heard from some staff members that they might be cleaning that requirement, getting a nodded head. So maybe in the future that number won't be quite so high across the site. Lots 8, 9, 10, 12. The T-Wows. If everyone remembers my T-Wows back in the guest property, We have them arranged out here along Athens-Boonesboro Road as, I'll put a bigger lot number on there so you can find them, but that's an intro to this development. The T-Wiles. T-Wiles? The landscape architecture that Rory taught me last week. Right. Scott, are you familiar with this term? this all happened with guest development before most y'all youngsters you don't know um as it came to us from a firm out of colorado when they came in did the master plan at your entrances instead of having a business or a home something right up on the street you ended up with giving them some sort of uh park tracy don't you live next to one as well so um yeah it was however your streets would come to a T or the entrances. What's that? Well, there's a really big city park over here. We'll get to him later. But, yes, we'll flesh out all these entry features if we get to go forward. I would like some more, and maybe it's in the zoning committee, but I'd like a little more information about the appropriateness of the multifamily. um we okay i think you show 700 units and like 100 parking spaces yes we do but that's um counter to the market according to you on other plans and other like the one catty corner you're right and what other developers have told us about the UGMP area. So it seems like a placeholder and unrealistic. That's fair. Okay. Yes, there was a – there's an overlay or a layer of the UGMP that signifies proposed acreages of land and its uses. And so when we went through the pre-app, we were given that and told to make sure that we had our residential units for this area. And so we found ways to get all of those residential units on site. Most of them are in the apartment complex in the back. And then we did do some apartments over businesses out front. we get to go forward with this then I'll get to work on coming up with a better parking scheme for the apartments again there's a lot of these questions in here follow up with the roads the intersections Rory to that point may I ask a question yes so your statement here as this is unrealistic and a placeholder would indicate that you are not you agreed that you are not interested in doing the land use that was proposed by the master plan? No. Just haven't worked out how to get the parking and the other uses that are wanted by the client. Okay. You might mention the parking study that we had to file that speaks to that. We think there is adequate parking with the ability to use spaces that aren't being used at certain times of day and night, and that is documented in the parking study. It doesn't mean it's not going to change, but we think this plan is viable. It will be a good test of the new parking theories that have evolved. And just asking, along the lines of multimodalism, most of the community that we are serving that we push for the removal of minimum parking was based around access to multimodal transportation options. Are there enhanced options that you're proposing with this plan that you're going to show on the plan? Not this time, no. We have a lot of commercial spaces and commercial parking facilities associated with those spaces that are available for residential parking uses at certain times of day. I believe there was said that the state had some long-range plans of bringing those facilities out this far. I believe now they haven't, it wasn't a part of the improvements that get to the interstate, but there's discussions of carrying them past that. And then as long as we follow the streets within the development, I think the bikes and the pedestrians, all that internally will be taken care of. It's bringing it over the interstate and out to the site, I think, for the multimodal side of it. And then bus routes is always up to get the people there, and then they route them in. I'm going to ask about the requirements not met. Yes, I've got a few. As far as I can tell, and it's maybe not as accurate, but the spring might be where your building one is. Okay, here's what I have found out. Previous owners did some work on grading, good grading on the site and worked with the core for some mitigation area. if the new property owner wishes to follow through with this development plan we get approval and we're moving forward then they will have to work with the core and there will be mitigations that they have to go through based on the agreements of the previous property owner does that does that address the streams on site as well it yes it addresses them it'll do you have copies of any I don't have... Yeah, we've got all that paperwork somewhere we'll share with you. Because, from what I can tell, there's a named tributary Boggs Fork going through the property. There's also a 40-inch culvert that does discharge this property. So, we'll need to address the pass-through drainage and how that's going to be managed. Okay. If all your permits are in order, I'm just not sure how... to treat the intermittent streams going through there when they've been disturbed. If you had permissions from the state, or not you, the property owner had permissions from the state or not, I don't have access to that information. In our file somewhere, we've got all that stuff we can share with you because I don't understand how the Corps permits stuff and what status it is after it's gone through that process either. So that, yeah, that, your comments about the blue line. Open space. Talked with Eve some and discussed that there is, This is an LFUCG park. We are within a quarter mile of all but one of our lots. The land between what we're asking for is zone change. Get this right. And then this path here is owned by the same person. The UGMP drew this hard line, and that's where we stopped. but we plan on using the city's park as our common open space. We'll run a pedestrian path over to that. Along 8th and Spoonboro? Probably interior, just somewhere coming off maybe one of the ends of the streets over. We'll have to work with parks wherever we can. So how's the timing of that work? Like, you know, is it when the first building is open? Is it when the last building is open? I'm just curious. You mentioned a connection that may not have a road network to it or sidewalks to it. We need to get to a final development plan before we get in the back. You own both those L shapes? Yes. Yeah, both of these are continuations of property that's in here, so it's all under the same ownership. For the record, Rory, if you want to build, I know we talked about this, but for the record, if you want to build access to the park, I would include Parks and Recreation on that conversation and loop me in. And we discuss either you need an encouragement agreement on Athens Boonsboro or we need documentation about the access easement through that adjacent property to the park. And we want to loop them in only because that park is currently closed off publicly. It's for baseball rentals. so it's a discussion we probably need to have all together about accessing that I don't think we put it on here but 8th and Spoonsboro Road is a state road is that right yeah so it looks like in the GIS information it transitions from a minor arterial where it intersects with the interstate to a local very quickly. So typically arterial roadway improvements are not like full section improvements are not required, but on a local street and a collector street, you would have to make improvements. So just putting it on the radar there that 8th and Spoonsboro Road will need improvements when you build any of that development up along the road. And I think traffic engineering mentioned a shared use sound. With the state, that was just a question. Go ahead. You said it's state controlled, so any improvements is permitted by them. Yeah, local and collector streets improvements are required with the subdivision regulations, and the state works with us to make sure we have the right cross-section. But like Greendale. Spire River. Yeah, those roads. Barlow. Yeah, we improve them. Arterials are excluded in the subregs in terms of making improvements unless you need a turn lane in or out or something to address the capacity and make sure the new road connections work. So it seems like your access cane break intersection, like lining up the intersections, obviously makes sense. No problem. Well, the other one, it doesn't meet the spacing already. so in terms of an arterial spacing along an arterial a collector spacing from the interstate from an expressway is supposed to be 1400 feet i think you're at like 13 or 12 we're matching what you said we had to so we're still gonna have to ask for a waiver even though it's for new streets yes perhaps and then the spacing as you go further out is that like 600 and then 400? Do you know the... I do not off the top of my head. And again, if it's a local-local, it's 250 and that's pretty narrow, or small distance. And you're aware Complete Streets is going through, and with that some subdivision regulation changes, potentially access spacing changes. So I just wanted to make sure that we're, yes, we're lining up with the plan, but the plan doesn't 100% line up with our regulations. Okay. We were also wanting to ask if private streets are under UGMP. If this went through here and this connection, if this could function more as a private street, the same section would be under private so that it was able to serve the businesses better. I think we'd have to have a conversation about that. What's the benefit of it being a private street? How would it serve the businesses better? private we get to have better and probably more access points no private and public streets are built to the exact same standards you just are agreeing to maintain it for us i i don't know why people want to build private streets honestly because no access easements and that earlier plan yeah it should there are no access easements if it's all one lot it works better as a parking lot All right, that is what we wanted. We'll have to discuss that. It mentioned stub streets to adjoining properties. Can you tell me which one you were talking about back out here? And on the left-hand side, are there any? The purpose of this plan is to depict a new, complete neighborhood development with 1,240 units in support of the requested zone change from AR zone to B1 zone and R4 zone. so we have Todd's Road along Plan North and I-75 is over in this area here we recently had a plan for townhomes in this area that went along with the church this is 136 acre parcel with commercial and residential uses and a road network within. So along Todd's Road here, this is the town center area, and then interspersed throughout are townhomes. and then we have multifamily in this area which go back maybe it's a little bit easier if I do it here showing multifamily here with the town center along Todd's there's some green space through the middle with a roadway depicted here. And then along this, showing a half boulevard improvement along the property boundary here. Let's go back. And then this is, it's showing this half boulevard terminates at the floodplain. And this is the regulating plan. For reference, we'll come back to that. Under requirements not met, number one, change note number 12 to read no building permit shall be issued unless until a final development plan is certified. And then we had some questions about fire access, being able to make the turns onto the alleys and the width of the alleys themselves for public safety. number 20 depict street connectivity and continuity number 21 fire department access road shall have an unobstructed width of not less than 20 feet and again that goes back to the mainly to the alley question number 22 they're required with the fire department access road shall not be obstructed in any manner including by the parking of vehicles number 23 the maximum allowable distance between interior landscape areas is 90 feet. Number 24, identify common areas in the site statistics box for each lot. Number 25, provide connection and development plan for southern tip of property. And again that's this this area down here. Under the waivers again there's a need for a finding for access easement assault access for or the townhomes, frontage requirements for parcels that do not front street right-of-way, cross-sections that do not meet current standards, block lengths greater than 1,000 feet, and connectivity to adjoining parcels. And under design consideration, see all ASELA comments provided by the Division of Engineering. Under plane questions or concerns, number one, how will roundabouts that are prescribed for intersections on boulevards be treated with just half-section construction? And again, that's along this portion here. Number two, will the parkland shown in the center of the site be dedicated, and will it be usable considering the slope of the site? Number three, labeled number four, discuss dedication and acceptance of parklands. Number five, discuss proposed half-road construction of proposed boulevard along eastern property perimeter. Number six, discuss access spacing along Todd's Road. Number seven, discuss proposed road types consistent with the UGMP. Number eight, discuss designation of roadways public or private rights-of-way or access easements. It seems like there's quite a mix of different types. Number nine, discuss if any portion of this development will be subdivided. Number 10, how will the existing sanitary sewer system be accessed for the proposed development? Number 11, what is the proposal for stormwater management? Number 12, discuss clomer requirement if fill placed on floodplain. Number 13, is there only one entrance to the development? Number 14, discuss place builder criteria and UGMP. And under that, A, we have standard intersection for avenues as a roundabout. B. Discuss timing concurrency of construction of single-family detached parcels. C. Section JJ should have a separate bike lane that eventually will connect to Canebrake Drive to the south. D. Block perimeter greater than 2,000-3,000 feet, and that's dependent on the intensity. E. Does not conform with roadway network depicted in the regulating plan area 4. And again, that's this. It shows this roadway coming and curving away from the property where the proposal here is showing that same road coming straight down along the property boundary all the way to the floodplain. Let's see. F, roadway network does not stub into adjacent properties. G, depict loading and unloading areas. H, demonstrate compliance with the active depth recommendations. I, depict intersection improvements per the UGMP. J, no more than one non-alley curb cut per block face. K, denote and depict bicycle parking and correct parking statistics. L, denote street trees on cross-section and in-the-site statistics. M, depict block perimeter requirements. N, depict shared driveways and inter-parcel access. and that's shared driveways for the townhome portion. O does not meet residential density requirements. P does not depict village center uses as shown on regulating plan area 4. It's showing the village center down here at the southern portion of the property. q denote concurrency requirements for residential buildings within quarter mile of town centers and village centers r denote no more than 80,000 square feet of commercial floor area shall be issued a certificate of occupancy until at least 50 percent of proposed number of dwelling units have been issued a certificate of occupancy s vehicular access is only allowed from alleys in village and town centers and t does not meet minimum adu requirements for single family lots we do recommend postponement at this time questions regarding compliance with the ugmp the land subregulate subregs and the zoning ordinance if the plan is approved the following conditions number one provided the urban county council approves the zone change to b3 and then sign offs for engineering traffic engineering urban forest or open space environmental quality and then provided the planning commission grants the the waivers and finally number eight correct all noted deficiencies listed as a requirements not met herein and with that i'll open it up to the committee one comment from us i mean i know this is pretty high level at this point but the buffer on the on the lower side of the pond appears to go into one of the townhomes and that may be changing with a clomer or lomer but just want to bring that to everyone's attention at the top similarly the main road that goes along the vegetative buffer i'm not sure how you're going to build that without a wall or or encroachment into that buffer so you ought to look at that when you're placing that road next to that greenway yeah Anybody else? So I'm Dick Murphy here on behalf of Anderson Communities, along with Sam Castro. and Tony Barrett's out of town, but he and Sam have collaborated on this development plan for you. I wanted to say first that, of course, this is UGMP property. Every property out there is different. We're fortunate here. We're using the entire tract here and we're showing a plan that we think that is pretty darn close to the plan itself here. We have a few variations we've come up with in looking at this on a more close level. But we think we're very close to total compliance with the UGMP. And Dennis is very eager on this. He wants to build it this way. And as we, however, as we get into things, looking at them closer, we sometimes have to make a few alterations due to topography or other issues. But we're very excited and eager to get started on a plan which we think is, will show the mixture of units with townhomes, apartments, single family, and retail uses on the property. What we'd like to do is set up a meeting, Chris, with you as soon as we can to go over some of these issues. There's a lot of detail on here. We view most of them as detailed items. Some of them will just have to show you how we feel we're in agreement with the UGMP. One is the roundabouts on the boulevard coming in. Of course, we're doing a half section, so we've got to figure out how to do that. We figured it's probably going to confuse drivers if we built half of the roundabout right now. Yeah, I've never seen one of those. We'll have to figure out how to do that. But there's a way we can work through that sort of thing. It poses a good question immediately. So that's the type of things we want to work out. And on the alleys, and we understand that I think Sam has designed those to try to comply with the new Complete Streets Manual, which brings me to my big question. I don't have the new ordinance about waivers in front of me, so I'm going to have to ask you all this. I think it would be good to defer our waivers until the final development plan when we come in here, when we have more details and when the complete streets manual will be adopted. What I want to avoid is an exercise where we come in and make a bunch of modifications to this, knowing that we're having more regulations come in that we're going to have to modify it back, hopefully the way we had it here on this. So I want to talk, do you think it's possible to defer our waivers until the final development plan stage? Yeah, I think there's some conflicts there. So we'd have to talk about it. Yeah, we'll look at the ordinance. Right now, I think that's the way to go if we can, because we'll have not only we'll know more about the land, but we'll know more about the regulations too so we know what we're asking for waivers about on this. So that's the way we'd like to go. I have a few particular things here to respond to. And, Sam, you jump in if I'm not saying enough. On the block lengths greater than 1,000 feet, which ones are we talking about here? It's really like the intersection you see here and then going north. Yeah, along the west side of the greenway there? Correct, yeah. Okay. It may be the case, you can justify it, but it doesn't currently mean. Yeah, we'll take a look at that. It is along the greenway. The half-road construction I've talked about. Sanitary sewers are going to, as I understand, are going to be going up Todd's Road. There will be a temporary pump station on this property going up Todd's Road. Dennis has had conversations with Charlie Martin about that, several conversations, conversations, but we'll try to flesh that out with you too. We have multiple entrances into the development. I don't think that's going to be an issue. We thought we met the residential density requirements, but we'll sit down with you and figure that out. Our goal was to meet those, and if If we didn't, we'll talk those over with you. So I'm not going to go and dive in all the rest of these things. That's what we need to meet with you all on that. But I appreciate your looking at it, and we're excited about this plan. Real quick, I noticed there's a stub into the adjacent property. I think that's a private property already developed into commercial apartments. We may have to take that off. Yeah, and I wasn't, I don't think we were exactly sure how to address that because that occurs in the UGMP to show Stub Street connections along all sides, even up against property that's already developed. Well, theoretically, the people who are living in the apartments might want to get to your village center. Correct. Yeah, so. Then would that need to be a hammerhead or cul-de-sac or something if it's a public street? Yeah, probably. The other thing is, is there no development at the southern tip of your lot? No, not at the moment. We don't cross the floodplain there just because it would be a very small, isolated portion of what is already set aside as the village center. and so you would just be building a tiny portion of a village center which wouldn't really activate it because it would, it's set for mixed use. Right, but your zone change is to set it up for the future development. So we still should, on a preliminary development plan, show development of your property unless you're proposing for it to be open space, which of course isn't compliant with the, and then you would phase things, and maybe that's a later phase for you, but you're zoning that entire piece to residential all the way down? Yeah. You're not rezoning a piece? No, we're not leaving any of this AR. Okay. We'll take a look at that. To be honest, there's zero plans for that right now. Right, but it's important. And basically the previous proposal was for this area of the parking. And with this minor they had submitted showing an expansion of that parking associated with building 2300. So this is basically just an expansion of the parking lot. Under requirements not met, we have number one, Denote all buildings paving signs, fences, walls, and retaining walls shall require a separate review and building permit from Division of Building Inspection. Number two, denote the location of fire hydrants, fire department, or fire service features, if required, shall be approved by the Division of Fire Water Control Office. This is a final record plot to subdivide the residential lots on the property. There are accesses coming in over here by the other townhomes into this area with access easements. we reviewed the preliminary subdivision plan final development plan a month or so ago we reviewed it it got approved we certified it just recently so this was postponed because that preliminary subdivision was not certified now it is so now we're creating the 14 lots from that preliminary subdivision plan. So we have revised conditions here for you all. We have design consideration, review all seller comments provided by Division of Engineering. Access and sewer to each lot are not yet complete. Please verify easements shown on plat match infrastructure and field. Then staff recommendation of approval now that that preliminary subdivision plan is signed. we have engineering, traffic, landscaping, addressing, urban forester, environmental quality, bike and ped, open space, utilities and streetlights, documentation for water quality, United States Postal Service. And with that, I'll open it to you all and see if anybody has any other comments or questions. We have our dumpster at the back end of the parking area. When the parking lot used to circle around, so then the dumpster was able to, the people were able to come through here, get the dumpster, and then swing out. Now we're showing this, that the dumpster is going to have to back out on Pine Street. So we have, they brought in revisions. Requirements not met. Commercial entrance must conform to the LFEC standard drawing 307-2. Compliance with the Board of Adjustment findings and conditions in May of 2002. Design considerations. If an area of disturbance is over 2,500 square feet, a land disturbance permit is required. If amending a driveway, use commercial driveway entrance compliant with the standard drawing 307-2. plan questions and concerns. Discuss 14-foot width of access on Pine Street, 24-foot drive lane for two-direction traffic. There we go. This is what we're looking at. This is like a 14-foot access, and if you're going to have people coming in and leaving the parking lot, you need to have the width of the drive line, which is 24 feet, so that two people can pass. There's some mention of infield redevelopment at 20, right? I was thinking. Not for your entrances. You mean in terms of a drive aisle? Driveway. Oh. Not the drive aisle itself. Just the idea of two vehicles, one coming in and one trying to leave at the same time. Yeah. 14 foot's just not wide enough. Yeah, yeah, yeah. No, that wasn't, yeah. And they show their drive aisle being 24. Right. I think it's just because that's the amount of space they have left. Mm-hmm. Yeah. That makes sense. to discuss the location of the dumpster again the idea of them backing up you know we thought that was greater than 20 or greater than 50 feet this is exceeding that 50 foot back up and then backing up to cars that could be parked across the street that's okay so i did have a meeting with our dumpster supervisor last week about this he's he's servicing it now and he tells me he is backing back out now. He's not going around. He's backing out. But he's got to get there early in the morning. He said that as long as there is signage and the curbs are out there on Pine Street, you know, colored, like yellowed out or whatever, no parking, then it won't be a problem. As far as the 50 feet goes, you know, I asked him, you know, how far is from the rear of the truck back out to Pine Street, and it's right at it. A little more, but I mean, So we won't let that bother us as far as the... So the marking of the yellow, has that been approved to be marked that way on the street, I guess is the question? Yeah, you just can't have no... Because it's going to be hard to make that turn and get in there if there's cars parked right up next to the entrance and back and back out. So yellow parking, yellow on the street behind and then along both sides of it. so then nobody can park on either side of the access or to the rear. To the rear? No, it would just be adjacent to the driveway. Typically, you're supposed to leave room anyway. Well, see, he's wanting to cross the street. You want to cross the street as well? Well, I mean, he's going to need as much room as he can get. So if it could be done like that, yes. That could be a... Well, so that's the whole, I mean, one of the discussion items, because the previously approved plan had through circulation. So there was not a patio. The patio has been built without permits. And you could come in, pick up your truck, or pick up the dumpster back up 20 feet and turn and go out to Upper Street. So I think the reason we're trying to figure out how we can make Pine Street work in terms of backing up is because the property owner already built this patio not that that's where we think of patio necessarily was the best idea since the now the circulation on the site is compromised might not be the right word but modified so and just it is gonna impact then the on-street parking because how do we still service the dumpster and not damage and you know private property and the other residential people that you know people that live in the homes adjacent that might be their only parking area and they might already well i don't know it wouldn't be more than i mean pine's 30 feet wide it looks like at least so you're saying you're saying they back up now right well only in the last like six months right since they did the patio Is there signage and stuff up there now? No, there's parking now. We can look at that as far as. I think there needs to be a little more discussion on that. But, I mean, you're not talking about restricting parking on the street. If anything, it's a space or two, so it's not a wholesale. But I guess if it's 32 feet wide now, I'd probably take a closer look and see. If you've got space by the entrance and they rebuild the entrance to a larger width like we were requesting, then you should have space to make that movement, I guess, is what I'm thinking. We can talk about it. Different kind of areas down there, our trucks will try to get down as early as possible. Through the course of a day, if it is a different driver and he's not familiar with the route, we don't know what time that could fall into place. I would think they'd be more parking down there early in the mornings than they would be throughout the day just because people that does reside in that area would be parked out on the street. But I don't know. Well, I'm figuring students park wherever they can find a spot. I mean, he says he's getting it now. I mean, and he's not – he's going out the same way he's going in. But he's just doing a different – backing out. Right, and he might be maneuvering now with that 14-foot width, right? And if it's going to be 20 to 24-foot wide, theoretically that would give them some more space to maneuver, right? I think that'd be fine. We also need to discuss use on the property and the B1 zone because of the conditional use. Not a conditional use, but okay. It's the landscaping that was. Well, the applicant has said that they're not having live entertainment. That's what would be the conditional use. Yeah. Does the raised patio disrupt existing drainage patterns? And then at this time, their staff was recommending postponement due to the concerns about the access for the dumpster and compliance with the Board of Adjustment case, making sure that they meet what was approved in May of 2002. Should the plan be approved, then you have engineering, traffic, landscape, urban forester, bike and ped, open space, division of fire, division of waste management, division of water quality, and the U.S. Postal Service, and then correct all note deficiencies listed as requirements not met here on. With that, I'll open it to you all to see if there's any other comments or questions or if anyone can be removed at this time. applicant morning scott schutte on behalf of the applicant a couple things one the design consideration i believe tony's open space identifies that patio as being less than 2,500 square feet so I think we can remove that to the open space point I can reach out to Tony but to get a little persnickety with the ordinance for your open space vegetated you're currently two square feet away from 1,176 you have 1,174 so all we need is two and Tony and I can touch base and try and find that I still don't think you need a waiver I think we can make it work I just want to make sure that one of the conditions for the Board of Adjustment had to do with the interior landscape islands being as depicted on the site plan and development plan or as amended by the Planning Commission. It doesn't say amended through a minor development plan. It says to the Planning Commission. So you are changing an interior landscaping island that was the corner, and then there were some triangles where we put the patio that are gone. So I guess my question is what left is required to be internal landscaping? Because the variance that was granted 20 years ago was to reduce the interior landscaping from 5% to 4%. percent yes we have seen that now though well i don't know you're showing open space our vegetated open space exceeds or is that the 10 percent yeah that's 10 percent you need i think interior landscaping can't count as open space and if we're changing the interior landscaping from what the plan was in 2002 which we are we may have to go to the planning commission no matter what, because that was the condition of the variance that was granted. Well, I think the patio qualifies as our open space, and then we exceed the vegetated open space as well. No, you exceed the usable open space you do not meet currently because of the two square feet vegetated open space. Okay, so that two square feet, we can handle that easily. And, well, where's your internal, I guess then there's the internal landscaping. Well, the only one in the corner, we're expanding that from what was originally approved in 2002. and the only other condition i'm aware from 2002 is to add the growing behind on it the wall fence so the where i i guess i think we need some help with the where's the internal landscaping island is a portion of that green space an internal landscape island if it is that square footage can't count either so if you're at 1074 but really 300 has to be an interior landscaping area, you're now at 700.
